HomeMy WebLinkAbout*Agenda 01-21-1997A G E N D A DUBLIN CITY COUNCIL - Tuesday, January 21, 1997, 7:00 p.m. REGULAR MEETING DUBLIN CIVIC CENTER, 100 Civic Plaza A complete packet of information containing Staff Reports and exhibits related to each item is available for public review several days prior to a Council meeting in the City Clerk’s Office and also at the Dublin Library. 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 3.ORAL COMMUNICATIONS 3.1Introduction of new employee, Planning Department Office Assistant Terry Gubera 3.2Proclamation Recognizing former Dublin Police Chief Jim Rose At this time, the public is permitted to address the City Council on non-agendized items. The Council must, however, comply with all State Laws in regard to items not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of January 7, 1997 STAFF RECOMMENDATION: Approve 4.2Mape Memorial Park Renovation/Dedication The City Council will receive an update on the schedule for the Mape Memorial Park renovation project and will also review key deadlines associated with publicizing the rededication ceremony for the park on the cover of the Schedule of Recreation Classes and Programs. STAFF RECOMMENDATION: Receive Report. 4.3Banner Compliance Program City Staff has prepared a report on the status of a work program to implement the City Council direction relating to compliance with City Regulations regarding Temporary Promotional Signs (Banners, Pennants and Decorative Flags). STAFF RECOMMENDATION: Receive Report. 4.4Acceptance of work - San Ramon Road Drainage Improvement Project Contract 96-06 This work included the repair of a creek bank along San Ramon Road next to the Shannon Center and the installation of a two foot retaining wall along the east side of San Ramon Road. This work was to alleviate storm flooding in the two areas. The contractor has now completed his work. STAFF RECOMMENDATION: Accept improvements and authorize payment of $42,705 (excluding 10% retention) to KBR Construction for final invoice and release retention in the amount of $4,745 after 35 days if there are no subcontractor claims. 4.5Agreement with Metricom to allow attachment of Wireless Radios within the Public Right- of-Way Metricom, Inc., has approached the City to obtain permission to place wireless communications radios within the public right-of-way. The small devices would be placed on an estimated 30 to 48 street lights to provide a wireless network within the City. The City would be compensated on an annual basis at the rate of $60 for each radio placed. The network allows Metricom subscribers to access the Internet without a wired connection. STAFF RECOMMENDATION: Adopt Resolution authorizing the City Manager to execute the Permit. 4.6City Treasurer's Investment Report for 2nd Quarter of Fiscal Year 1996-97 In accordance with State Law, on a quarterly basis, the City Treasurer reports on the status of City investments. The City Treasurer believes that the schedule of investments including the dates of maturity, contain adequate cash flow liquidity to meet anticipated expenditures over the next 6 months. STAFF RECOMMENDATION: Receive Report. 4.7Warrant Register ($586,981.88) dated January 21, 1997 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS 5.1Request for Skate Park A letter has been received from Dublin resident Doron Erenberg requesting that consideration be given to building a skate park in Dublin. STAFF RECOMMENDATION: Refer to Parks & Community Services Commission. 6.PUBLIC HEARING - None 7.UNFINISHED BUSINESS 7.1Response from TCI Communications, Inc., regarding Restoration of Arts & Entertainment (A&E) Channel and Status of System Upgrade Construction Schedule The City Council requested that TCI address the recent actions by TCI regarding changes in service to Dublin subscribers. In addition, the Council requested a status report regarding the proposed system upgrade. The Council also requested an opportunity to evaluate other measures which may be taken to address cable TV service issues, in the event that the response by TCI did not meet the City's needs. STAFF RECOMMENDATION: Consider response and if appropriate, authorize the issuance of a waiver of notice. Provide Staff with direction as to any further action to be taken regarding this issue. 8.NEW BUSINESS 8.1Initiation of a General Plan Amendment (GPA) Study for Nielsen Ranch ± Vince Fletcher, Applicant, is requesting a GPA Study for 200 acre parcel east of the terminus of Brittany Drive & Brittany Lane. STAFF RECOMMENDATION: Adopt Resolution authorizing GPA Study and authorizing Staff to retain consultant assistance to complete Staff Reports - OR - Adopt Resolution denying GPA Study. 8.2Kaufman and Broad Request for Interpretation of the Inclusionary Zoning Ordinance Fee Calculations and Timing of Payments Request for determination of whether in-lieu fee should be calculated on the basis of the square footage of the entire residence or that of the living area and whether the fee should be paid at the time of Final Map, first Building Permit, or each Building Permit for each residence. STAFF RECOMMENDATION: Direct Staff to prepare modifications to existing Ordinance: Option A - To allow payment at the time of building permit and to calculate fees based on total square footage of the structure (building and garage) - Staff's recommendation Option B - To allow payment at the time of building permit based on just building square footage (exclude garages) - K&B's request - OR - Option C - Reaffirm existing Ordinance to collect payments before issuance of the first building permit based on total square footage of the structure - Present Ordinance Instruct Staff to bring back Ordinance modifications, if necessary, to the City Council. 8.3Long Term Permit of Surplus Land at Camp Parks The City Council will determine whether to submit a request for a long term permit of surplus land at Camp Parks. The land in question has been earmarked for development by Dublin United Soccer League for additional soccer fields. STAFF RECOMMENDATION: Direct Staff to submit a letter to Col. Bain. 8.4Dublin Elementary School Sports Field/Park Development The Dublin Unified School District has contacted the City regarding a potential joint project for the renovation of the Dublin Elementary School fields. The project would be divided into two phases with the District funding Phase I and the City funding Phase II. The completed project would result in additional athletic fields and a children's play area for both school and community use. STAFF RECOMMENDATION: Review options and provide Staff with appropriate direction. 8.5Review of City Fireworks Ordinance Permit Process In accordance with Council direction, Staff was asked to place the Fireworks Ordinance on a future agenda in order that the Council may discuss whether or not the Ordinance should be modified in a manner so as to allow the issuance of fireworks sales permits to youth organizations only. STAFF RECOMMENDATION: Discuss and provide appropriate direction to Staff. 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10CLOSED SESSION . 10.1 Conference with Labor Negotiator (Government Code Section 54957.6) - City Negotiators: Councilmembers Burton and Barnes - Unrepresented Employee: City Manager REPORT OF CLOSED SESSION ACTION 11ADJOURNMENT .
