DUBLIN CITY COUNCIL
REGULAR MEETING - Tuesday, February 18, 1997, 7:00 p.m.
DUBLIN CIVIC CENTER, 100 Civic Plaza
A complete packet of information containing Staff Reports and exhibits related
to each item is available for public review several days prior to a Council
meeting in the City Clerk’s Office and also at the Dublin Library.
1.CALL TO ORDER
2.PLEDGE OF ALLEGIANCE TO THE FLAG
3.ORAL COMMUNICATIONS
At this time, the public is permitted to address the City Council on non-agendized items. In
accordance with State Law, however, no action or discussion may take place on any item not
appearing on the posted agenda. The Council may briefly respond to statements made or
questions asked, or may request Staff to report back at a future meeting concerning the matter.
Any member of the public may contact the City Clerk’s Office related to the proper procedure to
place an item on a future City Council agenda. The exceptions under which the City Council
MAY discuss and/or take action on items not appearing on the agenda are contained in
Government Code Section 54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City
Council with one single action. Members of the audience, Staff or the City Council who would like an item
removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of February 4, 1997

4.2Financial Report for the Month of January 1997

4.3Landscape Architectural Services for the Dublin Elementary School Sports Field Project
In order to proceed with the design and construction documents for the Dublin Elementary
School Sports Field project which was authorized by the City Council on January 21, 1997, a
consultant services agreement for landscape architectural services must be executed. The City
Council will review and approve the terms of the agreement as well as authorize a Budget
Change in order to finance the agreement.
STAFF RECOMMENDATION: Approve Agreement and authorize Mayor to execute same;
approve Budget Change Form.
4.4Amendment to City's Deferred Compensation Plan with International City Management
Association - Retirement Corporation (ICMA-RC)
Federal Laws have recently changed regarding the treatment of deferred compensation
benefits. This relates to tax deferred compensation which an employee elects to have paid at a
later date. The concept is similar to a private employer's 401(k) retirement account. The laws
now require the establishment of a Trust to hold these monies for the sole benefit of the
participating employees and their beneficiaries.
STAFF RECOMMENDATION: Adopt Resolution.
4.5Information on Proposition 209 Class Action
This proposition which was passed by voters in November, 1996 states the state shall not
discriminate against, or grant preferential treatment to, any individual or group on the basis of
race, sex, color, ethnicity, or national origin in the operation of public employment, public
education, or public contracting. The City Attorney has prepared a report describing the
impacts of Proposition 209 on the City.
STAFF RECOMMENDATION: Receive Report
4.6Authorization to Solicit Bids, Contract 97-02, Annual Sidewalk Safety Repair (Remove and
Replace)
This project will repair offset curb, gutter, and sidewalks throughout the City, as well as place
new sidewalks in the Civic Center parking lot and in Stagecoach Park.
STAFF RECOMMENDATION: Adopt policy resolution and authorize Staff to advertise for
bids.
4.7Response to Council Direction on Possible Code Violations
Staff has investigated and resolved code violations at the BP Station, 7197 Village Parkway
and along the Dougherty Road right-of-way.

5.WRITTEN COMMUNICATIONS - None
6.PUBLIC HEARING
6.1Amendment to Chapter 5.24 of the Dublin Municipal Code relating to Fireworks Permits
At the City Council meeting of February 4, 1997, an amendment to the Fireworks Ordinance
was introduced which would: 1) allow two or more groups to jointly apply for a single sales
permit; 2) allow more than one group to operate a single booth as long as each group meets
the requirements of Section 5.24.060.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT
Ordinance.
7.UNFINISHED BUSINESS
7.1Consideration of Special Excise Tax for Emergency Medical Services (EMS)
At the February 4, 1997 City Council meeting, Staff presented a report related to
implementation of Proposition 218. Staff was directed to prepare items related to a placement
of a special EMS tax on the June 3, 1997 ballot. This will require that the City Council adopt
the necessary documents at its meeting on March 4, 1997. In order to prepare the documents,
additional direction from the City Council is desired at this time.
STAFF RECOMMENDATION: Provide direction to Staff on various issues such as: Shall
rebuttal arguments be allowed? Shall the Council designate one or more members to write the
ballot argument in favor of the proposed tax? Shall the Council allow other voters who are
authorized to write the ballot argument to join in the Council's ballot argument, at the discretion
of the Council person(s) writing it? Shall the special tax increase annually by an inflator, or shall
the special tax be flat? Shall Staff prepare the Ordinance showing a $10 Benefit Unit amount to
be levied on Single Family units and a $6 amount on Multi-Family units?
8.NEW BUSINESS
8.1Agreement between Alameda County and City of Dublin for use of Fire Station located at
the Santa Rita Jail
The Dougherty Regional Fire Authority currently has an agreement with the County of
Alameda for use of the Santa Rita Jail Fire Station. As a result of the dissolution of DRFA on
July 1, 1997, it is necessary for the City to secure a station facility in the eastern Dublin area to
provide fire services. The use of this facility will enable the City to defer the construction of a
permanent station into the future until the development pattern in eastern Dublin is more
established.
STAFF RECOMMENDATION: Approve agreement and authorize Mayor to execute same.
8.214th Annual St. Patrick's Day Celebration and Parade
The City Council will receive a report summarizing the activities planned for the 14th Annual
St. Patrick's Day Celebration and Parade on Saturday, March 15, 1997.
STAFF RECOMMENDATION: Approve parade route and adopt resolution approving sidewalk
sales and promotional signs.
8.3Campaign Contribution Ordinance and Proposition 208
Proposition 208 was a statewide initiative on the November 1996 ballot which made a number
of changes to the Political Reform Act. Several lawsuits have been filed challenging the
constitutionality of Proposition 208. The City Council will discuss whether to: 1) direct Staff
to prepare an ordinance to repeal the provisions of Chapter 2.28 of the Dublin Municipal Code
which conflict with Proposition 208; or 2) notify all candidates and potential candidates that
the City will not enforce its ordinance pending resolution of the lawsuits challenging
Proposition 208.
STAFF RECOMMENDATION: Receive Staff presentation and provide appropriate direction.
8.4Reauthorization of Measure B Projects
This item requests that the City Council support a list of projects to be included in the
reauthorization of Measure B funding.
STAFF RECOMMENDATION: Authorize letter to be sent to ACTA supporting the Alameda
County congestion Management Agency project list and requesting inclusion of the Dublin
Boulevard Widening Project (Sierra Court to the Southern Pacific Right-of-Way and Dougherty
Road south of Dublin Boulevard to I-580) for the Reauthorization of Measure B Funding
Program.

SpecialMeeting
The City Council will hold a on Tuesday, February 25, 1997, at 6:00 p.m., to review
the status of the City's 1996 Goals & Objectives and to establish, review and prioritize the City's Goals
& Objectives for 1997. The Council will also provide direction to Staff with regard to preparation of
the 1997-98 Budget and Capital Improvement Program. In the event the Council does not finish the
business at hand, the meeting will be continued to Thursday, February 27, 1997, at 6:00 p.m.
Workshop
The City Council will participate in an Emergency Preparedness Training on March 4,
1997 from 6:00 p.m. - 7:00 p.m.
RegularMeeting
The next of the Dublin City Council will be on Tuesday, March 4, 1997, at 7:00 p.m.
