Certificates of Recognition for City of Dublin Young Citizen of the Year, Citizen of the Year and Organization of the Year The City Council will present Certificates of Recognition to the City of Dublin Young Citizen of the Year, Citizen of the Year and Organization of the Year. STAFF RECOMMENDATION: Present the Certificates of Recognition. 3.2. Proclamation for American Red Cross Month, March 2013 The City Council will present a proclamation for American Red Cross Month, March 2013. STAFF RECOMMENDATION: Present proclamation. 3.3. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Minutes of the Special City Council Meetings of February 5, 2013, and February 19, 2013 The City Council will consider the approval of the minutes of the Special City Council meetings of February 5, 2013, and February 19, 2013. STAFF RECOMMENDATION: Approve the minutes of the Special City Council meetings of February 5, 2013, and February 19, 2013. 4.2. Authorization for the City Manager to Execute a Consulting Services Agreement with RBF Consulting to prepare an Environmental Impact Report for the Heritage Park General Plan and Specific Plan Amendment The City Council will consider a Consulting Services Agreement with RBF Consulting, a planning, engineering, and environmental consulting firm, to prepare Environmental Impact Report for the Heritage Park General Plan and Specific Plan Amendment in accordance with the California Environmental Quality Act for an amount not to exceed $123,994. The Heritage Park project includes a General Plan and Specific Plan amendment to change the land use designation of 5.85 acres located at 11875 Dublin Boulevard from Retail/Office to Medium-Density Residential in order to construct 55- 60 small lot single-family homes and a 15,000 square foot office building in place of the existing office complex. STAFF RECOMMENDATION: Adopt Resolution Approving a Consulting Services Agreement with RBF Consulting to prepare an Environmental Impact Report for the Heritage Park General Plan and Specific Plan Amendment project at 11875 Dublin. 4.3. City Treasurer's Report of Investments for the Period October 1,2012 to December 31, 2012 The City's Investment Policy calls for a semi-annual report of investments to be reviewed by the City Council. This is an informational report for the period from October 1, 2012 through December 31, 2012. The City's investment portfolio totals $139,596,300 (par value). As of December 31, 2012, funds were invested at an average yield of 0.905%. The portfolio includes both discretionary and restricted funds and the balance fluctuates throughout the year. This report provides information on the City investment portfolio, in addition to the investment results, as of December 31, 2012. STAFF RECOMMENDATION: Receive the report. 5. WRITTEN COMMUNICATION —None. 6. PUBLIC HEARINGS—None. 7. UNFINISHED BUSINESS —None. 8. NEW BUSINESS 8.1. Participation Requests for Economic Development Incentive Programs The City received a request from Fresh Millions to participate in the City's Sewer Capacity Assistance Program, and a request from C & J Cox Corporation to participate in the City's Sales Tax Reimbursement Program. Fresh Millions is in contract to lease a commercial suite located in the Tralee Village project and would propose to use the assistance to offset the costs for the improvements in the new restaurant. C & J Cox Corporation is in negotiations to construct a new gas station/car wash proposed for the Fallon Gateway project and would propose to use the assistance to offset the costs for the construction of the station. STAFF RECOMMENDATION: Provide direction regarding each request for participation in the City's economic development incentive programs. March 5, 2013 Dublin City Council Agenda Page 2 of 4 8.2. Summerhill Homes Residential(Dublin Land Company/Summerhill Homes) General Plan and Eastern Dublin Specific Plan Amendment Study Initiation Request The City Council will consider a request to initiate a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designations on the northern 38.9- acres of the overall 80.1 acre Dublin Land Company property. The project Study Area is located north of Dublin Boulevard between Tassajara Road and Brannigan Street, including the property along the north side of Gleason Drive. The Study would evaluate a proposal to change the land use designation for the Study Area to Medium Density Residential from the existing land use designations of Neighborhood Commercial, General Commercial, Medium High Density Residential, High Density Residential, and Public/Semi-Public. STAFF RECOMMENDATION: Adopt Resolution Approving the Initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designation of a 38.9-acre area located north of Dublin Blvd. between Tassajara Road Brannigan Street to Medium Density Residential; OR adopt Resolution Denying the Initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designation of a 38.9-acre area located north of Dublin Blvd. between Tassajara Road Brannigan Street to Medium Density Residential. 8.3. Mid-Year Financial Report as of December 31, 2012 for the Adopted Budget and Financial Plan, 2012-13 and 2013-14 The financial review as of December 31, 2012 provides a mid-year budget update to the City Council for the current fiscal year. Analysis of the revenues collected and all expenditures through December 31, 2012 measures the budget's adherence to the adopted resource allocation plan. The primary focus of the report is on the General Fund, which accounts for a majority of the City's basic operations. STAFF RECOMMENDATION: Receive the Mid-Year Financial Report as of December 31, 2012 for the Adopted Budget and Financial Plan, 2012-13 and 2013-14 in accordance with California Government Code Section 41004. 8.4. Mid-Year Budget Amendment for the Adopted Budget and Financial Plan, 2012-13 and 2013-14 The City Council approves biennial budgets based on the best revenue and expenditure information available several months prior to the actual adoption of the budget appropriations. As a result, budget adjustments are periodically necessary for changes that require additional budget appropriations or re- appropriations between budget line items. The City Council approved the Adopted Budget and Financial Plan, 2012-13 and 2013-14 on June 19, 2012. This item will also amend the City's Classification Plan to add the following job descriptions: Budget Manager, Customer Service Assistant I/II, and Special Projects Manager, and establishes each classification's pay range and applicable health and welfare benefits. This report will also amend the City's Fiscal Year 2012-13 Position Allocation Plan to account for modifications throughout the year. STAFF RECOMMENDATION: Adopt the following resolutions: 1) Resolution Approving the Budget Amendments to the Adopted Budget and Financial Plan, 2012-13 and 2013-14; 2) Resolution Amending the Classification Plan; 3) Resolution Amending the Salary Plan for Management Positions Exempt from Competitive Service; 4) Resolution Amending Part-Time Salary Plan; 5) Resolution Amending the Management Positions Exempt from Competitive Service and Prescribing Leave Benefit for the Designated Positions; and 6) Resolution Amending the City of Dublin Position Allocation Plan for Fiscal Year 2012-13. 9.
