A complete packet of information containing Staff Reports and exhibits related to each item is available for public review several days prior to a Council meeting in the City Clerk’s Office and also at the Dublin Library. 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 10.CLOSED SESSION - To be held out of order at beginning of meeting 10.1Conference with Legal Counsel - Existing Litigation pursuant to Government Code Section 54956.9 subdivision (a): City of Dublin vs. Woolverton, et al., Alameda County Superior Court Case No. V-009571-4. REPORT OF CLOSED SESSION ACTION 3.ORAL COMMUNICATIONS 3.1Introduction of new Dublin Police Services Secretary Deena Hambleton 3.2Announcement of 1996 Citizen of the Year and presentation of Proclamation Nominees: Jerry Bush, Michael Johnson, Bonnie McCamon, Paul Moffatt, Adib Nassar, and Karol Ruppenthal 3.3Announcement of 1996 Organization of the Year and presentation of Proclamation Nominees: Dublin Lions Club & Friends of the Dublin Library At this time, the public is permitted to address the City Council on non-agendized items. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes: Adjourned Regular Meeting of February 25; Workshop Meeting of March 4, and Regular Meeting of March 4, 1997 STAFF RECOMMENDATION: Approve 4.2Release of Declaration of Restrictions - John Moore Property on Dougherty Road The conditions set forth in the Declaration of Restrictions have been satisfied, and the property owner is requesting that the Declaration be released. STAFF RECOMMENDATION: Adopt Resolution and authorize City Manager to execute documents. 4.3Street names for BART Parking Lot Access Roads Alameda County has requested the names "Iron Horse Parkway" and "DeMarcus Boulevard" for the 2 BART access roads. STAFF RECOMMENDATION: Adopt Resolution 4.4Financial Report for the Month of February, 1997 STAFF RECOMMENDATION: Receive Report. 4.5Award of Bid, Contract 97-02, Annual Sidewalk Safety Repair (Remove & Replace) The annual sidewalk safety repair program removes and replaces portions of sidewalks that have become offset and may pose tripping hazards. Bids have now been received for this repair work. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Sposeto Engineering, Inc. 4.6Award of Bid for Serra Court Drainage Improvements, Contract 97-01 This project will install a subdrain below Serra Court, across Peppertree Road to a storm drain in Dublin Green Drive. The subdrain will pick up spring water beneath these streets which is causing the street pavement to break up. This maintenance work will prolong the life of the pavement. STAFF RECOMMENDATION: Adopt Resolution awarding bid to VanGuard Construction. 4.7Authorization to Solicit Bids for Civic Center Waterproofing, Contract 97-06 This project would apply an elastomeric waterproofing material to the stone and block facing of the Civic Center. The intent of the work is to preclude deterioration of the stone as well as to resolve some of the rain water leaks in the building. STAFF RECOMMENDATION: Authorize Staff to solicit bids to spray the Civic Center with a waterproof coating. 4.8Master Surety Bond The City of Dublin participates in an excess liability insurance pool with 31 other public agencies (ABAG Plan). Included in the Plan coverage is public official bond insurance which covers the City Clerk, City Treasurer and all employees. ABAG has requested its members to approve the use of a master bond to fulfill the requirements of the new legislation. STAFF RECOMMENDATION: Adopt Resolution. 4.9Approval of Subdivision for Parcel Map 7042, Santa Rita Property This Parcel Map will subdivide out the parcel known as the Opus Industrial site from the remainder of the County's Surplus Property Authority lands in Eastern Dublin. It includes street dedications on Gleason Boulevard, Hacienda Drive and Arnold Road. STAFF RECOMMENDATION: Adopt Resolution approving Parcel Map and authorize Mayor to execute Subdivision Developer Agreement. 4.10Disposal of Surplus Property The City has 4 Police Patrol Vehicles which have been fully depreciated and replacement units are now in operation. In addition, Police Services has various items of unclaimed property which have been held for the required time limit. The most efficient method to dispose of these items is at a public auction. STAFF RECOMMENDATION: Adopt Resolution and authorize Staff to proceed with transfer of property to Nationwide Companies pursuant to their current agreement with the City. 4.11Warrant Register ($454,790.30) dated March 18, 1997 STAFF RECOMMENDATION: Approve. 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1BJ Dublin Commercial Planned Development (PD) District Rezone PA 96-050 The City Council will consider the second reading and adoption of a new PD District Rezone ± Ordinance for the BJ Dublin Commercial site (7.5 acres), including two City of Dublin remnant parcels. The project is located near the northeast corner of Dublin Boulevard and Dougherty Road. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.2Opus Development Agreement PA 96-020 The City Council will hold a public hearing on a proposed Ordinance approving a Development Agreement between the City of Dublin and Alameda County Surplus Property Authority. The DA is required by the Eastern Dublin Specific Plan. Items included in the DA include, but are not limited to, the financing and timing of infrastructure; payment of traffic and public facilities impact fees; oversizing of roads and general provisions. The Ordinance was introduced at the March 4, 1997 City Council meeting. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.3Ordinance Establishing Penalties for Cable TV Violations In accordance with provisions in the Government Code, Staff was directed to prepare an ordinance which would allow the City to impose penalties for failure to provide CATV services in addition to the $100 per day fine set forth in the City's Franchise Agreement with TCI. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 6.41996 Annual Review of Performance by TCI (Cable Television Provider) As directed by the City Council in January, Staff has prepared a review of services provided by TCI. Information related to various aspects of cable television services were analyzed including: Statistical Analysis of Subscribership Trends; Information regarding Current & Proposed Rates with Comparisons; Customer Service Information; Areas of Inadequacy related to items not in Compliance; Information on the Status of TCI Plans for a System Upgrade. The public is also to be provided with an opportunity to provide testimony. The report has found that there are areas of inadequacies. STAFF RECOMMENDATION: Conduct public hearing; deliberate; review draft Resolution and provide direction on any additional items to be included or changes to be made; direct Staff to proceed with a rate review of the Equipment Rates (FCC Form 1205) proposed to be implemented in June of 1997. 6.5Consideration of Franchise Violation by TCI (Cable Television Provider) - (Non- Compliance with Requirement to Notify Subscribers and City of Changes in Services) In preparing the review of the performance of TCI, it was noted that FCC regulations were violated by TCI. The company made changes to programming without granting proper notice to the City and Subscribers. In order to address violations such as this, a public hearing must be conducted to consider all of the evidence. STAFF RECOMMENDATION: Conduct public hearing; deliberate; determine whether the violation was excusable or inexcusable. If determined to be inexcusable, the Council must: a) determine the amount of any penalty to be assessed; and b) review draft Resolution and make any desired changes to reflect information gathered at the Public Hearing. 7.UNFINISHED BUSINESS - None 8.NEW BUSINESS ±± 8.1Initiation of a General Plan Amendment Study for a Vacant 2.4 acre site located on Starward Drive (APN 941-173-5-2) A request has been received by the DeSilva Group for initiation of a General Plan Amendment Study for a vacant parcel located on Starward Drive behind the Shamrock Village Shopping Center to change the General Plan designation from Retail Office to Medium High Density Residential (14.1 - 25.0 units per acre). STAFF RECOMMENDATION: Adopt appropriate Resolution either initiating or denying the request. 8.2Civic Center Modification Design Services This project provides for the services of an architect to prepare preliminary designs for the modification of existing and vacant space at the Civic Center. STAFF RECOMMENDATION: Authorize Staff to issue Request for Qualification for design services. 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY reports from Councilmembers and/or Staff 10CLOSED SESSION . - Held at beginning of meeting 11ADJOURNMENT .Note: The City Council and Planning Commission will hold a joint study session to review and discuss changes to update the City's Zoning Code Ordinance.
