DUBLIN CITY COUNCIL
REGULAR MEETING - January 27, 1992 DUBLIN CIVIC CENTER

A complete packet of information containing all Staff Reports and exhibits related to each agenda item is available
for public information and perusal several days prior to a Council meeting in the City Clerk's Office and also at
the Dublin Library.
1. CALL TO ORDER

3. ORAL COMMUNICATIONS
3.1 Presentation of February Customer Service Award to Penny
Grealis
At this time, members of the audience are permitted to address the City Council on any item which is NOT on the City
Counci l Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to
address their concern, that person should arrange with the City Clerk to have their particular concern placed on the
agenda for a future meeting. The City Council CANNOT deliberate or take action on a non-agenda item UNLESS there is
factual evidence presented to the Council indicating that the subject brought up falls into one of the exceptions
under Government Code Section 54954.2.
4. CONSENT CALENDAR
Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council
with one single action. Members of the audience who would like an item removed from the Consent Calendar for purpose
of public input may request the City Council to remove the item. The request may be made at the time that the Mayor
asks the audience members if there is anyone interested in removing an item from the Consent Calendar.
4.1 Minutes: Regular Meeting of January 13, 1992
STAFF RECOMMENDATION: Approve
4.2 Status Report regarding existing Non-Conforming Signs
identified on the Non-Conforming sign Summary List
The Council has requested monthly reports advising of the
status of the remaining 55 non-conforming and 2 illegal
signs. Letters will be sent reminding business and
property owners of the upcoming July 1992 compliance
deadline.
STAFF RECOMMENDATION: Receive Report.
4.3 Eden Canyon Road Interchange - Assurance of Availability of
Local Funds
This Resolution provides assurance to Caltrans that local
funding is available to construct improvements to the 1-580
Eden Canyon Interchange as development occurs in the
western hills. Funds are to be provided solely through
developers and/or future assessments, and no General Fund
monies are committed by this action.
STAFF RECOMMENDATION: Adopt Resolution.
4.4 Tri-Valley Community Television (CTV) Mid-Year Review
A total budget of $49,000 was approved by the City for CTV
programming, which includes a $1,000 grant from Viacom. As
has been done in the past, one-half of the money is paid
when the budget is adopted and the second one-half is made
following a review of CTV's performance during the first
six months of the fiscal year.
STAFF RECOMMENDATION: Review performance and authorize
payment for the second half of FY 1991-92.
4.5 Acceptance of Work Contract 91-07, Annual Sidewalk Safety
Repair and Handicap Ramp Construction
Work under Contract 91-07 has been completed to the
satisfaction of the City Engineer and within funds budgeted
for the project.
STAFF RECOMMENDATION: Accept improvements and authorize
$20,648.57 retention payment to B & B Concrete for a total
contract amount of $53,499.25.
4.6 Acceptance of Work Contract 90-05, Dublin High School Stadium
Renovation
This project has been completed to the satisfaction of the
City Engineer. The total project cost exceeded total funds
budgeted by approximately $15,000, but the FY91-92 costs
are within funds budgeted for this fiscal year.
STAFF RECOMMENDATION: Authorize approval of Change Order No.
6 for $19,454 as the total amount of Change Orders is over the
amount which the City Manager is authorized to approve; accept
improvements; authorize final progress and retention payment
of $54,454 to Collishaw Construction.
4.7 Authorization to Solicit Bids - Annual Street Overlay
Contract, Dougherty Road Bike Path Phase III, and Street
Subdrains, Contract 92-02
This project is a combination of 2 maintenance capital
improvement projects to prolong the structural section of
several City streets, plus the completion of the Dougherty
Road bike path extending to the north City limit line.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids.
4.8 Warrant Register Dated January 27, 1992
STAFF RECOMMENDATION: Approve
5. WRITTEN COMMUNICATION
5.1 Tri-Valley Joint City Council Meeting
The city of Livermore will be hosting the Tri-Valley Joint
City Council meeting on Thursday, February 27, 1992 and the
City of Dublin has been requested to indicate any items the
City would like included on the agenda.
STAFF RECOMMENDATION: Provide Staff with appropriate
direction.
6. PUBLIC HEARING
6.1 Repeal of Limited Parking and Loading Zones on Scarlett Court
The limited parking and loading zones were originally
requested by businesses which are or will no longer be
located on Scarlett Court once construction of the Dublin
Boulevard Extension commences. Removal of these special
zones will create additional on-street parking for
businesses which remain.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and ADOPT Ordinance.
6.2 Ordinance Implementing Mandatory Residential Garbage Service
The City Council has discussed the need for all residences
to receive regular garbage service. The proposed Ordinance
would require residences to subscribe to a minimum service
level costing $6.65 per month and providing for removal of
one 20 gallon can per week. The garbage company would be
required to provide service to each residence, including
curbside recycling. The proposed Ordinance includes
procedures for the City Council to assess property owners
for delinquent garbage bills. Notices were sent to all
residences not currently subscribing to garbage collection
service.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and ADOPT Ordinance to become effective in 30
days.
6.3 Dublin Zoning Ordinance Amendment Relating to Massage
Establishments PA 91-049
An Ordinance is being proposed for adoption which would
amend the Zoning Ordinance to include a definition of
"massage establishment" and to identify massage
establishment as a conditional use in the C-N, Neighborhood
Business District, C-1, Retail Business District and C-2,
General Commercial District.
STAFF RECOMMENDATION: Conduct public hearing; deliberate;
waive reading and ADOPT Ordinance.
7. UNFINISHED BUSINESS
7.1 Directly Elected Mayor - Placement of Issue on June, 1992
Ballot
In accordance with Council direction, Staff has prepared
the necessary documents to place the issue of whether
Dublin should directly elect a Mayor and 4 Councilmembers
to the voters. The electors would also determine whether
the term of office of the Mayor should be 2 or 4 years.
The cost for placing this initiative on the June 2, 1992
ballot is estimated at $3,000.
STAFF RECOMMENDATION: Consider and if appropriate, adopt
Resolutions. If election is called, authorize transfer of
$3,000 from the contingent Reserve to the Elections Activity.
7.2 Appointments to Library Planning Task Force
The City Council will review the applications received for
the Library Planning Task Force and make appointments to
the Task Force. A comprehensive study will look at the
long term library building needs in light of the City's
projected population growth.
STAFF RECOMMENDATION: Add one additional position to the Task
Force and appoint all four of the applicants to the Task
Force.
7.3 Dublin Meadows status Report
At the city Council meeting of December 9, 1991, a public
hearing was set for January 27, 1992, to consider abatement
of dangerous buildings at Dublin Meadows. It appears that
abatement is no longer necessary as construction has
resumed and no violations presently exist.
STAFF RECOMMENDATION: Direct Building Official to monitor
progress of construction.
7.4 Report on Potential Issues of Concern with the Proposed East
County Area Plan
Alameda County is proposing to completely revise the East
County Area Plan. Staff has several substantive concerns
with the policies contained in the East County Area Plan
Planning commission Policy Options Report.
STAFF RECOMMENDATION: Authorize Mayor to send letter to the
President of the Alameda County Board of Supervisors
expressing concerns.
8. NEW BUSINESS
8.1 Dublin Fine Arts (DFA) Foundation Request for Use of Civic
Center Lobby for Temporary Exhibitions
DFA is requesting use of the Civic Center lobby for
temporary exhibitions between February and August. The
proposal includes a program entitled "Dublin Collects",
where residents are encouraged to display collections.
The selection of the exhibits would be by the DFA
Community Advisory Council. The second program proposed
is an exhibit of professional artwork centered around
the theme of "Transportation".
STAFF RECOMMENDATION: Consider request and if appropriate,
approve of facility use and authorize Staff to approve
Exhibits where the value of the items displayed does not
exceed $5,000 and does not conflict with lobby use which is
already reserved.
8.2 Dublin Fine Arts (DFA) Foundation Request for Short-Term
Sculpture Exhibition and city Council Representative on the
Selection Jury
Dublin Fine Arts Foundation is requesting that the City
Council authorize them to utilize the Civic Center grounds
for a temporary sculpture exhibition. DFA would request
submittals from Artists in the area. A jury which would
include a representative of the City Council would select
the artwork to be displayed.
STAFF RECOMMENDATION: Consider request and if approved,
subject display to conditions that all installations,
including location, shall be approved by the Public Works
Department and a waiver prepared by Staff shall be completed
and signed by the Artist.
8.3 Dublin Fine Arts (DFA) Foundation Loaned Arts Program
Sculpture Agreement #3
In the past, the DFA has obtained large scale works of art
on loan from recognized Artists. DFA has located an Artist
who is willing to loan sculpture which could be placed in
the Civic Center Courtyard. DFA is requesting City Council
approval and a determination as to whether 1 or 2
sculptures should be placed.
STAFF RECOMMENDATION: If the City Council concurs with the
conditions under which the artwork will be displayed,
authorize the Mayor to execute the agreement and direct Staff
to work with DFA to complete the installation. Determine
whether 1 or 2 pieces shall be displayed.
8.4 Neighborhood Self-Help Earthquake Preparedness Program
In order to address Disaster Preparedness issues, a
workbook has been designed to be used by an individual or
family. Staff proposes that the workbook be printed and
distributed via mail to all residents of Dublin. Staff
also proposes to conduct neighborhood workshops. A
proclamation will be presented for Council consideration
declaring April as "California Earthquake Preparedness
Month", which encourages all citizens to enhance their
knowledge and awareness of proper safety measures to follow
before, during, and after an earthquake.
STAFF RECOMMENDATION: Approve a proclamation declaring April
as Earthquake Preparedness month and making it the kick-off
for implementing a Neighborhood Self-Help Disaster
Preparedness Program including printing and mail distribution
of an Emergency Preparedness Workbook in conjunction with
topic specific citizen training workshops.
8.5 status Report on Downtown Specific Plan Review Task Force Work
Program
The Task Force has developed a scope of work for each of
the sub-committees. In addition, members believe it would
be beneficial to have the City Council confirm the
participation by any business as well as a change in the
name.
STAFF RECOMMENDATION: 1) Review proposed Scope and provide
input and authorize the Task Force to proceed; 2) confirm that
Task Force participation is not restricted to businesses in
the specific Plan Area; and 3) authorize the Task Force to be
referred to as the Dublin Business Task Force.
8.6 Santa Rita Property Tax Exchange Agreement Negotiations
City and County Staff have been working on the
renegotiation of the Tax Exchange Agreement for several
months and the City Manager feels that input at the policy
level is appropriate at this time.
STAFF RECOMMENDATION: Appoint a Sub-Committee consisting of 2
Councilmembers to assist the City Manager in the renegotiation
of the Tax Exchange Agreement for the Santa Rita property.
8.7 Status Report on the Programs for the 10th Anniversary
Reception and the "Evening at the Civic"
A report will be presented to the Council by the Recreation
Director and the City Council Sub-Committee regarding the
program activities for the 10 Year Anniversary reception on
Friday, January 31, 1992 and the "Evening at the Civic" on
Saturday, February 1, 1992.
STAFF RECOMMENDATION: Receive Report.
9. OTHER BUSINESS
10. CLOSED SESSION
10.1 Pending Litigation, City vs. Schaffer, Gov't Code 54956.9(a).
11. ADJOURNMENT - The next Regular Meeting of the Dublin City Council
will be on Monday, February 10, 1992, 7:30 p.m., Council Chambers.
The Tri-Valley Joint Council meets every Monday morning at 7:30 a.m.,
(except holidays) in the Regional Meeting Room of the Dublin Civic
Center.
A Study Session will be held on Tuesday, February 25, 1992, 7:30 p.m.,
Council Chambers, for the Council to review the City'S 1991 Goals & 0
