CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of January 12, 1987 STAFF RECOMMENDATION: Approve 4.2 Financial Report for Period Ending December 31, 1986 STAFF RECOMMENDATION: Approve 4.3 Report Regarding Fall Recreation Report The Recreation Director has prepared a report highlighting the activities sponsored by the City's Recreation Department during the fall quarter of 1986. STAFF RECOMMENDATION: Receive Report 4.4 Agreement for Towing Services for Abandoned Vehicles Tow companies typically lose money on most abandoned vehicles and are therefore, reluctant to tow. Dublin Police Services tow approximately 250 abandoned vehicles from City streets each year. The City has developed an agreement whereby the City will pay a bonus of $25 per vehicle towed. This fee will help defray costs associated with towing, storage and lien sale incurred by the tow company. STAFF RECOMMENDATION: Approve program & authorize Mayor to execute agreement; authorize budget transfer of $3,000 from the Contingent Reserve. 4.5 Appropriation for costs associated with outfitting patrol vehicles with light & push bars, etc. The cost for this work was in excess of those costs which had been anticipated in the preparation of the 1986-87 annual budget. A Budget Change Form is required to transfer $13,450 from the General Fund non-departmental contingent reserve to the Internal Service Fund. STAFF RECOMMENDATION: Approve Budget Change Form 4.6 Warrant Register dated January 26, 1987 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 From "The Center" regarding Drug Intervention Program The Center is requesting that the City contribute 1/3 of the cost ($300) of putting on a Drug Intervention Program for Tri-Valley residents. The Cities of Livermore and Pleasanton have each committed to a $300 contribution. STAFF RECOMMENDATION: Consider 6. PUBLIC HEARING 6.1 Sign Ordinance Amendment - PA 86-129 This ordinance proposes to amend the City's Sign Ordinance to allow 2 freestanding signs on large parcels and to clarify several sections of the Sign Ordinance. The ordinance was introduced at the City Council meeting on January 12, 1987. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance 6.2 Appeal of Planning commission Action Denying PA 86-981, Howard Johnson Sign Variance application to exceed maximum permitted area for Directional Sign, 6680 Regional Street The Applicant has withdrawn the application. Under the recently introduced Sign Ordinance Amendment, the Applicant will be able to apply for a Conditional Use Permit for 2 freestanding signs. A diferent variance would also be needed. STAFF RECOMMENDATION: Accept withdrawal of application 6.3 Ordinance Changing Violations of Building and Zoning Regulations from a Misdemeanor to Infractions This proposed ordinance, which was introduced at the January 12, 1987 Council meeting, is intended to facilitate enforcement of building and zoning codes, leading to a higher compliance rate. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance 6.4 Ordinance Increasing City Council Salaries This ordinance, which was introduced at the January 12, 1987 Council meeting, would provide for the increase of Council salaries after November, 1988. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance. 6.5 Ordinance Repealing Campaign Contribution Ordinances No. 1-84 and No. 3-84 If this ordinance is adopted, the State Law re9ulating campaign contributions would be the law regulating campaign contributions in the Clty~ Candidates woul4rflave to disclose contributions and expenditures in excesS of $100 lnstead of $25 and the State Law does not place an upper limit on contributions candidates can receive, whereas Ordinance No. l-84 limits contributions to $100. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance or vote to reject ordinance. 6.6 Ordinance Amending Time for Filing Campaign Contribution & Expenditure Statements This ordinance would consolidate 7 filings into 4 filings, as well as bring the filing period for the City's ordinance into conformance with the filing period for the State. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance or take no action. 6.7 Ordinance Relating to Secondhand Dealers and Junk Dealers This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance would replace Title 1, Chapter 5 of the Alameda County Code and would require Secondhand Dealers and Junk Dealers to comply with the provisions of State Law and the City's Zoning Ordinance. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance. 6.8 Ordinance Prohibiting Solicitation at Accident Sites This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance prohibits soliciting or offering for sale tow services or any other services at the site of a vehicle accident or other catastrophe or calamity. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance. 6.9 Ordinance Relating to Hotel and Lodging Registration This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance establishes regulation regarding hotel registration and would replace Title 4, Chapter 5, Article 1 of the Alameda County Code. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance. 6.10 Ordinance Relating to the Exposure of Portions of the Human Body This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance prohibits the exposure of certain parts of the human body in any public place, places open to the public, or places open to public view. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance. 6.1l Ordinance Regulating Unauthorized Use of Corpus Data This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance would make it unlawful for any unauthorized person to obtain personal data from the Criminal Oriented Records Production Unified System (Corpus) or for any person to provide such data to an unauthorized person. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance. 6.12 Ordinance Relating to Drinking in Public This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance does not incorporate the provisions of the County Code which makes it unlawful to be in a drunken condition on public streets, because this provision is covered by State Law. This ordinance makes it unlawful to drink intoxicating beverages on any street, sidewalk, alley or highway, or to drink intoxicating beverages on public or private property open to the public and within 1,000 feet of any City street, sidewalk, etc., and intended to be used for parking of motor vehicles, without the permission of the property owner. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance. 6.13 Ordinance Establishing a Procedure for Disposition of Unclaimed and Stolen Property This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance establishes broad procedures and guidelines for the disposition of unclaimed and stolen property. STAFF RECOMMENDATION: Conduct public hearing; waive reading and introduce ordinance. 7. UNFINISHED BUSINESS - None 8. NEW BUSINESS 8.1 Request for Maintenance Assistance from Dublin High School The Recreation Department has received a request from Dublin High School for assistance with field maintenance. The Park & Recreation Commission was in favor of studying the request further and referred it to the City Council for their consideration. STAFF RECOMMENDATION: Consider request and determine whether there is sufficient benefit to the City to pursue consideration of providing financial assistant to Dublin High School and whether the City and School District should jointly fund the services of a landscape architect to identify those costs associated with the improvements identified and maintenance of those improvements. 9.
