Bid Results for Positano Hills Park Playground Expansion - Contract #14-04

EXECUTIVE SUMMARY:
The City Council is being asked to consider the conditional award of the contract to expand the
playground at Positano Hills Park, subject to further negotiation with the contractor.
FINANCIAL IMPACT:
Engineer’s Estimate $130,000
Bid Proposal $229,465
Alternate #1 $ 6,000
Subtotal $235,465
Construction Contingency 10% $ 23,547
Total Construction Budget $259,012
Amount over Engineer’s Estimate $129,012
RECOMMENDATION:
Staff recommends the City Council conditionally award the contract to Suarez and Munoz
Construction, subject to further negotiation with the contractor.

DESCRIPTION:
On November 19, 2013, the City Council approved the revisions to the playground area and the
inclusion of additional trees as a bid alternate for Positano Hills Park. Construction documents
were prepared and the project was solicited for bids on March 21, 2014. The project received
only one bid from Suarez and Munoz Construction, Incorporated which was significantly higher
than the Engineer’s estimate as shown in the Financial Statement.

Staff consulted with the City Attorney’s Office on the following options available for City Council
consideration:
1) Reject all bids and go out to bid again with the hope of receiving a lower bid result.
2) Conditionally award the contract subject to further negotiation with the contractor, and if
the City and Contractor can come to terms on the agreement, award the contract at a
future City Council meeting based on the revised agreement.
Staff has approached a representative from Suarez and Munoz who said they would be willing
to meet with Staff following City Council approval of the conditional award of contract to
negotiate terms of the agreement. The City has contracted with Suarez and Munoz on past
projects and Staff recommends that City Council consider this alternative rather than reject all
bids and re-bid the project.
If the City is able to come to terms on the agreement, the City Council would award the contract
subject to the agreed upon changes at a future City Council meeting.
NOTICING REQUIREMENTS/PUBLIC OUTREACH:
Notice of Inviting Bids were submitted to 10 plan rooms, posted in Tri-Valley Times twice,
posted on the City of Dublin’s website and individually emailed to eight playground specialty
contractors.
