CALL TO ORDER AND PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. Report on the Year-End Results for the 4 R's Challenge The City Council will receive a report on the activities of the Dublin Unified School District (DUSD) recycling contest for elementary schools and recognize the year-end top recyclers. STAFF RECOMMENDATION: Receive the report and present recognition plaques and prize money to Dougherty Elementary, Frederiksen Elementary, Murray Elementary and Wells Middle School for their recycling efforts. 3.2. Recognition of Achievement- Rhea Mitr, National Geographic California State Bee The City Council will recognize Quarry Lane fifth grader, Rhea Mitr, for her third place victory in the National Geographic California State Bee. STAFF RECOMMENDATION: Receive the presentation. 3.3. Report on 2013 Dublin Pride Week Activities The City Council will formally recognize the contributions made by various individuals and organizations that helped make the 2013 Dublin Pride Week a successful community event. The City Council will also recognize the Dublin Pride Week Poster Contest and Essay Contest winners. STAFF RECOMMENDATION: Receive the 2013 Dublin Pride Week activities report, recognize the sponsors and the poster and essay contest winners. May 21,2013 Dublin City Council Agenda Page 1 of 5 3.4. Presentation on the Little League Challenger Division Program Mr. Dave Wetmore, Administrator of Little League District 57, will make a presentation to the City Council on the Little League Challenger Division program. The 9th Annual Western Region Challenger Jamboree will be held in Dublin on May 25, 2013. This annual tournament attracts scores of teams from across the western United States and Canada. STAFF RECOMMENDATION: Receive the presentation. 3.5. Recognition of Achievement—Dublin High School Boys' Basketball Team The City Council will recognize the Dublin High School Boys' Basketball team for their achievements as Diablo-Foothill Athletic League Champions, North Coast Section Division II Finalists, and Northern California Division II Finalists. STAFF RECOMMENDATION: Receive the presentation. 3.6. Youth Advisory Committee Annual Report The Youth Advisory Committee will present an Annual Report on the Youth Advisory Committee's activities and accomplishments during the 2012-2013 term. STAFF RECOMMENDATION: Receive the report. 3.7. Youth Advisory Committee Appointments The Mayor is recommending the appointment of three middle school and ten high school youth, along with three alternates and one adult At-Large Community member to the Youth Advisory Committee for the term of June 2013 through May 2014. STAFF RECOMMENDATION: Confirm the Mayor's recommended appointments to the Youth Advisory Committee. 3.8. Appointment of Student Representative to Parks and Community Services Commission The Mayor is recommending the appointment of Dublin High School student, Vivian Sung, as the Student Representative to the Parks and Community Services Commission for the term of July 2013 through June 2014. STAFF RECOMMENDATION: Confirm the Mayor's recommended appointment of Vivian Sung as the Student Representative to the Parks and Community Services Commission for the term of July 2013 through June 2014. 3.9. 2013 Business Anniversary Awards The City Council will recognize those businesses that have been in Dublin 20, 25, 30, 35, 40, 45 and 50 years. STAFF RECOMMENDATION: Recognize those businesses that have been in Dublin 20, 25, 30, 35, 40, 45 and 50 years. 3.10 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and dearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE(3)MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the Special City Council Meeting of April 30, 2013, and the Regular City Council Meeting of May 7, 2013 The City Council will consider approval of the minutes of the Special City Council meeting of April 30, 2013, and the Regular City Council meeting of May 7, 2013. May 21,2013 Dublin City Council Agenda Page 2 of 5 STAFF RECOMMENDATION: Approve the minutes of the Special City Council meeting of April 30, 2013, and the Regular City Council meeting of May 7, 2013. 4.2. Conversion from "Yield" Control to "Stop" Control on Portage Road at Maple Drive The City received a request to convert the existing "yield" control on the Portage Road approach to Maple Drive into a "stop" control in order to increase traffic safety. Staff has reviewed the request and found that, to improve traffic safety and circulation, it would be appropriate to install a "stop" control at this approach. STAFF RECOMMENDATION: Adopt Resolution Amending the Dublin Traffic Code to designate a"Stop" control on the Portage Road approach to Maple Drive. 4.3. Approval of Agreement for Long-Term Encroachment for Landscape and Decorative Pavement Maintenance at Schaefer Ranch Tract 6765 and Schaefer Ranch Unit 2, Tract 8000 (Schaefer Ranch Holdings, LLC) Schaefer Ranch Holdings, LLC has executed an Agreement for Long-Term Encroachment for Landscape and Decorative Pavement Maintenance for Tracts 6765 and 8000 of the Schaefer Ranch development. The Agreement provides for the Schaefer Ranch Homeowners' Association to maintain project-related landscape and decorative pavement features within the public rights-of-way. STAFF RECOMMENDATION: Adopt Resolution Approving the Agreement for Long Term Encroachment for Landscape and Decorative Pavement Maintenance at Schaefer Ranch Tract 6765 and Schaefer Ranch Unit 2, Tract 8000 with Schaefer Ranch Holdings, LLC. 4.4. Check Issuance Report and Electronic Funds Transfers The City Council will receive a listing of payments issued from April 1, 2013 — April 30, 2013 totaling $7,886,842.78. STAFF RECOMMENDATION: Receive the report. 4.5. Third Quarter Financial Report as of March 31, 2013 for the Adopted Budget and Financial Plan, 2012-13 and 2013-14. This financial review as of March 31, 2013 provides an update to the City Council through three quarters of the current fiscal year. Analysis of the revenues collected and all expenditures through March 31, 2013 measures the budget's adherence to the adopted resource allocation plan. The primary focus of the report is on the General Fund, which accounts for a majority of the City's basic operations. STAFF RECOMMENDATION: Receive the Third Quarter Financial Report as of March 31, 2013 for the Adopted Budget and Financial Plan, 2012-13 and 2013-14 in accordance with California Government Code Section 41004. 4.6. Time Extension for the Traffic Impact Fee Deferral Program and the Transit District Multi- Family Residential Development Fee Deferral Program On September 1, 2009, the City Council adopted Resolution No. 127-09, approving a Traffic Impact Fee (TIF) Deferral Program for non-residential uses as one of several economic incentives to encourage development in the City. On December 20, 2011, the City Council adopted Resolution No. 215-11, approving a Transit District Multi-Family Residential Development Fee Deferral Program. Both programs are set to expire on June 30, 2013. Staff is recommending two-year extensions for both programs of June 30, 2015 and that the TIF fee payment date be changed to June 30, 2017 (two years following the completion of the program). STAFF RECOMMENDATION: Adopt Resolution Extending the Time Period for the Traffic Impact Fee Deferral Program, and adopt Resolution Extending the Time Period for the Transit District Multi-Family Residential Development Fee Deferral Program. Appointing Directors to ABAG PLAN, Corporation to represent the City of Dublin and Amending Resolution 168-05 to Update the City of Dublin Risk Management Policy to Include Adopting a Policy document The City Council will update employees that are designated as Directors to the Association of Bay Area Governments Plan (ABAG PLAN, Corporation). The City Council will also consider updating the City's Risk Management Policy to include adopting a Risk Management Policy document as provided by ABAG PLAN, Corporation. STAFF RECOMMENDATION: Adopt Resolution Rescinding Resolution 170-10 And Appointing Directors To ABAG Plan Corporation on Behalf of the City of Dublin; and adopt Resolution Amending Resolution 168-05 to Update the City of Dublin's Risk Management Policy to Include Adopting a Policy Document. 4.8. Approve Purchase of Software and Hardware, and Signal Communications Equipment through Sole Source Vendors for the Citywide Signal Communications Upgrade Project (CIP—960020) This item seeks City Council approval for the purchase of software and hardware, and communication equipment through sole source vendors to implement the Citywide Signal Communications Upgrade (CIP - 96002). STAFF RECOMMENDATION: Authorize Staff to use sole source purchase exceptions as per the City's Municipal Code Section 2.36.100 in procuring software and hardware upgrades, and signal communications equipment from Western Pacific Signal, LLC and Novani, LLC for the Citywide Signal Communications Upgrade (CIP - 960020) project. 5. WRITTEN COMMUNICATION—None. 6. PUBLIC HEARINGS—None. 7. UNFINISHED BUSINESS 7.1. Summerhill Homes Residential (Dublin Land Company/Summerhill Homes) General Plan and Eastern Dublin Specific Plan Amendment Study Initiation The City Council will consider a request to initiate a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designations on the northern 38.9-acres of the overall 80.1 acre Dublin Land Company property. The project Study Area is located north of Dublin Boulevard between Tassajara Road and Brannigan Street, including the property along the north side of Gleason Drive. The Study would evaluate a proposal to change the land use designation for the Study Area to Medium Density Residential from the existing land use designations of Neighborhood Commercial, General Commercial, Medium High Density Residential, High Density Residential, and Public/Semi-Public. STAFF RECOMMENDATION: Either adopt Resolution approving the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designation of a 38.9-acre area located north of Dublin Boulevard between Tassajara Road Brannigan Street to Medium Density Residential; or adopt Resolution denying the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designation of a 38.9-acre area located north of Dublin Boulevard between Tassajara Road Brannigan Street to Medium Density Residential. 7.2. Naming of the Historic Park Mini-Orchard and Emerald Glen Park Rose Garden The City Council will receive an update on naming the new mini-orchard at the Heritage Park after the Burton family, and the rose garden at Emerald Glen Park after the McCormick family. STAFF RECOMMENDATION: Approve the proposed plans for naming the two park amenities. May 21,2013 Dublin City Council Agenda Page 4 of 5 7.3. Amendments to the Sewer Capacity Assistance Program In May 2010, the City established a Sewer Capacity Assistance Program, in partnership with the Dublin San Ramon Services District, to allocate the City's excess sewer capacity to end users in the City of Dublin. To date, the maximum contribution per user has been 25 percent of the overall sewer capacity needs for that user. The City Council will consider revisions to the Program that include establishing criteria for the allocation of a higher percentage based on user type and location. STAFF RECOMMENDATION: Adopt Resolution amending the City's Sewer Capacity Assistance Program and Establishing Criteria for Program Implementation. 8. NEW BUSINESS 8.1. Site Development Review Amendment for the East County Hall of Justice(Alameda County Courthouse) The East County Hall of Justice (ECHOJ) Site Development Review approval was granted by the City Council on December 15, 2009. The Conditions of Approval and associated City/County Agreement state that the approval is valid for twenty-four (24) months. In November 2011, the County was granted an 18-month extension to the approval by the City Council, which will expire on June 15, 2013. The County is moving forward with the construction of the project, but will not be underway before the SDR approval expires. The County is requesting a twenty-four month extension, which necessitates a second amendment to the City/County Agreement. STAFF RECOMMENDATION: Adopt Resolution Approving a Second Amendment to the Agreement between the City of Dublin and the County of Alameda regarding the enforcement of Conditions of Approval for the East County Hall of Justice. 9. OTHER BUSINESS - Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings attended at City Expense (AB1234). 10.
