The packet is available in the City Clerk's Office and also at the Dublin Library. REGULAR MEETING 7:00 PM 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1. Presentation by Senator Mark DeSaulneir State Senator Mark DeSaulnier will make a presentation on recent activities in Sacramento. STAFF RECOMMENDATION: Receive the presentation. 3.2. Measure B Citizens Watchdog Committee Report James Paxson, Chair of the Alameda County Transportation Commission Measure B Citizens Watchdog Committee, will make a presentation on the Measure B Annual Report. STAFF RECOMMENDATION: Receive the presentation. 3.3. Eden Housing Proclamation The City Council will present a proclamation to Eden Housing. This year marks 45 years that Eden Housing has been providing housing to low-income seniors, families and persons with disabilities. STAFF RECOMMENDATION: Present the proclamation. 3.4. Acceptance of Gifts to City from splatter Event Sponsors The City Council will receive a report on the sponsors that provided monetary and in-kind donations to support the City of Dublin's 2nd annual splatter . . . not your ordinary food, wine & art festival on September 21, 2013. STAFF RECOMMENDATION: Recognize the sponsors and formally accept the contributions. 3.5. Presentation of the City of Dublin's OpenGov Transparency Site A representative of OpenGov, a local government data solutions firm, will present the City's new online financial reporting software to the City Council. Red Ribbon Week Proclamation Each year, Dublin Police Services participates in "NATIONAL RED RIBBON WEEK" events at the schools and in the community. Red ribbons are hung throughout the community and items with drug free messages are distributed to students. STAFF RECOMMENDATION: Present the proclamation regarding "Red Ribbon Week". 3.7. World Polio Day Proclamation The City Council will present a proclamation proclaiming October 24, 2013, World Polio Day in the City of Dublin. STAFF RECOMMENDATION: Present the proclamation. 3.8. Introduction of New Employee: Kristen Middleton A new member of City Staff will be introduced: Kristen Middleton, Office Assistant II in Parks and Community Services. STAFF RECOMMENDATION: Welcome new City of Dublin Staff member. 3.9. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE(3)MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the October 1, 2013 Special City Council Meeting and October 1,2013 Regular City Council Meeting The City Council will consider approval of the minutes of the October 1, 2013 Special City Council meeting and the October 1, 2013 Regular City Council meeting. STAFF RECOMMENDATION: Approve the minutes of the October 1, 2013 Special City Council meeting and the October 1, 2013 Regular City Council meeting. 4.2. Amendment to Consulting Services Agreement with Bellecci and Associates,Inc. for the Dublin Boulevard Improvements Project- Sierra Court/Civic Plaza to Dublin Court The City entered into an Agreement with Bellecci and Associates, Inc. in February 2012 to prepare the preliminary engineering plans and environmental documents for the Dublin Boulevard Improvements project - Sierra Court/Civic Plaza to Dublin Court. On June 18, 2013, the City Council adopted the Mitigated Negative Declaration and approved the preliminary engineering plans for the project. The City now desires to amend Bellecci and Associates' existing Agreement to prepare the 95% plans and specifications for the roadway widening project, prepare the Rule 20A utility underground design drawings, prepare property appraisal reports and acquire the properties needed to get the project shelf- ready for construction. STAFF RECOMMENDATION: Adopt Resolution Approving Amendment to the Agreement with Bellecci & Associates, Inc. to Provide Consulting Services for the Dublin Boulevard Improvements - Sierra Court/Civic Plaza to Dublin Court —CIP No. 960026. Acceptance of Tract Improvements for Tract 7642, Sorrento West Neighborhood 1, "Milano," and Approval of Regulatory Traffic Control Devices (Toll Brothers, Inc.) Toll Brothers, Inc. has constructed the improvements for Tract 7642, Sorrento West Neighborhood 1, "Milano," in accordance with their Tract Improvement Agreement. It is now appropriate for the City to accept these improvements and approve the regulatory traffic control devices. STAFF RECOMMENDATION: Adopt Resolution Accepting the Improvements for Tract 7642, Sorrento West Neighborhood 1, "Milano,"(Toll Brothers, Inc.) and Approving the Regulatory Traffic Control Devices. 4.4. Approval of Third Amendment to Sublicense Agreement with East Bay Regional Park District Regarding Maintenance and Operations of the Alamo Canal and Tassajara Creek Regional Trails The segment of the Alamo Canal Trail under Interstate 580 has been completed and is currently being maintained by the East Bay Regional Park District (Park District). The City's Sublicense Agreement with the East Bay Regional Park District regarding the maintenance and operation of the Alamo Canal and Tassajara Creek Regional Trails is being amended to formally assign maintenance responsibilities of this portion of the Alamo Canal Trail to the Park District and the City's agreement to pay its fair share of the maintenance costs. STAFF RECOMMENDATION: Adopt Resolution Approving the Third Amendment to Sublicense Agreement Between the City Of Dublin (City) and the East Bay Regional Park District (EBRPD) regarding the Alamo Canal and Tassajara Creek Regional Trails. 4.5. Acceptance of Tract Improvements for Tract 7646, Sorrento West Neighborhood 5, "Amalfi," (Toll Brothers,Inc.) Toll Brothers, Inc. has constructed the improvements for Tract 7646, Sorrento West Neighborhood 5, "Amalfi," in accordance with their Tract Improvement Agreement. It is now appropriate for the City to accept these improvements. STAFF RECOMMENDATION: Adopt Resolution Accepting the Tract Improvements for Tract 7646, Sorrento West Neighborhood 5, "Amalfi" (Toll Brothers, Inc.). 4.6. Check Issuance Report and Electronic Funds Transfers The City Council will receive a listing of payments issued from September 1, 2013 — September 30, 2013 totaling $7,477,807.53. STAFF RECOMMENDATION: Receive the report. 4.7. Resolution Amending Resolution 86-13 Adopting a Budget for the City of Dublin for Fiscal Year 2013-14 Staff recommends amending Resolution 86-13 to allow for more administrative efficiency in transferring budgets already approved by City Council between departments as long as the amount remains within the same fund. Staff also recommends authorizing the City Manager to increase revenue and expense budgets for specific department activities, where there is no net budget impact. Finally, Staff proposes that the City Council authorize the City Manager to transfer budgets between capital improvement projects, provided the projects have the same funding source. A full accounting of any budget changes will be provided to the City Council at the quarterly financial reviews. STAFF RECOMMENDATION: Adopt Resolution Amending the Budget Resolution for the City of Dublin for Fiscal Year 2013-2014. 5. WRITTEN COMMUNICATION—None. 6. PUBLIC HEARINGS October 15,2013 Dublin City Council Agenda Page 3 of 5 6.1. PUBLIC HEARING: City of Dublin Climate Action Plan Update and Negative Declaration The proposed City of Dublin Climate Action Plan Update (CAP Update) provides policies and measures aimed at reducing greenhouse gas (GHG) emissions within the City. The goal of the CAP Update is to reduce Dublin's community-wide GHG emissions by 15% below 2010 levels by 2020. The CAP Update identifies a variety of measures to achieve the City's GHG reduction target. The various GHG reduction measures are organized into three broad categories: 1) transportation and land use measures; 2) energy measures; and 3) solid waste and recycling measures. The CAP Update describes baseline GHG emissions produced in Dublin in 2010, and forecasts GHG emissions that could be expected if the proposed CAP Update is not implemented — the business-as-usual scenario. The City expects to reduce GHG emissions through a combination of reduction measures that are included in the CAP Update. These include measures that are under the City's control and State initiatives aimed at reducing GHG emissions. STAFF RECOMMENDATION: Conduct the public hearing, deliberate, and adopt Resolution Adopting a Negative Declaration for the City of Dublin Climate Action Plan Update; and adopt Resolution approving the City of Dublin Climate Action Plan Update. 7. UNFINISHED BUSINESS 7.1. Approve and Authorize Adoption of the Tri-Valley Transportation Council Joint Exercise of Powers Agreement The proposed Tri-Valley Transportation Council (TVTC) Joint Exercise of Powers Agreement (JEPA) document consolidates the existing Joint Powers Agreement (JPA) and JEPA into one all-inclusive governing document for the development and implementation of a Tri-Valley Transportation Plan/Action Plan and Fee program. The proposed JEPA includes changes to the voting structure along with administrative adjustments that allow more flexibility for administration of the TVTC and Fee program by member jurisdictions. The TVTC is tentatively scheduled to take formal action on the proposed JEPA at the October 17, 2013 meeting STAFF RECOMMENDATION: Adopt Resolution Approving and Authorizing the Adoption of the Tri-Valley Transportation Council Joint Exercise of Powers Agreement; and authorize the City's TVTC representative to approve and execute the JEPA on behalf of the City at a future meeting of the TVTC. 8. NEW BUSINESS 8.1. Promenade General Plan and Eastern Dublin Specific Plan Amendment Study initiation request The City Council will consider a request to initiate a General Plan and Eastern Dublin Specific Plan Amendment Study which would evaluate a proposal to change the existing Neighborhood Commercial and Public/Semi-Public Land Use designations to Medium Density Residential to accommodate a combination of single-family detached residential units and attached single-family townhomes with the possibility of mixed use development along Dublin Boulevard and community amenities within the project area. STAFF RECOMMENDATION: Either adopt Resolution Approving the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate changing the existing Neighborhood Commercial and Public/Semi-Public Land Use designations to Medium Density Residential to accommodate a combination of single-family detached residential units and attached single-family townhomes and mixed use development along Dublin Boulevard as well as community amenities within the project area; OR adopt Resolution Denying the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate changing the existing Neighborhood Commercial and Public/Semi-Public Land Use designations to Medium Density Residential to accommodate a combination of single-family detached residential units and attached single-family townhomes and mixed use development along Dublin Boulevard as well as community amenities within the project area. Presentation of Preliminary FY 2012-13 Year-End and FY 2013-14 1st Quarter Results This Staff Report transmits preliminary financial results in the City's General Fund for the fiscal year ending June 30, 2013, and presents updated information for the first quarter of the current fiscal year. Staff is asking the City Council to approve various budget adjustments to close the FY 2012-13 books, to accept grant funding in FY 2013-14, and to approve several items that have no net impact on the FY 2013-14 budget. STAFF RECOMMENDATION: Adopt Resolution Amending the FY 2012-13 Budget; receive the FY 2013-14 1st Quarter Financial Review; and adopt Resolution Amending the FY 2013-14 Budget and Position Allocation Plan. 8.3. Commercial Facade Improvement Grant Program Agreement with Khaled and Amal Aburahma (Rahma Mediterranean Market) In December 2011, the City Council adopted the Commercial Facade Improvement Grant Program as one way to improve the physical appearance of the Downtown Dublin Specific Plan Area and the segment of Dublin Boulevard between Village Parkway and Dougherty Road, and encourage the retention of existing businesses, as well as increase property values,tenant stability, and lease rates in the area. Rahma Mediterranean Market has requested participation in the Commercial Facade Improvement Grant Program to assist them with the substantial facade improvements for 7111 Village Parkway valued at an estimated cost of$225,000. STAFF RECOMMENDATION: Adopt Resolution Approving a Commercial Facade Improvement Grant Program Agreement with Khaled and Amal Aburahma relating to Facade Improvements to be Performed on the Property Located at 7111 Village Parkway. 9. OTHER BUSINESS, Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings at City Expense(AB 1234). 10.
