PUBLIC EMPLOYEE PERFORMANCE EVALUATION Title: City Manager REGULAR MEETING 6:00 PM 1. CALL TO ORDER AND PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT ON CLOSED SESSION 3. ORAL COMMUNICATIONS 3.1. Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1. Minutes of the December 2, 2014 Adjourned City Council Meeting The City Council will consider approval of the minutes of the Adjourned City Council meeting of December 2, 2014. Revisions to the Personnel System The City's Personnel System is governed by several documents. Each document addresses a specific set of issues. The Staff Report identifies proposed changes to the City's current Part-Time personnel system. The proposed adjustments are based on the need to add a new part-time job classification. STAFF RECOMMENDATION: Review the proposed modifications to the City's Classification and Part-Time Salary Plan, and adopt: 1) the Resolution Amending the Classification Plan; and 2) the Resolution Amending the Salary Plan for Part-Time Personnel. 4.3. Drought Emergency Continuance On March 18, 2014, the City Council adopted a Resolution declaring a State of Emergency in the City of Dublin due to extreme drought conditions within the State and City. The City Council will consider continuing extending the State of Emergency for an additional 30 days. STAFF RECOMMENDATION: By motion, as required by Government Code Section 8630(c), which states that the City Council shall review the need for continuing a local emergency at least once every 30 days until the governing body terminates the local emergency, continue the State of Emergency that was declared on March 18, 2014, based on the fact that extreme drought conditions continue to exist within both the State of California and City of Dublin, and the threat to the safety and welfare of Dublin residents remains. 4.4. Approval of Final Map and Tract Improvement Agreement, Approval of Agreement for Long- Term Encroachment for Landscape Features, and Acceptance of Park Land Dedication In-Lieu Credits for Park Land Dedication Requirements for Tract 8197,Jordan Ranch,Neighborhood 6 (LS-SF Jordan Ranch LLC, a California Limited Liability Company, and BJP-ROF Jordan Ranch LLC, a Delaware Limited Liability Company) The City Council will consider approving a Final Map by LS-SF Jordan Ranch LLC and BJP-ROF Jordan Ranch LLC for Tract 8197 (Jordan Ranch, Neighborhood 6) to create three lettered parcels and six developable lots for the construction of 67 townhomes. Tract 8197 is bounded on the north by Central Parkway, on the east by the Croak Property, on the south by the Chen Property, and on the west by Tract 8198. STAFF RECOMMENDATION: Adopt: 1) the Resolution Approving Final Map and Tract Improvement Agreement for Tract 8197, Jordan Ranch, Neighborhood 6; 2) the Resolution Approving the Agreement for Long-Term Encroachment for Landscape Features for Tract 8197, Jordan Ranch, Neighborhood 6; and 3) the Resolution Accepting Park Land Dedication In-Lieu Credits for Park Land Dedication Requirements for Tract 8197, Jordan Ranch,Neighborhood 6. 4.5. Approval of Final Map and Tract Improvement Agreement, Approval of Agreement for Long- Term Encroachment for Landscape Features, and Acceptance of Park Land Dedication In-Lieu Credits for Park Land Dedication Requirements for Tract 8198,Jordan Ranch,Neighborhood 6 (LS-SF Jordan Ranch LLC, a California Limited Liability Company) The City Council will consider approving a Final Map by LS-SF Jordan Ranch LLC for Tract 8198 (Jordan Ranch, Neighborhood 6) to create six lots for the construction of 42 townhomes. Tract 8198 is bounded on the north by Central Parkway, on the east by Tract 8197, on the south by the Chen Property, and on the west by Parcel E of Tract 8024. STAFF RECOMMENDATION: Adopt: 1) the Resolution Approving Final Map and Tract Improvement Agreement for Tract 8198, Jordan Ranch, Neighborhood 6; 2) the Resolution Approving the Agreement for Long-Term Encroachment for Landscape Features for Tract 8198, Jordan Ranch, Neighborhood 6; and 3) the Resolution Accepting Park Land Dedication In-Lieu Credits for Park Land Dedication Requirements for Tract 8198, Jordan Ranch,Neighborhood 6. Check Issuance Report and Electronic Funds Transfers The City Council will receive a listing of payments issued from November 1, 2014 — November 30, 2014 totaling $6,272,864.31. STAFF RECOMMENDATION: Receive the report. 4.7. Approval of Final Map and Tract Improvement Agreement, Approval of Agreement for Long- Term Encroachment for Landscape Features, and Acceptance of Park Land Dedication In-Lieu Credits for Park Land Dedication Requirements for Tract 8164,Dublin Ranch, The Groves—Lot 3 (Lennar Homes of California, Inc., a California Corporation) The City Council will consider approving a Final Map being filed by Lennar Homes of California, Inc., for Tract 8164 (Dublin Ranch, The Groves — Lot 3) to create eleven lettered parcels and eleven developable lots for the construction of 122 condominium homes. Tract 8164 is bounded on the north by Maguire Way, on the east by Lockhart Street, on the south by Dublin Boulevard, and on the west by Keegan Street. STAFF RECOMMENDATION: Adopt: 1) the Resolution Approving Final Map and Tract Improvement Agreement for Tract 8164, Dublin Ranch, The Groves — Lot 3; 2) the Resolution Approving the Agreement for Long-Term Encroachment for Landscape Features for Tract 8164, Dublin Ranch, The Groves — Lot 3; and 3) the Resolution Accepting Park Land Dedication In-Lieu Credits for Park Land Dedication Requirements for Tract 8164, Dublin Ranch, The Groves—Lot 3. 4.8. Extension of the City's Sales Tax Reimbursement Program The City Council will consider extending the termination date of the City's Sales Tax Reimbursement Program from January 5, 2015 to January 6, 2020. STAFF RECOMMENDATION: Adopt the Resolution Extending the Termination Date of the Sales Tax Reimbursement Program until January 6, 2020. 4.9. Authorization for the City Manager to Execute a Consulting Services Agreement with FirstCarbon Solutions (FCS) to Prepare an Environmental Impact Report for the Future Kaiser Dublin Medical Center. The City Council will consider authorizing the City Manager to execute a Consulting Services Agreement with FirstCarbon Solutions, an environmental consulting firm, to prepare an environmental impact report (EIR) for the proposed Kaiser Dublin Medical Center Project. The EIR will be completed in accordance with the California Environmental Quality Act for an amount not to exceed $443,480 (budget amount of$403,164 plus a 10% contingency fund to be spent only with authorization of City). STAFF RECOMMENDATION: Adopt the Resolution Approving a Consulting Services Agreement with FirstCarbon Solutions to Prepare an Environmental Impact Report for the Kaiser Dublin Medical Center Project and Authorizing the City Manager to Sign the Agreement on Behalf of the City. 4.10. Irrigation Controller Upgrades—Authorization to Bid Contract#14-16 The City Council will consider an authorization to bid upgrades to the City's irrigation controllers that support street median landscaping. STAFF RECOMMENDATION: Authorize Staff to advertise Contract#14-16, Irrigation Controller Upgrades, for bids. 4.11. Comprehensive Annual Financial Report (CAFR) and Annual Audit for Fiscal Year Ending June 30, 2014 and Supplemental Reports Completed by the Auditors The City of Dublin has compiled and published its Comprehensive Annual Financial Report (CAFR) for the fiscal year ending June 30, 2014. This report includes financial statements prepared by City Staff along with the audit prepared by Maze and Associates Accountancy Corporation (Maze), the independent auditors selected by the City Council. The CAFR is a report which encompasses information beyond minimum financial reporting requirements. The Auditors have provided a "clean opinion" based on their review. The report has also been reviewed by the City Council ad-hoc Audit December 16,2014 Dublin City Council Agenda Page 3 of 5 Subcommittee. The Auditors have also completed the following three supplemental reports: 1) A compliance audit of Alameda County Transportation Measure B Funds; 2) A compliance audit of the Alameda County Transportation Commission Vehicle Registration Fund (ACTC-VRF) Program; and 3) A review of the Annual Appropriations Limit Calculation. STAFF RECOMMENDATION: Receive and file the reports. 5. WRITTEN COMMUNICATION -None. 6. PUBLIC HEARINGS -None. 7. UNFINISHED BUSINESS -None. 8. NEW BUSINESS 8.1. City Council Vacancy At the December 2, 2014 City Council meeting, sitting Councilmember David G. Haubert was sworn in as Mayor. Also at the meeting, the City Council elected to fill his vacant City Council seat through an application and appointment process. In order to be considered eligible for the appointment, applicants were required to submit a completed application before the final closing date of Wednesday, December 10, 2014 at 3:00 p.m., be a Dublin resident and a registered voter. STAFF RECOMMENDATION: Review the applications, interview applicants, deliberate, and appoint and swear in a Dublin resident who is registered to vote, to the vacant City Council position or defer the appointment to a Special Meeting of the City Council, to make the appointment no later than January 30, 2015. 8.2. Mayor's Appointments to City Commissions and Committee Following the City of Dublin's general municipal elections in November of even-numbered years, terms expire on five of the City's Commissions and Committees. In response to two openings on the Planning Commission, 23 applications were received; nine applications were received in response to two openings on the Human Services Commission. Seventeen applications were received in response to three openings on the Parks & Community Services Commission; seven applications were received in response to three openings on the Heritage & Cultural Arts Commission; and seven applications were received in response to three openings on the Senior Center Advisory Committee. New members will be sworn into office in January 2015. STAFF RECOMMENDATION: Confirm the Mayor's appointments to the Commissions and Committee, or provide alternate direction. 8.3. City Council Organization/Committee Appointments/Assignments Each member of the City Council represents the City of Dublin on various local and regional Boards/Committees/Commissions. The City Council will discuss the Mayor's proposed appointments. STAFF RECOMMENDATION: Review and discuss the Mayor's Appointment/Assignment List, make any desired changes, confirm list and direct Staff to notify affected agencies, as appropriate. 8.4. Appointment of Delegate to Attend the National League of Cities Congressional City Conference and Designation of Voting Delegate for the 2015 National League of Cities Annual Conference The City Council will consider appointing one of its members as a delegate, and one as an alternate, to attend the National League of Cities (NLC) Congressional City Conference in March 2015, and appointing a voting delegate, and an alternate, to attend and vote, on the City's behalf, at the NLC Annual Conference in November of 2015. STAFF RECOMMENDATION: Review and discuss appointing one of its members as a delegate, and one as an alternate, to attend the NLC Congressional City Conference in March 2015, and appoint a voting delegate, and an alternate, to attend and vote on the City's behalf at the NLC Annual Conference in November of 2015. City Councilmember Dublin Pride Week Committee Appointments The City Council will consider appointing two of its members to the 2015 Dublin Pride Week Committee for a limited term beginning January 2015 and ending December 2015. The Dublin Pride Week Committee plans and prepares this annual event, which seeks to engage individuals and/or groups in action-based activities to help improve the community. STAFF RECOMMENDATION: Discuss two Councilmember appointments to the Dublin Pride Week Committee and confirm the appointments for the limited term of January 2015 through December 2015. 8.6. Authorization of Units from the Downtown Dublin Development Pool and Related Community Benefit Agreement Deal Points with Trumark Homes Trumark Homes seeks units from the Downtown Dublin Specific Plan Development Pool in order to develop a project at 7144 Regional Street. Staff will present the negotiated deal points to be included in the Community Benefit Agreement and is requesting authorization from the City Council to proceed in its preparation. STAFF RECOMMENDATION: Authorize preparation of a Community Benefit Agreement that includes the negotiated deal points summarized in this report. 8.7. Determine Date/Time of Assembly Bill (AB) 1234 Ethics Training for City Officials Under Assembly Bill (AB) 1234, "local agency officials" must receive ethics training at least once every two years if the City provides compensation, salary, stipend or reimbursement for actual and necessary expenses to a member of a legislative body. The City will offer a mandatory Ethics Training session to all required City officials. STAFF RECOMMENDATION: Discuss and determine a date for the AB 1234 Ethics Training session for City officials or provide Staff with alternate direction. 9. OTHER BUSINESS Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings at City Expense (AB 1234). 10.
