DUBLIN CITY COUNCILDUBLIN CITY COUNCIL
REGULAR MEETING - Tuesday, February 13, 1996, 7:00 p.m.

A complete packet of information containing Staff Reports and exhibits related to each
item is available for public review several days prior to a Council meeting in the City
Clerk’s Office and also at the Dublin Library.

3.1Introduction of new Community Development Director Eddie Peabody
3.2Appointment to Parks & Community Services Commission
In December, Staff was directed to advertise an opening on the Parks & Community
Services Commission. Applications were received by the January 10 deadline from 7
people: Randy Cahn, Tom Clancy, Bob Cocilova, Bob Fasulkey, Becky Hopkins, Mark
King and Eric Swalwell. Mayor Houston has appointed Bob Fasulkey to the Parks &
Community Services Commission for a term ending in December, 1996.
STAFF RECOMMENDATION: Confirm Mayor’s appointment of Bob Fasulkey or provide
appropriate direction to Staff.
3.3Proclamation declaring February “Black History Month”
3.4Appointment to LAVTA’s “Wheels Accessible Advisory Committee” (WAAC)
LAVTA recently solicited applications for membership on this committee to represent the
City of Dublin in accordance with their bylaws and Mary E. Gibbert has applied for
membership on this committee.
STAFF RECOMMENDATION: Confirm Mayor’s appointment of Mary Gibbert to LAVTA’s
WAAC Committee and direct Staff to notify LAVTA or provide appropriate direction to Staff.
At this time, the public is permitted to address the City Council on non-agendized items. The
Council must, however, comply with all State Laws in regard to items not appearing on the
posted agenda. The Council may respond to statements made or questions asked, or may
request Staff to report back at a future meeting concerning the matter. Any member of the
public may contact the City Clerk’s Office related to the proper procedure to place an item on
a future City Council agenda. The exceptions under which the City Council MAY discuss
and/or take action on items not appearing on the agenda are contained in Government Code
Section 54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for
approval by the City Council with one single action. Members of the audience, Staff or the
City Council who would like an item removed from the Consent Calendar for purposes of
public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of January 23, 1996
STAFF RECOMMENDATION: Approve.
4.2Amendment to Benefit Plan
This amendment to the Benefit Plan would include the new Community Development
Director position among those management positions eligible to receive a monthly car
allowance.
STAFF RECOMMENDATION: Adopt Resolution.
4.3Amendments to Personnel System
Amendments are proposed to several existing job descriptions and salary ranges for part-
time positions in the Parks & Community Services Department.
STAFF RECOMMENDATION: Adopt Resolutions.
4.4Integrated Solid Waste Management Agreement
This agreement, between the City and Waste Management of Alameda County, would
provide for a recycling program operation subsidy and a one-time only grant for 1
co-collection vehicle and green waste bins. The expenditures covered by this agreement
were negotiated as part of the original agreement and they will not affect current rates.
STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute
agreement.
4.5Agreement with Berlogar Geotechnical Consultants for Analysis and Recommendations
Pertaining to Slides in Dougherty Hills Park
This work would involve investigation and recommendations for repair of four slides in
Dougherty Hills Park, two on the east side of the hill and two on the west side.
STAFF RECOMMENDATION: Approve additional $27,000 appropriation from unallocated
reserves; adopt Resolution approving agreement and authorize Mayor to execute same.
4.6Award of Bid Contract 96-01, Annual Sidewalk Safety Repair and Handicap Ramp
Construction
This contract will provide for the removal and replacement of sidewalk and curb and gutter
which has become offset and poses a potential tripping hazard. A second contract is already
in effect to grind minor concrete sidewalk offsets.
STAFF RECOMMENDATION: Adopt Resolution awarding bid to Roquemore Engineering
($54,292).
4.7Fiscal Year 1995-96 Mid-Year Budget Report
Staff has prepared a mid-year analysis of the City’s revenues and expenditures, focusing on
activities within the General Fund, which represents the largest portion of the City Budget.
STAFF RECOMMENDATION: Receive Report and approve Budget Change Forms.
4.8Acceptance of Work - Shannon Center Floor Replacement, Contract 95-08
The total cost for this project was $25,083.20, including 2 change orders.
STAFF RECOMMENDATION: Accept improvements and authorize payment of $25,083.20
to Flooring Solutions.
4.9Request for Appropriation - Costs Related to Underground Utility District 95-1
The cost of utility undergrounding is paid by CPUC Rule 20A funds; however, the cost of
installing street lighting to replace lights on the distribution poles that are being removed
must be borne by the City.
STAFF RECOMMENDATION: Approve appropriation of $12,635 from Street Light
Assessment District Reserves (Fund 710) for the City’s share of costs associated with utility
undergrounding.
4.10Warrant Register ($2,827,466.68) dated February 13, 1996
STAFF RECOMMENDATION: Approve
5.WRITTEN COMMUNICATIONS
5.1Request from Livermore Amador Valley Transit Authority (LAVTA) to Oppose
Assembly Bill 2084 regarding Transportation Development Act (TDA) Funding
AB 2084 proposes to divert an unspecified percentage of local sales and use tax revenues
from a local transportation fund into the County’s General Fund. This could affect funding
for the City’s bicycle path construction, as well as some transit programs.
STAFF RECOMMENDATION: Authorize Mayor to send letter of opposition to State
Legislators.
6.PUBLIC HEARING
6.1Dublin Ranch Phase I PD Rezone PA 95-030
Dublin Ranch is located within the Eastern Dublin Specific Plan project area, east of
Tassajara Road, approximately 4,000’ north of I-580. At the January 23 City Council
meeting, the Council introduced an ordinance approving the PD District Rezoning of an
approximate 210 acre site to PD Single Family Residential (570 dwelling units); PD
Medium Density Residential (277 dwelling units); and PD Open Space (57.5 acres), for a
maximum total of 847 dwelling units. The rezoning also includes a 5 acre neighborhood
park and a 2 acre private recreational facility.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive second reading
and ADOPT Ordinance.
6.2Caffino Inc., Specific Plan Amendment, Conditional Use Permit, Site Development
Review PA 95-040
This Specific Plan Amendment to Area 3 of the San Ramon Road Specific Plan is to allow a
drive-in and drive-through business as conditional uses; a CUP to allow a drive-in and
drive-through use in the C-1 Retail Business District; to allow the alteration or expansion of

a pre-existing use; and Site Development Review to construct a 220 square foot drive-
through espresso bar/kiosk in front of the Workbench Tru-Value Hardware Store located at
7660 San Ramon Road.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolutions
approving Negative Declaration, Specific Plan Amendment, CUP and SDR -OR- give Staff
and Applicant direction and continue the matter.
6.3Public Facilities Fee
The City Council will review the results of the Public Facilities Fee Justification Study and
consider adoption of a Public Facilities Fee to finance municipal public facilities to reduce
the impacts caused by future developments in the City of Dublin and Eastern Dublin. Such
facilities include the following: completion of the Civic Center office space, construction of
a new library and expansion of the existing library, relocation and expansion of the existing
senior center, acquisition and construction of neighborhood and community parks and
community buildings (including a community theater, a community center, a recreation
center and an aquatic center).
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution
establishing a public facilities fee.
6.4Amendment to Chapter 9.28 of the Dublin Municipal Code - Quimby Act Ordinance
Proposed amendments to the Quimby Act Ordinance pertain to the amount of land to be
dedicated, the calculation of in-lieu fees, and credits for open space and recreational
facilities.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and INTRODUCE
Ordinance.
6.5Consideration of Adoption of a Resolution of Necessity directing the Filing of Eminent
Domain Proceedings to acquire Street Lights and Street Lighting Facilities from PG&E
Acquisition of street lights and street lighting facilities by the City will reduce the annual
energy and maintenance cost, improve the standard of maintenance, and allow the City to
impose higher construction and installation standards.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution (which
requires 4/5 vote).
6.6Amendment to City of Dublin Conflict of Interest Code
This proposed amendment to the City’s Conflict of Interest Code would include the new
position of Community Development Director as a designated position required to file
Statements of Economic Interest and disclosure : A) investments in and business positions
held in business entities and sources of income which: 1) have interests in real property
located in whole or in part within the City of Dublin; 2) do business, plan to do business, or
have done business during the preceding 2 year period within the City of Dublin; and B)
interests in real property which are located in whole or in part within the City of Dublin.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and
INTRODUCE Ordinance
6.7Proposed Amendments to Title 9 (Subdivisions) of Dublin Municipal Code
These Subdivision Ordinance revisions will update the City’s Municipal Code in relation to
subdivisions to include the latest state laws and to ease the submittal requirements for
Vesting Tentative Maps.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and
INTRODUCE Ordinance.
7.UNFINISHED BUSINESS - None
8.NEW BUSINESS
8.1Request for Proposals for Audit Services
The City of Dublin has obtained audit services from the firm of Maze & Associates for the
past 9 consecutive years. The current agreement expired with the issuance of reports
related to the period ending June 30, 1995. In order to allow time for preliminary audit
work prior to June 30, 1996, Staff has prepared a Request for Proposal. The RFP provides
for the ability to select a firm to provide services for the next 5 years.
STAFF RECOMMENDATION: Review RFP and provide Staff with input on: 1) any
restrictions on the firms to be included in the proposal process; and 2) selection of a City
Council ad-hoc subcommittee to assist with the selection process.
8.2Facade Enhancement Program
In 1995, the City Council ranked the establishment of a Facade Enhancement Program as a
high priority goal. Staff reviewed programs from 5 other agencies, all of whom are using
redevelopment funds in project areas which have been classified as blighted project areas.
STAFF RECOMMENDATION: Do not implement a Facade Enhancement Program due to
lack of funds and current market conditions that are facilitating store front improvements in
Dublin without the help of a City contribution. If the City Council decides to implement a
program using General Funds, Staff recommends a minimum funding level of $25,000.
8.3Status Report of City Participation in Dublin Pride Week and Acceptance of Gift to City
Dublin Pride Week is an annual event held to promote a positive image for the City of
Dublin. A committee, comprised of a City Councilmember and City Staff as well as various
civic organizations and business leaders has been formed to coordinate and expand this
years activities. City funding of $2,500 has been budgeted, and in addition, Livermore-
Dublin Disposal has offered to match the City’s contribution.
STAFF RECOMMENDATION: Accept gift; direct Staff to prepare a formal acknowledg-
ment to the donor; approve Budget Change Form; and approve City participation in Dublin
Pride Week activities with a City contribution not to exceed $2,500.
8.4Fire Service Study
On February 13, the San Ramon City Council will consider appointing members of a Public
Safety Committee to consider a proposal from the San Ramon Valley Fire Protection
District to provide fire service to south San Ramon and possibly evaluate other fire
protection service alternatives. If the City of San Ramon concludes that it is in its best
interest to terminate the Joint Exercise of Powers Agreement and notifies the City of Dublin
prior to June 29, 1996, the effective date of the termination would be June 30, 1997.
STAFF RECOMMENDATION: 1) Authorize City Manager to undertake an analysis of
Fire/Emergency Response Service Alternatives available to the City of Dublin if the City of San
Ramon withdraws from the Dougherty Regional Fire Authority; 2) Authorize preparation of
Request for Proposal for the purpose of evaluating contract Fire and Emergency Service; and
3) Request that DRFA study the financial and service impacts on the Cities of Dublin and San
Ramon and the Authority employees if the Authority is dissolved.

On Wednesday, February 21, 1996, beginning at 5:00 p.m., in the Regional Meeting Room, the City
Council will hold a Special Meeting to review the status of the City’s 1995 Goals & Objectives and
to establish, review and prioritize the City’s Goals & Objectives for 1996. The Council will also
provide direction to Staff with regard to preparation of the 1996-97 Budget and Capital
Improvement Program.
