REPORT OF CLOSED SESSION ACTION 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Acceptance of Gifts to City from 2000 St. Patrick's Day Sponsors (File 150-70) The City received $27,600 in monetary sponsorships for the St. Patrick's Day Festival and Fun Run. Additionally, numerous in-kind donations were received for both events. In recognition of their contributions, these sponsors will be presented with certificates of appreciation and event shirts for their support. STAFF RECOMMENDATION: Accept gifts and formally recognize donors for their contributions. 3.2 Reauthorization of Measure B (ltalf-Cent Sales Tax Program) (File 1060-90) This is one of the steps in placing the reauthorization of the half-cent sales tax to extend the program from 2002 to 2022. The monies are to fund major regional transportation programs. STAFF RECOMMENDATION: Receive presentation by representative of the Alameda County Transportation Authority (ACTA); adopt Resolution approving the Alameda County 20-Year Transportation Expenditure Plan and recommending that the extension of the half-cent sales tax be placed on the November, 2000 ballot; and authorize Mayor to sign letter to Alameda County Board of Supervisors 3.3 Appointment of Council Subcommittee to Sister City Committee (File 110-30) During the City Council's annual Goals & Objectives meeting in February of 2000, the Council collectively gave a high ranking to the goal, "appoint a Council subcommittee to investigate expanding the Sister City Program and to investigate opportunities for trade with an additional sister city". STAFF RECOMMENDATION: Appoint 2 Councilmembers to Sister City Committee. 3.4 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). '4. ~ONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of April 4, 2000 STAFF RECOMMENDATION: Approve 4.2 Agreement between the County of Alameda and the City of Dublin regarding the Community Development Block Grant Program for Fiscal Year 2000-2001 (File 600-40) In accordance with the Alameda County CDBG administrative procedures and the U. S. Department of Housing and Community Development regulations, the City of Dublin, as an Urban County City, must enter into an agreement with Alameda County for complying with the CDBG program for FY 2000-2001. STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute agreement. 4.3 Authorization to Solicit Bids for Contract 00-06, Annual Slurry Seal Program (File 600-35) This project will slurry seal various streets as a preventive maintenance technique used to prolong the life of the pavement. STAFF RECOMMENDATION: Authorize Staffto advertise for bids. 4.4 Acceptance of Gift to City (File 150-70) The Dublin Senior Center has received a check in the amount of $100 from the Women's Club of Dublin. The donation will be used to offset cost of the annual Mother's Day Luncheon. STAFF RECOMMENDATION: Accept gift; direct Staffto prepare formal acknowledgment to the donor; and approve Budget Change. 4.5 Preliminary Financial Report for the Month of March 2000 (File 330-$0) STAFF RECOMMENDATION: Receive Report. 4.6 Beverage Container Recycling Grant (File 810-60) The State Legislature recently passed a bill that appropriates $10.5 million to local jurisdictions to implement beverage container recycling and litter cleanup activities. The City is eligible to receive $8,389. It is unanticipated that the funds will be used to support the City's existing residential curbside recycling program. STAFF RECOMMENDATION: Adopt Resolution. 4.7 SB 2017 (Perata) Jobs Housing Balance in the Bay Area (File 660-40) At the Mayor's request, Staff has prepared a letter to the City's State Legislators opposing SB 2017 (Perata). This bill would require the Metropolitan Transportation Commission (MTC) and the Association of Bay Area Governments (ABAG) to develop policy criteria to evaluate whether cities and counties are accepting their fair share of housing starts and participating in regional congestion reduction plans. STAFF RECOMMENDATION: Direct that letter opposing SB 2017 be sent to State Legislators. 4.8 City Treasurer's Investment Report for 3ra Quarter of FY 1999-2000 (File 320-30) The City's investment portfolio totals $44,216,725 (cost basis), and funds during the 3~d quarter were invested at an average yield of 5.839%. STAFF RECOMMENDATION: Receive Report. 4.9 Request for ERAF Return (File 390-10) At the Mayor's request, StaiThas prepared a letter to the City's State Legislators requesting a return of ERAF (Educational Revenue Augmentation Fund) and a separate letter to other Tri-Valley Cities requesting their support in this effort. The large State Budget surplus presents cities with an excellent opportunity to demand a return of property tax revenues that were shifted from local govemments to the State General Fund during the recession in the early 1990's. STAFF RECOMMENDATION: Direct Staffto send letter over Mayor's signature to the Cities of Pleasanton, Livermore, San Ramon and the Town of Danville requesting support in pursuing a return of ERAF, and authorize the Mayor to deliver a separate letter to the City's State Legislators during the League of California Cities' City Action Day in Sacramento, May 22nd & 23ra. ~.10 4.11 4.12 4.13 4.14 Warrant Register ($1,491,858.93) dated April 18, 2000 (File 300-40) STAFF RECOMMENDATION: Approve Office of Traffic Safety Grant "Traffic Safety Radar Enforcement and Bicycle Safety Program" (File $90-90) Dublin Police Services is requesting authorization to apply for an Office of Traffic Safety grant in the amount of $35,000. This grant will allow DPS to enhance the current traffic safety program. The program would focus on the reduction of speed related collisions through enforcement and community education and implement an enhanced bicycle safety program. The funding would be used to purchase a new speed radar trailer, new radar units, and bicycle helmets for children. STAFF RECOMMENDATION: Authorize DPS to apply for the grant. Disposal of Surplus Property - Unclaimed Property & Surplus Equipment (File 350-40) Staff is requesting the City Council declare unclaimed property and equipment as surplus and authorize Staffto send the items to Nationwide Auction Companies for auction. STAFF RECOMMENDATION: Adopt Resolution and authorize Staffto proceed with transfer of property to Nationwide Companies pursuant to their current agreement with the City. Authorizing the Reprogramming of Federal Surface Transportation Program Funds for the Alamo Canal Bicycle Path Project (File 930-30) The City of Dublin is requesting the Metropolitan Transportation Commission to reprogram $175,000 of Federal Funds for the Alamo Canal Bicycle Path Project from Amador Valley Boulevard to the Iron Horse Trail Connection. STAFF RECOMMENDATION: Adopt Resolution. Declaration of Weeds and Combustible Refuse as a Public Nuisance (File $30-20) In accordance with the Dublin Municipal Code, the City Council may declare that there is a public nuisance created by weeds and combustible debris growing, accumulating upon the streets, sidewalks and property within the City of Dublin. The Fire Chief or his designee shall notify property owners of violations and order abatement without delay. STAFF RECOMMENDATION: Adopt Resolution; direct Staffto notify the public; and schedule a public hearing for May 16, 2000 to hear and consider objections to abatement order. 5. WRITTEN COMMUNICATIONS - None PUBLIC HEARING 6.1 Speed Limit Changes and Additions for Amador Valley Boulevard (Amador Plaza to Village Parkway), Arnold Road, Dougherty Road (Park Sierra to Monterey), Gleason Drive (Arnold Road to Hacienda Drive), Hacienda Drive, and St. Patrick Way (File 590-20) This is the second reading of a proposed ordinance which will revise existing speed limits and adopt limits for new streets. The proposed speed limits are: Amador Valley Boulevard (Amador Plaza to Village Parkway) - 30 mph; Arnold Road - 40 mph; Dougherty Road (Park Sierra entrance to Monterey) - 40 mph; Gleason Drive (Arnold to Hacienda) - 40 mph; Hacienda Drive - 35 mph; and St. Patrick Way - 25 mph. STAFF RECOMMENDATION: Conduct public heating; deliberate; waive reading and ADOPT Ordinance. 6.2 Enforcement of Vehicle Code within Hacienda Crossings Shopping Center (File $90-30) This is the second reading of a proposed Ordinance which would allow enforcement of the California Vehicle Code within the Hacienda Crossings Shopping Center. State Law allows enforcement of all provisions of the CVC on mare roadways within the shopping center and enforcement of regulations pertaining to speeding, reckless driving, and off-road vehicles within the parking areas. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.3 Dublin Ranch Town Center Supplemental Development Agreement, Area F - PA 98-068; Area G - PA 98-069; and Area H - PA 98-070 (File 600-60) This is the second reading of an Ordinance approving a Supplemental Development Agreement between the City of Dublin and the Lin Family for the Dublin Ranch Town Center project. The Supplemental DA is required by the Eastern Dublin Specific Plan. This Agreement will vest the project approvals recently granted by the City Council and provide for additional DA's at the time of the development of the individual parcels within the project area. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.4 Amendment to the City's Retirement Contract with the Board of Administration of the California Public Employees' Retirement System (PERS) (File 720-60) On an annual basis, the City conducts a benefit survey of approximately 30 Bay Area local government agencies. This analysis is performed in an effort to keep the City's benefit structure competitive with the market in which the City competes for labor. The City Council will review an amendment tO the City's retirement contract with the Board of Administration of the California Pubhc Employees' Retirement System to provide for a 2% ~ 55, single highest year, benefit plan. STAFF RECOMMENDATION: Conduct public heating; deliberate; adopt Resolution of Intention; and waive reading and INTRODUCE Ordinance. 6.5 Urgency Ordinance Authorizing Skateboard Use at the Emerald Glen Park Skate Park (File 920-20) In order to provide for use of the Skate Park at Emerald glen Park, the City Council needs to adopt an Ordinance authorizing the use and related safety rules, as well as adopt a Resolution designating the skateboard use area at the park. STAFF RECOMMENDATION: Conduct public heating; deliberate; waive reading and adopt Urgency Ordinance; and adopt Resolution. UNFINISHED BUSINESS 7.1 Evaluation of 2000 St. Patrick's Day Celebration (File 950-40) The City's annual St. Patrick's Day Celebration was held the weekend of March 18-19,2000. The weekend's events included a Green & White Gala~ Pancake Breakfast, Parade, Festival and Fun Run. Staff will present a summaxy of the events that were conducted. STAFF RECOMMENDATION: Review various components of the celebration and provide recommendations for implementation in next year's celebration, including: 1) determine the dates of the 2001 celebration; 2) appoint a representative(s) to serve on the St. Patrick's Day Liaison Committee; and 3) direct Staff to renew agreement with Teny Pimsleur & Company for the 2001 St. Patrick's Day Festival. NEW BUSINESS Analysis of Save Agricultural and Open Space Lands Initiative (File 660-30) In February of 2000, a Notice of Intention to Circulate Petition was filed with the Alameda County Registrar of Voters. Signatures are now being collected to place the "Save Agriculture and Open Space Lands Initiative" on the ballot. The goal of the initiative would be to preserve open space in the unincorporated area of West Dublin and to establish an Alameda County Urban Growth Boundary. STAFF RECOMMENDATION: Provide appropriate direction to Staff. 8.2 Emergency Fire/Medical Response Plan for Service (File 520-10) As the City of Dublin develops, the need for fire protection coverage and response planning becomes critical. Significant residential and commercial development is occurring in the Eastern Extended Planning Area of the City. A report has been prepared which takes into consideration fire response times and emergency medical service standards in relation to projected growth in order to develop criteria for new facilities, including site requirements and equipment needs. STAFF RECOMMENDATION: Approve Final Draft of the Response Plan for Service. 8.1 10. 8.4 8.5 Trumark Companies Study Session PA 99-030 (File 420-20) Staff is requesting direction regarding the Trumark Duet project, a 7.14 acre project located along the eastern side of Dougherty Road immediately southeast of the Park Sierra apartment complex, with respect to the following: 1) is the proposed product type and resulting development plan appropriate, given the proximity of Scarlett Drive; and 2) is the lower density range of 15 units per acre appropriate for the area. STAFF RECOMMENDATION: Provide appropriate direction to Staff. Western Dublin General Plan Amendment Study - Project Status PA 99-003 (File 420-30) Staffwill be presenting the status of the Western Dublin General Plan Amendment Study; and the City Council will be considering whether to complete the study before or after the November election. STAFF RECOMMENDATION: Direct staff to either conduct a public workshop and complete the Western Dublin GPA Study before the November 2000 election, or after the election. Comment letter on the proposed Designation of Critical Habitat for the Threatened Alameda Whipsnake (File 530-90) A letter has been prepared commenting on the proposal by the U. S. Fish & Wildlife Service to designate areas west of the urbanized area of the City of Dublin as Critical Habitat for the Alameda Whipsnake. This designation would include Schaefer Ranch and open space areas within the Hansen Hills subdivision and open space areas south of Bloomington Way and north of Creekside Drive. The designation could negatively impact the economy of the City if it precluded the development of Schaefer Ranch. STAFF RECOMMENDATION: Adopt Resolution.
