EXECUTIVE SUMMARY:
This is the second reading of an ordinance introduced at the regularly scheduled City Council
meeting of September 20, 2011. The ordinance will amend the Dublin Traffic Code to establish
bus stops on Dublin Boulevard at the Fallon Gateway shopping center.
FINANCIAL IMPACT:
There is no financial impact to the City of Dublin associated with this item.
RECOMMENDATION:
Staff recommends that the City Council waive the reading and adopt the ordinance amending
the Dublin Traffic Code establishing bus stops on Dublin Boulevard.

DESCRIPTION:
According to Dublin Municipal Code Section 6.04.360, the City Council may establish bus stops
by ordinance. Once established and marked accordingly, vehicles cannot stop, stand or park
within the designated area. This report includes an Ordinance (Attachment 1) to designate two
locations as bus stops intended to serve the Fallon Gateway shopping center.
The City Council considered this matter on September 20, 2011, waived the reading and
introduced the ordinance establishing bus stops on Dublin Boulevard (Attachment 2). At the
September 20, 2011, meeting, City Council also adopted a resolution approving the second
amendment to the Bus Shelter Encroachment and Maintenance Agreement between the
Livermore Amador Valley Transit Authority (LAVTA) and the City of Dublin. The second
amendment identifies the two new bus stops and establishes associated maintenance
responsibilities as part of Exhibit A to the agreement as well as authorizes the City Manager and
Executive Director of LAVTA to make certain amendments to Exhibit A.

AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF DUBLIN
AMENDING THE DUBLIN TRAFFIC CODE
ESTABLISHING BUS STOPS ON DUBLIN BOULEVARD
The City Council of the City of Dublin does ordain as follows:
Section 1. The following locations shall be added to Section 6.44.010 of the City of Dublin
Traffic Code:
Dublin Boulevard
North Side East of Fallon Gateway Shopping Center
South Side East of Fallon Gateway Shopping Center
Section 2. Severability. The provisions of this Ordinance are severable and if any provision,
clause, sentence, word or part thereof is held illegal, invalid, unconstitutional, or inapplicable to any
person or circumstances, such illegality, invalidity, unconstitutionality, or inapplicability shall not affect
or impair any of the remaining provisions, clauses, sentences, sections, words or parts thereof of the
ordinance or their applicability to other persons or circumstances.
Section 3. Effective Date. This Ordinance shall take effect and be enforced thirty (30) days
following its adoption, and after appropriate bus stop signage or markings have been placed providing
notice thereof.
Section 4. Posting. The City Clerk of the City of Dublin shall cause this Ordinance to be
posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the
Government Code of the State of California.

Boulevard and Adoption of Resolution Approving Second Amendment to the Bus
Shelter Encroachment and Maintenance Agreement with Livermore Amador
Valley Transit Authority (LAVTA)

EXECUTIVE SUMMARY:
The City Council will consider introducing an ordinance amending the Dublin Traffic Code to
establish bus stops on Dublin Boulevard at the Fallon Gateway shopping center. The City of
Dublin and Livermore Amador Valley Transit Authority (LAVTA) entered into an agreement in
November 2009 that defined the encroachment and maintenance responsibilities for both
parties. in operating and maintaining bus stops and. bus shelters within the City of Dublin. The
City Council will also consider approving an amendment to the agreement to add the proposed
bus stop locations and to authorize the City Manager and Executive Director of LAVTA to make
certain amendments to Exhibit A of the Agreement without City Council approval.
FINANCIAL IMPACT:
There is no financial impact to the City of Dublin associated with this item.

Staff recommends that the City Council conduct a public hearing; deliberate; waive the reading,
and introduce the Ordinance amending the Dublin Traffic Code establishing bus stops on Dublin
Boulevard; and adopt the Resolution approving Second Amendment to the Bus Shelter
Encroachment and Maintenance Agreement between the Livermore Amador Valley Transit
Authority and the City of Dublin.

DESCRIPTION:
The. Livermore Amador Valley Transit Authority (LAVTA) was created in 1985 under a Joint
Exercise of Powers Agreement between the Cities of Dublin, Livermore and Pleasanton.
LAVTA has since been providing transit service across the Tri-Valley. LAVTA and City staff
routinely work cooperatively on upcoming projects, day-to-day operations and proposed new
bus stop locations. This report includes an Ordinance (Attachment 1) to designate two locations
as bus stops intended to serve the Fallon Gateway shopping center and a Second Amendment
to the Bus Shelter Encroachment and Maintenance Agreement for City Council consideration.
Bus Stop Designations
There are currently over 100 locations throughout the City that are used as active bus stops,
which are indicated by either signs or curb markings and may include a bus pullout and
amenities such as benches and shelters. According to Dublin Municipal Code Section 6.04.360,
the City Council may establish bus stops by ordinance. Once established and marked
accordingly, vehicles cannot stop, stand or park within the designated area. Most recently in
2010, bus stops were added to accommodate LAVTA's Bus Rapid Transit (RAPID) Project.
With the opening of the new Target store in October 2011 at the Fallon Gateway shopping
center, City and LAVTA staff have worked cooperatively to identify two new bus stop locations
intended to serve the new shopping center. On both the north and south sides of Dublin
Boulevard, a bus stop is recommended east of the intersection with the Fallon Gateway
driveway. Because a sidewalk has not yet .been installed along the Fallon Gateway frontage,
the developer has constructed a temporary AC path along the south side of Dublin Boulevard to
connect the bus stop location to the Fallon Gateway intersection. An on-site pathway then
provides a connection to the new Target store. Because there also is no sidewalk on the
undeveloped north side of Dublin Boulevard, LAVTA is funding the installation of a temporary
AC path to connect the bus stop to the intersection.
It should be noted that these stops may be relocated further west in the future to better provide
bus service to the future Kaiser medical center. Should that project move forward, .the City and
LAVTA staff will work cooperatively throughout project development to identify the most
appropriate stop locations.
Encroachment and Maintenance Agreement
Since its inception, LAVTA routinely provided maintenance services at the various bus stops
throughout the City of Dublin, although no formal maintenance agreement was previously
established. In anticipation of the construction of LAVTA's RAPID Project, which was to include
the installation of various improvements and amenities, it became apparent that an
encroachment and maintenance agreement should be established.
At its November 17, 2009, City Council meeting, the City Council approved the Bus Shelter
Encroachment and Maintenance Agreement ("Agreement" -Attachment 2) with LAVTA. An
amendment ("First Amendment" -Attachment 3) was adopted by the City Council on August 20,
2010, to clarify maintenance responsibilities. The Agreement includes Exhibit A, which is a list
of all bus stop locations for which LAVTA will perform routine .upkeep, as well as specific
amenities for which LAVTA is responsible to maintain.

While the list of amenities included in Exhibit A may be revised administratively according to the
terms of the Agreement, the City Council must designate new bus stops by ordinance and must
adopt an amendment to the agreement to add or remove bus stop locations within Exhibit A.
The Resolution (Attachment 4) approves the Second Amendment to the Agreement (Attachment
5), which contains a revised Exhibit A (Attachment 6) with the two proposed bus stops on Dublin
Boulevard added. While the existing Agreement already allows the City Manager to revise the
specific amenities identified in Exhibit A at each bus stop, the proposed Resolution extends
authority to the City Manager and Executive Director of LAVTA to add or remove bus stop
locations listed on Exhibit A in so far as the City Council has first adopted an ordinance
designating or removing said bus stop locations.
