CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 March Customer Service Award to Deputy Randy Skarphol At this times me~bers of the audience are permitted to address the City Council on any item which is NOT on the City Council Agenda. Co~nents should not exceed 5 minutes. If any person feels that this is not sufficient tim to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meting. The City Council .CANNOT deliberate or take action on a non-agenda item UNLESS there is factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions under Government Code Section 54954.2. 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City CounCil with one single action. Hembers of the audience or members of the Council who would like an item removed from the Consent Calendar for purpose of public input may make the request known to the Nayor at the time that the Nayor announces consideration of items on the Consent Calendar. 4.1 Minutes: Regular Meeting of February 14, 1994 STAFF RECOMMENDATION: Approve 4.2 Report on city's Alarm Systems Ordinance Dublin Police Services has prepared a report giving an overview of how the city's Alarm Systems Ordinance has been working since its adoption in May of 1992. STAFF RECOMMENDATION: Receive Report 4.3 Financial Report for Period Ending January 31~ 1994 STAFF RECOMMENDATION: Receive Report 4.4 Grant Deed for Access Easement across City Property (Dublin Boulevard Extension Remnant Property east of Dougherty Road) As part of the Dublin Boulevard extension (east of Dougherty Road)~ the City of Dublin owns a remnant parcel of land which was previously the Valley Boat House property° The approval of a land use permit for the adjacent property (Isuzu parcel) was required to obtain access over the Boat House parcel if it was to have access to Dublin Boulevard. This purchase of Grant of Easement will allow Dublin Boulevard access. The purchase price for the easement is $19~312 '($8.50 per square foot). STAFF RECOMMENDATION: Adopt Resolution approving quitclaim deed for access easement across City property° 4.5 Unmarked Police Vehicle Purchase and Authorization to Dispose of Surplus Property Staff recently solicited bids for a 1993 car to replace a 1985 Ford LTD which will be sold at auction. The low bidder was Shamrock Ford for a 1993 Ford TaurUs $13,433.83· STAFF RECOMMENDATION: Direct Staff to prepare purchase order for Shamrock Ford; approve budget adjustment for an additional appropriation in the Internal Services Fund; adopt Resolution declaring surplus property; and aUthorize Staff to secure auction services from Nationwide Companies~ Inc. 4.6 Agreement with Equitax for Utility Auditing Services This agreement provides for an audit of utility bills to determine whether proper rates have been used and whether anY errors have been made. The commission for the work is 50% of refunds or savings. STAFF RECOMMENDATION: Adopt Resolution approving agreement. 4°7 Heritage Center RenoVation - Agreement for Architectural Services with Alan R. Dreyfuss AIA and H. Ruth Todd AIA~ Associated Architects The City Council will review an agreement for architectural services for the renovation of the Heritage Center. STAFF RECOMMENDATION: Approve agreement and authorize Mayor to execute° 4.8 Warrant Register Dated February 28, 1994 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION 5.1 Request for Funding from the Livermore Amador Valley Transit Authority LAVTA has requested a $1,500 contribution to support Dial- A-Ride services in Fiscal Year 1994-95 in order to avoid fare increases. STAFF RECOMMENDATION: Consider request. 5°2 Request from Dublin Little League Dublin Little League has requested permission to build 2 batting cages at the Dublin Sports Grounds and then to have exclusive use of the batting cages upon completion. STAFF RECOMMENDATION: Approve request to build batting cages; approve request for exclusive use of batting cages; authorize Mayor to execute agreement. 6. PUBLIC HEARING 6.1 Cable Television and Consumer Protection Act of 1992 - Adopting Compliance Regulations An Ordinance was introduced at the February 14th Council meeting which would adopt detailed FCC regulations, including customer service standards by reference. The Cable Television Consumer Protection and Competition Act of i992 enacted by Congress allows cable systems not subject to effective competition to be regulated by franchising authorities such as cities. Rates for premium channels and pay-per-view channels are not regulated, but rates for all other cable programming are subject to regulation by the FCC. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance; direct Staff to notify Viacom Cablevision of these regulations° 6.2 Ordinance Increasing City Council Salaries In accordance with State Law, the City Council may consider increasing City Council salaries by 5% per calendar year. A 5% increase for calendar year 1994 would increase Council salaries to $422.12 per month. The Mayor receives an additional $100 per month. This increase would not become effective, however~ until after the November 1994 election° The last Council salary increase was approved in May, 1991, and became effective following the November 1992 election. No Council salary increases were approved for calendar years 1992 or 1993. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and consider INTRODUCING Ordinance. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS 8.1 Acceptance of Gift to City The Dublin-San Ramon Lions Club has donated 3 mountain bikes to the City to be Used for law enforcement and community service in the City of Dublin. STAFF RECOMMENDATION: Accept gift and direct Staff to prepare formal acknowledgment to the donor. 8.2 AcceptanCe of Gifts to City Two belt sanders have been donated by Mrs. Setsuko Nakazawa to the Senior Center Wood Shop and a stainless steel serving cart has been donated by the Women's Club of Dublin for use at the Shannon Community Center. STAFF RECOMMENDATION: Accept gifts and direct Staff to prepare formal acknowledgments to the donors. 8.3 Designation of One Council Seat in November 1994 Election to a 2-Year Term State Law provides that if an unequal staggering of Council terms occurs as a result of a city directly electing its Mayor, the City Council may, on a one-time only basis declare that the person elected who receives the least number of votes shall serve a 2-year (rather than 4-year) Council term. This determination must be made prior to the first day for candidates to take out nomination papers which will be July 18, 1994. STAFF RECOMMENDATION: Provide appropriate direction to Staff by minute action. 8.4 Update of BART Extension Progress The Dublin/Pleasanton BART extension has been progressing for several years. The design of the station parking lots are now nearing completion, with a goal to open service to Dublin at the end of 1995. STAFF RECOMMENDATION: Receive presentation information. ° 8°5 Initiation of Study for ~the Realignment of the Right-of-Way Lines for the Road Parallel to and South of DUblin BOulevard between the limits of Golden Gate Drive and Regional Street A right-of-way line alignment was previously approved for a road parallel to Dublin Boulevard and running between the rear of the Orchard Supply Shopping Center and the Unisource Warehouse building. Both sites are owned by the same partnership. Due to the need to place loading docks at the rear of the shopping center, a request is being made to study a realignment away from the shopping center toward the warehouse° STAFF RECOMMENDATION: Adopt Resolution initiating a right-of- way line realignment study. 8.6 Consideration of League of CA Cities Committee on Local Government Reform Recommendations The upcoming 1994 legislative session marks the fourth consecutive year that the State of California has faced substantial budget deficits. California's recent economic downturn, coupled with the preexisting fiscal conditions faced by the state have prompted the elected leadership of California, both at the local and state levels, to make serious inquiries into the governmental structure, its finances and the public services delivered. In an effort to address this program, the League of CA Cities has developed a number of short and long-term financial reform measures. STAFF RECOMMENDATION: Receive Report° 9. OTHER BUSINESS 10. ADJOURNMENT Special Meetings have been scheduled on Tuesday and Wednesday, March 1 and 2, 1994, beginning at 7:30 p.m., in the Council Chambers. On March id the Council will review the status of 1993 Goals & Objectives and establish and prioritize 1994 Goals & Objectives.
