Foss, City Manager SUBJECT: Authorization to Purchase Police Motorcycle and Emergency Equipment Directly from Vendor Prepared by: Nate Schmidt, Captain Dublin Police Services EXECUTIVE SUMMARY: The City Council will consider approving the purchase of one new marked police motorcycle and associated emergency equipment to accommodate the addition of one sworn staff member to the Dublin Police Services Traffic Unit in Fiscal Year 2018-19. Staff conducted an extensive study to determine which available police motorcycle would best suit the upcoming needs of Dublin Police Services and is recommending the purchase of one 2019 Police Harley-Davidson FLHTP Electra Glide from Livermore Harley-Davidson and emergency equipment. STAFF RECOMMENDATION: Adopt the Resolution Authorizing Staff to Procure One 2019 Police Harley-Davidson FLHTP Electra Glide from Livermore Harley-Davidson and Emergency Equipment, and approve the budget change. FINANCIAL IMPACT: The purchase price of one 2019 Police Harley-Davidson FLHTP Electra Glide is $22,913.81, with an additional cost of approximately $12,000.00 to outfit the vehicle with emergency equipment. Sufficient funds exist in the Abandoned Vehicle Abatement fund to make this purchase and will be appropriated with City Council approval of the budget change. Staff has obtained approval from the Alameda County Abandoned Vehicle Abatement Authority to utilize funds in this account for the purchase of this vehicle and emergency equipment. DESCRIPTION: In October of 2018, Dublin Police expanded the Traffic Unit by one sworn staff member. The Traffic Unit now consists of four Officers and one Sergeant. Currently, the Traffic Unit has four motorcycles in the fleet and will need to purchase an additional motorcycle to fully outfit the unit. Page 2 of 3 Staff conducted an extensive study to determine which available police motorcycle would best suit the upcoming needs of Dublin Police Services and is recommending the purchase of one 2019 Police Harley-Davidson FLHTP Electra Glide. On June 19, 2018, City Council authorized the purchase of a 2019 Harley-Davidson FLHTP from Livermore Harley-Davidson at a cost of $22,913.81. This purchase was made to replace a current police motorcycle and utilized ISF funds. Authorization to purchase an additional motorcycle from the same vendor will result in an excess of $45,000 purchased from the vendor in one fiscal year, which, per the Municipal Code, required City Council approval. Dublin’s Municipal Code further establishes that such purchases will be based on formal sealed bids unless one of the allowed exceptions is utilized. The following exception applies specifically to the purchase of vehicles: Section 2.36.100(B)(10) Dublin Municipal Code: When the City Council specifically waives the competitive bid process and authorizes staff to negotiate the purchase of vehicles by a four-fifths (4/5) vote. (Ord. 12-12 § 2 (part). Staff requests that the City Council authorize the purchase through competitive pricing for the addition of one police motorcycle. The lowest cost presented for one 2019 Police Harley-Davidson FLHTP Electra Glide is Livermore Harley-Davidson. It is estimated it will cost approximat ely $12,000 to outfit this vehicle which will be built consistent with the current Dublin Police motorcycles. Adoption of the attached Resolution (Attachment 1) authorizes the purchase of the vehicle from Livermore Harley-Davidson through direct negotiation instead of using a formal bid, and the related emergency equipment. Approval of the budget change (Attachment 2) will direct Staff to appropriate the amount from existing balance in the Abandoned Vehicle Abatement Fund. Written approval from the Alameda County Abandoned Vehicle Abatement Authority to utilize those funds for the purchase is included as Attachment 3. STRATEGIC PLAN INITIATIVE: None. Approval Letter from the Alameda County Abandoned Vehicle Abatement Authority ATTACHMENT 1 RESOLUTION NO. xx - 18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN * * * * * * * * * AUTHORIZING STAFF TO PROCURE ONE 2019 POLICE HARLEY-DAVIDSON FLHTP ELECTRA GLIDE FROM LIVERMORE HARLEY-DAVIDSON AND EMERGENCY EQUIPMENT WHEREAS, the City currently has four police motorcycles in the traffic/motor unit; and WHEREAS, in October of 2018, Dublin Police added one sworn position to the traffic/motor unit requiring the purchase of one police motorcycle to fully outfit the unit; and WHEREAS, Staff conducted an extensive study to determine which available police motorcycle would best suit the upcoming needs of Dublin Police Services and is recommending the purchase of one 2019 Police Harley-Davidson FLHTP Electra Glide. WHEREAS, adequate funding exists in the Abandoned Vehicle Abatement Fund for the purchase of one police motorcycle including emergency equipment and installation costs; and WHEREAS, staff has obtained approval from the Alameda County Abandoned Vehicle Abatement Authority to utilize funds from the Abandoned Vehicle Abatement Fund; and WHEREAS, Section 2.36.100(B)(10) of the Dublin Municipal Code allows for exceptions to the typical public bidding process when the City Council specifically waives the competitive bid process and authorizes staff to negotiate the purchase of vehicles by a four-fifths vote; and WHEREAS, as presented in a Staff Report on November 20, 2018, Staff has obtained competitive pricing from three Harley-Davidson dealers for comparably equipped vehicles and it is recommended that the City Council authorize the purchase of one 2019 Police Harley-Davidson FLHTP Electra Glide from Livermore Harley-Davidson at a cost of $22,913.81 and an estimated cost of emergency equipment of $12,000. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Dublin hereby authorizes the City Manager as P urchasing Agent to procure in Fiscal Year 2018/2019 one 2019 Police Harley-Davidson FLHTP Electra Glide from Livermore Harley-Davidson, purchase and install emergency equipment on the new vehicle.
