SUBJECT: Accepting of Improvements for Tract 7982 to be Constructed with Tract 7652 for
Bulk Grading, Park Site Rough Grading and Erosion Control, and Traffic Signal
Modification, Approving Traffic Regulatory Control Devices at the Intersection of
Lee Thompson Street and Central Parkway, and Approving Partial Release of
Securities for Improvements at Palermo Way and Lee Thompson Street, Sorrento
East, Neighborhood 6, Tract 7652 (Standard Pacific Corporation, a Delaware

EXECUTIVE SUMMARY:
Standard Pacific Corporation, a Delaware Corporation, recently completed a portion of
improvements for Tract 7982 to be constructed with Tract 7652, including traffic signal
modifications, bulk grading, and park site grading and erosion control, in accordance with the
Tract Improvement Agreement for Tract 7652. The developer also constructed more than 75%
of the required improvements at Palermo Way and Lee Thompson Street in accordance with the
Tract Improvement Agreement for Tract 7652. Tract 7652 is located east of Grafton Street,
north of Palermo Way, west of Lockhart Street, and south of Gleason Drive. It is now
appropriate for the City to accept completed improvements, approve the regulatory traffic control
devices, and approve partial release of securities for improvements more than 75% complete.
FINANCIAL IMPACT:
Standard Pacific Corporation, a Delaware Corporation, has provided a Warranty Bond to
replace the Faithful Performance and Labor and Materials Bonds that guaranteed the
improvements for the traffic signal modifications. The Warranty Bond will guarantee against
defects for one year.
The City will incur costs for maintenance of the traffic signal at the intersection of Lee Thompson
Street and Central Parkway at the termination of the one -year warranty bond period. This cost
is estimated to be $2,300 annually.
Erosion control measures associated with the bulk grading are covered by separate bonds
provided by the developers of each neighborhood.
Standard Pacific Corporation, A Delaware Corporation, has provided a bond rider in the reduced
amount to guarantee construction of the remainder of improvements for construction deemed
more than 75% complete.

RECOMMENDATION:
Staff recommends that the City Council adopt the Resolution Accepting the Improvements for
Tract 7982 to be Constructed with Tract 7652 for Bulk Grading, Park Site Rough Grading and
Erosion Control, and Traffic Signal Modification, Approving Traffic Regulatory Control Devices at
the Intersection of Lee Thompson Street and Central Parkway, and Approving Partial Release of
Securities for Improvements at Palermo Way and Lee Thompson Street - Sorrento East, Tract
7652, Neighborhood 6 (Standard Pacific Corporation, A Delaware Corporation).

Standard Pacific Corporation, a Delaware Corporation, recently constructed a portion of
improvements governed by the Tract Improvement Agreement for Tract 7652 executed on July
19, 2011 via City Council Resolution No. 122 -11. Tract 7652 is located east of Grafton Street,
north of Palermo Way, west of Lockhart Street, and south of Gleason Drive.
The completed work includes improvements for Tract 7982 to be constructed with Tract 7652,
consisting of Bulk Grading, Park Site Rough Grading and Erosion Control, and Traffic Signal
Modification at Lee Thompson Street and Central Parkway. These improvements have been
constructed pursuant to the Tract Improvement Agreement and to the satisfaction of the City
Engineer. It is appropriate for those improvements to now be accepted by the City.
The improvements for Tract 7982 to be constructed with Tract 7652, consisting of the
improvements at Palermo Way and Lee Thompson Street, are constructed to more than 75% of
completion pursuant to the Tract Improvement Agreement and to the satisfaction of the City
Engineer. It is appropriate for securities provided for those improvements to be reduced to 25 %.
At the time the City and Standard Pacific Corporation, a Delaware Corporation, executed the
Tract Improvement Agreement, the developer provided the following securities for the
improvements listed above:
• Faithful Performance and Labor and Materials Bonds each in the amount of $50,000.00
for "Tract 7982 Traffic Signal Modification at Lee Thompson Street and Central Parkway
to be constructed with Tract 7652" as security to guarantee performance of the work.
• Faithful Performance and Labor and Materials Bonds each in the amount of $50,000.00
for "Tract 7982 -Phase 2 — Park Site Rough Grading and Erosion Control" as security to
guarantee performance of the work, and
• Grading Permit Bond in the amount of $50,000.00 for "Bulk Grading — Tract 7982,
Sorrento East, Dublin Ranch, Sheets 1 -11" as security to guarantee performance of the
work.
• Faithful Performance and Labor and Materials Bonds each in the amount of
$1,306,000.00 for "Tract 7982 Improvements to be constructed with Tract 7652 at

Palermo Way and Lee Thompson Street" as security to guarantee performance of the
work.
Now that the work associated with the Bulk Grading, Park Site Rough Grading and Erosion
Control are complete, the bonds submitted as security guaranteeing construction of these
improvements may be released in accordance with the authority contained in §66499.7 of the
Government Code of the State of California. The developers for each neighborhood within Tract
7982 have provided securities to guarantee construction of improvements and erosion control
measures associated with each of their neighborhoods.
Now that the work associated with the Traffic Signal Modifications at the Intersection of Central
Parkway and Lee Thompson Street are complete, the bonds submitted as security guaranteeing
construction of these improvements may be released in accordance with the authority contained
in §66499.7 of the Government Code of the State of California. The developer has provided a
Warranty Bond in the amount of $12,500, 25% of the original bond amount, to guarantee the
improvements against defects for a one -year period after acceptance.
Now that the work associated with the Tract 7982 Improvements to be constructed with Tract
7652 at Palermo Way and Lee Thompson Street are more than 75% complete, the bonds
submitted as security guaranteeing construction of these improvements may be reduced to 25%
of the original bond amounts, in accordance with the authority contained in §66499.7 of the
Government Code of the State of California. The developer has provided a Bond Rider for the
Faithful Performance and Labor and Materials Bonds, in the amount of $326,500, to guarantee
the construction of the remainder of these improvements.
NOTICING REQUIREMENTS /PUBLIC OUTREACH:
The staff report will be provided to Standard Pacific Corporation, a Delaware Corporation.

A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
ACCEPTING IMPROVEMENTS FOR TRACT 7982
TO BE CONSTRUCTED WITH TRACT 7652 FOR BULK GRADING, PARK SITE ROUGH
GRADING AND EROSION CONTROL, AND TRAFFIC SIGNAL MODIFICATION,
APPROVING TRAFFIC REGULATORY CONTROL DEVICES AT THE INTERSECTION OF
LEE THOMPSON STREET AND CENTRAL PARKWAY,
AND APPROVING PARTIAL RELEASE OF SECURITIES FOR IMPROVEMENTS AT
PALERMO WAY AND LEE THOMPSON STREET
SORRENTO EAST, TRACT 7652, NEIGHBORHOOD 6
(STANDARD PACIFIC CORPORATION, A DELAWARE CORPORATION)
WHEREAS, Standard Pacific Corporation, a Delaware Corporation, the developer of
Tract 7652, previously entered into a Tract Improvement Agreement dated July 19, 2011,
Resolution No. 122 -11, with the City of Dublin, to complete improvements for Tract 7652 and
construct certain improvements for Tract 7982 with Tract 7652, including improvements along
Palermo Way, Lee Thompson Street (including traffic signal modifications at Central
Parkway), the streambed corridor pathway along Gleason Drive between Lockhart Street and
Fallon Road, the streambed corridor pathway and along the eastern frontage of Lockhart
Street between Gleason Drive and Central Parkway, the Gleason Drive frontage landscaping
along Tract 7652, the Lockhart Street eastern frontage landscaping between Palermo Way
and Central Parkway and the Phase 2 rough grading of the park site required for Tract 7982,
in accordance with plans and specifications on file with the City Engineer; and
WHEREAS, the improvements for the Traffic Signal Modifications at Lee Thompson
Street and Central Parkway, Bulk Grading, and Park Site Rough Grading and Erosion Control,
are complete in accordance with said plans and specifications, and any modifications thereto,
to the satisfaction of the City Engineer; and
WHEREAS, certain traffic regulatory devices have been installed as part of the Traffic
Modifications at the intersection of Lee Thompson Way and Central Parkway; and
WHEREAS, the Faithful Performance Bond and Labor and Materials Bond that
guaranteed the Park Site Rough Grading and Erosion Control can be released, in accordance
with the authority contained in §66499.7 of the Government Code of the State of California;
and
WHEREAS, the Grading Permit Bond that guaranteed the Bulk Grading can be
released, in accordance with the authority contained in §66499.7 of the Government Code of
the State of California; and

WHEREAS, the Faithful Performance and Labor and Materials Bonds that guaranteed
the improvements for the Traffic Signal Modifications at Lee Thompson Street and Central
Parkway, can be released in accordance with the authority contained in §66499.7 of the
Government Code of the State of California, and replaced with Warranty Bonds to guarantee
the completed work against any defects for a one -year period following acceptance; and
WHEREAS, Standard Pacific Corporation, a Delaware corporation, has provided
Warranty Bonds to guarantee the Traffic Signal Modification Improvements against defects for
a one -year period; and
WHEREAS, the improvements for Palermo Way and Lee Thompson Street are more
than 75% complete; and
WHEREAS, the Faithful Performance and Labor and Materials Bonds for the
improvements at Palermo Way and Lee Thompson Street, can be partially released, in
accordance with the authority contained in §66499.7 of the Government Code of the State of
California, each in the amount of 25% of the original bond; and
WHEREAS, Standard Pacific Corporation, a Delaware corporation, has provided a
Bond Rider for the Faithful Performance and Labor and Materials Bonds in the amount of 25%
of the original bond to guarantee construction of the remainder of the improvements.
NOW, THEREFORE, BE IT RESOLVED that:
1. The said "Tract 7982 Traffic Signal Modification at Lee Thompson Street and
Central Parkway to be constructed with Tract 7652" is hereby approved and
accepted to a one -year guarantee period; and
2. The original Faithful Performance Bond issued by Safeco Insurance Company of
America in the amount of $50,000.00 (Bond No. 6753804) for improvements be
released; and
3. The original Labor and Materials Bond issued by Safeco Insurance Company of
America in the amount of $50,000.00 (Bond No. 6753804) for improvements be
released; and
4. The submitted Warranty Bond issued by Safeco Insurance Company of America,
in the amount of $12,500.00 (Bond No. 6753804), for "Tract 7982 Traffic Signal
Modification at Lee Thompson Street and Central Parkway to be constructed
with Tract 7652 ", be accepted as security for the aforesaid one -year warranty
period, said period to commence on this date and terminate on the 16th day of
October, 2013; and
5. The said "Tract 7982 Phase 2 — Park Site Rough Grading and Erosion Controf'
are hereby approved and accepted; and

6. The original Faithful Performance Bond issued by Safeco Insurance Company of
America in the amount of $50,000.00 (Bond No. 6753803) for improvements be
released; and
7. The original Labor and Materials Bond issued by Safeco Insurance Company of
America in the amount of $50,000.00 (Bond No. 6753803) for improvements be
released; and
8. The said "Bulk Grading -Tract 7982, Sorrento East, Dublin Ranch, Sheets 1 -11"
is hereby approved and accepted; and
9. The original Grading Permit Bond issued by Safeco Insurance Company of
America in the amount of $50,000.00 (Bond No. 6753786) for "Bulk Grading —
Tract 7982, Sorrento East, Dublin Ranch, Sheets 1 -11 ", be released; and
10. The said improvements for "Tract 7982 Improvements to be Constructed with
Tract 7652 at Palermo Way and Lee Thompson Street' are hereby more than
75% complete; and
11. The original Faithful Performance Bond issued by Safeco Insurance Company of
America in the amount of $1,306,000.00 (Bond No. 6753808) for "Tract 7982
Improvements to be constructed with Tract 7652 at Palermo Way and Lee
Thompson Street', be reduced; and
12. The original Labor and Materials Bond issued by Safeco Insurance Company of
America in the amount of $1,306,000.00 (Bond No. 6753808) for "Tract 7982
Improvements to be constructed with Tract 7652 at Palermo Way and Lee
Thompson Street', be reduced; and
13. The submitted Bond Rider for the Faithful Performance and Labor and Materials
Bonds issued by Safeco Insurance Company of America, dated October 3, 2012,
in the reduced amount of $326,500.00 (Bond No. 6753808), be accepted as
security to guarantee construction of the remaining improvements for "Tract
7982 Improvements to be constructed with Tract 7652 at Palermo Way and Lee
Thompson Street'; and
14. The traffic regulatory devices installed by the developer within the development
are hereby included in the City of Dublin Traffic Code, and said regulatory
devices to include the following:
• Traffic signal control at the intersection of Lee Thompson Street and Central
Parkway.
