The packet is available in the City Clerk’s Office and also at the Dublin Library. REGULAR MEETING 7:00 PM 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Certificates of Recognition for City of Dublin 2015 Citizen, Young Citizen, and Organization of the Year, and Mayor's and Mayor's Legacy Award Recipients The City Council will present Certificates of Recognition to the City of Dublin 2015 Citizen, Young Citizen, and Organization of the Year, the Mayor’s Award recipients, and the Mayor’s Legacy Award recipient. STAFF RECOMMENDATION: Present the Certificates of Recognition. 3.2 St. Patrick's Day Festival Update The City Council will receive a brief update on promotions for the upcoming St. Patrick’s Day Festival and review a 30-second commercial developed by TV30 to promote both the event and Dublin’s “New American Backyard” branding. STAFF RECOMMENDATION: Receive the update. 3.3 Proclamation for American Red Cross Month, March 2016 The City Council will present a proclamation for American Red Cross Month, March 2016. STAFF RECOMMENDATION: Present the proclamation. 3.4 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. Page 1 of 5 March 1, 2016 Dublin City Council Agenda 4.1 Minutes of the February 16, 2016 Regular City Council Meeting and the February 16, 2016 Special City Council Meeting The City Council will consider approval of the minutes of the February 16, 2016 Regular City Council meeting and the February 16, 2016 Special City Council meeting. STAFF RECOMMENDATION: Approve the minutes of the February 16, 2016 Regular City Council meeting and the February 16, 2016 Special City Council meeting. 4.2 Authorization to Prepare Engineer’s Reports: Citywide Street Lighting Maintenance Assessment District 83-1; Landscaping and Lighting Maintenance Assessment District 83-2; Landscaping and Lighting Maintenance Assessment District 86-1; Landscaping and Lighting Maintenance Assessment District 97-1; Street Lighting Maintenance Assessment District 99-1 The City Council will consider authorizing the preparation of Engineer’s Reports for the Fiscal Year 2016- 2017 assessments for the City’s two street lighting maintenance assessment districts and three landscaping and lighting maintenance assessment districts. Public hearings will be held prior to the levy of assessments. STAFF RECOMMENDATION: Resolutions Adopt five Directing Preparation of the Annual Engineer's Reports for: Citywide Street Lighting Maintenance Assessment District 83-1; Landscaping and Lighting Maintenance Assessment District 83-2 (Stagecoach Road); Landscaping and Lighting Maintenance Assessment District 86-1 (Villages at Willow Creek); Landscaping and Lighting Maintenance Assessment District 97-1 (Santa Rita Area); and Street Lighting Maintenance Assessment District 99-1. 4.3 Approval of Governmental Money Purchase Plan & Trust Adoption Agreement with International City Management Association Retirement Corporation (ICMA-RC) The City Council will consider the approval of a Governmental Money Purchase Plan and Trust Adoption Agreement with International City Management Association Retirement Corporation (ICMA-RC) for the City’s 401(a) Plan. STAFF RECOMMENDATION: Resolution Adopt the Authorizing the City Manager to Execute a Governmental Money Purchase Plan and Trust Adoption Agreement With International City Management Association Retirement Corporation. 4.4 Annual Progress Report on the Status of the Dublin General Plan and Housing Element for Calendar Year 2015 The City Council will review the Annual Progress Report on the Status of the Dublin General Plan and Housing Element for Calendar Year 2015 in accordance with Government Code Section 65400(a)(2). STAFF RECOMMENDATION: Accept the Annual Progress Report on the Status of the Dublin General Plan and Housing Element Compliance for Calendar Year 2015; and direct Staff to forward the Annual Progress Report to the California State Office of Planning and Research and the California Department of Housing and Community Development. 4.5 CalRecycle Payment Program Participation The City Council will consider adopting a resolution authorizing the City’s participation in programs offered through the California Department of Resources, Recycling and Recovery (CalRecycle). The new resolution covers both existing and future all payment programs for CalRecycle and rescinds Resolution No. 109-10 that authorized the filing for only one of their payment programs. STAFF RECOMMENDATION: Resolution Adopt the Authorizing Submittal of Applications for CalRecycle Payment Programs and Rescinding Resolution No. 109-10. 4.6 Revisions to the Personnel Rules The City Council will consider approving adjustments to the City’s Benefit and Classification Plans, which are being proposed in order to bring certain job classifications in line with current and future departmental operations. STAFF RECOMMENDATION: ResolutionResolution Adopt the Amending the Benefit Plan and the Amending the Classification Plan. Page 2 of 5 March 1, 2016 Dublin City Council Agenda 4.7 Fiscal Year 2015-16 2nd Quarter Financial Review The City Council will receive a financial report through the second quarter for Fiscal Year 2015-16 and consider amendments to the Fiscal Year 2015-16 Budget. The City Council will also consider approval of a resolution amending the City’s agreement with Fehr and Peers for additional work related to the update to the Downtown Dublin Traffic Impact Fee. STAFF RECOMMENDATION: Resolution Receive the report, approve the Budget Change, and adopt the Approving an Amendment to the Agreement between the City of Dublin and Fehr and Peers for Consultant Services. 4.8 Approve Resolution to Execute a Memorandum Of Understanding with Livermore for Conducting Preliminary Engineering for Dublin Boulevard Extension to Livermore The City Council will consider approving the execution of a Memorandum of Understanding (MOU) with the City of Livermore to conduct a joint study to create a precise alignment and prepare preliminary engineering documents for the extension of Dublin Boulevard from Fallon Road in Dublin to North Canyons Parkway in Livermore. The extension of Dublin Boulevard is a planned roadway in the City of Dublin’s and the City of Livermore’s General Plans. Both cities are collecting partial funding for this project through their traffic impact fee programs. This project is also included in the Countywide Transportation Plan and the Regional Transportation Plan. The City of Dublin and the City of Livermore would like to initiate the preliminary engineering for this project to ensure that it remains a good candidate for regional or federal funding. STAFF RECOMMENDATION: Resolution Adopt the Authorizing the Execution of a Memorandum of Understanding with the City of Livermore to Conduct a Preliminary Engineering Study for the Dublin Boulevard Extension to North Canyons Parkway in Livermore, and approve the budget change. 4.9 Approve Project Plans and Specifications and Authorize Bidding for the Dougherty Road Improvements Project; and Approve Amendment No. 2 to the Agreement with Kimley-Horn & Associates, Inc. to provide Consulting Services for the Project Final plans and specifications have been completed for the Dougherty Road Improvements Project (Dougherty Project). The project provides for the widening of Dougherty Road from four lanes to six lanes between Sierra Lane and the Northern City limits. The work includes the installation of new Class II bike lanes and a Class I trail, landscaped median islands, storm drainage improvements, new curb, gutter, and sidewalk, and associated improvements. The City has submitted a grant application to the Alameda County Transportation Commission (ACTC) for partial funding of the Dougherty Project and Staff is anticipating receiving these grant funds in early summer. To expedite project delivery and reduce construction-related impacts to the residents, Staff is seeking for the City Council to approve early bidding of the project and to authorize the City Manager to execute the grant funding agreements with ACTC. Staff is also requesting approval of an amendment to the agreement with Kimley-Horn & Associates, Inc. to provide additional design services and design support during construction. STAFF RECOMMENDATION: Resolution Adopt the Approving the Plans and Specifications and Authorizing Bidding; Authorizing the City Manager to Execute Agreements with Alameda County Transportation Commission and Approving Amendment No. 2 to the Agreement Between the City of Dublin and Kimley-Horn & Associates, Inc. for Consulting Services for the Dougherty Road Improvements Project (No. ST0911). 5. UNFINISHED BUSINESS 7.1 Agreements Between the City of Dublin and the Dublin Unified School District Relating to the Ground Lease of the Jordan Ranch School/Park Site, Updates to the Master Joint Use Agreement and Approval of a New Use Agreement for the Center for Performing Arts and Education at Dublin High School The City Council will consider the following actions between the City of Dublin and the Dublin Unified School District: 1) Approval of the Option to Ground Lease Between the City of Dublin and the Dublin Unified School District and Authorize the City Manager to Enter Into a Ground Lease Agreement in substantially the form attached to the Option for the Jordan Ranch School/Park Site; 2) Approval of the Second Amended and Restated Agreement Between the City of Dublin and Dublin Unified School District Regarding Use of Facilities for Community Recreation; and 3) Approval of the Agreement Between the City of Dublin and the Dublin Unified School District for Use of Theater Facilities at Dublin High School Center for Performing Arts and Education. STAFF RECOMMENDATION: Resolution Adopt the Approving the Option to Ground Lease Between the City of Dublin and the Dublin Unified School District and Authorizing the City Manager to Enter Into a Ground Lease Agreement in substantially the form attached to the Option for the Jordan Ranch School/Park Site; Approving the Second Amended and Restated Agreement Between the City of Dublin and Dublin Unified School District Regarding Use of Facilities for Community Recreation; and Approving the Agreement Between the City of Dublin and the Dublin Unified School District for Use of Theater Facilities at Dublin High School Center for Performing Arts and Education. 7.2 Creation of a Capital Improvement Project to Relocate Dublin Police Services to the Public Safety Complex and Approval of an Amendment to the Agreement with Indigo/Hammond + Playle Architects, LLP The City Council will consider the creation of a new Capital Improvement Project – Public Safety Complex/Police Services – in order to provide for needed expansion space for Dublin Police Services through the community’s buildout. STAFF RECOMMENDATION: Resolution Adopt the Approving a new Capital Improvement Project – Dublin Police Services Building and Approving an Amendment to the Agreement with Indigo/Hammond + Playle Architects, LLP, and approve the Budget Change. 8. NEW BUSINESS 8.1 Utility Box Art Pilot Project The City Council will consider implementing a Utility Box Art Pilot Program. Under the proposal, Staff would issue a call for local professional artists to design and paint six utility boxes along Village Parkway. The Heritage and Cultural Arts Commission unanimously approved the concept and recommended that the City Council allocate funding and consider allowing high school-aged artists to compete for the commissions on the three boxes closest to Dublin High School. STAFF RECOMMENDATION: Approve the Budget Change allocating $8,000 from the Public Art Fund for the purpose of implementing a Utility Box Art Pilot Program, and provide Staff with direction to guide the process of artist and theme selection. 8.2 City Council Salary Options The City Council will discuss options regarding Councilmember salaries in the future. STAFF RECOMMENDATION: Discuss and provide direction to Staff regarding options for a possible adjustment to City Council salaries. Page 4 of 5 March 1, 2016 Dublin City Council Agenda 8.3 Designation of Agency Labor Negotiators, Unrepresented Employee: City Manager The City Council will consider the appointment of two Councilmembers as representatives to discuss conditions of employment for the City Manager. STAFF RECOMMENDATION: Appoint two Councilmembers as representatives to discuss conditions of employment for the City Manager. 8.4 Discussion of Exemption of Consultant and Professional Services Contracts from Competitive Bidding Under Purchasing Ordinance (Chapter 2.36, Contracts and Purchasing) At the February 2, 2016, the City Council requested, in response to a comment from Vice Mayor Gupta during Item 9, that Staff bring back an item for discussion related to the City Purchasing Ordinance (Chapter 2.36 of the Dublin Municipal Code) exemption of “consultant and professional services” from competitive bidding. STAFF RECOMMENDATION: Receive the report and provide direction on whether changes should be made to Chapter 2.36, Contracts and Purchasing, relative to the existing exemption of contracts for consultant and professional services from competitive bidding. 8.5 Consideration of New Date for January City Council Meeting The City Council will consider scheduling its regular meeting in January to the second Tuesday of the month. STAFF RECOMMENDATION: Discuss moving its regular meeting in January to the second Tuesday of the month. 9. OTHER BUSINESS - Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB1234). 10.
