CALL TO ORDER & CLOSED SESSION (6:30 p.m.) I. CONFERENCE WITH LEGAL COUNSEL --ANTICIPATED LITIGATION Government Code section 54956.9, subdivision (b)(1) (one potential case) Facts and Circumstances: Government Code section 54956.9(b)(3)(A) 1. CALL TO ORDER & PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Proclamation Recognizing Dublin United Soccer League for First Place Division Finishes (610-50) 3.2 Acceptance of Gift from Tri- Valley Convention and Visitors Bureau (150-70) The Tri-Valley Convention and Visitors Bureau generously donated wine for the City's 25th Anniversary Dinner. Pursuant to Government Code 37354, the City Council will formally accept the gift. STAFF RECOMMENDATION: Accept gift; and direct Staff to prepare a formal acknowledgement to donor. 3.3 Appointment of Mayor to Tri-Valley Community Television Board of Directors (110-30) For the past several years, Valerie Barnes has been City Council's appointee to the Tri-Valley Community Television Board of Directors. Ms. Barnes' current term as Dublin's representative expires at the end of February 2007, and she has elected to not seek reappointment. To fill this vacancy, the Mayor is recommending that she be appointed as the City's representative on the Board. STAFF RECOMMENDATION: Confirm the appointment of Mayor Lockhart to the Tri-Valley Community Television Board of Directors. 3.4 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of December 19,2006, Special Meeting of January 12,2007, and Regular Meeting of January 16,2007. STAFF RECOMMENDATION: Approve 4.2 Acceptance ofImprovements, Contract No. 06-09, Civic Center Window Sealing (600-35) This project replaced gaskets and sealing material on the Civic Center atrium windows. STAFF RECOMMENDATION: Accept improvements constructed under Contract No. 06-09 and authorize payment to Allied Construction Services, less retention to be paid in 35 days if no subcontractor or supplier claims received. 4.3 Informational Report: Status Update to Dublin Municipal Code, Standard Agreements and Conditions of Approval (620-20) A comprehensive update to the Dublin Municipal Code is currently underway. The City's standard agreements, standard forms, and standard conditions of approval are also to be reviewed as part of the comprehensive update. This informational report provides the Council with the status of the comprehensive update. STAFF RECOMMENDATION: Receive report. 4.4 Consulting Services Agreement with Plan B Municipal Consulting for Contract Planning Services in the Community Development Department (600-30) The City Council will consider authorizing Staff to hire an outside consultant to assist Staff with projects on an as-needed basis. STAFF RECOMMENDATION: Adopt Resolution approving Agreement with Plan B Municipal Consulting and authorizing the City Manager to execute Agreement. 4.5 City Treasurer's Investment Report for 2nd Quarter Fiscal Year 2006-2007 (320-30) The City's investment portfolio totals $117,055,392 (market value). As of December 31,2006, funds were invested at an average yield of 4.46%. This was an increase from the 4.20% reported for the fIrst quarter. STAFF RECOMMENDATION: Receive report. 4.6 Authorization to Prepare Engineer's Report for Street Lighting Maintenance Assessment District 83-1 (360-20) This assessment district pays the cost of energy and maintenance for the City's street light system except the lights that are included in Dublin Ranch Street Light Maintenance Assessment District 99- 1. This action authorizes City Staff to prepare the Engineer's Report for the 2007-08 assessment. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution directing Staff to prepare the Engineer's Annual Report for Street Lighting Maintenance Assessment District 83-1. 4.7 Authorization to Prepare Engineer's Report for Landscaping and Lighting Maintenance Assessment District 83-2 (Stagecoach Road Area) (360-20) This assessment district pays the cost of utilities and maintenance for landscaping improvements along Stagecoach Road and on the "interior slopes" of the Dublin Hills Estates development. This action authorizes City Staff to prepare the Engineer's Report for the 2007-08 assessment. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution directing Staff to prepare the Engineer's Annual Report for Street Landscaping and Lighting Maintenance Assessment District 83-2. 4.8 Authorization to Prepare Engineer's Report for Landscaping and Lighting Maintenance Assessment District 86-1 (Dougherty Road) (360-20) This assessment district pays the cost of utilities and maintenance for certain landscaping improvements associated with the Villages at Willow Creek development. This action authorizes City Staff to prepare the Engineer's Report for the 2007-08 assessment. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution directing Staff to prepare the Engineer's Annual Report for Street Landscaping and Lighting Maintenance Assessment District 86-1. February 6, 2007 Dublin City Council Agenda Page 2 of5 4.9 Authorization to Prepare Engineer's Report for Landscaping and Lighting Maintenance Assessment District 97-1 (Santa Rita Area) (360-20) This assessment district pays the cost of utilities and maintenance for certain landscaping improvements within the Santa Rita development area. This action authorizes City Staff to prepare the Engineer's Report for the 2007-08 assessment. A public hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution directing Staff to prepare the Engineer's Annual Report for Street Landscaping and Lighting Maintenance Assessment District 97-1. 4.10 Authorization to Prepare Engineer's Report for Street Lighting Maintenance Assessment District 99-1 (Dublin Ranch) (360-20) This assessment district pays the cost of utilities and maintenance for the street lighting system in Dublin Ranch and Tract 7067 (Clifden Parc). This action authorizes City Staff to prepare the Engineer's Report for the 2007-08 assessment. A pubic hearing will be held prior to the levy of assessments. STAFF RECOMMENDATION: Adopt Resolution directing Staff to prepare the Engineer's Annual Report for Street Lightening Maintenance Assessment district 99-1. 4.11 St. Patrick's Day Street Closures (950-40) Each year the City Council adopts a resolution to temporarily close the streets for the St. Patrick's Day events. Vehicle Code Section 21101(e) provides that local authorities may, by ordinance or resolution, temporarily close a portion of any street under their jurisdiction. STAFF RECOMMENDATION: Adopt Resolution authorizing temporary street closures for the 2007 St. Patrick's Day Parade and Fun Run. 4.12 Agreement with MuniFinancial for Assessment District and Fee Administration Services (600-30) This agreement provides for assessment district and fee administration services for the City's five maintenance assessment districts, the refuse collection fee, the EMS service fee, and the Dublin Boulevard Extension assessment district. The cost of the service is provided through the individual assessments or fees. STAFF RECOMMENDATION: Adopt Resolution approving agreement with MuniFinancial. 4.13 Warrant Register ($2,094,543.41) dated February 6, 2007 (300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARINGS 6.1 Ordinance Amending Section 1.04.030 of the Dublin Municipal Code Relating to Penalties for Violations of the Municipal Code (610-20) A comprehensive update to the Dublin Municipal Code (DMC) is currently underway. Staff anticipates that each chapter will include an enforcement provision, which indicates whether a violation of the chapter constitutes a misdemeanor or an infraction. Rather than listing the penalties for a misdemeanor or infraction in each chapter, the chapters will reference DMC Section 1.04.030, which establishes the general penalty provisions for the DMC. Thus, Staff recommends that DMC Section 1.04.030 be revised at the outset to properly serve as the DMC's general penalty provision. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE the Ordinance Amending Section 1.04.030 of the Dublin Municipal Code Relating to Penalties for Violation of the Municipal Code. February 6, 2007 Dublin City Council Agenda Page 3 of5 6.2 Peddlers and Solicitors Ordinance and Charitable Solicitation Ordinance (585-60) A comprehensive update to the Dublin Municipal Code (DMC) is currently underway. One chapter proposed for review is Chapter 4.16, which establishes regulations relating to peddlers within the City of Dublin. Staff recommends the amendment of Chapter 4.16 to clarify the permit requirements for peddlers and solicitors. In addition, Staff has identified the need for a charitable solicitation ordinance to encourage safe charitable solicitation to support philanthropic, social service, benevolent, patriotic, and religious activities. Both ordinances serve the City's interest in protecting the public health, safety and welfare against unlawful activities or operations by fraudulent individuals and from criminal activity including fraud and burglary. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance Amending Chapter 4.16 of the Dublin Municipal Code relating to Peddlers and Solicitors; waive reading and INTRODUCE Ordinance Adding Chapter 4.18 to the Dublin Municipal Code Relating to Charitable Solicitation. 6.3 Continue Public Hearing of Mitigated Negative Declaration for the Scarlett DrivelIron Horse Trail Extension Project and Authorization to Prepare Proposed Alignment of Public Improvements (820-90) A Mitigated Negative Declaration has been prepared for the Capital Improvement Program Project, Scarlett Drive/Iron Horse Trail Extension. In order to provide additional time to adequately address comments received during the 30-day public comment period, the City Council will consider continuing the public hearing to the March 6, 2007, meeting. STAFF RECOMMENDATION: Open public hearing; receive public comment; and continue public hearing to the March 6, 2007 Council meeting. 7. UNFINISHED BUSINESS 7.1 Dougherty Hills Park - Dog Park (920-20) In early 2006, the Parks & Community Services Commission and the City Council reviewed the conceptual plan for the Dougherty Hills Dog Park. Construction has recently been completed and the 3-month maintenance period has commenced. Staff is seeking input from the City Council on whether to install two additional drinking fountains at the park. STAFF RECOMMENDATION: Provide direction to Staff on whether two additional drinking fountains should be added to the dog park. 7.2 Area F Neighborhood Square - Authorization to Bid Contract No. 07-03 (600-35) As approved in the 2006-2011 Capital Improvement Program, construction of the 2-acre Neighborhood Square in Dublin Ranch Area F (Sorrento) will begin in Fiscal Year 2006-2007 and be complete in Fiscal Year 2007-2008. In order to meet this timeframe, Staffis seeking City Council approval to advertise for bids. STAFF RECOMMENDATION: Authorize Staff to advertise Contact No. 07-03, Area F Square for bid with the additive bid item of the trellis. 7.3 Alamo Creek Play Equipment Proposals - Contract No. 07-04 (350-20) In December 2006, Staff distributed a Request for Proposal to qualified play equipment representatives to replace the existing play equipment at Alamo Creek Park. At its January 22, 2007 meeting, the Parks & Community Services Commission recommended the Option #1 play equipment proposed by Ross Recreation in the green, tan and brown color scheme, and the toddler rock as part of the 2-5 year old area. The City Council will review the proposal and provide Staff direction on play equipment selection. STAFF RECOMMENDATION: Approve Option #1 play equipment proposal or provide alternate direction; adopt Resolution accepting proposal for equipment and authorizing City Manager to execute purchase order; and authorize Staff to seek bids for installation. NEW BUSINESS 8.1 Community Development Block Grant (CDBG) Program for Fiscal Year 2007-2008 Project Applications (480-30) The City Council will determine how to allocate $83,866 in anticipated CDBG funds for Fiscal Year 2007-2008. STAFF RECOMMENDATION: Direct Staff to submit applications to the County HCD for $83,866 in CDBG funding for Fiscal Year 2007-2008 as follows: Bay Area Community Services, $5,000; City Sidewalk Ramp Program, $10,926; Open Heart Kitchen, $10,000; Senior Support Program of the Tri-Valley, $10,476; Spectrum Community Services - Meals on Wheels, $5,578; Tri-Valley Haven. Domestic Violence/Homeless Shelter, $15,000; Housing Rehabilitation (required by the County), $14,859; Annual Contribution toward Sojourner House, $5,427; and Program Administration, $6,600; and ifthere should be a decrease in funds allocated to the City of Dublin, direct Staff to distribute the decrease evenly across all programs that do not have mandatory set amounts; and, if there should be an increase in funding, direct Staff to apply the funds to the City's Sidewalk Safety Repair and Curb Ramp Replacement Program. 8.2 St. Patrick's Day Parade Float (950-40) The City Council will consider options for entry of a City Council float in the 2007 St. Patrick's Parade to be held on March 17, 2007. STAFF RECOMMENDATION: Provide direction to Staff regarding parade float entry. 8.3 Public Records Act "Audit" of California Law Enforcement Agencies by Californians Aware (CalAware) (660-40) This report provides background information on CalAware's self-described "audit" of law enforcement agencies compliance with the Public Records Act in California and detailed information about Dublin Police Services response to the inquiry. STAFF RECOMMENDATION: Receive report. 8.4 Proposal for Implementation of Canine Program for Dublin Police Services (580-40) The City Council will receive a report discussing the need and benefits of a canine program for Dublin Police Services and consider implementation of a canine program. STAFF RECOMMENDATION: Authorize implementation of canine program. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
