DUBLIN CITY COUNCIL REGULAR MEETING Tuesday, July 20, 1999, 7:00 p.m. DUBLIN CIVIC CENTER, 100 Civic Plaza A G E N D A · Agendas are posted on the City’s Internet Website (www.dublinca.org) · A complete packet of information containing Staff Reports and exhibits related to each item is available for public review prior to a Council meeting in the City Clerk’s Office and also at the Dublin Library. · Agendas may be picked up at the City Clerk's Office for no charge, or to request information on being placed on the annual subscription list, please call 833-6650. 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 10CLOSED SESSION . 10.1 Conference with Legal Counsel – Anticipated Litigation – initiation of litigation pursuant to subdivision © of Government Code Section 54956.9 – One potential case REPORT OF CLOSED SESSION ACTION 3.ORAL COMMUNICATIONS 3.1Introduction of new employees: Central Services Management Assistant Jason Behrman and Deputy Derek Hesslein, Dublin Police Services 3.2Certificate of Appreciation to Anu Gill, Outgoing Student Representative on the Parks & Community Services Commission At this time, the public is permitted to address the City Council on non-agendized items. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of July 6, 1999 STAFF RECOMMENDATION: Approve 4.2Acceptance of Gifts to City The Senior Center has received donations in the amount of $496.25, and the Heritage Center has received a donation of an Edison Phonograph with horn speaker and one pair of toddler’s red button top shoes. STAFF RECOMMENDATION: Accept gifts and direct Staff to prepare formal acknowledgments to donors. 4.31999-2000 Contract for Services with the Alameda County Library This contract will provide for 21 City funded hours at the Dublin Branch Library. STAFF RECOMMENDATION: Authorize Mayor to execute Agreement. 4.4Authorization for Grant Application for the 1999 Transportation Fund for Clean Air Program for the construction of the Alamo Canal Bicycle Trail Project This project would construct a 12’ asphalt bike path along Zone 7’s Alamo Canal between the Iron Horse Trail on the northeast to I-580 on the southwest. Resolution STAFF RECOMMENDATION: Adopt . 4.5Award of Purchase Order – Replacement Traffic Signal Cabinet for Dublin Boulevard/ Dublin Court Intersection This item consists of purchase of a wired traffic signal cabinet to replace an existing cabinet, which was damaged by an automobile accident. The low bid received, $7,036, is within funds available for this purchase. STAFF RECOMMENDATION: Award purchase order to Synchronex, Inc. 4.6Acceptance of Work, Contract 98-11A, Heritage Center Improvements, Phase I This project included grading and paving improvements to the Heritage Center grounds. STAFF RECOMMENDATION: Accept improvements and authorize $9,034.91 payment to Grade Tech, Inc., and release the retention of $4,788.28 after 35 days if there are no subcontractor or supplier claims. 4.7Award of Purchase Order – Replacement LED Traffic signal Modules This item consists of the purchase of red LED traffic signal modules to replace the older LED modules installed 3 years ago in 5 downtown Dublin intersections. The low bid received, $13,195, is within funds available for this purchase. STAFF RECOMMENDATION: Award purchase order to Synchronex, Inc. 4.8Disposal of Surplus Property – Unclaimed Property & Surplus Equipment The City has unclaimed property as well as surplus equipment available for disposal. Consistent with past practice, Staff proposes to transfer all items to a single professional auction firm (Nationwide Companies), which has a current agreement with the City. Resolution STAFF RECOMMENDATION: Adopt and authorize Staff to proceed with transfer th of property to Nationwide Companies for auction, to be held August 14 in Benicia.. 4.9Architectural Services for Dublin Swim Center Renovation, Phase II The Council will consider an Agreement with Arch Pac, Inc. to provide architectural services for the renovation and expansion of the Dublin Swim Center Mechanical Room and for installation of a 100’ double loop water slide. STAFF RECOMMENDATION: Approve and authorize Mayor to execute Agreement. th 4.10City Treasurer’s Investment Report for 4 Quarter 1998-99 FY th The City’s investment portfolio totals $34,390,208 (market value), and funds during the 4 quarter were invested at an average yield of 5.332%. STAFF RECOMMENDATION: Receive Report. 4.11Agreement with TJKM Transportation Consultants for Traffic Engineering Services TJKM has been providing Consulting Traffic Engineering Services to the City since 1983. This contract amendment will extend the TJKM contract for an additional 2 years. TJKM has proposed a 5.15% overall increase in rates for FY 1999-2000. There has been no increase in rates for the previous 2 years. Resolution STAFF RECOMMENDATION: Adopt . 4.12Approval of Appraisal Consulting Services: Eastern Dublin Facility Impact Fee Study Update The approval of the last update of the Eastern Dublin Facility Impact Fee included an automatic escalator for construction and land values. This appraisal will be the basis for the land value update. Resolution STAFF RECOMMENDATION: Adopt approving agreement with Associated Right of Way Services, Inc. 4.13Update on 1999 Dublin Pasta Festival The City Council will receive a report on the preparations related to the 1999 Dublin Pasta Festival which will be held on September 11, and 12, 1999. The Festival location will be on and adjacent to Amador Plaza Road. STAFF RECOMMENDATION: Receive report and accept gift from sponsor. 4.14Award of Bid – Contract 99-06, Dublin Boulevard Improvements in the Vicinity of Hansen Drive This project will construct a traffic signal at the intersection of Dublin Blvd and Hansen Dr, as well as widen Dublin Blvd approximately 500 ft westerly of Hansen Dr. STAFF RECOMMENDATION: Adopt resolution awarding bid to Bay Cities Paving & Grading Inc. 4.15Warrant Register ($1,332,999) dated July 20, 1999 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATIONS - None 6.PUBLIC HEARING 6.1Appeal of Planning Commission denial of Munchkin-Care Day Care Center Conditional Use Permit for a child day care center for 30 children. Munchkin Care is appealing a decision of the Planning Commission denying a Conditional Use Permit for a Day Care Center for 30 children located at 11586 Alegre Drive. STAFF RECOMMENDATION: Conduct public hearing; deliberate; and provide Staff with direction. 6.2Resolution of Intention to Establish Rights-of-Way for portions of Tassajara Road, Gleason Drive, Central Parkway & Dublin Blvd This item will set public hearings for protest for the setting of roadway right-of-way lines for portions of Tassajara Rd, Dublin Blvd, Central Pkwy and Gleason Dr. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading; ADOPT rdth Resolution and set Public Hearings for August 3 and August 17 for protest. 6.3Reconsideration of Rite Aid/KinderCare Conditional Use Permit and Site Development Review PA 98-038 The Rite Aid applicant is requesting a reconsideration of the approved CUP and SDR to construct a 16,700 sq. ft. retail drug store with a drive-through pharmacy. The applicant is requesting to relocate the drive-through pharmacy from the eastern building elevation (San Ramon Road side) to the western building elevation where it had originally been proposed. The applicant is also requesting that the drive-through pharmacy operate from 7:00 a.m. to 11:00 p.m., instead of on a 24-hour basis. STAFF RECOMMENDATION: Conduct public hearing; deliberate; deny applicant’s Resolutions reconsideration request; -OR- reconsider request and adopt approving the drive- through pharmacy relocation and revised hours; -OR- give Staff and applicant direction and continue to a future meeting. 6.4Heritage & Cultural Arts Commission The City Council will consider the second reading of an ordinance which establishes compensation for the newly formed Heritage & Cultural Arts Commission. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 7.UNFINISHED BUSINESS 7.1Improvement Study of Handicapped Access to BART A citizen has requested that the City provide interim handicapped access to the BART Station until public sidewalk improvements can be installed on Dublin Blvd. STAFF RECOMMENDATION: Add a Capital Project to the FY 1999-2000 CIP to complete a pathway along the northside of Scarlett Court to BART and approve a budget appropriation in the amount of $20,000 from Unappropriated Gas Tax Reserves. 7.2Bay Laurel Street Traffic Issues The Council will receive a report on potential solutions to neighborhood “shortcutting” and speeding on Bay Laurel Street. STAFF RECOMMENDATION: Receive report, approve turning restrictions, installation of striping, 25 mph signs, and pavement markings. Provide direction regarding other measures. 8.NEW BUSINESS 8.1Request for BMX Park The Parks & Community Services Commission recommends pursuing the development of a BMX park and recommends the formation of a sub-committee to work with Staff and interested BMX riders to evaluate potential sites and to determine how such a park would be developed and funded. STAFF RECOMMENDATION: Consider recommendation of Parks & Community Services Commission to form a sub-committee –OR- provide alternate direction. 8.2Heritage Tree Report The City Council will review Tree Preservation Ordinances of surrounding cities and will consider directing Staff to prepare a City Tree preservation Ordinance for Dublin.
