REPORT OF CLOSED SESSION ACTION
3.ORAL COMMUNICATIONS
At this time, the public is permitted to address the City Council on non-agendized items. In accordance with
State Law, however, no action or discussion may take place on any item not appearing on the posted agenda.
The Council may respond to statements made or questions asked, or may request Staff to report back at a future
meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the
proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council
MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code
Section 54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for
approval by the City Council with one single action. Members of the audience, Staff or
the City Council who would like an item removed from the Consent Calendar for purposes
of public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of April 21, 1998
STAFF RECOMMENDATION: Approve
4.2Eastern Dublin School Mitigation Agreement between the Dublin Unified School District and Clyde
Casterson
The City Council will consider this agreement between Dublin Unified School District and Eastern
Dublin property owner, Clyde Casterson which complies with the Planned Development Prezone
Resolution for the Eastern Dublin Annexation Project (1,538 acres) and Action Program 8B of the
Eastern Dublin Specific Plan. The agreement establishes the method and manner of financing and/or
constructing school facilities necessary to service the student population generated by Eastern Dublin
development.
STAFF RECOMMENDATION: Approve agreement or provide Staff with other appropriate direction and
continue the matter.
4.3Appropriation of Donations Previously Accepted
The City Council will consider a request from the Dublin Senior Center Staff and Advisory Committee
to utilize donations which are retained in a liability account to install partitions at the Dublin Senior
Center to create additional small meeting and storage areas.
STAFF RECOMMENDATION: Approve Budget Change Form.
4.4Award of Purchase Order for Fire Station Roof Repair
The City Council will consider awarding a purchase order to B. U. R. Services for repair of the
Donohue Drive Fire Station roof. Only one bid was received, in the amount of $6,475. This
bid is within funds budgeted for this project.
STAFF RECOMMENDATION: Adopt Resolution.
4.5Amendment to Agreement with Earth Systems Consultants for General Geotechnical
Services
This item proposes to extend the term of the agreement for an additional year (ending June 30,
1999) and allows for a 2% rate increase. Earth Systems provides geotechnical services to the
City on an as-needed basis.
STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute amendment.
4.6Approval of Parcel Map 7259 (Opus Industrial Site, Phase I)
Approval of this Parcel Map will subdivide the existing Opus Industrial site, located between
Gleason Drive, Arnold Road and Hacienda Drive, into 3 parcels, each containing one building
with related parking. Easements are being provided for sidewalk, utilities and emergency
access.
STAFF RECOMMENDATION: Adopt Resolution.
4.7State-Local Transportation Partnership Program - State Local Entity Agreement
Supplement 008 (Cycle 8)
The State-Local Transportation Partnership Program provides matching monies for
transportation projects that are not funded by State Gas Tax or Federal ISTEA monies.
Dublin is eligible to receive $98,160 from this program toward its 1997-98 $400,000 Street
Overlay Project.
STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute agreement.
4.8Authorization to Solicit Bids - Contract 97-11 Dougherty Hills Slope Repair, Phase II
This project will repair potentially unstable slopes in the City’s Dougherty Hills Open Space
Park above Crossridge Road. The improvements include the installation of subdrains in the
slopes as well as the installation of concrete storm drain interceptor ditches along the face of
the slope.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids.
4.9Voice Mail software/Hardware Purchase to Replace Voice Mail
As authorized by the City Council in March of 1998, Staff issued a Request for Proposal for
Voice Mail Hardware/software to four companies. Two companies responded to the RFP.
STAFF RECOMMENDATION: Adopt Resolution awarding purchase to NEC BCS (West) Inc.
4.10Establishing date of Public Hearing for Property Related Fees related to Garbage
Company Rates and Annual Fee for Minimum Residential Garbage Service
In accordance with State Law, a 45 day written notice must be provided regarding adjustments
to property related fees and charges. Garbage and Recycling rates are established by the City
Council in accordance with a franchise agreement with Livermore Dublin Disposal. Staff has
developed proposed rate adjustments which would be effective July 1, 1998. A public hearing
will be conducted on June 29, 1998.
STAFF RECOMMENDATION: Authorize Staff to mail the notices and establish the public
hearing for June 29, 1998.

6.PUBLIC HEARING
6.1Urban Opportunity Area - General Plan Amendment PA 98-029
The City is proposing a General Plan Amendment to designate Urban Opportunity Area
boundaries within the Eastern and Western Extended Planning Areas.
STAFF RECOMMENDATION: Continue item to City Council meeting of May 19, 1998 in
order to provide affected property owners and the public an adequate public comment period.
6.2A Creative Playschool Modification to Conditional Use Permit PA 98-028
A modification is being requested to allow an increase from 15 to 30 children allowed in the
back yard at any one time of the A Creative Playschool at 6837 Amador Valley Boulevard.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution EITHER
approving or denying request; or provide other appropriate direction to Staff.
6.3Continued Public Hearing - Request by American Building Components (ABC) to Appeal
the Application and Interpretation of the Building Code for Violations Located at 6253
Dougherty Road APN 941-550-5-1
ABC has various building/structures that are illegal and dangerous according to the Building
Code. Following a public hearing at the April 21, 1998 City Council meeting, Staff was
directed to draft a Resolution upholding the Building Official’s determination and making
appropriate findings for formal adoption.
STAFF RECOMMENDATION: Reopen public hearing; receive Staff Report; close public
hearing; adopt Resolution upholding the Building Official’s findings.
6.4SummerGlen Development Agreement PA 97-036
This is the second reading of an Ordinance approving a Development Agreement (DA)
between the City of Dublin and Alameda County for the SummerGlen 347 single family
dwelling unit subdivision. The DA provides security to developers that the City will not
change its zoning and other laws applicable to the project for the 5 year term of the agreement
and allows the City to obtain commitments from the developer relating to issues such as
improvements and fees.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT
Ordinance approving Development Agreement.
6.5Casterson Property Development Plan, Planned Development Rezone, and General Plan/
Specific Plan Amendment PA 97-040
The City Council will hold a public hearing to consider approval of a Planned Development
and minor land use amendment for a residential subdivision of 109 homes on the west side of
Tassajara Road, north of Gleason Drive. The project includes a segment of the Tassajara
Creek regional trail and open space stream corridor.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolutions; waive
reading and INTRODUCE Ordinance; and schedule second reading of Ordinance for the May 19,
1998 City Council meeting.
7.UNFINISHED BUSINESS
7.1All Aboard Mini Storage GPA Request for RR Right-of-Way Property
All Aboard Mini Storage and the Union Pacific Railroad company are proposing to construct
an 85,669 square foot self storage facility on a 4.21 acre site (part of a larger approximately 9
acre right-of-way) located in the Union Pacific Railroad company right-of-way south of
Dougherty Road. This matter was continued from the April 21, 1998 City Council meeting.
STAFF RECOMMENDATION: Adopt Resolution EITHER authorizing or denying initiation of
GPA - OR - give Staff further direction.
7.2Dublin Swim Center Master Plan Study
The City Council will review the findings and recommendations contained in the Dublin Swim
Center Master Plan Study which was prepared by Water Technology, Inc.
STAFF RECOMMENDATION: 1) Accept study and direct Staff to evaluate the availability of
funding for the proposed improvements in the 1998-2003 CIP; and 2) authorize Staff to secure
architectural services for the preparation of construction documents for the deck replacement
only.
7.3Selection of Farmers’ Market Operator and Location of Event
The City Council will consider entering into a contract with Urban Village Farmers’ Market for
the creation of a certified farmers’ market at either the Shamrock Village Shopping Center or
on Donlon Way.
STAFF RECOMMENDATION: Authorize City Manager to enter into an agreement with
UVFM for the operation of a farmers’ market on Fridays from 3:00 p.m. to 7:00 p.m. during the
summer season; approve Budget Change Form; and approve the Donlon Way location
8.NEW BUSINESS
8.1Tri-Valley Transportation Development Fee Joint Powers Agreement
The Tri-Valley Transportation Council is made up of seven local jurisdictions: Dublin,
Pleasanton, Livermore, San Ramon, Danville, Alameda County and Contra Costa County.
This TVTC has been working for several years to develop a regional transportation fee to be
levied on new development to construct major transportation improvements necessitated by
new development. This JPA will provide a common basis for the levy and use of a
Transportation Fee for regional improvements.
STAFF RECOMMENDATION: Adopt Resolution.
