SUBJECT: Authorization to Solicit Bids -Contract No. 12-02, Fiscal Year 2011-2012 Annual
Sidewalk Safety Repair Program and Curb Ramp Installation

EXECUTIVE SUMMARY:
Contract No. 12-02 is proposed to complete improvements identified in two Capital Improvement
Projects. The Annual Sidewalk Safety Repair Program (CIP No. 949103) will remove and
replace approximately 3,900 square feet of sidewalk with offsets of 3/4-inch or more that may
pose tripping hazards. The Americans with Disabilities Act (ADA) Transition Plan (CIP No.
939103) will complete the installation of 8 handicap accessible curb ramps.
FINANCIAL IMPACT:
The budgets for these projects include project design, inspection and administration, related
contract services and improvements. Both projects are funded by the General Fund.
• For the Annual Sidewalk Safety Program (CIP No. 949103), the total project
appropriation, including design, inspection, and administration, is $84,074. Of this
amount $65,000 is included for improvements to be bid as part of Contract 12-02.
• For the ADA Transition Plan (CIP No. 939103), the total project appropriation, including
design, inspection and administration, is $19,650. Of this amount, $17,850 is included for
improvements to be bid as part of Contract 12-02.
RECOMMENDATION:
Staff recommends that the City Council: 1) Adopt the Resolution establishing a policy for the
repair of public improvements deemed to be possible pedestrian hazards (City funded sidewalk
repair program); and 2) Authorize Staff to advertise for bids for Contract No. 12-02, Fiscal Year

DESCRIPTION:
The Annual Sidewalk Safety Repair Program (remove and replace) repairs sidewalk offsets of
3/4-inch or more that may pose a tripping hazard. The remove and replace process is used in
locations where the offset is significant or where tree roots are causing the offset. This
procedure requires the removal of the existing sidewalk and, in the case of root problems,
removal of the tree roots, and then replacement of the concrete sidewalk. This project
anticipates the removal and replacement of approximately 3,900 square feet of sidewalks.
While maintenance of sidewalks and other frontage improvements is legally the responsibility of
the adjacent private property owner, the City Council has adopted aCity-funded sidewalk repair
program on a year-by-year basis since 1983. The City Council extended funding for the City-
paid repair program for an additional year in the Fiscal Year 2011-12 budget.
The City Council, in adopting the policy for the repair of public improvements deemed to be
potential pedestrian hazards, accommodates property owners who find it difficult to hire their
own contractors to make necessary sidewalk repairs or replacements. This policy will be in
effect for Fiscal Year 2011-2012 and thereafter be reviewed annually for extension, modification,
or replacement. This policy has historically been adopted each year as part of the annual
Sidewalk Safety Repair Program. Staff recommends that the City Council adopt the proposed
resolution (Attachment 1) establishing the policy (Attachment 2).
In addition to the Sidewalk Safety Repair Program, the bid documents will also include the
construction of approximately eight (8) pedestrian curb ramps. The ramps are funded by
General Fund, as identified in the ADA Transition Plan. The curb ramp work and sidewalk
replacements are being bid as a single package since the work is similar and combining the
projects will be acost-savings due to economy of scale in the bidding process.

OF THE CITY OF DUBLIN
ESTABLISHING A POLICY FOR THE REPAIR OF PUBLIC IMPROVEMENTS
DEEMED TO BE PEDESTRIAN HAZARDS
(CITY-FUNDED REPAIR PROGRAM)
WHEREAS, public improvements such as curbs, gutters, driveways, and sidewallcs sometimes
become damaged due to natural and man-made causes; and
WHEREAS, these damaged improvements occasionally become tripping hazards to pedestrian
traffic; and
WHEREAS, it is in the best interest of safety to have these hazards elinunated;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin
establishes a policy, attached hereto as Exhibit "A," of the City of Dublin for Fiscal Year 2011-2012
entitled, "Annual Sidewallc Safety Repair Program."

POLICY FOR THE REPAIR OF PUBLIC IMPROVEMENTS DEEMED TO
BE PEDESTRIAN HAZARDS -CITY OF DUBLIN
ANNUAL SIDEWALK SAFETY REPAIR PROGRAM
Fiscal Year 2011-2012
It is the policy of the City of Dublin to cause repairs to be made to certain public improvements for the
safety of the general public under the following guidelines.
Improvements Included:
Public improvements included under this program shall be linuted to those improvements which may
constitute a potential tripping hazard to pedestrian traffic such as curbs, gutters, driveways, and sidewallcs.
Need.:
Where these improvements have settled, heaved and/or cracked and offset such as to represent tripping
hazards as identified by the Public Works Director, or a representative, these improvements shall be
replaced.
Responsibility:
Where it is apparent that the damage to improvements has been caused by natural causes, such as tree
roots, utility trench settlement, or soil heaving, the City of Dublin will pay for the cost of repair.
Where it is apparent that the property owner fronting the damaged improvement has caused the damage,
such as driving vehicles into a side yard, the property owner shall be responsible for the repair. The Public
Works Director shall establish a procedure whereby the property owner will be notified of the needed
repair, and if not done in a specified reasonable time, the Public Works Director shall cause the repair to be
made and the cost of the repair, together with reasonable adnunistrative costs, shall become a lien against
the property.
Time Linut of Policy:
This policy shall be in effect for Fiscal Year 2011-2012 and thereafter be reviewed for extension,
modification, or replacement.
Le a~ 1 Responsibility:
The City of Dublin, in adopting this policy, does so as an accommodation to property owners who find it
difficult to hire their own contractors to make these necessary sidewallc repairs. The City will let one
contract for the 2011-2012 Fiscal Year and repair those defective sidewallcs which have been brought to
the attention of the City by the property owners (or others), and that have an offset of over three-quarters
of an inch (3/4") measured vertically, within the budget available to do so. The existence of this program
does not abrogate the responsibility of the property owners to maintain their frontage improvements in a
safe manner under Section 5610 of the California Streets and Highways Code. Property owners and
persons in possession of property are required to maintain adjacent public sidewallcs in a safe condition per
Dublin Municipal Code Section 7.04.420 of Article 4, Chapter 7.04 of Title 7.
