ORAL COMMUNICATIONS 3.1. Presentation from the League of California Cities to the City of Dublin for the Helen Putnam Award for Excellence for the Valor Crossing Affordable Housing Development A representative from the League of California Cities will present the League Partners Helen Putnam Award for Excellence in City-Business Relations to the Dublin City Council for the Valor Crossing affordable housing development. STAFF RECOMMENDATION: Receive the award. 3.2. Employee Introduction: John Stefanski A new member of City Staff will be introduced: John Stefanski, Assistant to the City Manager, City Manager's Office. STAFF RECOMMENDATION: Welcome the new City of Dublin Staff member. 3.3. Proclamation in Recognition of United Against Hate Week (November 17-23, 2019) The City Council will consider proclaiming the week of November 17-23, 2019 as United Against Hate Week. STAFF RECOMMENDATION: Proclaim the week of November 17-23, 2019 as United Against Hate Week and direct staff to distribute the proclamation to representatives from United Against Hate Week. 3.4. Public Comment At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Approval of the October 1, 2019 Special City Council Meeting Minutes, October 15, 2019 Two Special City Council Meetings' Minutes and the October 15, 2019 Regular City Council Meeting Minutes The City Council will consider approval of the October 1, 2019 Special City Council meeting minutes, October 15, 2019 two Special City Council meetings' minutes and the October 15, 2019 Regular City Council meeting minutes. STAFF RECOMMENDATION: Approve the October 1, 2019 Special City Council meeting minutes, October 15, 2019 two Special City Council meetings' minutes and the October 15, 2019 Regular City Council meeting minutes. 4.2. Westin Hotel PLPA-2019-00006 The City Council will consider a request by the property owner to adopt an ordinance amending the Zoning Map and approving a Planned Development Zoning District with a Stage 2 Development Plan for the 5.88-acre site located on the southern portion of Site D-2 in the Dublin Transit Center. On October 15, 2019, the City Council held a public hearing and introduced this Ordinance. The City Council also approved Tentative Parcel Map No. 10949 and a Site Development Review Permit for the proposed 198-room hotel, including 9,762 square feet of assembly space, and a restaurant. The City Council is now requested to hold a second reading of the Ordinance approving the Planned Development Zoning District and related Stage 2 Development Plan for the project. STAFF RECOMMENDATION: Waive the reading and adopt an Ordinance Amending the Zoning Map and Approving a Planned Development Zoning District with a Stage 2 Development Plan for the Westin Hotel Project. 4.3. Agreement with Redwood Toxicology Laboratory, Inc. The City Council will consider an agreement for toxicology testing services with Redwood Toxicology Laboratory, Inc. STAFF RECOMMENDATION: Adopt the Resolution Approving the Agreement with Redwood Toxicology Services, Inc. for the Provision of Toxicology Testing Services for Fiscal Year 2019-20 and Fiscal Year 2020-21, contingent upon budget approval. 4.4. Ordinance Amending the Dublin Traffic Code Establishing 15 New Bus Stops The City Council will consider adopting an ordinance to amend the Dublin Traffic Code establishing 15 new bus stops in the City as requested by the Livermore Amador Valley Transit Authority. STAFF RECOMMENDATION: Waive the second reading and adopt an Ordinance Amending the Dublin Traffic Code Establishing 15 New Bus Stops. 4.5. Updates to the City’s Construction and Fire Codes in Accordance with Requirements of State Law The 2019 Edition of the California Building Standards Codes (CBSC) was approved by the California Building Standards Commission earlier this year and will go into effect on January 1, 2020. The City must adopt an Ordinance incorporating the updated provisions to ensure accuracy and alignment with state law. The City Council is being asked to introduce an Ordinance repealing the 2016 California Building Standards Code and adopting the 2019 California Building Standards Code and to set a public hearing for November 19, 2019. In November 5, 2019 Dublin City Council Agenda Page 3 of 5 connection with this action, the City Council will be asked to adopt a Resolution approving findings relating to the City’s local amendments to the California Building Standards Code. STAFF RECOMMENDATION: 1) Waive the first reading and INTRODUCE an Ordinance Repealing and Replacing Chapters 5.08 (Fire Code), 7.28 (Building Regulation Administration Code), 7.32 (Building Code), 7.34 (Residential Code), 7.36 (Electrical Code), 7.40 (Plumbing Code), 7.44 (Mechanical Code), and 7.94 (Green Building Code), of the Dublin Municipal Code, in Order To Adopt By Reference and Amend Provisions of the 2019 Edition of the California Building Standards Code, Title 24, California Code of Regulations and Repealing Chapter 7.48 (Housing Code) and Adopting Chapter 7.48 (Building Maintenance Code), of the Dublin Municipal Code, in Order to Adopt by Reference and Amend Provisions of the 2018 International Property Maintenance Code. 2) Set the Public Hearing of November 19, 2019 to: a) Adopt the Resolution Approving the Finding of Necessity for Amendments to the 2019 California Building Standards Code, as recommended by Staff, b) Waive the second reading and adopt an Ordinance Repealing and Replacing Chapters 5.08 (Fire Code), 7.28 (Building Regulation Administration Code), 7.32 (Building Code), 7.34 (Residential Code), 7.36 (Electrical Code), 7.40 (Plumbing Code), 7.44 (Mechanical Code), and 7.94 (Green Building Code), of the Dublin Municipal Code, in Order to Adopt by Reference and Amend Provisions of the 2019 Edition of the California Building Standards Code, Title 24, California Code of Regulations and Repealing Chapter 7.48 (Housing Code) and Adopting Chapter 7.48 (Building Maintenance Code), of the Dublin Municipal Code, in Order to Adopt by Reference and Amend Provisions of the 2018 International Property Maintenance Code. 4.6. Reducing the Speed Limit on Golden Gate Drive to 25 MPH The City Council will consider adopting an ordinance to reduce the speed limit from thirty miles per hour (30 mph) to twenty-five miles per hour (25 mph) on Golden Gate Drive. STAFF RECOMMENDATION: Waive the second reading and adopt an Ordinance Amending the Dublin Traffic Code to Reduce the Speed Limit on Golden Gate Drive. 4.7. Award of Contract to IBS USA Incorporated for the Mape Memorial Park Playground Replacement (CIP No. PK0319) The City Council will consider approving the plans and specifications, awarding a construction contract to IBS USA Incorporated for the Mape Memorial Park Playground Replacement (CIP No. PK0319), and approving a budget change to increase project funding. The project will demolish and replace existing play equipment at Mape Memorial Park. STAFF RECOMMENDATION: Adopt the Resolution Approving the Plans and Specifications and Awarding a Contract to IBS USA Incorporated for the Mape Memorial Park Playground Replacement (CIP No. PK0319); and, approve the budget change. 4.8. Clover Park Art Selection and Agreement The City Council will consider approval of public art, as recommended by the Heritage and Cultural Arts and Parks and Community Services Commissions and approve the associated artist agreement for Clover Park. STAFF RECOMMENDATION: Approve the Public Art design, and adopt the Resolution Approving an Agreement with Colin Selig for a Public Art Project at Clover Park. Agreement to Employ Linda Smith as City Manager The City Council will consider approval of an agreement to employ Linda Smith as the next City Manager of the City of Dublin. The terms and conditions of her employment were discussed with the appointed Negotiating Committee, consisting of Mayor Haubert and Councilmember Josey. The Negotiating Committee is recommending the approval of the agreement. The City Council will consider an amendment to the City Salary Plan to establish the flat monthly salary for the position of City Manager, effective December 31, 2019 to conform with the proposed Agreement. RECOMMENDATION: The Negotiating Committee recommends that the City Council approve, and authorize the Mayor to execute, the Agreement with Linda Smith for employment as City Manager and adopt the Resolution Amending the Salary Plan. 5. WRITTEN COMMUNICATION – NONE. 6. PUBLIC HEARING 6.1. Density Bonus Regulations Amendments — Dublin Municipal Code Chapter 8.52 (PLPA-2019-00039) The City Council will consider the introduction of an Ordinance to adopt proposed Density Bonus Regulations. The City initiated an amendment to the Zoning Ordinance to update the Density Bonus Regulations in the Dublin Municipal Code (DMC) to comply with state law. As proposed, DMC Chapter 8.52 would be deleted in its entirety and replaced with new density bonus regulations. The proposed amendment is exempt from the requirements of the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15061(b)(3). STAFF RECOMMENDATION: Conduct the public hearing, deliberate, waive the reading and INTRODUCE an Ordinance Amending Chapter 8.52 (Density Bonus Regulations) of the Dublin Zoning Ordinance. 7. UNFINISHED BUSINESS 7.1. Downtown Dublin Preferred Vision The City Council will consider approval of the Downtown Dublin Preferred Vision and its three main principles (siting of the town square, a new street grid network, and the downtown character). STAFF RECOMMENDATION: Adopt the Resolution Approving the Downtown Dublin Preferred Vision. 8. NEW BUSINESS – NONE. 9. OTHER BUSINESS Brief information only reports from City Council and/or Staff, including committee reports and reports by City Council related to meetings attended at City expense (AB1234). 10.
