Ananthan Kanagasundaram, Assistant Civil Engineer EXECUTIVE SUMMARY: Citation Homes Central and Eden Housing Inc. acquired the former Arroyo Vista Housing site property located at 6700 Dougherty Road from the Dublin Housing Authority. The Final Map for Tract 7943 approved in February 2011 allowed Citation Homes Central and Eden Housing Inc. to acquire separate parcels from the Dublin Housing Authority. Pursuant to the Tract Improvement Agreement executed in conjunction with the Final Map for Tract 7943, the Developer is currently installing the public infrastructure improvements associated with the Project. In March of 2011, KB Home Arroyo Vista LLC (KB Home) purchased the Citation Homes portion of the Project (the master development was then renamed Emerald Vista). KB Home will develop the 198 for sale units and Eden Housing Inc. will develop the 180 affordable rental units. Approval of the Final Maps for Tracts 8069 and 8070 and the associated Tract Improvement Agreements will allow KB Homes to complete the tract improvements and proceed with building permit applications. FINANCIAL IMPACT: Parkland dedication requirements are proposed to be satisfied by the payment of fees in lieu of dedicating park land. Parkland In -Lieu Fees in the amount of $2,195,788.38 have been collected for both Tract 8069 and 8070 in conjunction with the filing of the Maps. KB Home will construct certain private streets and public utility improvements with Tracts 8069 and 8070, and will pay the cost of construction inspection. The City requires that Performance and Labor & Materials bonds are posted to guarantee construction of the street, grading, utility improvements and landscaping. Maintenance cost information will be provided to the City Council at the time of improvement acceptance. The Homeowners' Association will be responsible for maintaining private project - related landscape features and sidewalk within the public right -of -way. RECOMMENDATION: Staff recommends that the City Council: (1) Adopt the Resolution Approving Final Maps and Tract Improvement Agreements for Tracts 8069 & 8070, Emerald Vista; and (2) Adopt the Resolution Accepting Parkland Dedication In -Lieu Fees for Parkland Dedication Requirements for Tract 8069 and Tract 8070 at Emerald Vista. u Submit ed By Public Works Director DESCRIPTION: Submitted By Administrative Services Director (9/t,"'. ""I., /" - Reviewed by Assistant City Manager The Final Maps for Tract 8069 (Attachment 1) and Tract 8070 (Attachment 2) will create a community of 198 market rate units (128 attached town homes and 70 detached dwellings) developed by KB Home. The Final Maps for Tracts 8069 and 8070 dedicate public service easements, storm drain easements, water line easements and emergency vehicle access easements. The Final Maps for Tracts 8069 & 8070 have been reviewed and found to be in conformance with the Tentative Map and Conditions of Approval adopted by Planning Commission Resolution No.09 -15 on April 28, 2009. The Developer has submitted executed Tract Improvement Agreements, together with the required Performance and Labor & Material Bonds. Staff has prepared a resolution approving the Final Maps and Tract Improvement Agreements for Tract 8069 & Tract 8070, Emerald Vista (Attachment 3 and 4), and a Resolution Accepting Parkland Dedication In -Lieu Fees for Parkland Dedication Requirements for Tract 8069 and Tract 8070, Emerald Vista (Attachment 5). Page 2 of 3 Parkland Dedication Requirements Pursuant to Dublin Municipal Code Chapter 9.28, a Subdivider is required to dedicate parkland or pay a fee in lieu of dedicating such land. Resolution No.07 -11 adopted February 1, 2011 satisfied the park dedication requirements for the Eden Housing Portion of Tract 7943. Therefore, only the fees in lieu of park dedication need to be collected from KB Home with the approval of the Final Maps for Tracts 8069 and 8070. The contribution for Neighborhood Parkland is calculated according to a formula specified in Chapter 9.28 of the Dublin Municipal Code that takes into account the market value of the property and the number of units. Community Parkland Fees are paid based on the schedule in the Public Facilities Fees. N,NS!"Ill; :SANK06(rr (.;AV.XftNkMl7�w W 1,AJi ["9"I hoff IrIET JNIIl RESOLUTION NO. -12 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN APPROVING FINAL MAP AND TRACT IMPROVEMENT AGREEMENT FOR TRACT 8069, EMERALD VISTA WHEREAS, the Final Map for Tract 8069, in the incorporated territory of the City of Dublin, State of California, has been presented to this City Council for approval, all in accordance with provisions of the Subdivision Map Act of the State of California and the City of Dublin Municipal Code; and WHEREAS, the Developer, KB Home Emerald Vista LLC., has executed and filed with the City of Dublin a Tract Improvement Agreement for Tract 8069 to improve required subdivision improvements in accordance with the Conditions of Approval for the Tentative Map, and with the improvement plans attached thereto; and WHEREAS, said Tract Improvement Agreement is secured by bonds fiirnished by Bond Safeguard Insurance Company in the amount of $ 547,000.00 for the in -tract improvements (Bond No. 5040282), conditioned upon faithfid performance of said Agreement, and in the amount of $ 973,923.21 for landscape improvements (Bond No. 5040281) conditioned upon faithfiil performance of said Agreement; and WHEREAS, said Tract Improvement Agreement is secured by bonds fiirnished by Bond Safeguard Insurance Company in the amount of $ 547,000.00 for the in -tract improvements (Bond No. 5040282) and in the amount of $ 973,923.21 for landscape improvements (Bond No. 5040281) conditioned upon payment for labor performed or material furnished under the terms of said Agreement; NOW, THEREFORE, BE IT RESOLVED that said agreement and bonds are hereby approved. BE IT FURTHER RESOLVED that the City Manager of the City of Dublin is hereby authorized to execute said Tract Improvement Agreement, attached hereto as Exhibit "A."
