Soto, City Clerk/Records Manager EXECUTIVE SUMMARY: At the December 2, 2014 City Council meeting, sitting Councilmember David G. Haubert was sworn in as Mayor. Also at the meeting, the City Council elected to fill his vacant City Council seat through an application and appointment process. In order to be considered eligible for the appointment, applicants were required to submit a completed application before the final closing date of Wednesday, December 10, 2014 at 3:00 p.m., be a Dublin resident and a registered voter. FINANCIAL IMPACT: None. RECOMMENDATION: Review the applications, interview applicants, deliberate, and appoint and swear in a Dublin resident who is registered to vote, to the vacant City Council position or defer the appointment to a Special Meeting of the City Council, to make the appointment no later than January 30, 2015. Reviewed By Assistant City Manager DESCRIPTION: At the December 2, 2014 City Council meeting, sitting Councilmember David G. Haubert was sworn in as Mayor. At that meeting, the City Council elected to fill this vacancy through an application and appointment process. In order to be considered eligible for this appointment, applicants were required to submit a completed application before the final closing date of Wednesday, December 10, 2014 at 3:00 p.m., be a Dublin resident and a registered voter. On Wednesday, December 3, 2014, at 12:00 p.m., Staff began soliciting applications for this position, which continued through Wednesday, December 10, 2014, at 3:00 p.m. In order to Page 1 of 2 ITEM NO. 8.1 ensure that the community was made aware of this vacancy, Staff promoted the application process in the following manner: • Issued a press release on Wednesday, December 3 (Attachment 1), which was sent out via the City's website notification system and included distribution to the media. • Made applications available at (Attachment 2) the Civic Center City Clerk's Office. • Placed an announcement on the City's website, with a link to the application. As a result of the City's outreach efforts, Staff has received 12 applications from interested community members (Attachment 3). Additionally, Staff recommends that the City Council interview applicants for this position, deliberate, appoint and swear in a resident to this vacancy, which would take effect immediately at this December 16, 2014 meeting. If necessary, the City Council may continue the vacancy appointment process to a Special Meeting of the City Council, to be held at a future date, to make the appointment no later than January 30, 2015. The City Council will consider this appointment at its December 16th City Council meeting. The City will begin accepting applications for the City Council vacancy beginning today, Wednesday, December 3rd at 12 p.m. (noon) through Wednesday, December 10 until 3:00 p.m. All applications must be hand delivered and received by the City Cleric by this deadline, no postmarks will be accepted. To select the candidate, the Dublin City Council will hold a public interview process at its December 16th City Council meeting which will begin at 6 p.m. and will be held in the City Council Chambers. Applicants must be present at this meeting and will be asked to make a three-minute presentation, followed by a question and answer period with the City Council. If the City Council is able to reach a decision that evening, the selected candidate would begin serving the term of the vacated seat immediately at the meeting, which expires December 2016. Should the City Council not be able to reach a decision that evening, a Special Meeting of the City Council will be held at a future date to make the appointment prior to January 30, 2015. Development What is best today vs. long-term growth—A holistic view is needed. Continue striving to build a diverse business&retail portfolio Positive&Negative effects on our existing vs. potential tax base Traffic Congestion—impacts from downtown housing infill and 580 traffic diverting to Dublin Boulevard which is the only thoroughfare for residents driving from one side of Dublin to the other Parking—Especially downtown and in high density housing neighborhoods These are all inclusive—All must be considered and addressed from a strategic and holistic standpoint. I can help the council build a unified "picture"that captures an overall plan that takes into account all of these items holistically across the community, in contrast to each project by itself. Then the city council can look at proposals that come in against this master strategic plan for the entire city. Dublin Unified School District Partnership Maintain constant open communication with the School District Keeping the School District apprised of developments and status of projects Great cities are measured by quality of life and one large component is schools The Council has a responsibility to be conscientious concerning the School District's obligation to receive and provide for students expected from residential developments coming online,as well as,understanding there is currently no funding from the State to support the School District or help them manage these surges in student populations. I can play a key role in working with the school district to enhance the engagement model and develop broader strategies for long-term collaboration between the organizations. Economic Growth Balance tax and revenue with resident quality of life 1 Need to attract and maintain a class of business that puts Dublin on the map as a center of excellence (Tech, Pharma,etc.)that would enable more residents to work in the community they reside,we have a phenomenal residence base in Dublin that travel outside the city to work in high tech. I can help the council with building marketing plans to evangelize to businesses,why Dublin. Building out campaign tied to our development plan could aid in bringing together our developers and potential businesses together to strengthen the economic base for the city. Being prepared is paramount for one to make informed decisions.As a Parks and Community Services commissioner, I am familiar with this process. Having served on other boards and committees, I have not had any issues with allocating time and making the reading of such material the priority.I am an avid reader and love to do research. I've made it a habit to read materials more than once because I know that there are some things one can miss on the first reading that one is more than likely to catch on the second or third reading.When I make a commitment to a project or assignment, I devote my full resources until the targeted outcome is successfully achieved. In your view,what do you believe your relationship,as a City Councilmember should be to the public, other Councilmembers,City Manager and City employees? Council members are civil servants.They represent the public and represent the City to the public. Council members also have the responsibility of representing the resident's and the City's interests at regional,county and state levels.As a council member I would be open and available to speak with residents to hear their concerns. I also would view myself as an ambassador to new residents and new businesses. Council member's relationships to each other would be to respectfully share ideas, perspectives and to collaborate on reaching the common outcome of creating the best possible quality of life for the residents. The City Manager and City employees are experts in their fields and should be called upon in that capacity whenever a council member feels more information is needed before making a decision.They are the providers of service to all Dublin residents.City employees take direction from the City Manager.The City Manager serves as the Council's Chief Staff Adviser. What is your view of providing services to the community and the financing of those services?What additional services,if any,do you believe should be provided to the Community? Police and Fire are essential services and should always be provided to our residents. Financing of these services are vital and should remain funded. Having these services contracted allows for scalability and financial flexibility. Additional services to consider would be the bolstering the Wheels bus system.Wheels is a great service and option to reduce traffic congestion as well as a cost effective way for residents to commute or travel around the Tri—Valley There are many approaches for financing,one would be to look at existing measures and examine alternative measures.We as a community need to create tiers of funding that range from Essential Services, Enhanced Community Services& Lastly Enriched Pay Per Use Services. If we create a framework with criteria and assess against that we can start to decipher which category a particular service would fit into. What do you feel is the most important contribution you can make as a member of the City Council? From DUSD Parcel Tax Oversight committee member to DPIE Board member to City of Dublin Parks and Community Services Commissioner, I am and have been an active resident of Dublin for over a decade. 2 I have a sound and reasonable sense of judgment. I know the decisions I make today will affect Dublin residents and business for many years to come. I believe my business acumen,which I have acquired from years of service through the City of Phoenix and DSRSD,combined with the skills and experience I have garnered through my participation with the City of Dublin and School District over the years will make me a successful council member.Insightful experiences such as these are needed for someone who is coming onboard into a position that is already in motion. During the time that Marcus was in my class, Mona was an active parent at school.She was very attentive to her son's needs and it was clear that she was intellectual,smart and highly educated.She helped with school events and fundraisers all while displaying the qualities of a team player and a cooperative member of the community. I've known her since 2006 through our jobs at the Dublin San Ramon Services District. We both started at the Front Desk and worked our way up to our current positions as Administrative Technician and Analyst. I came to know her as a very smart and dedicated worker, with technical skills higher than what is required of her position. She has very good people skills with her diplomacy. At the same time, she is a very confident person and does not shy in sharing her opinions in a professional manner. Mona is a proactive employee and continuously participates in various committees and process improvement workgroups at the District. I've known of her passion in serving the Dublin community from early on when she first told me she was taking the Dublin 101 Leadership Academy course in 2006. The top three policy issues currently facing Dublin are continued rapid growth, business development and long term financial stability. Since moving here in 1995, 1 have witnessed tremendous growth in the City. As a member of the School Board, I have dealt first hand with the challenges associated with a fast growing community. Dublin needs to continue to work on balancing the demands for more housing in the City with the current residents'desire for more amenities. It needs to work with the developers as well as residents to ensure there is a proper balance of housing,quality retail and office space. In addition, Dublin needs to continue to collaborate with the School District on the impact of more housing on the schools. The City needs ensure that its infrastructure can handle the influx of new residents. Dublin also needs to continue to find ways to attract new businesses. A strong City needs a good business base that offers jobs for its residents and a strong tax base for the City. Dublin has done a good job of attracting retail/restaurants; however, it needs to attract businesses that provide good salaries for its employees in order for them to have the opportunity to live where they work. Finally, Dublin needs to continue to focus on the issue of long term funding. Dublin has a strong sales tax base; however,even with a strong sales tax base,the City faces a potential budget shortfall in the near future. Dublin needs to find new funding sources in order to continue to offer the high level of services provided to our residents. Being an effective member of the City Council requires a good deal of pre-meeting preparation including the willingness to read up to several hundred pages of staff reports before each meeting. How will you handle this responsibility? Currently as a member of the School Board, I have to prepare for meetings with similar pre-meeting preparation requirements. In order to be prepared for the meetings, I set aside time the weekend prior to the meeting to read the material and prepare any questions I may have. I review my questions with the Superintendent on the Monday prior to the meeting. This gives the Superintendent, as well as District Staff,time to answer the questions and be prepared for any questions that may arise during the meeting. In your view,what do you believe your relationship as a City Councilmember should be with the public,other City Councilmembers,the City Manager and City employees? As a City Councilmember, my relationship with the public should be one that allows the residents of Dublin to bring questions and concerns they have to me. If I don't have the answer to their question or concern, I would direct them to the proper department in the City. It's important that the public feels that the members of the City Council are open and available to hear their issues. My relationship with other City Councilmembers should be collaborative. I believe that even if you disagree with a fellow member of the Council,the interaction should always be professional and cordial. In addition,once a decision is made by the Council, it's imperative that all members of the council support the decision. During my time on the School Board, I have learned that by developing a strong working relationship with other members,the entire process runs more smoothly. The relationship with the City Manager needs to be open and honest. The City Council is responsible for the performance of the City Manager. It's important that City Council and City Manager have a strong working relationship. The relationship with City employees needs to be a mutually supportive one. It's important that the Council understands what the City employees need to do their jobs. In addition,the City employees need to support the City Council so that they have adequate information to make the best decisions for the City. The City Council's job is not to tell the City employee what to do. The City Council's vote gives direction to the City Manager. The City Manager determines how the employees execute the direction of the City Council. What is your view of providing services to the community and the financing of those services?What additional services,if any,do you believe should be provided to the Community? The City needs to provide a wide variety of services to the community in order for the City to be vibrant. The City's first priority for services are life safety services such as Police and Fire. In addition to Fire and Police services,the City needs to provide and maintain safe roads. The City should provide facilities for recreation such as parks and hiking trails. It's important for a City to provide safe and adequate parks for the residents. I believe that the City needs to have an adequate tax base in place before approving new services. In particular, I prefer that the City avoid going into debt in order to provide new facilities or services. The City of Dublin has done a commendable job of paying for services and capital projects without incurring debt. This would continue to be the preferred way in which I would want the City to approach the financing of services. What do you feel is the most important contribution you can make as a member of the City Council? As a member of the City Council, I believe my strong background in finance and accounting as well as my experience on the Dublin School Board would enable me to bring a balanced approach to making sound decisions. My experience as a Chief Financial Officer as well as a business owner gives me the experience in making tough decisions. In addition,on the School Board I have had to make many difficult decisions. It's important to be able to make the decision that is best for the community as a whole. City Growth: Dublin has experienced tremendous growth generally it has been very well planned. As a city we must insure that we continue to allow for growth to keep our local economy growing while protecting the quality living standards of Dublin. Insuring that we are maintaing balance between residential and commercial. This includes living up to the promises we have made to residents when we approve large mixed use projects. Parks and Recreation: Our East Dublin residents have anxiously awaited the Positano Park, Aquatic Center and Fallon Park to be completed. Making sure we are committed to a timely and thorough process for awarding contracts for the Aquatic Center and Parks and Recreation work is a priority for me. I would advocate for contracts that help fulfill our economic goal while allowing us the best agreement and negation possible. We should be open to alternative delivery methods like developer built parks if it would allow us to have parks delivered sooner. Providing services when necessary is essential for our City and our residents. Making sure the financial foundation is there initially is of great importance. Dublin is known as a city that pays as we go along, not accruing debt is important. It is of great significance to make sure that we are able to maintain that perspective. With that being said making sure we plan for the future as the market will dictate which services we can provide. I do not believe there are significant City service that need to be added to the City's obligation. Often times public private partnerships can be created to deliver services without making it something done by City employees. Staff will have all applicant names on separate sheets of paper. The City Clerk will read each name aloud and then place them in a container. The Assistant City Manager will mix names, and the City Clerk will then pull one name at a time, read it aloud, and Staff will record them down in the order drawn. The list will then be forwarded to the Mayor to begin the process. • Process for Candidate Statements: Based on the order drawn, each City Council candidate will be given a 3-minute time limit to address the City Council. The podium timer will be set for 3 minutes with a 30-second wrap up light. There will be no questions from the City Council of the candidates at this time. • Following the candidates' statements, each City Councilmember will be given a sheet of paper that will allow them to select two candidates for further consideration by the City Council. Once the names have been written down on the paper by each City Councilmember, the paper will be folded and handed to the City Clerk. The City Clerk will then read aloud the two candidates selected by each City Councilmember. Staff will record each of those names and each of those named will be included in the next round of interviews. • At this point, the City Clerk will write the name of each candidate for the second round of interviews on a separate piece of paper, put them in the container, the Assistant City Manager will mix the names, and the City Clerk will then pull one name at a time, read it aloud—thereby establishing the interview order. ■ Each candidate will then be asked questions by the City Council. ■ Once the interviews are concluded, the item will be brought back to the entire City Council for discussion and a possible motion for nomination. • The City Council will vote on motion for nomination. RESOLUTION NO. 12 - 13 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING AND RESTATING THE RULES FOR THE CONDUCT OF MEETINGS OF THE CITY COUNCIL (REPLACING RESOLUTION NO. 19-11) WHEREAS, from time to time, the City Council amends and restates the Rules for the Conduct of Meetings of the City Council, and the Rules were last restated by Resolution No. 19-11; and WHEREAS, the City Council wishes to amend and restate the Rules in order to add a definition of the term "political activities" to the provision prohibiting Councilmembers from engaging in political activities during meetings of the City Council. NOW, THEREFORE, BE IT RESOLVED that the Rules for the Conduct of Meetings of the City Council are amended to read as follows in their entirety: 1. REGULAR MEETINGS a. Time Regular meetings of the City Council shall be held on the first and third Tuesday of each month at the hour of 7:00 p.m., except that Closed Session Items shall be held at 6:30 p.m. Whenever the day fixed for any regular meeting of the City Council falls upon a day designated as a holiday, such meeting will be held at the same hour on the next succeeding day not a holiday. b. Place All regular meetings of the City Council shall be held at the Civic Center, as designated by Ordinance. C. Public All meetings of the City Council shall be open to the public; provided, however, the City Council may hold closed sessions as provided by the laws of the State of California. 2. SPECIAL MEETINGS A special meeting may be ordered at any time by the Mayor whenever in his/her opinion the public business may require it or upon the written request of any three members of the City Council. Whenever a special meeting shall be called, written notice of such meeting shall be delivered personally or by any other means by the City Clerk to each member of the City Council and to each local newspaper of general circulation and radio/television station requesting notice in writing. Such notice must be delivered at least twenty-four (24) hours before the time of such meeting as specified in the notice. The notice shall specify the time and place of the special meeting and the business to be transacted or discussed. No other business shall be considered at such meetings by the City Council. The agenda for special meetings shall contain the information set forth in Section 3.a. - f. below. At least twenty-four (24) hours before each special meeting, the City Clerk shall post a copy of the agenda, including the call and notice of the special meeting at the same location identified in Section 3 below. AGENDA In order to facilitate the orderly conduct of the business of the City Council, the City Clerk shall be notified no later than 11:00 a.m., on the Tuesday immediately preceding a regular City Council meeting of all reports, communications, ordinances, resolutions, contract documents or other matters to be submitted to the City Council at such meeting. Immediately thereafter, the City Clerk shall arrange an agenda of such matters according to the order of business and furnish each member of the City Council, the City Manager, City Attorney, City Department Heads and Staff with a copy of the agenda packet prior to the City Council meeting and as far in advance of the meeting as time for preparation will permit. The agenda prepared by the City Clerk shall, at a minimum, include: a. The date of the meeting b. The time of the meeting C. The location of the meeting d. A brief general description of each item of business to be transacted or discussed at the meeting e. Specified period of time for members of the public to address the City Council on items of interest to the public that are within the jurisdiction of the City Council, including a provision that no person may speak longer than three (3) minutes, and including language that the City Council can only briefly respond with questions, refer to Staff, or place on a future agenda f. A specified section under which City Councilmembers and Staff may present informational only reports. At least seventy-two (72) hours before each regular meeting, the City Clerk shall post a copy of the agenda in the Kiosk in front of the Civic Center located at 100 Civic Plaza, Dublin, California. The City Clerk shall execute a declaration of posting which shall be filed in the Office of the City Clerk. The City Clerk shall so mark or denote "Consent Calendar" items on the agenda to identify those items on the agenda which can reasonably be expected to generate no discussion by members of the City Council, City Staff or interested persons in the audience. The City Council shall consider all of the items on the Consent Calendar portion of the agenda at onetime by a vote after a motion has been duly made and seconded. If any member of the City Council, City Staff or interested person in the audience requests that a consent item be removed from the list, such item shall be taken up for consideration and disposition in the order listed on the agenda. 4. PRESIDING OFFICER The Mayor shall preside at all City Council meetings and perform such other duties consistent with his/her office as may be imposed by the City Council. The Mayor shall be entitled to vote, but shall possess no veto power. The Mayor shall be recognized as the official head of the City for all ceremonial purposes. Page 2of7 The Mayor shall preserve strict order and decorum at all regular and special meetings of the City Council. The Mayor shall state every question coming before the City Council, call for the vote, announce the decision of the City Council on all subjects and decide all questions of order, subject however, to an appeal of the City Council, in which event a majority vote of the City Council shall govern and conclusively determine such question of order. The Mayor shall sign all Ordinances adopted by the City Council during his/her presence. In the event of the absence of the Mayor, the Mayor Pro Tempore shall sign Ordinances as then adopted. 5. CALL TO ORDER The Mayor, or in his/her absence, the Mayor Pro Tempore, shall take the chair precisely at the hour appointed for the meeting, and shall immediately call the City Council to order. In the absence of the Mayor or Mayor Pro Tempore, the City Clerk shall call the City Council to order, whereupon a temporary chair shall be elected by the members of the City Council present. Upon the arrival of the Mayor or Mayor Pro Tempore, the temporary chair shall immediately relinquish the chair upon the conclusion of the business immediately before the City Council. C. ATTENDANCE Before proceeding with the business of the City Council, the City Clerk shall enter into the minutes, the names of the members present or absent. No formal roll call need be taken. 7. QUORUM A majority of the members of the City Council shall constitute a quorum for the transaction of business, but a lesser number than a quorum may adjourn from time to time. The City Council may adjourn any regular, adjourned regular, special or adjourned special meeting to a time and place specified in the order of adjournment. If all members are absent from any regular or adjourned regular meeting, the City Clerk may declare the meeting adjourned to a stated time and place. If he/she does, he/she shall cause written notice of the adjournment to be given in the same manner as provided for special meetings. A copy of the order or notice of adjournment shall be posted in the Civic Center Kiosk and other places designated by the City Council within twenty-four (24) hours after the time of adjournment. Whenever a regular or adjourned regular meeting is adjourned as provided in this section, the resulting adjourned regular meeting is a regular meeting for all purposes. When an order of adjournment of any meeting fails to state the hour at which the adjournment meeting shall be held, it shall be held at the hour specified for regular meetings. 8. MATTERS TOO LATE FOR THE AGENDA a. No action or discussion shall take place on any item not appearing on the agenda for a regular meeting as posted, unless (1) The City Council determines by majority vote that an emergency situation exists, as defined in Government Code Section 54956.5; (2) The City Council determines by vote of two-thirds of the members present (i.e. four votes if five members are present and three votes if four members are present), or by a unanimous vote of the members of the City Council if only 3 members are present, that there is a need to take immediate action and that the need for action came to the City Council's attention after the agenda was posted; (3) The item was included in a posted agenda for a prior meeting held not more than five (5) calendar days prior to the meeting at which the item is acted upon and at the prior meeting the item was continued to the meeting at which the action is being taken. b. When an item not on an agenda is raised by a member of the public, the City Council may briefly respond, may ask questions for clarification, provide a reference to Staff or other resources, or request Staff to report back at a subsequent meeting. Furthermore, a member of the City Council may take action to place a matter of business on a future agenda. 10. READING OF MINUTES Unless the reading of the minutes of a City Council meeting is requested by a member of the City Council, such minutes may be approved without reading if the City Clerk has previously furnished each member with a copy thereof. 11. RULES OF DEBATE a. Presiding Officer may debate The Mayor or such other member of the City Council as may be presiding may move, second and debate from the chair, subject only to such limitations of debate as are by these rules imposed upon all members. He/she shall not be deprived of any of the rights and privileges of a City Councilmember by reason of his /her acting as the Presiding Officer. b. Getting the floor Every member desiring to speak shall address the Mayor, and upon recognition by the Mayor, shall confine himself/herself to the question under debate. Page 4 of 7 C. Interruptions A member once recognized, shall not be interrupted when speaking unless it be to call him/her to order, or as herein otherwise provided. If a member, while speaking, be called to order, he/she shall cease speaking until the question of order be determined, and if in order, he/she shall be permitted to proceed. d. Privilege of closing debate The City Councilmember moving the adoption of an Ordinance or Resolution shall have the privilege of closing the debate. e. Motion to reconsider A motion to reconsider any action taken by the City Council may be made at any time. Such a motion must be made by one of the prevailing side, but may be seconded by any member, and may be made at any time and have precedence over all other motions or while a member has the floor; it shall be debatable. Nothing herein shall be construed to prevent any member of the City Council from making or remaking the same or other motion at a subsequent meeting of the City Council. f. Remarks of City Councilmember A City Councilmember may request through the Mayor, the privilege of having an abstract of his /her statement on any subject under consideration by the City Council entered in the minutes. If the City Council consents thereto, such statement shall be entered in the minutes. g. Synopsis of Debate The City Clerk may be directed by the Mayor with the consent of the City Council, to enter in the minutes a synopsis of the discussion of any question coming regularly before the City Council. h. Rules of Order Except as otherwise provided in this Resolution, the current edition of "Roberts Rules of Order" shall govern the conduct of the meetings of the City Council. 12. ADDRESSING THE CITY COUNCIL Any person desiring to address the City Council at a meeting shall first secure the permission of the Mayor to do so; provided, however, that under the following headings of business, any qualified and interested person shall have the right to address the City Council upon obtaining recognition by the Mayor. a. Written Communications Interested persons or their authorized representative may address the City Council by written communication on any matters concerning the City's business, or any matters over which the City Council has control. Such written communication shall be delivered to the City Clerk no later than 11:00 a.m., of the Tuesday immediately preceding the regular City Council meeting for which such written communication is intended. b. Oral Communications Interested persons in the audience or their authorized representatives may address the City Council by oral communications on any matters over which the City Council has control; provided, however, that preference shall be given to those persons who have notified the City Clerk in advance of their desire to speak in order that the same may appear on the agenda of the City Council. 13. ADDRESSING THE CITY COUNCIL AFTER MOTION IS MADE After a motion is made by the City Council, no person shall address the City Council without first securing the permission of the Mayor to do so. Page 5 of 7 14. MANNER OF ADDRESSING CITY COUNCIL Each person addressing the City Council shall stand at the podium, and give his/her name and address in an audible tone of voice for the record. A Speaker Slip shall be completed in order to facilitate preparation of the minutes. All remarks shall be addressed to the City Council as a body and not to any member thereof. No person, other than the City Council and the person having the floor shall be permitted to enter into any discussion, either directly or through a member of the City Council, without the permission of the Mayor. No question shall be asked a City Councilmember except through the Mayor. 15. VOTING a. Members of the City Council shall vote by a "voice vote" on all Ordinances, Resolutions and other matters, unless a roll calf vote is required by law or is requested by a City Councilmember. Silence shall be recorded as an affirmative vote. The Mayor shall announce the result of the vote. The City Clerk shall show on Ordinances and Resolutions, the names of City Councilmembers voting "Aye" and "No". b. The vote on any matter being considered by the City Council may be delayed by the Mayor until all members of the City Council present for a meeting, and not excused as herein provided, are present at the City Council dais. C. A member of the City Council who has a conflict of interest regarding any matter being considered by the City Council shall declare the conflict and excuse himself/herself from participating in the City Council's deliberations and decisions regarding that matter. 16. ORDER AND DECORUM a. By City Councilmembers While the City Council is in session, the members must preserve order and decorum, and a member shall neither by conversation or otherwise, delay or interrupt the proceedings or the peace of the City Council nor disturb any member while speaking or refuse to obey the orders of the City Council or Mayor, except as otherwise herein provided. b. By Persons Any person making personal, impertinent, or slanderous remarks or who shall become boisterous while addressing the City Council or who shall by conversation or otherwise, delay or interrupt the proceedings or the peace of the City Council or disturb any member while speaking or refuse to obey the orders of the City Council or the Mayor shall be forthwith, by the Mayor, barred from further audience before the City Council, unless permission to continue is granted by a majority vote of the City Council. C. Enforcement of Order and Decorum A law enforcement officer shall be designated as Sergeant-at-Arms of the City Council meetings when requested by the Mayor. He/she shall carry out all orders and instructions given at the City Council meeting. Upon instruction of the Mayor, it shall be the duty of the Sergeant-at -Arms, as to any person who violates the order and decorum of the meeting to remove and bar such person from the City Council meeting. Violation of the order and decorum of a City Council meeting is a misdemeanor. d. Smoking Smoking is prohibited at all times in all City-owned facilities. 17. PROHIBITION ON POLITICAL ACTIVITIES Members of the City Council shall not engage in political activities related to local, state, or federal elections during Council meetings. For the purposes of this section, the term "political activity" shall mean an activity directed toward the success or failure of a political party, a candidate for elected office, a ballot measure, or a political group. Nothing in this Page 6 of 7 section shall prevent the City Council from considering whether or not to support or oppose a ballot measure or state or federal legislation. 18. SPECIAL COMMITTEES/TASK FORCES All special committees/task forces shall be appointed by the Mayor, subject to approval of the City Council. 19. CITY COUNCILMEMBER VACANCIES When a vacancy occurs on the City Council, in the office of City Councilmember or Mayor, and the City Council determines to consider filling the vacancy by appointment, the City Council will make such appointment only at a meeting at which all remaining City Councilmembers (including the Mayor) are present. This rule shall not preclude the City Council from calling a special election to fill the vacancy or from adopting an ordinance to fill the vacancy pursuant to Government Code Section 36512 at a meeting at which one of the remaining City Councilmembers (including the Mayor) is absent. 20. PROTESTS Any City Councilmember shall have the right to have the reasons for his/her dissent from or protest against, any action of the City Council entered in the minutes. 21. ADJOURNMENT A motion to adjourn shall always be in order and decided without debate. 22.
