CALL TO ORDER DUBLIN UNIFIED SCHOOL DISTRICT Board Room 7471 Larkdale Avenue 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this t:ime, members of the audience are permitted to address the City Council on any item which is not on the C:_ty Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficiellt time to address their concern, that person should arrange with the City Clerk to have their particular concern placed on the agenda for a future meeting. 3.1 Introduction of new employee, Phillip Tiewater, Public Works Inspector 3.2 Presentation by Dublin Fine Arts Foundation 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. [vlembers of the audience who would like an i tern removed from the consent calendar for purpose of public input ma:1 request the City Council to remove the item from the consent calendar. The request may be made at I:he time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 ~linutes of Adjourned Regular Meeting of January 24, 1989 STAFF RECOMMENDATION: Approve 4.2 Agreement re Implementation of Nonpoint Source Control Evaluation Program This agreement provides for Dublin's participation in the second phase of the Nonpoint Source (of water pollution) Evaluation Program. Dublin's share of the cost is $6,990 per year for 3 years. Sufficient funds for the first year have been budgeted for Fiscal Year 1988-89. STAFF RECOM~lENDATION: Adopt Resolution approving agreement and authorize Mayor to execute same. 4.3 Request for Banner Installation - American Cancer Society The American Cancer Society is requesting use of the San Ramon Road banner poles to promote their annual crusade (April 22 - May 1, 1989). STAFF RECOMMENDATION: Authorize Staff to issue encroachment permit once insurance certificate has been received. 4.4 Award of Bid - Contract No. 89-2 - Annual Sidewalk Safety Repair Program Five bids were received and the low bidder is Ambo Engineering, with a bid of $37,884.15. This bid is within funds budgeted for construction. STAFF RECO~1MENDATION: Adopt Resolution awarding bid to Ambo Engineering and authorize Mayor to execute agreement. 4.5 1988 Fall Recreation Report The Recreation Director has prepared a report containing a registration analysis/comparison of the programs offered by the Recreation Department during the past fall quarter. STAFF RECOMMENDATION: Receive Report 4.6 Agreement with Dublin Joint Unified School District to utilize Dublin Swim Center The City Council will consider approval of an agreement between the City and DJUSD for early opening of the Dublin Swim Center. STAFF RECOMMENDATION: Adopt resolution authorizing execution of the agreement. 4.7 June 30, 1988 Audit and Management Letter STAFF RECOMMENDATION: Accept and file the Audit, Management Letter and Staff's responses. 4.8 Financial Report for Period Ending June 30, 1988 STAFF RECOMMENDATION: Approve 4.9 Warrant Register dated February 27, 1989 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARING 6.1 Change of Speed Limit on Stagecoach Road (Second Reading) This proposed ordinance would establish a uniform 30 mph speed limit on Stagecoach Road. The City's traffic engineer recommends the proposed 30 mph speed limit on the basis that this limit is more in conformance with prevailing speeds and the character of the street. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT ordinance establishing a 30 mph speed limit for the entire length of Stagecoach Road within the City of Dublin. 6.2 Dublin Cyclery-Request for Variance to Section 22.19 of Ordinance No. 58-87 Charles R. Tyler, property owner at 7381 Amador Valley Boulevard is requesting a variance to Section 22.19 of Ordinance No. 58-87 which requires installation of automatic fire sprinklers throughout the existing building when an addition is Inade to an existing building which is greater than 5,000 sq ft in area. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution denying request. 6.3 Ordinance Amending Ordinance No. 10-82 Regulating the Sale and Use of Fireworks This is the second public hearing on an ordinance amending Ordinance No. 10-82 regulating the sale and use of fireworks. Recommended arnendments deal with administrative matters, a fee change, hours of operation and clean up of fireworks booths. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT ordinance. 6.4 Appeal of PA 88-054 Dublin Security Storage/Ryder Truck Kent Sign Conditional Use Permit and Site Development Review, 6055 Scarlett Court The Applicant proposed a 35 ft tall single faced freestanding sign with a 7 1/2 ft x 15 ft, or 112 1/2 sq ft sign area. The Planning Commission approved the sign with a 7 ft x 12 ft, or 84 sq ft sign area. The Applicant is appealing the Planning Co~nission action. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution upholding Planning Commission action -or- adopt modified resolution -or- give Staff and Applicant direction and continue the matter. 6.5 Hansen Ranch General Plan Amendment Study, EIR, Planned Development Prezoning, Tentative Subdivision Map No. 5766, and Annexation request for 240 dwelling units on 147 acres, west of Silvergate Drive and north of Hansen Drive (PA 87-045) At the January 24, 1989 Council meeting, the City Council directed Staff to prepare necessary resolutions to: 1) certify the EIR as complete and adequate; 2) approve the EIR Mitigation Monitoring Program; and 3) adopt the GPA related to PA 87-045 Hansen ilill kanch GPA/EIR. An addendum to the EIR is attached to the Staff Report, including a revised project description with GPA land use designations of low density, single family residential (0.5 to 3.8 DUlAc) and open space, stream corridor. The certification of the EIR includes a statement of overriding considerations in that impacts from the grading and construction of roadways through open space cannot be mitigated to an acceptable level. STAFF RECOM~lENDATION: Conduct public hearing; deliberate; adopt resolutions 1) making findings and certifying the Final EIR with a statement of overriding considerations; 2) approving the mitigation monitoring program; 3) adopting General Plan Amendments -or- give Staff and Applicant direction and continue the matter. 6.6 Abandonment of Parcell, Western Terminus of Betlen Drive; Quitclaim of Parcel 2 This item was continued from the February 13th Council meeting. The stub end of Betlen Drive west of the newly constructed Las Palmas Way (Tract 5777), is no longer needed by the City for roadway purposes. The area is proposed to be used by DSRSD as parking for their adjacent water storage tank and is to be landscaped and screened by fencing. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution abandoning the western terminus of Betlen Drive; and adopt resolution approving Quitclaim Deed and authorize Mayor to execute deed. 6.7 Ordinance increasing City Council Salaries An ordinance will be considered which would increase Councilmembers salaries by 5% for calendar year 1989. Incumbent Councilmembers would not, however, lle eligible to receive the increase until after the November 1990 election. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE ordinance 7. UNFI~ISHED BUSINESS 7.1 Dublin Swim Center Renovation The City Council will review the report prepared by Pool Consultant, August Waegemann for the proposed renovation for the Dublin Swim Center. STAFF RECOMMENDATION: Review report prepared by the Pool Consultant & provide Staff with input prior to preparation of the final scope of work and cost estimates. 8. NEW BUSINESS M.l Tri-Valley Transportation Planning Program - MemoraIldum of Understanding The Tri-Valley Transportation Council has requested that each jurisdiction adopt a Meloorandum of Understanding (MOU). The purpose of the MOU is to cooperatively address transportation planning issues. STAFF RECOMMENDATION: Consider 8.2 Dublin School Facilities Ilnprovements The City Council will review the project list and cost estimates for inlprovements on school grounds recomrnended by the Dublin Schools Facilities Task Force and make recomrnendations on project priorities. STAFF RECOMMENDATION: Provide Staff witll input on prioritization of projects. 8.3 1989-90 Budget Hearing and Contract Evaluation Staff is requesting that roeeting dates be set for the annual contract evaluations and Budget hearings during the week of June 26th, in order that these dates can be noted in the upcoming publication of the City's Spring/Summer Newsletter. STAFF RECOMMENDATION: Set Budget Hearing and Contract Evaluation dates 9. OTHER BUSINESS 10. CLOSED SESSION - Potential Litigation, Government Code Section 54956.9(c). 11. ADJOU~NMENT
