HomeMy WebLinkAbout*12-27-1994 CC Agenda AGENDA DUBLIN CITY COUNCIL REGULAR MEETING - December 27, 1994 Tuesday - 6:30 p.m. DUBLIN CIVIC CENTER 100 Civic Plaza A complete packet of information containing StaffReports and exhibits related to each item is available for public review several days prior to a Council meeting in the City Clerk's Office and also at the Dublin Library. 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Administration of Oath of Office by City Clerk to newly elected Councilmember Barnes 3.2 Interviews of City Council Applicants On November 28, 1994, Staffwas directed to place ads in local newspapers inviting interested residents of Dublin to apply for the opening on the City Council. Applications were requested by a total of 22 residents; and 14 applications were returned to the City Clerk by the 5:00 p.m., December 22nd deadline. STAFF RECOMMENDATION: Conduct interviews. If an applicant receives a majority vote, determine whether the new Councilmember is to be sworn in immediately or at the January 9, 1995 meeting. If no applicant receives a majority vote, direct Staff to prepare necessary documentation to call election for June 6, 1995. If direction is given to call a special election, the Council should determine if an interim appointment should be made until the election. An urgency Ordinance would have to be introduced and adopted on January 9, 1995. 3.3 Election by City Council of Vice Mayor 3.4 City Council Organization/Committee Appointments Individual members of the City Council represent the City of Dublin on various local and regional Boards/Committees/Commissions. Several openings occurred as a result of the November election. STAFF RECOMMENDATION: Review appointment list and advise Staff appropriately. At this time, members of the audience are permitted to address the City Council on items of interest to the public; however, in accordance with State Law, no ACTION or DISCUSSION shall take place on any item which is NOT on the City Council Agenda. The Council may respond briefly to statements made or questions posed, or may request Staff to report back at a future meeting concerning the manner. Further, a member of the City Council may direct Staff to place a matter of business on a future agenda. Any person may arrange with the City Clerk (no later than 11:00 a.m., on the Tuesday preceding a regular meeting) to have an item of concern placed on the agenda for the next regular meeting. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in GC 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of December 12, 1994 STAFF RECOMMENDATION: Approve. 4.2 Renewal of Agreement with NORCAL Employment Relations Training Consortium Since 1987, the City has participated in this training consortium which provides employee relations training covering a wide range of issues such as the ADA, employee evaluations, employment discrimination and affirmative action, discipline procedures and leadership. STAFF RECOMMENDATION: Approve City's continued participation in the program and authorize the City Manager to execute the agreement. 4.3 Annual St. Patrick's Day Celebration The City Council will review the proposed plans for the 1995 St. Patrick's Day celebration, including the parade route, the site for the community celebration and business participation. ST,S~F RECOI~,@vfENDATION: Approve parade route; approve location of com~nunity celebration; adopt Resolution. 4.4 Warrant Register ($ 267,084.52) Dated December 27, 1994 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATION - None 6. PUBLIC HEARING 6.1 Noise Mitigation Fee Ordinance One of the mitigation measures required as part of the adoption of the Eastern Dublin General Plan Amendment and Specific Plan Environmental Impact Report was that the City should develop a noise mitigation fee to pay for mitigation measures such as noise barriers, earthen berms or retrofitting existing structures with sound-related windows. Adoption of this enabling ordinance is not subject to CEQA. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE ordinance. 10. 6.2 Eastern Dublin Traffic Impact Fee/Area of Benefit Fee The Eastern Dublin General Plan and Specific Plan requires that this plan area pay for the transportation needs of the area as well as improvements to existing facilities that are identified as being impacted by the development in the area. This proposed Traffic Impact Fee is planned to be the vehicle for assuring that the major transportation infrastructure is funded and constructed. STAFF RECOMMENDATION:_ Conduct public hearing~ determine value of protests (to area of benefit fee only)~ deliberate~ adopt Resolution imposing Eastern Dublin Traffic impact Fee and Area of Benefit Fee -OR- modify Resolution to eliminate Area of Benefit Fee is majority protest is received. UNFINISHED BUSINESS 7.1 Award of Bid Contract 94-04A Dougherty Road/Sierra Lane Improvements The low bid received exceeds funds budgeted for construction. Staffis recommending an additional appropriation and budget transfer in order to construct the project including the 2 alternate items. STAFF RECOMMENDATION: Adopt Resolution awarding Contract to Cn-ade-Tech, Inc., ($273,573.50) including both Alternates 1 and 2; approve Budget Change Forms in the amount of $35,252. 7.2 Award of Bid Contract 94-07 Heritage Center Renovation Four bids were received for the Heritage Center Renovation project. Staffhas reviewed the bids and recommends that the bid be awarded to the low bidder. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Skyline Construction ($168,500); approve Budget Change Form; authorize Mayor to execute agreement. NEW BUSINESS 8.1 Request to submit Federal Grant Proposal for COPS FAST Program Staff is requesting authorization from the City Council to submit a Federal Grant Application for the hiring of one police officer to participate in community policing. Grant has been established by the Federal Government to assist agencies serving populations under 50,000. STAFF RECOMMENDATION: Authorize Staffto submit Grant Application.
