CALL TO ORDER AND PLEDGE OF ALLEGIANCE 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. Employee Introductions: Andrew Freeman, Jr., Emily Determan, Rebecca Parnes, and Walfred Solorzano. New members of City Staff will be introduced: Andrew Freeman, Jr., Parks & Community Services Business Manager; Emily Determan, City Manager's Office Office Assistant I; Rebecca Parnes, Public Works Environmental Technician; and Walfred Solorzano, Deputy City Clerk. STAFF RECOMMENDATION: Staff recommends that the City Council welcome City of Dublin Staff members. 3.2. Introduction to Dublin Unified School District Superintendent, Dr. Leslie Boozer The City Council will receive an introduction to the new Dublin Unified School District Superintendent, Dr. Leslie Boozer. STAFF RECOMMENDATION: Staff recommends the City Council receive the introduction. 3.3. Public Comment At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item.. 4.1. Minutes of the August 16, 2016 Regular City Council Meeting The City Council will consider approval of the minutes of the August 16, 2016 Regular City Council meeting. STAFF RECOMMENDATION: Staff recommends that the City Council approve the minutes of the August 16, 2016 Regular City Council meeting. 4.2. Amendment to Legal Services Meyers Nave, the law firm that has served as Dublin's City Attorney since its incorporation, has requested that the City Council consider amending its legal services agreement with the City to increase the hourly rates for general legal services, litigation services, and reimbursable third-party services. STAFF RECOMMENDATION: Staff recommends that the City Council approve the Sixth Amendment to Agreement for Legal Services and authorize Mayor to execute the same. 4.3. Consulting Services Agreement with Lanlogic, Inc. The City Council will consider approval of a consulting services agreement between the City and Lanlogic, Inc. for ongoing support of the City’s network, and special project work related to technological upgrades identified in the Information Technology (IT) Master Plan. STAFF RECOMMENDATION: Staff recommends that the City Council adopt the Resolution Approving a Consulting Services Agreement Between the City of Dublin and Lanlogic, Inc., and approve the Budget Change. 4.4. Furniture Purchase for the Dublin Library Tenant Improvement Project (CIP No. PK0315) The City Council will consider the purchase of furniture for the Dublin Library Tenant Improvement Project (CIP No. PK0315), the cost of which will be reimbursed by the Alameda County Library. STAFF RECOMMENDATION: Staff recommends that the City Council authorize the purchase of furniture for the Dublin Library Tenant Improvement Project (CIP No. PK0311) and approve the budget change. 4.5. 2016 Notice of Required Amendments to Conflict of Interest Code At the June 21, 2016 meeting, the City Council requested a report on the City’s Conflict of Interest Code. The Political Reform Act requires every local government agency to review its Conflict of Interest Code biennially to determine if it is accurate or if the Code needs amendment. The City must make a determination by October 3, 2016, if there is a need to amend the Conflict of Interest Code. The City then has 90 days to complete the necessary amendments. As explained in the report, Staff intends to complete a thorough review and return with an ordinance amending the Conflict of Interest Code within 90 days of today. STAFF RECOMMENDATION: Staff recommends that the City Council direct Staff to prepare an ordinance amending the City’s Conflict of Interest Code. 4.6. Contract Change Order with O’Grady Paving Inc. For Emergency Repairs at the William J. McCammon Alameda County Fire Department Vehicle Maintenance Facility The City Council will consider the authorization of funds associated with emergency repair work necessary at the Alameda County Fire Maintenance Facility and authorize the City Manager to execute a Contract Change Order with O’Grady Paving Inc. September 6, 2016 Dublin City Council Agenda Page 3 of 4 STAFF RECOMMENDATION: Staff recommends that the City Council adopt the Resolution authorizing the use of remaining funds from the construction of the Alameda County Fire Maintenance Facility Project and authorize the City Manager to execute a Contract Change Order with O’Grady Paving Inc. for emergency repair work. 5. WRITTEN COMMUNICATION 5.1. Public Art Policy Overview - Ordinance and Master Plan At the June 7 City Council Meeting, the City Council requested an overview on the City's Public Art policies, including the adopting Ordinance and approved Master Plan. Staff will make a presentation and be available to answer additional questions. STAFF RECOMMENDATION: Staff recommends that the City Council receive the report. 6. PUBLIC HEARING 6.1. Update to the Western Dublin Transportation Impact Fee (formerly known as “Downtown Traffic Impact Fee”) and Update to the City of Dublin Consolidated Impact Fee Administrative Guidelines The City Council will consider an update to the City’s Downtown Traffic Impact Fee, including related amendments to ensure consistency with the City’s Consolidated Impact Fee Administrative Guidelines. Additionally, the update will include a new name, the Western Dublin Transportation Impact Fee, reflecting the fact that the fee is applicable to all of the areas of Dublin west of Dougherty Road and the Iron Horse Trail. This item was continued twice from two different City Council meetings due to response letters submitted. Staff responded to the comment letters and is now bringing the item back before the City Council. STAFF RECOMMENDATION: Staff recommends that the City Council conduct the public hearing, deliberate, and adopt the Resolution Updating the Downtown Traffic Impact Fee for Future Developments within the Western Dublin Area, Renaming it the Western Dublin Transportation Impact Fee, and Updating the City of Dublin Consolidated Impact Fee Administrative Guidelines. 7. UNFINISHED BUSINESS - NONE. 8. NEW BUSINESS 8.1. Sub Area 3 Neighborhood Square – Approval of Preferred Conceptual Neighborhood Square Design (CIP No. PK0117) The City Council will consider approval on the Preferred Conceptual Neighborhood Square Design for the two-acre site located in the Irongate Development. The Dublin Ranch Sub Area 3 Neighborhood Square is included in the 2016-2021 Capital Improvement Program, Dublin Ranch Sub Area 3 Parks project (CIP No. PK0117). STAFF RECOMMENDATION: Staff recommends that the City Council receive the presentation, approve the Preferred Conceptual Neighborhood Square Design and authorize Staff to direct the Consultant to proceed with preparation of construction documents. 9. OTHER BUSINESS 10.
