ORAL COJVIlVlUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the Ci ty Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Adjourned Regular Meeting of December 18, 1985 STAFF RECOIVllVIENDATION: Approve 4.2 Financial Report for Period Ending November 30, 1985 STAFF RECOIVllVIENDATION: Approve 4.3 City Treasurer's Investment Report for Period Ending December 31, 1985 STAFF RECOIVllVIENDATION: Approve 4.4 Claim of Kevin Kittredge A claim has been presented on behalf of Kevin Kittredge. The amount of the claim is $10,000 and is for the all edged value of his vehicle and emotional distress. The vehicle was removed from the street pursuant to Vehicle Code Section 22651(0). The claim was not submitted within the time limits required by State Government Code Section 911.2. STAFF RECOIVllVIENDATION: Deny claim and direct Staff to notify the claimant and the City's Insurance Carrier. 4.5 Claim submitted on behalf of George W. Filstead and David C. Filstead A claim has been submitted on behalf of George and David Filstead. The claim alledges property damage, physical injury and emotional trauma. The amount of damages claimed is $3,088 plus an unspecified amount for pain and suffering. The claimants also seek $500,000 in punitive damages. STAFF RECOIVllVIENDATION: Deny claim and direct Staff to notify the claimants and the City's Insurance Carrier. 4.6 Dublin High School Super Bowl Sunday Run Two races have been scheduled on January 26, 1986 on both local and San Ramon Ci ty streets. One race will be a 2 mile fun run and one will be a 10K run. Reserve Officers will furnish police and traffic control. This is the third year for this event which benefits the Dublin High School track team. STAFF RECOlVJlVlENDATION: Approve request and waive permit fee. 4.7 Agreement for City Purchase of Park Land at Dolan School Site The General Plan designates a five-acre park site on the former Dolan School site. Approximately 0.97 acres will be given to the City by the developer as fulfillment of his park dedication requirement. The remaining 4.03 acres will be purchased by the City from the Murray School District. The agreement specifies how the transaction and transfer of title is to occur. STAFF RECOIVllVIENDATION: Approve agreement with Murray School District. 4.8 Report from Police Chief Re: Li ttering Law Pursuant to a previous request from the City Council, the Police Chief has prepared a report on the City's existing litter law. STAFF RECOlVJlVlENDATION: Receive Report 4.9 Report from Recreation Director Re: 1986 St. Patrick's Day Celebration Saturday, March 15, 1986 is the 3rd Annual St. Patrick's Day Celebration coordinated by the City's Recreation Department and the Dublin San Ramon Lions Club. The days activities include a parade through downtown Dublin, a community celebration dinner and dance at Shannon Center/Park. STAFF RECOlVJlVlENDATION: Approve St. Patrick's Day Celebration, authorize installation of banner and approve parade route. 4.10 Participation in Alameda County Liability Insurance Pool Study The Alameda County "City/County Managers'" group has formed a subcommittee investigating the possibility of local agencies pooling their liability insurance risks. The first phase of the study will analyze data from the participating cities and project their cost to be involved in a pooled arrangement for insurance purposes. STAFF RECOlVJlVlENDATION: Authorize participation in Phase I of the Study and authorize a $500 budget transfer from the Contingent Reserve to an Insurance Professional Services Account. 4.11 Annual Statement of Investment Policy Section 53646 of the Government Code requires a city to annually adopt a Statement of Investment Policy. The first policy was adopted pursuant to this law in January of 1985. No changes are recommended for the upcoming year. STAFF RECOlVJlVlENDATION: Adopt Statement of Investment Policy for 1986 4.12 1986-87 Community Development Block Grant Project Funding The 1986-87 anticipated funding levels for the Community Development Block Grant Program have been reduced. This is a federal program which is administered through the Alameda County Housing and Community Development Program. Due to the reduced allocations, the City must revise its anticipated expenditures. STAFF RECOlVJlVlENDATION: Revise the 1986-87 CDBG Project priority to fit the reduced funding available. 4.13 Warrant Register dated January 13, 1986 STAFF RECOIVllVIENDATION: Approve 4.14 Final Report Traffic Engineering Study The California Office of Traffic Safety has awarded the City of Dublin a grant for a comprehensive traffic engineering study. The objective of this project was to improve traffic safety and relieve congestion. JHK & Associates have developed a final report which outlines their findings and provides recommendations. STAFF RECOIVllVIENDATION: Adopt Final Report and direct Staff to implement recommendations. 5. PUBLIC HEARING 5.1 PA85-017 Kaufman and Broad of Northern California, Inc., Planned Development (PD) Prezoning, Rezoning, Annexation, Tentative Map and Site Development Review Application, Silvergate Drive North of Hansen Drive Kaufman & Broad is proposing a 130 unit multiple family residential project on Silvergate Drive north of Hansen Drive. The project involves the pre zoning and annexation of approximately 13.4 acres that are now outside of City limits. Major issues involve: 1) size and configuration of western recreation area; 2) layout of units along Martin Canyon Creek; 3) size and configuration of eastern recreation area; 4) need for future public hearing on Site Development Review; and 5) reduction of project density by 2-3 dwelling units. STAFF RECOIVllVIENDATION: Open public hearing; hear presentation and testimony; pose questions; close public hearing; deliberate; adopt resolutions; waive reading and introduce ordinance. 5.2 PA85-077 Zoning Ordinance Amendment Regarding Recreational Vehicles (RV Ordinance) The existing Zoning Ordinance prohibits parking or storage of Recreational Vehicles, boats, trailers and similar items in required Front Yards and required Side Yards in Residential Districts. The Planning Commission has recommended adoption of an RV Ordinance to allow storage in rear yards and side yards. In front yards, only parking on driveways would be allowed. Maj or issues involve: 1) storage in front yards, 2) safety and sight distance, 3) storage in driveways, 4) potential City liability. STAFF RECOIVllVIENDATION: Open public hearing; hear Staff presentation; take testimony from public; question Staff and public; close public hearing; deliberate; direct Staff to make revisions and continue OR adopt resolution, waive reading and introduce ordinance. - 5.3 Appeal of Planning Commission action to conditionally approve PA84-049 Imperial Freeholds California Inc., application for Parcel Map 3582 Extension On September 23, 1985, the City Council granted Imperial Freeholds a second continuance on their appeal of the Planning Commission approval for Parcel Map 3582 Extension. The appealed condition required the developer to pay $69,000 toward the installation of traffic signals at Sierra Court and Dublin Boulevard. Imperial Freeholds is requesting an additional continuance to allow escrow to close on the sale of the property. If escrow closes, the matter becomes moot. STAFF RECOIVllVIENDATION: Continue public hearing until May 12, 1986 City Council meeting. 6. UNFINISHED BUSINESS 6.1 Murray School District Notice of Intent to sell portions of Fallon School as surplus real property The Murray School District is selling portions of the Fallon School site. The Dublin General Plan calls for a 5 acre neighborhood park and single family residential uses on the site. The City has 60 days from the time of notice to indicate an interest in purchasing part or all of the site. STAFF RECOIVllVIENDATION: 1) Express interest in proposed park site as modified in Staff Alternative Layout; 2) express interest proposed City Recreation Center subject to parking agreement; 3) direct Staff to work with School District per the Staff Alternative Layout; 4) Adopt resolution indicating interest in purchasing portions of Fallon School site; 5) direct Staff to negotiate purchase and bring back to City Council for review and approval. 6.2 Actuarial Report on Inclusion of Elected Officials in PERS Membership The City Council directed Staff to request information from the Public Employees Retirement System (PERS) related to the inclusion of elected officials. PERS required an actuarial valuation of the City's account. The results identify the increased costs to the City if the contract is amended. STAFF RECOIVllVIENDATION: Review report and direct Staff to request appropriate documents to undertake inclusion of elected officials, if the Council desires to proceed. 6.3 City of Dublin Public Facilities Project No.1, 1985 Certificates of Participation On December 31, 1985, the City finalized a financing package for the purchase of property and development of a civic center facility. The financing was arranged through the issuance of Certificates of Participation. On the recommendation of Bond Counsel, the final documents were amended to facilitate obtaining financing under 1985 tax laws. The report reviews the amendments and identifies the details of the financing. STAFF RECOIVllVIENDATION: 1) Adopt resolution which: a) amends Section 8 of Resolution No. 134-85; b) approves purchase agreement; c) requires the City to redeem all outstanding certificates in the event that the City does not acquire ownership of the civic center site by December 31, 1986; d) ratifies and affirms all acts, actions and documents signed or issued by the City in connection with the issuance of $11,968,000 in Certificates of Participation and including all such changes in the Lease Agreement, Trust Agreement, Agency Agreement and Trustee Agreement. 2) Authorize a temporary loan in the amount of $3,100,000 from the City's Street Improvement Reserve to Dublin Information, Inc. 7. NEW BUSINESS 7.1 Demolition of Illegal Buildings and Structures at 7360 San Ramon Road On October 8, 1984, the City Council directed the City Attorney to proceed with the abatement of building safety and zoning violations at the above location. This resulted in a Stipulation for Entry of Judgement and Order Thereon, which was filed in Superior Court. This document was signed by the property owner and his legal representative identifying his obligation to eliminate the violations. If the owner failed to do so, the City was authorized to enact the necessary measures to obtain compliance. STAFF RECOIVllVIENDATION: 1) Appropriate $50,000 from the Street Improvement Reserve to accomplish the demolition of buildings and structures; 2) Approve specifications and authorize the Building Official to advertise for bids for removal and storage of materials 3) Approve specifications and authorize the Building Official to advertise for bids to demolish the buildings and structures. 8.
