CALL TO ORDER AND PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. 2013 Dublin Farmers' Market Recap; Recognition of Sponsors and Supporters The City Council will present Certificates of Recognition to the sponsors and supporters of the 2013 Dublin Farmers' Market. Staff will also offer a re-cap of the 2013 season. STAFF RECOMMENDATION: Receive Staff report and present the Certificates of Recognition. 3.2. Update on Shop Local Holiday Campaign and Proclamation in Recognition of Small Business Saturday—November 30, 2013 The City Council will receive an update on this year's Shop Local Holiday Campaign which, in partnership with the Dublin Chamber of Commerce, will encourage shopping throughout the City of Dublin during the holidays. Additionally, the City Council will issue a proclamation regarding Small Business Saturday on November 30, 2013. The national initiative's goal is to support those local businesses that create jobs, boost the economy, and preserve neighborhoods around the country. This initiative to prompt residents to dedicate a portion of holiday shopping to local, independently-owned small businesses aligns closely with Dublin's Shop Local Campaign. STAFF RECOMMENDATION: Accept report and proclaim November 30, 2013 as Small Business Saturday in Dublin. November 5,2013 Dublin City Council Agenda Page 1 of 5 3.3. Public Comments At this time,the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the October 15,2013 Regular City Council Meeting The City Council will consider approval of the minutes of the Regular City Council meeting of October 15, 2013. STAFF RECOMMENDATION: Approve the minutes of the Regular City Council meeting of October 15, 2013. Approval of Partial Release of Security for Tract 8000, Schaefer Ranch Unit 2 (Schaefer Ranch 4.2. Holdings,LLC) Discovery Builders, dba Schaefer Ranch Holdings LLC, previously posted bonds to guarantee the construction of improvements associated with Tract 8000, Schaefer Ranch Unit 2. As these improvements are now more than 80% complete, the City may accept replacement bonds in the amount of 200% of the estimated cost of the remaining items of work and release the original bonds. STAFF RECOMMENDATION: Adopt Resolution Approving the Partial Release of Security for Tract 8000, Schaefer Ranch Unit 2. 4.3. Amendments to Dublin Zoning Ordinance Chapters 8.08 (Definitions),8.12 (Zoning Districts and Permitted Uses of Land), 8.76 (Off-Street Parking and Loading Regulations), 8.104 (Site Development Review) and 8.116 (Zoning Clearance) and the Creation of Chapter 8.82 (Day Care Centers) (PLPA-2012-00037) On July 17, 2012, the City Council directed Staff to prepare Zoning Ordinance Amendments to establish a ministerial process for the review and approval of Day Care Centers. Based on the City Council's direction, Staff has prepared a new Zoning Ordinance chapter to regulate the establishment and operation of Day Care Centers. Staff is also proposing other Zoning Ordinance Amendments to: 1) streamline the review and approval of trash enclosures; 2) allow parking exceptions for new or modified trash enclosures; 3) define tutoring centers and establish them as Personal Services (use type); 4) identify language schools and private schools in the School-Commercial (use type); 5) clarify that parking lot restriping is subject to approval of a Site Development Review Waiver; 6) revise the parking requirement for Health Services/Clinics based on a Community Development Director determination; 7) clarify how the height of a retaining wall is measured; 8) allow minor exterior modifications to glass storefronts to be exempt from Site Development Review; 9) minor grammatical corrections and clarifications in the Site Development Review Chapter; and 10) revisions to the Zoning Clearance chapter to establish consistency and clarity among the various types of permits subject to a Zoning Clearance. On October 1, 2013 the City Council waived the reading and introduced an Ordinance approving the amendments. The City Council will consider waiving the second reading and adopting the Ordinance. STAFF RECOMMENDATION: Waive the reading and adopt Ordinance approving amendments to Dublin Zoning Ordinance Chapters 8.08 (Definitions), 8.12 (Zoning Districts and Permitted Uses of Land), 8.76 (Off-Street Parking and Loading Regulations), 8.104 (Site Development Review), and 8.116 (Zoning Clearance) and the creation of Chapter 8.82 (Day Care Centers). Authorization of Staff to Purchase Police Vehicles Directly from Vendor In order to ensure reliability and to minimize repair expense, the City routinely reviews fleet vehicles for potential replacement. Staff has scheduled seven marked Police vehicles for replacement during the current fiscal year based upon general vehicle condition and history of maintenance and repair expenses. Staff conducted an extensive study to determine which available police vehicle(s) would best suit the upcoming needs of Dublin Police Services and is recommending the Dodge Charger for patrol staff and the Ford Interceptor SUV for patrol K-9 units. STAFF RECOMMENDATION: Adopt Resolution Authorizing Staff to Procure Five Police Vehicles from Stoneridge Chrysler Jeep Dodge of Dublin, Procure Two Police Vehicles from Livermore Auto Group and Declaring Vehicles Replaced as Surplus Property. (Note: The City Purchasing Ordinance will require this item to be approved by a four-fifths vote, as the pricing was negotiated and not obtained from a sealed bid.); and approve the Budget Change to allocate the funds necessary to make the vehicle purchases. 4.5. Updates to the City's Construction and Fire Codes in accordance with requirements of State Law The 2013 Edition of the California Building Codes Standards (CBSC) was approved by the California Building Standards Commission earlier this year and will go into effect on January 1, 2014. In order to ensure the continuity of the City's building standards, the City must adopt an Ordinance incorporating the new codes. The City Council is being asked to review and introduce an Ordinance repealing the 2010 California Building Codes Standards and adopting the 2013 California Building Codes Standards. In connection with this action, the City Council is also being asked to adopt a Resolution approving findings relating to the City's amendments to the California Building Code Standards. STAFF RECOMMENDATION: 1) Set the Public Hearing of November 19, 2013 to: a) Adopt Resolution approving the Finding of Necessity for Amendments to the 2013 California Building Standards Code, as recommended by Staff, b) Waive the reading and introduce an Ordinance Repealing and Adopting Chapters 5.08 (Fire Code), 7.32 (Building Code), 7.34 (Residential Code), 7.36 (Electrical Code), 7.40 (Plumbing Code), Chapter 7.44 (Mechanical Code), and 7.94 (Green Building Code), of the Dublin Municipal Code, in Order To Adopt By Reference and Amend Provisions of the 2013 Edition of the California Building Standards Code, Title 24, California Code of Regulations. 4.6. Proposal to Use ICMA/Alpha3 for Removal and Disposal of Surplus Telephone System The City recently replaced the telephone system at City facilities. The removal of the surplus telephone system was excluded from the scope of the replacement project. It is proposed to use ICMA/Alpha3 for removal and disposal of the surplus telephone system. STAFF RECOMMENDATION: Adopt Resolution Authorizing the use of ICMA/Alpha3 for the removal and disposal of the surplus telephone system. 5. WRITTEN COMMUNICATION—None. 6. PUBLIC HEARINGS 6.1. Dublin Crossing General Plan Amendment, Specific Plan, Zoning Ordinance Amendments, Development Agreement, and Environmental Impact Report. The City Council will consider the Dublin Crossing Specific Plan (DCSP) and associated implementation actions. The Dublin Crossing Specific Plan is a plan for the orderly development of approximately 189 acres in the City of Dublin. The project area includes 8.7 acres owned by Alameda County Surplus Property Authority, an 8.9 acre parcel owned by NASA, and an approximately 172 acre portion of the 2,485 acre Camp Parks Reserve Forces Training Area (Camp Parks) in the center of Dublin, north of Interstate 580 and Dublin Boulevard. The Specific Plan addresses the future development of the project area, which includes demolition of the existing buildings and other improvements on the site and construction of a residential mixed-use project with up to 1,995 single- November 5,2013 Dublin City Council Agenda Page 3 of 5 and multi-family residential units; up to 200,000 square feet of retail, office and/or commercial uses; a 30 acre Community Park; a 5 acre Neighborhood Park, and a 12 acre elementary school site to serve approximately 900 students. In addition to adopting the DCSP, amendments are proposed to the General Plan, the Dublin Zoning Ordinance, and Zoning Map to implement the Specific Plan. Certification of a Final Environmental Impact Report (EIR) and approval of a Development Agreement is also being considered. STAFF RECOMMENDATION: Conduct public hearing, deliberate, adopt Resolution Certifying the Final Environmental Impact Report, adopting environmental findings, a Statement of Overriding Considerations, and Mitigation Monitoring and Reporting Program under CEQA for the Dublin Crossing Specific Plan; adopt Resolution amending the General Plan and adopting the Dublin Crossing Specific Plan; waive the first reading and Introduce an Ordinance approving Zoning Ordinance Amendments to create a new Chapter: 8.31 (Dublin Crossing Zoning District), rezone all properties within the Dublin Crossing Specific Plan project area to the Dublin Crossing Zoning District, amend the Zoning Map to identify the location of the new Zoning District, amend Zoning Ordinance Chapter 8.12 (Zoning Districts and Permitted Uses), and amend Chapter 8.104 (Site Development Review); and waive the first reading and INTRODUCE an Ordinance approving a Development Agreement between the City of Dublin and Dublin Crossing Venture LLC relating to the Dublin Crossing Project. 6.2. Adoption of Rates for Garbage Collection, Disposal, and Recycling Services and Adding the Alameda County Waste Management Authority Benchmark Information Services Fee At the City Council meeting on June 18, 2013, the City Council adopted the rates for solid waste collection services for the City of Dublin for Fiscal Year 2013-2014. However, the rates approved by the City Council did not include a fee for benchmark information services, which was adopted by the Alameda County Waste Management Authority. The City Council will consider adopting a resolution amending the garbage rates to include the benchmark information services fee. STAFF RECOMMENDATION: Adopt Resolution Amending the Schedule for Service Rates for Integrated Solid Waste Services; and adopt the Budget Change. 7. UNFINISHED BUSINESS -None. 8. NEW BUSINESS 8.1. Proposal for Telecom Marketing and Management Services The City Council will consider a proposal received by Horizon Tower, LLC to provide consulting services for marketing and management of telecommunications sites on City property. STAFF RECOMMENDATION: Approve the concept of securing a consultant to market and manage telecommunications services on City property, and direct Staff to negotiate an Agreement with Horizon Tower, LLC. 8.2. Agreement with Dublin Unified School District for the Enhancement of Community Amenities at the Dublin High School Center for Performing Arts and Education Staff is seeking City Council authorization to execute a Cooperative Agreement with Dublin Unified School District for the enhancement of community amenities at the Dublin High School Center for Performing Arts and Education. STAFF RECOMMENDATION: Adopt Resolution Authorizing the City Manager to execute a Cooperative Agreement with Dublin Unified School District for the Enhancement of Community Amenities at the Dublin High School Center for Performing Arts and Education; and approve the Budget Change. Consideration of Date of Volunteer Recognition Event and Appointments to Citizens/Organization of the Year Ad-Hoc Committee Each year, the City of Dublin recognizes a Citizen, Young Citizen and Organization of the Year at its Volunteer Recognition Event. As part of the process, an Ad-Hoc Committee comprised of two Dublin City Councilmembers is needed to perform duties including arranging for impartial judging and selection of winners. The City Council will consider appointment of two City Councilmembers to the Ad-Hoc Committee, as well as determine a date of the Recognition Event. STAFF RECOMMENDATION: Confirm the appointment of two City Councilmembers to the Citizens/Organization of the Year Ad-Hoc Committee, and determine the date of the Recognition Event. 9. OTHER BUSINESS Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings at City Expense (AB 1234). 10.
