Soto, City Clerk EXECUTIVE SUMMARY: The City Council will discuss options regarding Councilmember salaries in the future. FINANCIAL IMPACT: Financial impact would be dependent on City Council direction to Staff. RECOMMENDATION: Staff recommends that the City Council discuss and provide direction to Staff regarding options for possible adjustments to City Council salaries. ~~Fg r 7 Submitted By City Clerk DESCRIPTION: ~,r , Reviewed By Assistant City Manager Government Code Section 36516(a) allows a general law city to provide a salary to City Councilmembers. An increase in compensation is allowed by ordinance, and "may not exceed an amount equal to 5% for each calendar year from the operative date of the last adjustment of the salary in effect when the ordinance or amendment is enacted" (Government Code Section 36516(4). The Dublin City Council last adjusted salaries for the City Council in January 2008, which was effective after the November 2008 election. City Councilmembers currently receive $835.76 per month as compensation. Dublin Municipal Code section 2.08.040 provides an additional $100 per month to the Mayor in addition to the salary he/she receives as a Councilmember. The Mayor's current salary is $935.76 per month. The City Council could direct Staff to return with the first reading of an ordinance that would increase salaries the allowable 5% per year to $1,015.87 per month. The allowable increase for calendar years 2009, 2010, 2011 and 2012 was calculated as follows: Page 1 of 2 ITEM NO. 8.5 Current compensation (established 2008): $835.76 5% increase, 2008 to 2009: $877.55 5% increase, 2009 to 2010: $921.43 5% increase, 2010 to 2011 $967.50 5% increase, 2011 to 2012: $1,015.87 If the maximum increase were adopted, the financial impact fora partial year increase (December 2012 -June 2013) including salary based taxes and contributions is approximately $7,776. The full year (12 month) additional cost is approximately $15,768 compared to current costs. In accordance with Dublin Municipal Code Section 2.08.0206 and State Law, the increase would not become effective until newly elected Councilmembers are sworn into office following certification of the November 2012 election. The City Council could also consider: ^ Reducing current salaries ^ Eliminating salaries altogether ^ Increasing them by an amount less than the maximum permitted by law; or ^ As decided by the City Council in 1992, 1994, and 2010, not increase to the current salary. Any of these alternatives, if selected, would not become effective until new City Councilmembers are sworn into office following certification of the November 2012 election. A. The City Council will hold all regular meetings in the Council Chambers at the Dublin Civic Center, located at 100 Civic Plaza, in the city. B. If the regular meeting place is unable to accommodate the number of persons in attendance, the City Council may recess the meeting to another place. If the City Council anticipates that the regular meeting place will be inadequate, the City Council, or Mayor in the event of an emergency, may order that the meeting be held in another place. Pursuant to Section 36516 of the Government Code, which provides that a City Council may enact an ordinance providing that each member of the City Council shall receive a salary which shall be determined by a schedule of population for cities, the members of the City Council shall receive a salary of seven hundred fifty-eight dollars and six cents ($758.06) per month. B. No Councilmember shall be eligible to receive the increase provided herein until one (1) or more Councilmembers begin a new term of office. A. The electors shall hereafter elect a Mayor and four (4) City Councilmembers. B. The term of office of the Mayor shall be two (2) years. (Ord. 17-09 § 1 (part): Ord. 11-92 §§ 1, 2) 2.08.040 Mayor's salary. The Mayor shall receive a monthly salary of one hundred dollars ($100), in addition to that which he/she receives as a Councilmember. (Ord. 17-09 § 1 (part): Ord. 13-92 § 2) ORDINANCE NO. OS - 08 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF DUBLIN AMENDING DUBLIN MUNICIPAL CODE SECTION 2.08.020 AND PROVIDING FOR AN INCREASE IN THE SALARY FOR MEMBERS OF THE CITY COUNCIL THE CITY COUNCIL OF THE CITY OF DUBLIN DOES ORDAIN AS FOLLOWS: Section 1. PURPOSE, Ordinance No. 6-82 established salaries for members of the City Council, as amended by Ordinances No. 22-85, 8-87, 4-88, 3-89, 1-90, 6-91, 23-99, 7-02, 7-04, and 3-06. The purpose of this Ordinance is to modify salaries for members of the City Council in accordance with Government Code Section 36516. The salary increase shall become effective when new Councilmembers are sworn into office following the certification of the November 2008 General Municipal Election. Section 2: AMENDMENT OF MUNICIPAL CODE Section 2.08.020, Subsection A of the Dublin Municipal Code is hereby amended to read as follows: Pursuant to Section 36516 of the Government Code which provides that a City Council may enact an ordinance providing that each member of the City Council shall receive a salary which shall be determined by a schedule of population for cities, the members of the City Council shall receive a salary of eight hundred thirty-five dollars and seventy-six cents. ($835.76) Section 3: EFFECTIVE DATE AND POSTING OF ORDINANCE This Ordinance shall take effect and be in force thirty (30) days from and after the date of the passage. The City Clerk of the City of Dublin shall cause this Ordinance to be posted in at least three (3) public places in the City of Dublin in accordance with Section 36933 of the Government Code of the State of California.
