Certificate of Recognition for Roberta Dikeman The City Council will present a Certificate of Recognition to the Dikeman Family in honor of Roberta's recent rowing accomplishments. STAFF RECOMMENDATION: Present Certificate of Recognition. 3.2. Introduction of New Employees: Chris Armosino, Officer; Alan Corpuz, Officer; Dawn Sullivan, Officer; Dennis Teichera, Officer; Yesenia Sanchez, Investigations Sergeant; and Steve Akascsos, Patrol Sergeant New members of City Staff will be introduced. STAFF RECOMMENDATION: Welcome new City of Dublin Staff members. 3.3. Acceptance of Charitable Donation from Anthony, Angie and Lauren Hilich February 21, 2012 Dublin City Council Agenda Page 1 of 5 Dublin Police Services' Crime Prevention Unit received a generous $500 donation from Anthony, Angie and Lauren Bilich which will be used to purchase replacement booster seats and car seats' for low-income Dublin residents. The Dublin City Council will present the Bilich family with a Certificate of Appreciation for their donation. STAFF RECOMMENDATION: Accept the $500 donation and recognize Anthony, Angie and Lauren Bilich; and approve the Budget Change. <> 3.4. Mid-year Results for the Elementary School Recycling Contest The City Council will receive a report on the activities of the Dublin Unified School District ("DUSD") recycling contest for elementary schools and recognize the mid-year top recyclers. STAFF RECOMMENDATION: , Receive the report and present a certificate of recognition to Dougherty Elementary, Murray Elementary and Green Elementary for their recycling efforts. 3.5. All-America City and 30th Anniversary Recognition Representatives from the offices of Congressman Jerry McNerney, State Senator Loni Hancock, Assemblywoman Joan Buchanan, and Alameda County Supervisor Scott Haggerty will recognize Dublin's All-America City designation and the City's 30th Anniversary. STAFF RECOMMENDATION: Receive the presentations. 3.6. Dublin Unified School District Presentation The City Council will receive a presentation from representatives of the Dublin Unified School District on a potential capital bond measure. This item was postponed at the February 7, 2012 City Council meeting. STAFF RECOMMENDATION: Receive the report. 3.7. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the pOdium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of Regular City Council Meeting of February 7,2012 The City Council will consider the approval of the minutes of the Regular City Council Meeting of February 7, 2012. STAFF RECOMMENDATION: Approve the minutes of the Regular City Council Meeting of February 7, 2012. 4.2. Authorization to Solicit Bids - Contract No. 12-02, Fiscal Year 2011-2012 Annual Sidewalk Safety Repair Program and Curb Ramp Installation. Contract No. 12-02 is proposed to complete improvements identified in two Capital Improvement Projects. The Annual Sidewalk Safety Repair Program (CIP No. 949103) will remove and replace approximately 3,900 square feet of sidewalk with offsets of 3/4-inch or more that may pose tripping hazards. The Americans with Disabilities Act (ADA) Transition Plan (CIP No. 939103) will complete the installation of 8 handicap accessible curb ramps. STAFF RECOMMENDATION: Adopt Resolution establishing a policy for the repair of public improvements deemed to be February 21, 2012 Dublin City Council Agenda Page 2 of 5 possible pedestrian hazards (City funded sidewalk repair program); and authorize Staffto advertise for bids for Contract No. 12-02, Fiscal Year 2011-2012 Annual Sidewalk Safety Repair Program and Curb Ramp Installation. 4.3. Check Issuance Report and Electronic Funds Transfers The City Council will receive a listing of payments issued from January 1, 2012 - January 31, 2012 totaling $2,856,945.31. STAFF RECOMMENDATION: Receive the report. 4.4. Revisions to the City's Fireworks Ordinance At the February 7, 2012 Council Meeting, a Public Hearing was held for changes to the Fireworks Ordinance. This WIll be the second reading of said Ordinance. STAFF RECOMMENDATION: Waive the reading and adopt ordinance amending Chapter 5.24 of the Dublin Municipal Code in relation to the Fireworks Ordinance. 4.5. Agreement with Harris and Associates for Assessment District and Fee Administration Services The City Council will consider a three year agreement with Harris and Associates for assessment district and fee administration services. STAFF RECOMMENDATION: Adopt Resolution approving the agreement with Harris and Associates for Assessment District and Fee Administration Services. . 5. WRITTEN COMMUNICATION - None. 6. PUBLIC HEARINGS 6.1. Amendments to the Community Design and Sustainability Element of the General Plan (Chapter 10) to incorporate a Sustainable Neighborhood Design Strategy The City of Dublin has taken an active role in promoting environmental sustainability with various initiatives such as the Green Building Ordinance and the Climate Action Plan. Earlier this year, Staff presented the City Council with various options for implementing a "Sustainable Neighborhood Design Strategy," which would promote sustainable site design and planning for the street, land use, and open space patterns for neighborhoods in Dublin. The City Council provided feedback on the draft Strategy and directed Staff to incorporate the Strategy into the Community Design and Sustainability Element of the General Plan for implementation. ST AFFRECOMMENDATION: Conduct public hearing, deliberate and adopt Resolution amending the Community Design and Sustainability Element of the General Plan to incorporate strategies on Sustainable Neighborhood Design. 7. UNFINISHED BUSINESS 7.1. Fallon Sports Park Master Plan Update One of the City Council's Key Initiatives for Fiscal Year 2011-2012 is to "develop phasing options and costs for the Fallon Sports Park to include two new soccer fields and a 90-foot baseball diamond". Staff and the landscape architect have developed a proposed update to the Master Plan based on the City Council direction and input from local sports organizations: In addition to the proposed update, the City Council will consider phasing options for the lower terrace and additional amenities not included in the original Park Master Plan that local sports organizations are requesting that the City include in the lower terrace. STAFF RECOMMENDATION: Direct Staff to update the Fallon Sports Park Master Plan based on the proposed revisions and the First Phase Option for the Lower Terrace as recommended by Staff or provide alternate direction. Positano Hills Park Authorization to Bid Co.ntract #12-03 Staff is seeking City Council authorization to bid the construction of Positano Hills Park, which is a 4.6 acre neighborhood park in the Positano development. Construction of the park would be paid for with Public Facility Impact fees collected on new development. STAFF RECOMMENDATION: Authorize advertising Contract #12-03, Positano Hills Park for public bids as presented with the opportunity to have deductive alternates. 7.3. Report on StopWaste.Org Mandatory Recycling and Single-use Ban Ordinances The City Council will determine whether to participate in two Countywide ordinances adopted by the Alameda County Waste. Management Authority. The first ordinance places a mandate on businesses and multi-family dwellings to recycle all recyclable and compostable materials, and prohibits them from placing such materials in a garbage container. The second ordinance bans single-use bags from being used within the County and requires that businesses begin charging their customers a fee for giving out reusable bags. STAFF RECOMMENDATION: Deliberate and, if desired, adopt Resolution opting out of one or both of the Alameda County Waste Management Authority ordinances. 8. NEW BUSINESS 8.1. Community Grants Program Committee STAFF RECOMMENDATIONs for the Use of Community Development Block Grant (CDBG) Funds for Fiscal Year 2012-2013 On January 25, 2012, the Community Grants Program Committee, made up of Vice Mayor Hart and Councilmember Swalwell, held a public meeting, reviewed information provided by Staff and . received agency presentations on CDBG applications for funding. The Committee recommended that five CDBG eligible agencies should receive their full funding request. STAFF RECOMMENDATION: Approve the Committee's recommendation to fund the following CDBG eligible agencies and programs; . Axis Community Health - Access to Care $10,000 . Bay Area Community Services - Wellness Program $10,000 . Open Heart Kitchen - Hot Meals Program $10,000 . Senior Support Program - Case Management $10,000 . Spectrum Community Services - Meals on Wheels $ 6,475 . Housing Rehabilitation (administered by the County) $11,148 . Program Administration $ 6,600 TOTAL $ 64,223 3) Direct Staff to submit applications to the Alameda County Department of Housing and Community Development (HCD) for $64,223 in CDBG funding for Fiscal Year 2012-2013; and 4) Should there be a further decrease in the CDBG allocation, Staff recommends that the percentage of the decrease be distributed evenly across all the programs, with allowance for rounding. This excludes any mandatory set CDBG contributions. 8.2. Tri-Valley Community Television ("TV30") Capital Budget Request The City Council will consider appropriating funds to support TV30 capital improvements. STAFF RECOMMENDATION: Approve the budget change. 8.3. Authorize the City Manager to not exercise the City's purchase option on for-sale affordable February 21, 2012 Dublin City Council Agenda Page 4 of 5 residences that are in foreclosure. The City Council is being asked to authorize the City Manager, in certain circumstances, to not exercise the City's option .to purchase residences that were constructed pursuant to the City's Inclusionary Zoning Ordinance. STAFF RECOMMENDATION: Adopt Resolution Authorizing the City Manager to Not Exercise the City's Option to Cure a Default On Any Residence Subject to a Resale Restriction Agreement and to Not Exercise the City's Option to Purchase Such Residences In Certain Circumstances. 8.4. The City Council will consider whether to establish an annual Design Recognition Program for projects built in the City of Dublin. This new program would recognize those projects that promote the City Council goal of encouraging new projects to be of high quality design. City Council Salary Options The City Council will discuss options regarding Councilmember salaries in the future. STAFF RECOMMENDATION: Discuss and provide direction to Staff regarding options for possible adjustments to City Council salaries. 9.
