The terms for Dublin's current appointments, Edy Coleman and Claudia McCormick will expire on February 28, 1997. The Mayor proposes to reappoint both to terms expiring in February, 1999. STAFF RECOMMENDATION: Confirm Mayor's appointments or provide other appropriate direction to Staff. 3.5CLOSED SESSION . Conference with Legal Counsel - Existing Litigation pursuant to Government Code Section 54956.9 subdivision (a): City of Dublin vs. Woolverton, et al., Alameda County Superior Court Case No. V- 009571-4. REPORT OF CLOSED SESSION ACTION At this time, the public is permitted to address the City Council on non-agendized items. The Council must, however, comply with all State Laws in regard to items not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of January 21, 1997 STAFF RECOMMENDATION: Approve 4.2Authorization to Go to Bid for Contract 97-01, Serra Court Drainage Improvements This project will install subdrains along and across Serra Court to protect the asphalt pavement from deteriorating. The subdrains will be tied into a storm drain pipe crossing Dublin Green Drive. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.3City Manager's Employment Agreement Vice Mayor Burton and Councilmember Barnes, the Agency's Negotiating Team, have met with the City Manager regarding terms and conditions of employment and are recommending that the Council amend the City Manager's current Employment Agreement with the City. RECOMMENDATION: Approve Amendment to City Manager's Employment Agreement. 4.4Heritage Center Master Plan The City Council will consider a proposal submitted by Alan R. Dreyfuss for the development of a master site plan for future site improvements at the Dublin Heritage Center. STAFF RECOMMENDATION: Authorize the City Manager to execute the agreement at a cost not to exceed $4,000. 4.5Warrant Register ($1,604,067.06) dated February 4, 1997 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS 5.1Presentation from Alameda County Transportation Authority (ACTA) regarding Reauthorization of Measure B Sales Tax This is an informational presentation by a representative of ACTA which will indicate that the current Measure B 1/2 cent sales tax expires in the Year 2002 and that ACTA is in the process of preparing a new Expenditure Plan for future years. City Staff plans to present a list of proposed Measure B projects to the Council at the February 18 City Council meeting. STAFF RECOMMENDATION: Receive presentation and provide an applicant to serve on ACTA's Expenditure Plan Development Committee. 5.2Request from Women's Club of Dublin for Waiver of Use Fees for Regional Meeting Room The City Council will consider a request from the Women's Club of Dublin to waive the facility use fees for use of the Dublin Civic Center for a reception to honor the entrants of an art contest sponsored by the Women's Club. The art contest is an annual event of the California Federation of Women's Clubs designed to motivate talented artists at all grade levels K-12 and supplement the limited art programs in California schools. STAFF RECOMMENDATION: Consider request. 6.PUBLIC HEARING 6.1Proposed Amendment to Chapter 5.24 of the Dublin Municipal Code relating to Fireworks Permits At the City Council meeting of January 21, 1997, Staff was directed to prepare an amendment to the Fireworks Ordinance which would: 1) allow two or more groups to jointly apply for a single sales permit; 2) allow more than one group to operate a single booth as long as each group meets the requirements of Section 5.24.060. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 7.UNFINISHED BUSINESS - None 8.NEW BUSINESS 8.1Community Development Block Grant (CDBG) Program for Fiscal Year 1997-98 - Project Applications The City of Dublin's allocation for next fiscal year's CDBG program funding is $90,809. From this allocation, an advance funding of $16,724 has already been approved for completing handicapped accessibility improvements for Mape Memorial Park. The City Council will consider funding one additional City application (handicap sidewalk ramp improvements) and three non-City applications (Arroyo Vista Child Development Center, Valley Community Health Center-Senior Support Program and the Arroyo Vista Project Improvements). Once the City Council decides what projects will receive funding, the appropriate applications will be forwarded to the Alameda County Housing and Community Development Department for processing. STAFF RECOMMENDATION: Direct Staff to submit applications for $90,809 in CDBG funding for FY 1997-98. 8.2Resolution on Affordability by Design, Affordable Housing Agreement for Kaufman & Broad California Creekside Development and Policy for Issuance of Building Permits This Resolution will establish that inclusionary units are affordable by design, and the Affordable Housing Agreement establishes how affordable housing will be provided or in-lieu fees paid. Direction from the Council will also be provided on collection of in-lieu fees for all units prior to issuance of building permits until such time as the Inclusionary Zoning Ordinance is amended. STAFF RECOMMENDATION: Adopt Resolution finding certain units in the California Creekside project affordable by design at moderate income levels; authorize City Manager to execute Affordable Housing Agreement; direct that until such time as the Ordinance is amended, Staff collect the in-lieu fee for each dwelling unit being built at the time of issuance of the building permit. 8.3City Participation in Dublin Pride Week and acceptance of Gift to the City Dublin Pride Week is an annual event to instill community pride and encourage clean-up efforts. An ad-hoc City Council sub-committee has been working with community representatives, including the school district, local businesses and service organizations, to plan activities for Dublin Pride Week, March 22-29, 1997. City funding of $4,000 has been budgeted for activities. In addition, Livermore Dublin Disposal has generously donated $2,500 to support Dublin Pride Week activities. STAFF RECOMMENDATION: Approve City participation not to exceed $4,000; accept gift and direct Staff to prepare formal acknowledgment to Livermore Dublin Disposal. 8.4Fiscal Year 1996-97 Mid-Year Budget Report A Financial Report has been prepared analyzing revenues and expenditures through December 31, 1996. Staff has also examined areas where budget adjustments are required based upon results during the first half of the fiscal year. The overall budget in the General Fund remains balanced with all expenditures projected to be funded from current year revenues. STAFF RECOMMENDATION: Receive Report and approve Budget Change form. 8.5Analysis of Issues Related to Implementation of Proposition 218 At the November 1996 election, voters approved Proposition 218, which was supported by the Howard Jarvis Taxpayers Association (HJTA). The measure was a Constitutional Amendment which makes significant changes to the imposition and collection of taxes, assessments, and property related fees. The services to be included in the NPDES fee are proposed to be reduced resulting in less cost to the property owner. Staff has reviewed the need to consider a $10 special tax to support emergency medical services. A typical Single Family household would experience an estimated 2.1% ($0.64) decrease in total annual City-wide assessments and fees. STAFF RECOMMENDATION: Consider directing Staff to prepare a ballot measure providing for a Special Tax of $10 per household, to be placed on the June Ballot. The tax will provide for Emergency Medical Services, provided by the contract Fire Service provider in the City of Dublin. Freeze all Landscaping and Lighting assessments at the rates authorized in FY 1996-97. Proceed with mailed public notices regarding both garbage fees and NPDES fees. The NPDES fees are anticipated to be approximately 50% of the fee collected in 1996-97, due to the inclusion of only refuse and administrative costs. 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10ADJOURNMENT . 2 K/cc-mtgs/ Agenda Printed 2/14/00 2:49 AM
