DUBLIN CITY COUNCIL

3.ORAL COMMUNICATIONS
3.1Acceptance of Gifts to City from 1997 St. Patrick's Day Celebration
The City received $1,900 in sponsorships this year for the St. Patrick's Day Celebration. The
1997 sponsors included the J. Patrick Land company and the Dublin Ranch Project. In
recognition of their contributions, the sponsors will be presented with certificates of
appreciation as well as 1997 St. Patrick's Day Celebration T-shirts.
STAFF RECOMMENDATION: Accept gifts; formally recognize donors for their contributions;
approve Budget Change Form.
At this time, the public is permitted to address the City Council on non-agendized items. In accordance with State Law,
however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond
to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any
member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City
Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the
agenda are contained in Government Code Section 54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City
Council with one single action. Members of the audience, Staff or the City Council who would like an item
removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of April 15, 1997
STAFF RECOMMENDATION: Approve
4.2Administering Agency-State Master Agreement No. 04-5432
From time to time, the City of Dublin receives Federal Grants for City transportation projects.
To be able to use these funds, the City must enter into an agreement with the State to ensure
that the City follows proper Federal procedures and properly maintains the finished work. This
agreement is an update to an earlier one approved in 1983.
STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute agreement.
4.3Designation of Assistant City Manager/Administrative Services Director as Agent for
purpose of applying for State and/or Federal Assistance for costs incurred in Storm
Damage Prevention or Mitigation
The Federal Emergency Management Agency requires that the City Council designate an agent
to execute applications for assistance.
STAFF RECOMMENDATION: Adopt Resolution.
4.4Allocation of Oil Recycling Grant to Regional Project
The State of California distributes grant funds to be used for programs and activities related to
the recycling of oil. Alameda County agencies have joined together and propose to jointly
prepare a public information and education program with grant funds. The City of Oakland
will act as the lead agency for this effort. The joint effort offers the City the ability to achieve
greater exposure from the limited funds available.
STAFF RECOMMENDATION: Adopt Resolution and direct Staff to work with project
coordinators to implement informational activities.
4.5Agreement for Local Match, I-580/I-680 Direct Connector Project
The I-580/I-680 direct connector project (south bound to east bound) is being funded primarily
by Measure B one-half cent sales tax revenue. There is a requirement for local matching
money in the amount of $10 million. Five cities and two county agencies have agreed to
contribute to this local match. This agreement will formalize Dublin's share of the project.
STAFF RECOMMENDATION: Adopt Resolution approving agreement and authorize Mayor to
execute on behalf of the City.
4.6Amendment to Agreements for the temporary displays of sculpture at the Dublin Civic
Center
The City of Dublin currently has two large scale sculptures on loan from KLMLP, LP
(formerly Kemper Real Estate Management Company). The agreement terms for both
sculptures have expired but there are provisions for extension.
STAFF RECOMMENDATION: Authorize Mayor to execute amendments extending agreements
for one additional year.
4.7Approval of Subdivision for Parcel Map 7109
This is a resubdivision of two existing lots into four lots located near the north east corner of
Dublin Boulevard and Dougherty Road. The purpose of the subdivision is to conform to
development proposals on the property.
STAFF RECOMMENDATION: Adopt Resolution approving Parcel Map.
4.8Purchase of Abutter's Rights on San Ramon Road by See's Candy Shops, Incorporated
The State of California previously purchased the access rights to the highway which later
became San Ramon Road. These rights passed on to Alameda County when the highway
right-of-way was relinquished and then on to Dublin at incorporation. See's Candy Shops is in
the process of selling its property at the corner of Dublin Boulevard and San Ramon Road for
development. Access to this development will need to be purchased from the City.
STAFF RECOMMENDATION: Adopt Resolution approving purchase of access rights and
authorize Mayor to execute quitclaim deed.
4.9Schaefer Ranch Project Annexation Initiation PA 96-037
The Schaefer Ranch development project received City approval for annexation in July of
1996. The annexation must now be approved by the Alameda County Local Agency
Formation Commission (LAFCo). The LAFCo process was put on hold until additional
assurance of water/wastewater service could be obtained. The application is now ready to be
re-initiated to LAFCo.
STAFF RECOMMENDATION: Adopt Resolution authorizing initiation of an application for
reorganization.
4.10No Parking Zones - Dublin Boulevard from Dougherty Road to Arnold (Sebille) Road,
DeMarcus Boulevard, and Iron Horse Parkway
Opening of the East Dublin/Pleasanton BART station on May 10th creates the potential for
some BART patrons to park on surrounding streets. There is insufficient lane width to safely
allow on-street parking in these areas.
STAFF RECOMMENDATION: Adopt Resolution and approve Budget Change Form.
4.11Award of Bid for one marked Police Patrol Vehicle
In response to the City's request for bids, Shamrock Ford in Dublin submitted a bid for a
marked Police car (Ford Crown Victoria Police Interceptor) based on specifications developed
by the CHP. The total purchase cost of the car, including extended warranty service is
$25,178.52 and delivery will be made in August, 1997.
STAFF RECOMMENDATION: Award bid to Shamrock Ford and authorize Staff to issue
necessary Purchase Order and include funding in the Fiscal Year 1997-98 Budget.

6.PUBLIC HEARING
6.1Amendment to Dublin Municipal Code Chapter 2.28 related to Campaign Contribution
Limitations and Expenditures
At the November, 1996 election, voters passed Proposition 208 which amended the state law
regarding campaign contributions. Following a review of the City's Ordinance in February,
1997, the Council directed Staff to revise the City's Ordinance to bring it into compliance with
current state law. An Ordinance was introduced at the April 15, 1997 City Council meeting
which would establish a voluntary spending limit of $1 per resident based on population figures
as of January 1 of each election year. The Ordinance has also been amended to delete the
requirement that $25 contributions be itemized.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT
Ordinance.
6.2Adoption of 1994 Edition of the Uniform Fire Code and Uniform Fire Code Standards by
Reference
The above referenced codes establish standards and regulations that provide for fire and life
safety in the City of Dublin. As a part of the dissolution process of the Dougherty Regional
Fire Authority, the City of Dublin will be responsible for providing fire suppression and
prevention services to its residents and businesses. It is therefore necessary for the City
Council to adopt the Uniform Fire Code and Fire Code Standards so that these standards and
regulations will continue to be applicable in the City of Dublin.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; read title and INTRODUCE
Ordinance; approve form of public notice for May 20, 1997 public hearing.
6.3Weed and Refuse Abatement Ordinance
As a part of the dissolution process of the Dougherty Regional Fire Authority, it is necessary
for the City to adopt an ordinance establishing authority for weed and refuse abatement.
DRFA's fire prevention function has included a successful weed abatement program which
reduces fire hazards and unsightly debris in the City. The Alameda County Fire Department,
under contract with the City, will continue to provide essentially the same program as has been
provided by DRFA.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and
INTRODUCE Ordinance.

8.NEW BUSINESS
8.1Eastern Dublin School Mitigation Agreement between the Dublin Unified School District
and Jennifer Lin
As a requirement of the Eastern Dublin prezone condition for the 1,538 acre annexation area,
developers of property within the annexation area must enter into a written mitigation
agreement with the affected school district and the City. The Council will consider the school
mitigation agreement between DUSD and the property owner, Jennifer Lin.
STAFF RECOMMENDATION: Approve Mitigation Agreement between DUSD and Jennifer
Lin - OR - give Staff direction and continue the matter.
8.2Heritage Center Master Site Plan
The City Council will review the master site plan for the Dublin Heritage Center which, if
approved, will serve as a model for future site improvements and include a strategy for their
implementation.
STAFF RECOMMENDATION: Receive presentation from Staff and Consultant; receive public
comments; approve proposed master site plan; direct Staff to prepare a phasing plan based upon
available funding; direct Staff to prepare plans and specifications for the parking lot.
8.3Valley High School Community Gymnasium
The City Council will consider a proposal related to the construction of the Valley High School
Community Gymnasium. The proposal changes the terms of the agreement whereby the City
will now fund the incremental cost difference between the multi-purpose room and the
gymnasium and will only fund its pro-rated share of the operating costs for the gym.
STAFF RECOMMENDATION: Consider Staff proposal and if Council concurs, authorize
Mayor to execute letter to DUSD.
8.4Establishing the date of the Public Hearing for Property Related Fees related to: Storm
Water Program-Refuse Services; Garbage Company Rates; and Annual Fee for Minimum
Residential Garbage Service
Proposition 218, which was approved by the voters in November of 1996, establishes
procedures for the imposition of property related fees. The City Council will need to conduct
a public hearing after providing 45 days written notice to all parcel owners. Staff has prepared
the draft notices and a recommended date for the public hearing.
STAFF RECOMMENDATION: Authorize Staff to mail notices and schedule June 25, 1997 for
public hearing.
