CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. CLOSED SESSION - Pending Litigation, Rose Jurich and Mario Jurich vs. City of Dublin et al., Government Code Section 54956.9(a) 3. O::tAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on t.he City Council Agenda. Comrnents should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City ~anager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public inp~t may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 I'linutes of Regular neeting of January 11, 1988 STiC\.FF RECOI''lHENDATIOtJ: Approve 4.2 Financial Report for Period Ending December 31, 1987 STAFF RECOr'1[.1ENDZ\TION: 2-\pprove 4.3 Resolution Supporting the Use of Public Facilities as Polling Places The Alameda County Registrar of Voters has requested that cities support the use of public facilities as polling places. STAFF RECO~~1ENDATION: Adopt Resolution 4.4 Special Account for Capi tal Outlay .l'loneys The City has been awarded $100,000 in grant funds for Shannon and Alamo Creek Parks under the special account for capital outlay. In order to process the grant request, the Council must approve the application and adopt a resolution for each project. STAFF RECOrlMENDATION: Adopt Resolutions 4.5 Shannon Center Renovation Architectural Services Staff has prepared a Request for Proposal to provide architectural services for the renovation of the Shannon Comrauni ty Center. STAFF RECOlvInENDATIOt1: Approve RFP and authori ze Staff to advertise for consul tants 4.6 Claim submitted by Larry Quesada on January 19, 1988 (0028DU) This claim alleges that Alameda County Sheriff's Department personnel unlawfully arrested Mr. Quesada at Baxter's Restaurant. The arrest was made at the request of Baxter's personel who placed the claimant under citizen's arrest. STAFF RECO~nlliNDATION: Deny claim and direct Staff to notify the claimant and tender the claim to Alameda County pursuant to existing agreements. 4.7 Claim submitted on behalf of Darci Townsend on December 28, 1987 (0027DU) This claim involves a traffic accident between ~ls. Townsend and Officer Kuwitzky, an employee of the Alameda County Sheriff's Department. The cause of the accident was the claimant's violation of Section 2l806(A) of the California Vehicle Code, in that she failed to yield the right-of-way to an Energency Vehicle with its red light and siren activated. STAFF RECOMMENDATIOIJ: Deny claim and direct Staff to notify the claimant and tender the claim to Alameda County pursuant to existing agreements. 4.8 tlarrant Register dated January 25, 1988 STAFF RECOHf.'1ENDATION: Approve ~.9 Renewal of Agreement for NorCal Employment Relations Consortium During the past year, the City has participated in a Consortium which provides Employee Relations Training. The law firm which prepares the presentations is well recognized in their field and they represent many public agencies. The cost for retaining the law fir3 is spread evenly among the members. \lith 14 participants, the base cost of participating would be $1,154. STAFF RECOfU.1EHDZ\TION: l\.pprove the Ci ty' s continued participation and authori ze the Ci ty Manager to execute the agreement. 4.10 lC\.mendmentsto Personnel Systern The Council will consider a resolution amending -the Classification Plan to include part-time aquatic personnel, a resolution establishing a salary ?lan fo~ the new positions and those positions affected by the increase in the State minimum wage. STAFF RECOMMENDATION: Adopt Resolutions and authorize recruitment of aquatics coordinator. 4.11 Award of Agreement for Civic Center Inspection and Testing At the regular City Council meeting on December 21, 1987, the Council authorized Staff to seek proposals for testing and inspection services. Seven proposals \Yere received and reviewed. Three semi-finalists were invited to participate in an interview and presentation. STAFF RECOMMENDATION: Adopt Resolution awarding the agreement to Consolidated Engineering Laboratories and authorize the City Manager to procure additional services as needed. 5. BRITTEN COHHUNICATIONS - None 6. PUBLIC HEARING 6.1 Crest Enterprises & The New Ewe, PA 87-127 Request for a Planned Development Rezoning to expand the permitted uses within a portion of the existing Heritage Park Planned Development, l362nd Zoning Unit At the January 11, 1987 City Council meeting, the Council adopted new Findings and General provisions and re-introduced an Ordinance amending the City's Zoning Ordinance rezoning APN 941-1550-4 to a Planned Development expanding the uses for a portion of the Heritage Park Planned Development. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt Ordinance amending City Zoning Ordinance to permit the rezoning of property located at the southeast corner of Donlon Way and Dublin Boulevard. 6.2 The Good Guys/Enea Properties, Appeal of Planning Commission action re PA 87-161, Sign Location Variance, Southwest Corner of fuuador Plaza Road & Dublin Boulevard. The Applicant is requesting approval of Sign Location Variance to allow construction of a wall-mounted business sign which would not be located on Primary or Secondary Building Frontage of the retail space it is proposed to identify. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution upholding Planning Commission's action denying Sign Location Variance request -OR- provide direction and continue the item. 6.3 San Ramon Road Soundwall and Amador Valley Boulevard Fence Replacement (Masonry Walls) and East Side of San H.amon Road OJood I'Jalls) This item represents an update on the projects to construct soundwalls along San Ramon Road and to replace the wooden fences along funador Valley Boulevard between Village Parkway and Stagecoach Road. STAPF RECO~lMENDATION: Conduct public hearing; deliberate; authorize Staff to advertise Contract 88-1 for bids (masonry soundwall for east side of San Ramon Road and for backyard fence replacement on Amador Valley Boulevard between Village Parkway and Stagecoach Road; deny r'1r. Ilohondro' s request for gate in wall on Amador Valley Boulevard; authorize Staff to solicit permission, through construction easements, from the property owners abutting the west side of San Ramon Road to replace their fences with wooden soundwalls. 6.4 Ordinance and Resolutions related to Pireworks Advisory Ballot r1easure and Special Election on June 7, 1988 In accordance with City Council direction, the City Attorney has prepared Resolutions calling a s~:>ecial election for a Pire\'lOrks Advisory Ballot Neasure for June 7, 1988. The City Attorney has also prepared an Ordinance for Council consideration which would amend Ordinance IJo. 10-32 by noticing potential fireworks applicants for 1988 of the ?otential repeal of Ordinance l~. 10-82 and No. 12-82 prior to June 28, 1988. STAFF RECOHMEIJDATION: Open I)ublic hearing; hear Staff presentation; hear public comments; 1) Consider proposed Ordinance amending Ordinance No. 10-82; 2) Adopt Resolution calling special advisory election; 3) Adopt Resolution requesting County to provide election services; 4) Adopt Resolution rela.ting to ballot arguments and impartial analysis 6.5 Ordinance adopting Alameda County Code Title 3, Chapter 6, Article 14, by Reference (Construction, Repair, Reconstruction, Destruction, or Abandonment of Hells) This ordinance incorporates the provisions of Alameda County Code Title 3 Cha?ter 6 Article 14, which provides a permit procedure and standards for work relating to wells. Alameda County Flood Control & Hater Conservation District, Zone 7, would enforce this ordinance. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and introduce ordinance. 6.6 Ordinance increasing City Council salaries The City Attorney's Office has prepared a draft ordinance which would provide for the increase of Council salaries after November, 1988. STAFF RECO~iII-1ENDATIOIJ: Conduct public hearing; deliberate; waive reading and introduce ordinance. 7. UNFINISHED BUSINESS 7.1 Fire Authority Joint Powers Agreement and Bylaws The Dublin and San Ramon Liaison Committee are recommending that the City Council consider adoption of a Joint Powers Agreement and Bylaws for the future provision of Fire Services to the City of Dublin and the City of San ~amon. This Joint Powers Agree8ent was developed in accordance with the r~morandum of Understanding which was approved by the Cities of Dublin and San Ramon and the Dublin San Ramon Services District. If the City Councils of both Cities approve this agreement, the Joint Powers Authority will work towards assuming operational responsibility of the Fire Services from the Dublin San Ramon Services Distric.t by July 1, 1988. STAFF RECOMMENDATION: 1) Adopt Resolution approving Joint Powers Agreement and approving Bylaws in concept; authorize Mayor to execute JPA Agreement; 2) Appoint three (3) members of City Council to Joint Powers Authority Board of Directors and one (1) member of the City Council as alternate. 8 . '\~EvJ BUS I NESS 8.1 Acquisition of Strip of Land Adjacent to Mape Park The City has been advised by the County Tax Collector that a 20'+ wide s.trip of land adjacent to Mape Park is being sold for defaulted taxes. The mi~imum bid is $250. :3TAFF RECO:f;lMENDATIO],~: Z\dopt resolution authorizing purchase at the minimum bid of $250 and execution of a Chapter 3 agreement; authorize budget transfer from the Contingent Reserve in the amount of $250. 8.2 Proposed Soundwall for Arroyo Vista The Ci.ty Council approved construction of a soundwall along the residential frontage of Arroyo Vis.ta as part of the 1987-88CIP. The Housing Authority will be selecting a wall type at their January 25th meeting just prior to the City Council meeting. STAFF RECOMHENDATION: Approve the recommendation of the Dublin Housing Authority and one of the following: 1) If the reco~~endation is to install a block wall to match the one proposed to be constructed along the east side of San Ramon Road, direct Staff to include the construction of the Arroyo Vista wall with the San Ramon Road/l~Jador Valley Boulevard wall project and authorize Staff to solicit bids as soon as plans and specifications have been integrated (approximately one week); or 2) If the recomendation is to install a wall other than one matching the San Ramon Road wall, direct Staff to complete the plans using the recommended wall pattern and request authorization at a future meeting to solicit bids as a separate project. 8.3 The Computerization of the City's Administration Records The City Council previously authorized Staff to request bids for the City's Data Processing needs. The City has received 19 responses to its request for bids. After evaluating these bids over the last several months, the City Staff collectively determined that the software available with IBM hardware best met the City's data processing needs. STAFF RECOMMENDATION: Authorize Staff to purchase the IBM System 36, the software from DLH for Finance and Muni-Hetrix software for the City Clerk. 8.4 1988 Goals & Objectives Study Session Annually, the City Council holds a special meeting to define its Goals & Objectives for the City in the upcoming year. In accordance with Council direction, this meeting is held during the month of February to coincide with the City's incorporation anniversary. srrAFF RECOHiYlENDATION: Call a Special Heeting for a Goals & Obj ecti ves Study Session and advise Staff of any desired changes in the format of the City's Goals & Objectives Study Session. 9.
