CALL TO ORDER AND PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. Selection of Vice Mayor The City Council's policy is to select, in December of each year, a member of the City Council to serve as Vice Mayor for a period of one year. In the absence of the Mayor, the Vice Mayor would become Mayor Pro Tempore and would assume the temporary responsibilities of the Mayor. STAFF RECOMMENDATION: Determine who shall serve as Vice Mayor for a one-year period. 3.2. Introduction to Commander of Camp Parks, Lt. Col. Christopher Gerdes The City Council will receive an introduction to the Commander of Camp Parks, Lieutenant Colonel Christopher Gerdes. STAFF RECOMMENDATION: Receive the introduction. 3.3. Appointment to Alameda County Mosquito Abatement District The City Council will consider re-appointment of Rich Guarienti as the City of Dublin appointee to the Alameda County Mosquito Abatement District. Public Comments At this time,the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the November 19, 2013 Regular City Council Meeting The City Council will consider approval of the minutes of the Regular City Council meeting of November 19, 2013. STAFF RECOMMENDATION: Approve the minutes of the Regular City Council meeting of November 19, 2013. 4.2. Annual Report of Developer Impact Fee Funds Deposits: Pursuant to Government Code Sections 66002,66006 and 66008 (AB 1600) and Budget Adjustment for Distribution of Excess Funds State law requires the City to review and report, on an annual basis, the status of Development fees collected to finance public improvements. The report covers activity which occurred in the funds during Fiscal Year 2012-2013. The analysis has determined that all funds held for more than 5 years are necessary to complete identified projects. Annually the City also completes an assessment of funding available to reduce Impact Fee Credits that have converted to Rights to Reimbursement. The City Council will be requested to approve a Budget Adjustment reflecting the distribution of funds in Fiscal Year 2013-2014. STAFF RECOMMENDATION: Accept the Annual Report of Developer Impact Fee Funds for the Year Ended June 30, 2013; adopt Resolution Making Findings Regarding Unexpended Traffic Mitigation Contributions and Downtown Traffic Impact Fees for Fiscal Year 2012-2013; and approve the Budget Change. 5. WRITTEN COMMUNICATION—None. 6. PUBLIC HEARINGS 6.1. The Village at Dublin Retail Center. General Plan Amendment,Eastern Dublin Specific Plan Amendment, Planned Development Rezoning, Site Development Review,Vesting Tentative Map, and Supplemental Environmental Impact Report(PLPA-2012-00031). The City Council will consider The Village at Dublin General Plan and Eastern Dublin Specific Plan Amendment and associated implementation actions. The Proposed Project would involve the development of a 152,500 square foot retail commercial center on a 14.32 acre parcel at 5054 Hacienda Drive. Other improvements would include surface parking lots, installation of utilities and services, site landscaping, pedestrian plazas and placement of identification signs. Requested land use approvals include a General Plan Amendment, an amendment to the Eastern Dublin Specific Plan, Planned Development Rezoning, Site Development Review, and a Vesting Tentative Map. Certification of a Final Supplemental Environmental Impact Report(Final SEIR) is also being considered. STAFF RECOMMENDATION: Conduct the public hearing, deliberate; adopt Resolution Certifying the Final Environmental Impact Report, adopting environmental findings, a Statement of Overriding Considerations, and Mitigation Monitoring and Reporting Program under CEQA for The Village at Dublin Retail Center; adopt Resolution Amending the General Plan and the Eastern Dublin Specific Plan for The Village at Dublin Retail Center; waive the first reading and INTRODUCE an Ordinance approving Ordinance amending December 3,2013 Dublin City Council Agenda Page 2 of 4 the Zoning Map to rezone 14.32 acres of 5054 Hacienda Drive to a Planned Development Zoning District and approving the related Stage 1 and 2 Development Plan for The Village at Dublin Retail Center; and adopt Resolution Approving Site Development Review and Vesting Tentative Map for Parcel 3 of Parcel Map 8262 for The Village at Dublin Retail Center. 6.2. Iron Horse Nature Park and Open Space. General Plan Amendment and Planned Development Rezoning with a related Stage 1 and 2 Development Plan for a New Public Park The City Council will consider a General Plan Amendment and Planned Development Rezone in order to facilitate the future development of the Iron Horse Nature Park and Open Space on approximately 35 acres of land north and south of Amador Valley Boulevard along the former Union Pacific railroad right-of-way. STAFF RECOMMENDATION: Conduct the public hearing, deliberate, adopt Resolution Approving a General Plan Amendment for the future Iron Horse Nature Park and Open Space Project; and waive the reading and INTRODUCE an Ordinance amending the Zoning Map to Rezone 12.13 acres of former Union Pacific Railroad right-of- way adjacent to the Iron Horse Regional Trail to a Planned Development Zoning District and approving the related Stage 1 and 2 Development Plan for the Iron Horse Nature Park and Open Space Project. 6.3. Zoning Ordinance Amendments to Chapter 8.08 (Definitions), Chapter 8.36 (Development Regulations) and Chapter 8.76 (Off-Street Parking and Loading Regulations) The City is initiating amendments to the Zoning Ordinance to bring greater clarity and consistency to existing regulations. Amendments are proposed to: 1) Chapter 8.08 (Definitions) to add a new definition for Accessory Storage — Multi-Family; 2) Chapter 8.36 (Development Regulations) to create a minimum requirement for accessory storage in the R-2 (Two-Family), R-M (Multi-Family) and comparable PD (Planned Development) Zoning Districts and the Downtown Dublin Zoning District; and 3) Chapter 8.76 (Off-Street Parking and Loading Regulations) to establish a consistent guest parking standard for apartments and condominiums and limit the use of tandem parking for residential uses. The City Council will consider introducing an Ordinance to amend these Chapters of the Zoning Ordinance. STAFF RECOMMENDATION: Conduct the public hearing, deliberate, waive the reading and INTRODUCE an Ordinance approving amendments to Dublin Zoning Ordinance Chapters 8.08 (Definitions), 8.36 (Development Regulations) and Chapter 8.76 (Off-Street Parking and Loading Regulations). 7. UNFINISHED BUSINESS 7.1. Summerhill Homes Residential (Dublin Land Company/Summerhill Homes) General Plan and Eastern Dublin Specific Plan Amendment Study Initiation Request The City Council will consider a request to initiate a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designations on the northern 23.77 acres of the overall 80.1 acre Dublin Land Company property. The project Study Area is located north of Central Parkway between Tassajara Road and Brannigan Street, including the property along the north side of Gleason Drive. The Study would evaluate a proposal to change the land use designation to Medium Density Residential (6.1-14 du/acre) from the existing land use designations of General Commercial, Medium-High Density Residential (14.1-25 du/acre), High Density Residential (25+ du/acre), and Public/Semi-Public. STAFF RECOMMENDATION: Either adopt Resolution Approving the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designation of a 23.77 acre area located north of Central Parkway between Tassajara Road and Brannigan Street to Medium Density Residential; or adopt Resolution denying the initiation of a General Plan and Eastern Dublin Specific Plan Amendment Study to evaluate a proposal to change the land use designation of a 23.77 acre area located north of Central Parkway between Tassajara Road and Brannigan Street to Medium Density Residential. December 3,2013 Dublin City Council Agenda Page 3 of 4 8. NEW BUSINESS 8.1. Consider Mayor's Request to Study the Need for an Amendment to the Zoning Code Regarding Freeway-facing Signs and Potentially Consider Adoption of an Urgency Ordinance Related to Freeway-facing Signs At Mayor Sbranti's request, the City Council will consider initiating a study regarding the need for an amendment to the Zoning Code regarding freeway-facing signs. In order to preserve the status quo during the pendency of the study, the City Council may also consider adopting an Urgency Ordinance prohibiting the issuance of use permits, building permits, or any other land use entitlement to any business intending to install new signs (a) that are on parcels that abut or are adjacent to either (i) the Caltrans right-of-way, (ii) Interstate 580, (iii) Interstate 680, or (iv) publicly owned property that abuts or is adjacent to any of the foregoing, and (b) that would be visible from a vehicle traveling on said freeway. STAFF RECOMMENDATION: Receive Staff presentation, deliberate; and direct staff to take one of the following actions: a. Initiate a study on the need for an amendment to the Zoning Code regarding regulation of signs viewable from the freeway and report back to the City Council with a recommendation, or if appropriate, an Ordinance for consideration. b. In addition to the above, adopt an Urgency Ordinance prohibiting the issuance of use permits, building permits, or any other land use entitlement to any business intending to install new signs (a) that are on parcels that abut or are adjacent to either (i) Caltrans right-of-way, (ii) Interstate 580, (iii) Interstate 680, or (iv) publicly owned property that abuts or is adjacent to any of the foregoing, and (b) that would be visible from a vehicle traveling on said freeway, for a period of 45 days. If the City Council supports the proposed Urgency Ordinance, the City Council would waive the reading and adopt the Urgency Ordinance by a 4/5th vote. c. Take no action. 9.
