3.ORAL COMMUNICATIONS
3.1Introduction of New Employee, Computer Systems Specialist James Slaughter
At this time, the public is permitted to address the City Council on non-agendized items. In accordance with State
Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The
Council may respond to statements made or questions asked, or may request Staff to report back at a future
meeting concerning the matter. Any member of the public may contact the City Clerk’s Office related to the proper
procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY
discuss and/or take action on items not appearing on the agenda are contained in Government Code Section
54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City
Council with one single action. Members of the audience, Staff or the City Council who would like an item
removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of August 5, 1997
STAFF RECOMMENDATION: Approve.
4.21997 Goals & Objectives Status Report
In March of 1997, the City Council established, prioritized and ranked a list of Goals &
Objectives to be accomplished during the year. Staff has prepared a status report as of
August 1, 1997. Of the total 123 goals, 26% have been completed; and with respect to high
priority goals, 36% have been completed.
STAFF RECOMMENDATION: Receive Report.
4.3Informational Report on Water Quality Fines
The Regional Water Quality Board has levied fines to two local developers for violations of the
Clean Water Act. In lieu of some of the fines, the developers may construct projects or spend
monies to enhance regional water quality. The City Council has asked for a clarification on
how these monies can be spent in Dublin.
STAFF RECOMMENDATION: Receive Report.
4.4Acceptance of Work - San Ramon Road Landscape Repair and Silvergate Drive Median
Landscaping Project - Contract 97-03
This project installed shrubs and ivy along San Ramon Road and improved the median island
on Silvergate Drive, including the planting of trees, shrubs and installation of paver stones.
The work has been completed.
STAFF RECOMMENDATION: Accept improvements; authorize $1,257.80 payment to Herzer
Landscaping, Inc., for their final invoice and release retention of $10,391.10 after 35 days if there
are no subcontractor claims.
4.5Approval of Contract Change Order No. 16, and Acceptance of work for Contract 95-01,
Dublin Boulevard Widening (Donlon Way to East of Village Parkway)
The Dublin Boulevard widening project added an additional through lane in each direction on
Dublin Boulevard, as well as additional turn lanes. The project was combined with an
underground utility project and a pavement overlay project. The project is now complete and
it is appropriate to accept the contract as complete.
STAFF RECOMMENDATION: Adopt Resolution; accept project as complete and authorize
$136,397.83 retention payment to Redgwick Construction Company after 35 days if no claims are
made to the contract, and direct Staff to file a notice of completion; appropriate $104,922 from
Unallocated General Fund Reserves, transfer $90,000 from General Fund monies unspent in the
Street Maintenance Operating Budget for the Overlay Project, and appropriate $107,978 from
Fund 300 to the 1996-97 Capital Improvement Budget for the Dublin Boulevard Widening
project. These monies ($107,978) will be paid by the General Fund and reimbursed as fees are
collected.

5.WRITTEN COMMUNICATIONS - None
6.PUBLIC HEARING
6.1Villas at Santa Rita Development Agreement PA 97-007
An ordinance is proposed which would approve a Development Agreement between the City
of Dublin and the Alameda County Surplus Property Authority. The Villas at Santa Rita is a
324 unit apartment project located on approximately 11.9 acres of land at the northeast corner
of Dublin Boulevard and Hacienda Drive. The DA is required by the Eastern Dublin Specific
Plan. Items included in the DA include, but are not limited to, the financing and timing of
infrastructure, payment of traffic and public facilities impact fees, dedication of park land, and
general provisions.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and
INTRODUCE Ordinance.
6.2Comprehensive Revision of the Dublin Zoning Ordinance PA 95-027
A comprehensive revision has been done on the Dublin Zoning Ordinance to bring it into
conformity with the requirements of law and to make it consistent with current planning
practice.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution; waive
reading and INTRODUCE Ordinance.
7.UNFINISHED BUSINESS
7.1Appointments to the Library Planning Task Force
The City Council will review the applications received for membership on the Library Planning
Task Force.
STAFF RECOMMENDATION: Approve appointments to the Task Force.
7.2Appointments to the City Park Task Force
The City Council will review the applications received for membership on the City Park Task
Force.
STAFF RECOMMENDATION: Approve appointments to Task Force.
8.NEW BUSINESS
8.1Sale of Public Property - Remnant Parcels from Dublin Boulevard Extension Acquisition
As part of completing the Dublin Boulevard Extension, two small parcels of land were left
over as excess property on the north side of Dublin boulevard. The two parcels are contiguous
and represent 22,337 square feet. IHOP Corporation has expressed interest in purchasing the
parcels for the development of a 3,970 square foot IHOP restaurant at Dublin Boulevard and
Dougherty Road. The purchase price is $245,000.
STAFF RECOMMENDATION: Authorize Mayor to sign a Purchase & Sales Contract with
IHOP Realty Corporation per the terms and conditions of the contract.
8.2Enforcement Policy for the Zoning Ordinance, Building Code, Housing Code, and
Property Maintenance Ordinance; and time frame for enforcing the above ordinances and
codes PA 95-027
The City Council will review potential changes recommended by the Planning Commission to
the enforcement policies for the above ordinances and codes.
STAFF RECOMMENDATION: Adopt Resolution establishing the Enforcement Policy for the
Zoning Ordinance, Building Code, Housing Code, and Property Maintenance Ordinance; and
rescinding City Council Resolution No. 104-95; and give instruction to Staff to provide one
verbal warning and one written warning (unless circumstances dictate more) on all enforcement
issues, followed by citations and fees; - OR - provide other direction to Staff.
