PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Manager to have their particular concern placed on the agenda for a future meeting. 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes of Regular Meeting of January 26, 1987 and Adjourned Regular Meeting of January 28, 1987 STAFF RECOMMENDATION: Approve 4.2 City Treasurer's Investment Report for Period Ending January 31, 1987 STAFF RECOMMENDATION: Approve 4.3 Acceptance of Work - Tract 4859 - Authorization for Staff to Accept Maintenance Bond Improvements in Tract 4859 have been completed to the satisfaction of the City Engineer. STAFF RECOMMENDATION: Adopt resolution and authorize Staff to accept maintenance bond in connection with guarantee of work 4.4 Acceptance of Contract 85-4 Annual Street Overlay Program The City Engineer has reviewed the work on the project and determined that it lS In accordance with the approved plans, specifications and modifications. STAFF RECOMMENDATION: Accept improvements according to Contract 85-4 4.5 Federal Aid Urban (FAU) Program Supplement No.3 - San Ramon Road Phase II Project The program supplement is required in order for the City to use the allotted FAU funds for t:1i~ p~Oj0Ct.a STAFF RECOMMENDATION: Adopt Resolution approving Program Supplement No. 3 to the Local Agency- State Agreement for Federal Aid Projects No. 04-5432 and authorize Mayor to execute the Agreement. 4.6 Contract 87-2 Annual Street Overlay and Repair Program This is an annual program to repair streets that are in a deteriorated condition. STAFF RECOMMENDATION: Authorize Staff to advertise for bids 4.7 Resolution supporting concept of hosting of the 1996 Summer Olympic Games on a Regional Basis At the regular City Council meeting on January 26, 1987, Staff was requested to prepare a model resolution regarding the 1996 Olympic Games. ABAG Board of Directors has supported the concept of hosting the Games on a regional basis. They have asked cities to consider adopting resolutions supporting these efforts. STAFF RECOMMENDATION: Adopt Resolution 4.8 American Planning Association (APA) National Planning Conference, New York City 4/25-29/87 This conference, being held in New York City from April 25-29, 1987, offers seminars/workshops which can directly benefit the Staff and the City in a number of areas, including design review and urban design methods, zoning regulations, recent Supreme Court cases and planning process streamlining. STAFF RECOMMENDATION: Authorize attendance of Planning Director. 4.9 Transportation Development Act Funds 4.5 Measure B Paratransit Systems Representatives of 8 Alameda County Cities that submit claims for TDA funds are recommending the adoption of a resolution which would recommend that l)the City of Dublin recommends that the TDA 4.5 Measure B funds designated for paratransit purposes be made available to Dublin for paratransit needs; and 2) that the Alameda County Transportation Authority cooperate with each claimant to provide a high level of aid and coordination for paratransit service. STAFF RECOMMENDATION: Adopt Resolution 4.10 Warrant Register dated February 9, 1987 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 From Steve Lambert, Alameda County Coordinator of Californians for Safe Motorcycling This group has requested that the City Council consider adoption of a resolution which supports AB 36 which has been introduced by Assemblyman Floyd. This legislation would require that all motorcycle riders wear safety helmets, regardless of their age. STAFF RECOMMENDATION: Consider request to adopt resolution. 6. PUBLIC HEARING 6.1 Ordinance Repealing Campaign Contribution Ordinances No. 1-84 and No. 3-84 If this ordinance is adopted, the State Law regulating campaign contributions would be the law regulating campaign contributions in the City. Candidates would have to disclose contributions and expenditures in excess of $100 instead of $25 and the State Law does not place an upper limit on contributions candidates can receive, whereas Ordinance No. 1-84 limits contributions to $100. This ordinance was introduced at the Council meeting of January 26, 1987. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance 6.2 Ordinance Prohibiting Solicitaticn at Accident Sites This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance prohibits soliciting or offering for sale tow services or any other services at the site of a vehicle accident or other catastrophe or calamity. This ordinance was introduced at the Council meeting of January 26, 1987. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance 6.3 Ordinance Relating to Hotel and Lodging Registration This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance establishes regulation regarding hotel registration and would replace Title 4, Chapter 5, Article 1 of the Alameda County Code. This ordinance was introduced at the Council meeting of January 26, 1987. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance 6.4 Ordinance Relating to the Exposure of Portions of the Human Body This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance prohibits the exposure of certain parts of the human body in any public place, places open to the public, or places open to public view. This ordinance was introduced at the City Council meeting of January 26, 1987. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance. 6.5 Ordinance Regulating Unauthorized Use of Corpus Data This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance would make it unlawful for any unauthorized person to obtain personal data from the Criminal Oriented Records Production Unified System (Corpus) or for any person to provide such data to an unauthorized person. This ordinance was introduced at the City Council meeting of January 26, 1987. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance. 6.6 Ordinance Relating to Drinking in Public This ordinance lS part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance does not incorporate the provisions of the County Code which makes it unlawful to be in a drunken condition on publi_c strppt~f hpcausp this provision is covered by State Law. This ordinance makes it unlawful to drink intoxicating beverages on any street, sidewalk, alley or highway, or to drink intoxicating beverages on public or private property open to the public and within 1,000 feet of any City street, sidewalk, etc., and intended to be used for parking of motor vehicles, without the permission of the property owner. This ordinance was introduced at the City Council meeting of January 26, 1987. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance. 6.7 Ordinance Establishing a Procedure for Disposition of Unclaimed and Stolen Property This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinanl:e establishes broad procedures and guidelines for the disposition of unclaimed and stolen property. This ordinance was introduced at the City Council meeting of January 26, 1987. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance. 6.8 Ordinance Relating to Secondhand Dealers and Junk Dealers This ordinance is part of the comprehensive revision of the City's ordinances and development of a municipal code. This ordinance would replace Title 1, Chapter 5 of the Alameda County Code and would require Secondhand Dealers and Junk Dealers to comply with the provisions of State Law and the City's Zoning Ordinance. This ordinance was introduced at the City Council meeting of January 26, 1987. .-iTAFF RECOMMENDATION: Conduct public hearing ; waive :n -ading and adopt o:dinance. 6.9 Stop Sign on Clark Avenue at the Intersection of Maple Drive/Ebensburg Lane It is recommended by Staff to add a stop sign on Clark Avenue at Maple Drive/Ebensburg Lane. It has been requested by a neighbor to make this intersection a 3-way stop. STAFF RECOMMENDATION: Open public hearing; receive Staff presentation and public testimony; question Staff and the public; close public hearing and deliberate; continue the item to the City Council meeting of February 23, 1987 and give Staff direction regarding drafting of an ordinance for traffic control at this intersection. 6.10 Traffic Ordinance regarding Stop Signs, Parking Zones and Turning Regulations The City's Traffic Safety Committee has reviewed several locations and recommends changes in regulations. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinances on an urgency basis by one motion and instruct the City Clerk to r-.ord the vote separately for each of the 3 ordinances. 6.11 Yield Right-of-Way Signs recommended by the JHK Traffic Survey This ordinance provides for Yield Signs at several free right turn locations in the City. STAFF RECOMMENDATION: Conduct public hearing; waive reading and adopt ordinance on an urgency basis. 7. UNFINISHED BUSINESS 7.1 Request for Assistance from Dublin High School The City Council directed Staff to develop guidelines for establishment of a task force to study the need for additional outdoor sports facilities and if the grounds at Dublin High School could be upgraded to meet this need. STAFF RECOMMENDATION: I) Review Proposed Guidelines; 2) Provide direction to Staff on membership; 3) Direct Staff to obtain Amador Valley Joint Union High School District support for the Task Force 7.2 Liaison Committee Report on Reorganization of Dublin San Ramon Services District At the request of the City Council, the Liaison Committee has prepared a report which provides some background on the various proposals that have been made by the 3 agencies involved in the Dublin San Ramon Services District reorganization. The Committee will explain this report in more detail at the meeting. STAFF RECOMMENDATION: Receive report from Liaison Committee and direct Staff to send draft letter to Local 1885 of the International Association of Firefighters 8. NEW BUSINESS - None 9.
