3.2 Public Comments
At this time, the public is permitted to address the City Council on non-agendized items. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES.
In accordance with State Law, however, no action or discussion may take place on any item not appearing on the posted agenda. The Council may
respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public
may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City
Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54,qC~.2(b)(1)(2)(3).
4. CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City
Council with one single action. Members of the audience, Staff or the City Council who would like an item
removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item,

STAFF RECOMMENDATION: Approve
4.2 Authorization to Solicit Bids, Civic Center Automatic Doors and Outdoor Electrical
Upgrade, Contract 01-01 (File 600-35)
This contract combines two projects. The first project would retrofit two sets of existing Civic
Center doors for actuated operation. The construction budget for the door project is $16,000.
The outdoor electrical upgrade would renovate the site lighting in the lawn area and add
electrical outlets for events in the plaza area. The budget for the electrical upgrade project is
$13,250.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids.
4.3 Program Supplement Agreement No. 003-M to Administering Agency - State Agreement
No. 04-5432, covering construction of the Alamo Canal Bike Path - Areadot Valley
Boulevard to Iron Horse Trail Connection (File 600-50)
The execution of this agreement is required for Caltrans to reimburse the City up to $175,000
for the construction of the bike path.
STAFF RECOMMENDATION: Adopt Resolution and authorize Director of Public Works to
execute Program Supplement Agreement.
4.4 Amendment to Agreement for 2001 St. Patrick's Day Festival (File 600-30)
Bright Moments Event Production, LLC, has acquired the assets of Terry Pimsleur &
Company, Inc., the producer of the City's annual St. Patrick's Day Festival. Ms. Terry
Pimsleur will continue to be the executive producer of the festival.
STAFF RECOh/Ih/IENDATION: Authorize the Mayor to execute an amendment to the
Agreement with Terry Pimsleur & Company consenting to the assignment of the Agreement for
event production services.
4.5 Approval of draft Disadvantaged Business Enterprise (DBE) Program for Federally
Funded Projects (File 1060-90)
The DBE Program is established to encourage small businesses owned by socially or
economically disadvantaged individuals to participate in City projects utilizing federal funds.
STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute Program.
4.6 Extension of Time - Dublin Boulevard Underground Utility District 99-1 (File 1020-30)
Due to delays in the design and right-of-way acquisition of the associated Dublin Boulevard
widening project (Village Parkway to Sierra Court), it is necessary to extend the deadline for
the undergrounding of the three cable TV services within the District.
STAFF RECOMMENDATION: Adopt Resolution extending the time limit for 12 months.
4.7 Acceptance of Work, Contract 00-15, Dougherty Road Tree Planting (File 600-35)
This project planted 54 sycamore trees along the east side of Dougherty Road between north
of Willow Creek Drive and Amador Valley Boulevard.
STAFF RECOMMENDATION: Accept improvements and authorize release of retention after
35 days if there are no subcontractor claims, and approve $980 Budget Change from unallocated
General Fund Reserves.
4.8 Agreement with Alameda Connty Congestion Management Agency for Local Fund
Exchange for the 1-580FFassajara Road Interchange Improvements Project (File 600-40)
T~s agreement provides that Dublin will exchange $4.23 million of local developer Traffic
Impact Fees in exchange for $4.7 million of federal highway monies.
STAFF RECOMMENDATION: Adopt Resolution and authorize Mayor to execute Agreement.
4.9 Amendments to the Wildfire Management Plan (File 540-70)
Under the City's vegetation removal requirements and Wildfire Management Plan, new homes must
provide up to a 100' defensible space and trees within that space must be pruned up at least 6' from
the ground. Proposed amendments to the WMP and vegetation removal standards reflect the higher
fire resistance of certain Heritage Trees, and allow residences to be built closer to specified trees
when enhanced construction and vegetation management standards are met.
STAFF RECOMMENDATION: Adopt Resolution amending the Wildfire Management Plan.
4.10 Acceptance of Improvements for Tract 7084, Dublin Greene (Toll Brothers) (File 600-60)
This project is a residential subdivision located north of Dublin Boulevard, east of Tassajara
Creek, south of Central Way and west of Glynnis Rose Drive. This action proposes to accept
the public street improvements for maintenance and allows the developer to reduce his
performance bond by 75% to guarantee the improvements from defects for the next year.
STAFF RECOMMENDATION: Adopt Resolution, release Performance Bond and accept
maintenance bond.
4.11 Warrant Register ($1,351,414.38) dated February 20, 2001 (File 300-40)
STAFF RECOMMENDATION: Approve
WRITTEN COMMUNICATIONS
5.1 Request for funding support in the amount of $2,500 from Valley Community Health
Center's Family Crisis Shelter (File 520-40)
An urgent request has been received from the Valley Community Health Center's Family Crisis
Shelter. Approval of this funding request would require an appropriation from reserves.
STAFF RECOMMENDATION: Consider request.
PUBLIC HEARING-
6.1 Commerce One Corporate Headquarters Development Agreement PA 00-015 (File 600-60)
This is the second reading of an Ordinance approving a Development Agreement between
Commerce One, Alameda County Surplus Property Authority and the City of Dublin for the
Commerce One project.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt
Ordinance.
6.2 Appeal of Planning Commission approval of the Black Mountain Site Development Review
for the construction of 7 single-family homes on 7 existing lots ranging in size from 11,635
square feet to 21,942 square feet created as lots 1 and 7 - 12 of block 1 of Tract Map 5073
PA 00-009 (File 410-30)
This item was continued from the January 16~ 2001 City Council meeting to allow revision to
plans to move homes on Lots 1~ 8 and 9 away from fire resistire Heritage Trees.
Residents of Brittany Lane filed an appeal of the approval by the Planning Commission on six grounds:
1 ) Proposed housing should be lowered from proposed elevation to reflect an elevation based on
"Natural Grade", the contour of the ground surface that existed before the lots were graded in 1985.2)
The height limit on these custom or modified homes should not exceed 25 feet if the impacts to the
views are to be properly minimized. Application of a residential exception to height limits for sloping
lots (Section 8.36.110.C.2 of the Zoning Ordinance) is incorrect. 3) Staff and Planning Commission
failed to preserve Tree 340 as required by Condition of City Council Resolution No. 82-85 and by
Section 5.60.40(b) of the Heritage Tree Ordinance and Section 8.04.020(F) of the Zoning Ordinance.
4) The failure to consider the City of Dublin Wildfire Management Plan requirement that all open space
areas shall have two points of access suitable for wildland fire access. Failure of Staff and Planning
Commission to consider proper construction requirements for buildings on lots adjacent to undeveloped
land. 5) Appellants were not allowed to present issues and points for review of the Agenda Statement.
6) Resolution of the Planning Commission of the City of Dublin approving PA 00-009 Black Mountain
Development Site Development Review for 7 single-family homes on existing lots on Brittany Lane is
not consistent with the Heritage Tree Ordinance, Dublin General Plan, Zoning Ordinance, City Council
Resolution No. 82-85 and the City of Dublin Wildfire Management Plan.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; (options for action) 1.
Decide that the Planning Commission action be AFFIRMED and adopt Resolution approving the
Black Mountain Development SDR for 7 homes on 7 existing lots with changes proposed by
Staff. - OR - 2. Decide that the Planning Commission decision be REVERSED and direct Staff
to prepare a Resolution reversing the Planning Commission decision and deny the Black Mountain
Development SDR.
UNFINISHED BUSINESS
7.1 Naming of Neighborhood Park in Dublin Ranch Phase I Development (File 920-60)
The City Council will consider names for the 5-acre neighborhood park currently under
construction in the Dublin Ranch Phase I development.
STAFF RECOMMENDATION: Select a name from the Parks & Community Services
Commission recommendations - OR - determine an alternate name.
7.2 Public Art - EXPO Design Center (File 900-50)
The City Council will consider proposed artwork for the EXPO Design Center, located
between Montgomery Wards and Target within the Dublin Place Shopping Center, as well as
potential locations on the site for the artwork.
STAFF RECOMMENDATION: Receive presentation from Artist, Ray Lamb; approve artwork -
OR - provide additional direction; direct Staff to secure a Letter of Credit to guarantee the
installation of the artwork; and provide direction on the preferred location for the artwork and
authorize the Community Development Director to work with EXPO Design Center and the
shopping center property owners to determine a location based on Council direction.
7.3 Status Report on City Intervention in 2002 Tri-Va!ley Capacity Increase Project, which
may approve a permit for PG&E to expand electricity transmission facilities in the Dublin
area (File 1020-40)
Based on Council direction, the City Attorney's Office filed a Petition to Intervene with the
Administrative Law Judge (ALJ) handling this ease and also filed Opening Testimony on the
City's behalf. The ALJ has not yet acted on the petition. Hearings begin on February 20th.
Staff will provide an update on the status.
STAFF RECOMMENDATION: Receive Report.

NEW BUSINESS
8.1 Street Banner Art Project (File 900-50)
Funds were included in the 2000-2005 Capital Improvement Program for Street banners to
include the eastern Dublin area in the City's banner program. The City Council will consider
incorporating children's artwork into the banner production and contracting with an art
consultant and artist to oversee the project.
STAFF RECOMMENDATION: Approve proposed process for Banner Art Project; select a
workshop scenario; authorize City Manager to negotiate and execute agreements with an art
consultant and artist in an amount not to exceed $20,000; and direct Staff to adjust the project
budget as part of the 2001-02 Update to the Five-Year CIP.
8.2 Martin Canyon Creek Trail Dedication (File 930-30)
One of the conditions for development of the Hansen Hills Ranch residential development
project required the developer to make improvements to the Martin Canyon Creek, develop a
creekside trail and dedicate the land to the City. The developer has completed the
improvements and the trail is ready for use by the community. Staff will report on the
dedication event for the trail.
STAFF RECOMMENDATION: Receive report and provide direction on preferred event date,
components, and commemorative item, and approve Budget Change.
8.3 Review of Planning Division Projects and Assignments (File 700-20/420-10)
The City Council will review a status report of the Planning projects and provide direction to
Staff regarding project priorities.' Part of the review will include the consideration of adding
two positions: one Associate Planner and one Planning Manager. The addition of the
Planning Manager position will require revisions to the City's Personnel System.
STAFF RECOMMENDATION: Review status of Planning projects and provide direction to
Staff regarding priorities; approve the addition of two positions in the Planning Division; and
adopt Resolution(s).
