CONFERENCE WITH LEGAL COUNSEL—ANTICIPATED LITIGATION Initiation of litigation pursuant to paragraph (4) of subdivision (d) of Section 54956.9: 1 case REGULAR MEETING 7:00 PM 1. CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. Presentation by Dublin Unified School District on the Jordan Ranch School/Park Site The City Council will receive a presentation from Kim McNeely from the Dublin Unified School District regarding the Jordan Ranch School/Park Site . STAFF RECOMMENDATION: Receive the presentation. 3.2. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3) . 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of the January 19, 2016 Regular City Council Meeting The City Council will consider approval of the minutes of the Regular City Council meeting of January 19, 2016. STAFF RECOMMENDATION: Approve the minutes of the Regular City Council meeting of January 19, 2016. Page 1 of 4 February 2, 2016 Dublin City Council Agenda 4.2 Amendment No. 2 to the Development Agreement between the City of Dublin and Dublin Crossing LLC related to the Dublin Crossing Project On January 19, 2016, the City Council introduced an Ordinance approving Amendment No. 2 to the Development Agreement between the City of Dublin and Dublin Crossing LLC Related to the Dublin Crossing Project. The City Council will consider adopting this Ordinance. STAFF RECOMMENDATION: Ordinance Waive the reading and adopt Approving Amendment No. 2 to the Development Agreement Between the City of Dublin and Dublin LLC Related to the Dublin Crossing Project. 4.3 Approval of Final Map and Quitclaim Deed and Acceptance of Park Land Dedication In- Lieu Fees for Park Land Dedication Requirements for Tract 8230, Heritage Park Phase 2 (Pulte Home Corporation) Pulte Home Corporation is filing a Final Map for Tract 8230 (Heritage Park Phase 2) to create 25 developable lots for the construction of 25 single family homes. Tract 8230 is located on the former Heritage Park Office Center property, bounded on the north by Tract 8160 (Heritage Park Phase 1), on the east by San Ramon Road, on the South by Interstate Highway 580, and on the west by Donlon Way. The proposed Quitclaim Deed would quitclaim vacated public right-of- way on Donlon Way to Pulte Home Corporation in exchange for pavement rehabilitation on Donlon Way from the project’s southern boundary to Dublin Boulevard. STAFF RECOMMENDATION: Resolution Adopt Approving Final Map and Quitclaim Deed for Tract 8230, Heritage Park Phase Resolution 2, and adopt Accepting Park Land Dedication In-Lieu Fees for Park Land Dedication Requirements for Tract 8230, Heritage Park Phase 2. 4.4 Declaration of Weed and Combustible Debris Abatement In accordance with Dublin Municipal Code section 5.70.030, the City Council may declare that there is a public nuisance created by weeds and combustible debris growing or accumulating upon the streets, sidewalks and property within the City of Dublin. This declaration requires the Fire Chief or his designee to notify property owners of the nuisance conditions and demand that the conditions be abated without delay. If the abatement is not completed, the City of Dublin shall, at the expense of the owner, have the weeds or refuse removed. STAFF RECOMMENDATION: Resolution Adopt Declaring Weeds and Combustible Refuse a Public Nuisance and Ordering the Abatement Thereof; direct Staff to notify the public of the adoption of this Resolution; and schedule a public hearing for the April 5, 2016 City Council meeting at which time the City Council will hear and consider objections to this abatement order. 4.5 St. Patrick's Day Celebration Road Closures California Vehicle Code section 21101, subdivision (e), provides that local authorities may, by ordinance or resolution, temporarily close a portion of any street under their jurisdiction for “celebrations, parades, local special events, and other purposes” as long as the authorities determine that the closing is “necessary for the safety and protection of persons who are to use that portion of the street during the temporary closing.” In order to close streets affected by the 2016 St. Patrick’s Day Parade and Shamrock 5k Fun Run and Walk, it is necessary for the City Council to adopt a Resolution. STAFF RECOMMENDATION: Resolution Adopt Authorizing Temporary Street Closures for the 2016 St. Patrick’s Day Parade and Shamrock 5K Fun Run and Walk. 4.6 Approval of a Consulting Service Agreement with Harris & Associates Inc. for Tassajara Road Overlay Project The Annual Street Overlay Program is included in the 2014-2019 Capital Improvement Program (CIP). This year’s project will provide for an asphalt overlay of Tassajara Road from the I-580 off-ramp to North Dublin Ranch Drive. The project will include installation of an asphalt rubber Page 2 of 4 February 2, 2016 Dublin City Council Agenda overlay, repairs to failed segments of the roadway, installation of new traffic signal detection loops and pavement markings, and modifications to comply with Americans with Disabilities Act (ADA). Staff recommends the selection of Harris & Associates, Inc. to complete the engineering design work for the project. STAFF RECOMMENDATION: Resolution Adopt approving a Consulting Services Agreement With Harris & Associates, Inc. for the Tassajara Road Overlay Project. 4.7 Introduction of Ordinance Amending Chapter 2.12 (Planning Commission) of the Dublin Municipal Code making Technical Amendments and Revising the Process for Removing Planning Commissioners and Adoption of Resolutions Amending Commission Bylaws to Revise Process for Removing City Commissioners and Clarifying Expectations of Professionalism At its January 19, 2016 meeting, the City Council directed Staff to prepare 1) an Ordinance updating Chapter 2.12 (Planning Commission) of the Dublin Municipal Code and 2) Resolutions adopting revised bylaws for the City’s Human Services Commission, Parks and Community Services Commission, Heritage and Cultural Arts Commission, Senior Center Advisory Committee, and Youth Advisory Committee. Under existing City Council-adopted rules, the removal of City Commissioners can only be initiated by the Mayor. State law provides that City Commissioners serve at the pleasure of the City Council, and therefore the existing rules can be changed to provide that the City Council can initiate the removal process. STAFF RECOMMENDATION: Waive the reading and INTRODUCE an Ordinance Amending Dublin Municipal Code Chapter 2.12 (Planning Commission), and adopt the Resolutions updating the bylaws for the other five City Commissions. 5. WRITTEN COMMUNICATION - None 6. PUBLIC HEARINGS -None 7. UNFINISHED BUSINESS 7.1 Sean Diamond Neighborhood Park – Preferred Concept Presentation The 2014-2019 Capital Improvement Program (CIP) includes funding to complete the design of Sean Diamond Park. As part of the design process, Staff is seeking City Council approval on the Preferred Concept Park Design for this 4.8-acre park located in the Positano subdivision, and approve a scope of work from Environmental Foresight under an existing on-call services contract to provide design development services, including the preparation of construction documents, and the provision of support through bidding and construction. STAFF RECOMMENDATION: Receive the presentation, approve the Preferred Concept Park Design, and approve the Environmental Foresight scope of work for design development services. 8. NEW BUSINESS 8.1 City Council St. Patrick's Day Parade Participation The Annual Dublin Lions Club St. Patrick’s Day Parade will be held on Saturday, March 12, 2016. Each year the Dublin City Council participates in the parade. Last year the City Council rode on a fire truck. STAFF RECOMMENDATION: Participate in the St. Patrick’s Day Parade by riding on a fire truck. 8.2 Proposed Public Facilities - Public Safety and Cultural Arts The City Council will be asked to provide direction on two new projects - the Cultural Arts Page 3 of 4 February 2, 2016 Dublin City Council Agenda Center Project and the Public Complex Safety Buildout Project, and approval of an amendment to the agreement with Indigo Architects to provide design services for Police Services space at the Public Safety Complex. The Public Safety Complex Buildout Project would move the Police Department from its current location at the Civic Center to the Public Safety Complex and provide enough space for current and future needs of Dublin Police Services at City buildout. The Cultural Arts Center Project would repurpose the Police Department’s existing space in the Civic Center to serve as a multi-use facility that affords cultural, educational, and social opportunities for the community. STAFF RECOMMENDATION: Provide direction on the creation of the Public Safety Complex Buildout Project and the Cultural Arts Center Project, and if directed, adopt the Resolution Approving an Amendment to the Agreement with Indigo/Hammond + Playle Architects, LLP for the Dublin Police Services Building Renovation. 9. OTHER BUSINESS Brief INFORMATION only reports from Council and/or Staff, including Committee Reports and Reports by Council related to meetings attended at City Expense (AB1234). 10.
