CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 10. CLOSED SESSION 10.1 Conference with Legal Counsel - Anticipated Litigation - Significant exposure to litigation pursuant to GC Section 54956.9(b)(1) and (3)(A) - One potential case REPORT ON CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Introduction of new employee Gregory Reuel, Economic Development Manager 3.2 Appointments to Planning Commission Mayor Houston's recommended appointments to the Planning Commission, Steven L. Lockhart and Don D. Johnson, were delayed at the last Council meeting by a majority vote of the Council, in order to give them an opportunity to review applications and resumes from all applicants. STAFF RECOMMENDATION: Confirm appointments or provide appropriate direction to Staff. 3.3 Appointments to Parks & Community Services Commission Mayor Houston's recommended appointments to the Parks & Community Services Commission, Marjorie Wong-Gillmore, George Cramer and Jeffery B. Chapman, were delayed at the last Council meeting by a majority vote of the Council, in order to give them an opportunity to review applications and/or resumes from ali applicants.. STAFF RECOMMENDATION: Confirm appointments or provide appropriate direction to Staff. At this time, members of the audience are permitted to address the City Council on items of interest to the public; however, in accordance with State Law, no ACTION or DISCUSSION shall take place on any item which is NOT on the City Council Agenda. The Council may respond briefly to statements made or questions posed, or may request Staff to report back at a future meeting concerning the manner. Further, a member of the City Council may direct Staff to place a matter of business on a future agenda. Any person may arrange with the City Clerk (no later than 11:00 a.m., on the Tuesday preceding a regular meeting) to have an item of concern placed on the agenda for the next regular meeting. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in GC 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes: NONE 4.2 Amendment to City Council Rules related to starting time for regular City Council meetings On January 9, 1995, the City Council unanimously agreed to change the starting time for regular City Council meetings from 7:30 p.m., to 7:00 p.m. Staffwas directed to incorporate this change into the Council Rules Resolution and bring it back to the Council for adoption. ' STAFF RECOMMENDATION: Adopt Resolution and direct Staff to notify the Dublin Housing Authority in order that the necessary amendments to DHA Bylaws may be prepared. 4.3 Acceptance of Work - Civic Center Cabling Project This project consisted of installing cabling for the new computer network throughout the Civic Center. Additional work included installing cables for telephones in Police Services investigations bay. STAFF RECOMMENDATION: Accept project as complete and authorize $18,433 final payment to Johnson Controls. 4.4 Warrant Register ($1,652,627.18) dated January 23, 1995 STAFF RECOMMENDATION: Approve. 5. WRITTEN COMMUNICATION - None PUBLIC HEARING 6.1 Eastern Dublin Reorganization PA 94-030 (Annexation/Detachment No. 10) This public hearing item is for the adoption of the final resolution ordering: 1) the annexation of 1,538 acres to the City of Dublin; 2) the annexation of approximately 1,542 acres to the Dublin San Ramon Services District; and 3) the detachment of approximately 1,029 acres from the Livermore Area Recreation and Park District. STAFF RECOMMENDATION: Open public hearing; receive oral and written protests from property owners and registered voters; close public hearing; determine value of written protests filed and no.t withdrawn; deliberate; adopt appropriate resolution -OR- continue item to the next Council meeting for adoption of a resolution calling a special election -OR- terminate proceedings if a majority protest exists. 6.2 Negative Declaration for Dublin Boulevard Widening Project In 1990, the City Council held a public hearing to receive comments regarding the Environmental Assessment for the Dublin Boulevard widening project; however, no formal action was taken at that time. This is a housekeeping item to formally adopt the Environmental Document as a Negative Declara.tion. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution adopting Negative Declaration and Findings of De Minimis Impact on Wildlife for the Dublin Boulevard Widening Project and to ratify previous approval of the project. 6.3 Santa Rita Commercial Center Planned Development Rezoning and Development PA 94-001 (Homart) This Planned Development Rezoning would allow an approximate 800,000 square foot shopping center on the 75 acre site at the southeast corner of Dublin Boulevard and Hacienda Drive. The Council will consider the associated Development Agreement, Mitigated Negative Declaration and Mitigation Monitoring Program. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution approving Mitigated Negative Declaration and Mitigation Monitoring Program; waive reading and INTRODUCE Ordinance approving PD Rezone to a General Commercial Planned Development; waive r. eading and INTRODUCE Ordinance approving Development Agreement; continue public hearing to January 31, 1995 at 7:00 p.m. UNFINISHED BUSINESS 7.1 Garbage'and Recycling Services Draft Request for Proposal and Draft Agreement The current agreements for solid waste collection and disposal, as well as recycling services expire in March of 1996. The City's Consultant has assisted Staff in preparing a Request for Proposal which will seek bids on a variety of services. Alternatives are presented in order to obtain costs on services not currently provided. The Consultant has also prepared a Draft Agreement outlining terms and conditions. Also, at a previous meeting, the Council requested an opportunity to reconsider the procurement process for 'obtaining these services. STAFF RECOMMENDATION: 1) Provide input on the service options presented in the RFP; 2) Review the criteria to be used in evaluating proposals; 3) Provide input on the key terms and conditions of the agreement; and 4) Provide Staff with direction as to whether the procurement process will involve sole source negotiation or competitive RFPs. NEW BUSINESS 8.1 Proposed Teen Task Force The City Council will consider the formation of a Teen Task Force to ascertain the needs and desires of the teens in the community. STAFF RECOMMENDATION: Approve formation of Teen Task Force and direct Staff to advertise openings. 8.2 1995 Goals & Objectives/Budget Study Session The City Council annually holds a study session meeting to define the City's Goals & Objectives for the upcoming year. This study session provides a means for the Council to provide Staffwith guidelines for developing the City's Annual Budget for the upcoming year. STAFF RECOMMENDATION: 1) Determine process to be used; 2) establish meeting date for Goals & Objectives Study Session during the week of February 27, 1995; and 3) determine if the Budget Study Session should be held on the same date as the G&O Study Session or at a separate meeting. 8.3 Preliminary Report on Garbage Rate Increase requested by Waste Management of Alameda County (WMAC) The City participates in a joint review of garbage rate applications with several agencies serviced by WMAC. The Consultant has issued the recommendations for 1995 rate adjustments. The report outlines various factors contributing to an estimated 17.9% increase in operating expenses. STAFF RECOMMENDATION: Direct Staff to prepare documents necessary for a public hearing on February 13, 1995, to consider adjustments to the Solid Waste Collection Rate Schedules. 8.4 8.5 National Small Business Administration Tree Planting Program 1995 The City Council will review the grant requirements for the Small Business Administration Tree Planting Program and consider submitting an application for funding. STAFF RECOMMENDATION: Direct Staff to submit grant application. Draft Tri-Vailey Transportation Plan/Action Plan - Land Use Issue The Tri-Valley Transportation Council will be circulating the Draft Tri-Valley Transportation Plan which includes growth control measures to 'reduce congestion on gertain roadways. The City Council will be reviewing this land use issue as it relates to the Plan. STAFF RECOMMENDATION: Authorize Mayor to sign draft letter to the Tri-Valley Transportation Council. ADJOURNMENT - A special City Council meeting has been scheduled for Tuesday, January 31, 1995, beginning at 7:00 p.m., in order for the Council to consider the adoption of ordinances related to the proposed Homart Project Rezoning. The City Council has been invited to participate in a live call-in show being produced by CTV30 on Tuesday, January 24, 1995, from 7:30 p.m., to 8:30 p.m. Agenda Printed 1/20/95 3:19 PM
