CLOSED SESSION - None 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Recognize the Participants ofthe 2006-2007 Dublin Leadership Academy (150-80) The Dublin Leadership Academy, an II-week program, was designed to inform participants about the issues facing the community, and to encourage community involvement at all levels. The last class for the third Dublin Leadership Academy was held on March 1, 2007, with 19 participants completing the class. STAFF RECOMMENDATION: Recognize the participants of the 2006-2007 Dublin Leadership Academy. 3.2 Presentation from Dublin Branch Manager Lee Jouthas on "Dublin Reads" Project (940-50) The City Council will receIve a presentation on the proposed "Dublin Reads" project sponsored by the Dublin Library. STAFF RECOMMENDATION: Direct Staff to work with Dublin Library to support project. 3.3 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meeting of Special Meeting of February 20, 2007 STAFF RECOMMENDATION: Approve March 6,2007, Dublin City Council Agenda Page 1 of5 4.2 Approval of a Resolution Authorizing Application to the State of California Department of Housing and Community Development for a Workforce Housing Reward Program Grant (430-20) The City Council will review a Resolution to authorize the City's Application to the State of California Department of Housing and Community Development for a Workforce Housing Reward Program Grant. STAFF RECOMMENDATION: Adopt Resolution authorizing Application for Workforce Housing Reward Grant and authorizing the City Manager to execute the application. 4.3 Declaration of Weeds and Combustible Refuse as a Public Nuisance (540-50) In accordance with Dublin Municipal Code Section 5.70.030, the City Council may declare that there is a public nuisance created by weeds and combustible debris growing, accumulating upon the streets, sidewalks and property within the City of Dublin. STAFF RECOMMENDATION: 1) Adopt Resolution declaring weeds and combustible refuse a public nuisance and requiring the abatement thereof; 2) Direct Staff to notify the public of the adoption of this Resolution; and 3) Schedule public hearing for the April 17, 2007, City Council meeting at which time the Council will hear and consider objections ofthis abatement order. 4.4 Authorization to Solicit Bids - Contract No. 07-05, 2006-2007 Annual Sidewalk Safety Repair Program and Curb Ramp Installation (600-35) The Annual Sidewalk Safety Repair Program (remove and replace) repairs sidewalk offsets of %-inch or more that may post a tripping hazard. This year's Sidewalk Safety Report Program will include the construction of approximately seven (7) pedestrian curb ramps. STAFF RECOMMENDATION: Adopt Resolution establishing the City-paid sidewalk safety repair policy for FY 2006-2007; and authorize Staff to advertise for bids for the FY 2006-2007 Annual Sidewalk Safety Repair Program and Curb Ramp Installation. 4.5 Approval of Final Map and Tract Improvement Agreement, and Acceptance of Parkland Dedication and Credits for Tract 7646, Sorrento at Dublin Ranch, Neighborhood 5 (Toll Brothers) (600-60) Tract 7646 is the subdivision map for Neighborhood 5 of Toll Brothers' Sorrento at Dublin Ranch, situated on the west side of Grafton Street between Palermo Way and Capoterra Way. Tract 7646 subdivides 4.54 acres into 4 lots for 96 residential condominium units. The City Council will also consider the acceptance of parkland dedication and credits to satisfy a Condition of Approval for this development. STAFF RECOMMENDATION: Adopt Resolution(s) Approving the Final Map and Tract Improvement Agreement, and Accepting Parkland Dedication and Credits for Tract 7646. 4.6 Stage 1 Planned Development Amendment/Stage 2 Planned Development Plan for Wallis Ranch for PA 05-051 (450-30/420-30/410-55) The City Council will consider adopting an Ordinance approving a Stage 1 Planned Development Amendment and a Stage 2 Planned Development Plan for the Wallis Ranch proj ect. STAFF RECOMMENDATION: Waive reading and adopt Ordinance approving the Stage 1 Planned Development Amendment and a Stage 2 Planned Development Plan for the Wallis Ranch proj ect. 4.7 Adoption of Resolution Authorizing the Investment of Monies in the State of Local Agency Investment Fund (LAIF) The City Council will consider adoption of a Resolution which specifies the authorization to use the State Treasurer Local Agency Investment Fund. This is an administrative update requested by the State Treasurer Office. The City has used LAIF as an investment since inception. STAFF RECOMMENDATION: Adopt Resolution authorizing the investment of monies in the State of California Local Agency Investment Fund. March 6, 2007, Dublin City Council Agenda Page 2 of5 4.8 Amendment to the leMA Retirement Corporation 457 Plan and Trust (720-30) The City Council will consider the adoption of ICMA's amended model 457 plan document. This is a deferred compensation program, which is made available to employees. Participation is voluntary and contributions are from employee withholding. The plan is being updated to comply with legal requirements and to provide sponsors and participants with additional plan flexibility. STAFF RECOMMENDATION: Adopt Resolution approving amendment to the ICMA Retirement Corporation 457 Plan and Trust. 4.9 Amendment to the ICMA Retirement Corporation 401(a) Governmental Money Purchase Plan and Trust (720-30) The City Council will consider the adoption of ICMA's amended model 401(a) plan document. This is a tax-deferred retirement plan that is made available to employees. Participation is voluntary and contributions are from employee withholding. The plan is being updated to comply with legal requirements and to provide sponsors and participants with the most flexible plans allowed by law. STAFF RECOMMENDATION: Adopt Resolution approving amendment to the ICMA Retirement Corporation 401(a) Governmental Money Purchase Plan and Trust. 4.10 Warrant Register ($6,075,286.63) dated March 6, 2007 (300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARINGS 6.1 Proposed Ordinance Repealing and Replacing the Density Bonus Regulations (610-20) The City Council will consider adopting an Ordinance repealing Chapter 8.52 of the Dublin Municipal Code (Zoning Ordinance) and adding Chapter 8.52 of the Dublin Municipal Code relating to Density Bonus Regulations. STAFF RECOMMENDATION: Conduct public hearing; deliberate, waive reading and INTRODUCE Ordinance repealing Chapter 8.52 of the Dublin Municipal Code and Adding Chapter 8.52 of the Dublin Municipal Code (Zoning Ordinance) relating to Density Bonus Regulations. 6.2 Adopt Mitigated Negative Declaration for the Scarlett Drive/Iron Horse Trail Extension Project and Authorize Preparation of Proposed Alignment of Public Improvements (820-90) A Mitigated Negative Declaration has been prepared for the Capital Improvement Program Project, Scarlett Drive/Iron Horse Trail Extension. This project will extend Scarlett Drive and relocate and enhance a portion of the Iron Horse Trail as a connection between Dougherty Road and Dublin Boulevard (within the old Southern Pacific Railroad Right-of-Way corridor). STAFF RECOMMENDATION: Conduct public hearing; deliberate; and adopt Resolution approving the Mitigated Negative Declaration; and authorize Staff to prepare a Precise Plan AlignnIent for the Scarlett Drive/Iron Horse Trail Extension between Dublin Boulevard and Dougherty Road for review and action by the Planning Commission and City Council. March 6,2007, Dublin City Council Agenda Page 3 of5 6.3 Peddlers and Solicitors Ordinance and Charitable Solicitation and Sales Ordinance (585-60) A comprehensive update of the Dublin Municipal Code (DMC) is currently underway. This will be a second review of Chapter 4.16 which established regulations relating to peddlers and solicitors within the City of Dublin. The proposed Ordinances include the City Council's comments and direction provided to Staff at the February 6, 2007 meeting. Both Ordinances serve the City's interest in protecting the public health, safety and welfare against unlawful activities or operations by fraudulent individuals and from criminal activity including fraud and burglary. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance Amending Chapter 4.16 of the Dublin Municipal Code relating to Peddlers and Solicitors; waive reading and INTRODUCE Ordinance Adding Chapter 4.18 to the Dublin Municipal Code Relating to Charitable Solicitation and Sales. 7. UNFINISHED BUSINESS 7.1 Campbell Green (formerly Village Green) Alternative Play Structures, P A03-058 (350-20) The City Council will review and consider an alternative play structure for a play dome for the Campbell Green (formerly Village Green) I-acre open space area located within Dublin Transit Center Site B 2, Avalon @ Dublin Station. STAFF RECOMMENDATION: Provide direction to Staff on which play structure the City Council prefers for Campbell Green and direct Staff to process a Site Development Review Waiver as appropriate. 7.2 Area G Neighborhood Square - Design Presentation (600-30) The Council will receive a presentation of the preferred Alternative for the 2-acre Neighborhood Square in Area G located at Finnian and Chancery Way. Staff is seeking approval of the plan and authorization to begin construction documents. STAFF RECOMMENDATION: Approve preferred alternative and authorize Staff to prepare construction documents. 7.3 Dublin Pride - Integrity in Action Program (130-30) The City Council will consider the recommendation of the Parks and Community Services Commission on how the Dublin Pride - Integrity in Action program can be incorporated into City programs. STAFF RECOMMENDATION: Provide Staff with direction on implementation of the Dublin Pride - Integrity in Action program; approve Budget Change or direct Staff to include funds in the Fiscal Year 2007-2008 budget for the program. 7.4 Authorize the Filing of a Grant Application for Federal Surface Transportation Program and/or Congestion Mitigation and Air Quality Improvement Funding and Committing the Necessary Local Match for the Projects and Stating the Assurance of the City of Dublin to Complete the Projects (1060-90) In order to receive $3.0 million of federal funds for the East and West Dublin BART Station Corridor Enhancement projects, the City is required to adopt a resolution authorizing the filing of an application for federal funding for the two projects, committing the necessary local match for the projects, and stating the assurance of the City to complete the projects. STAFF RECOMMENDATION: Adopt the Resolution authorizing the filing of an application for federal funding, committing the necessary non-federal (local) match for the East West Dublin BART Station Corridor Enhancement projects, and stating the assurance of the City to complete these projects. NEW BUSINESS 8.1 Dougherty Hills Dog Park Grand Opening (950-40) The City will consider holding a grand opening for the Dougherty Hills Dog Park. The Council will consider potential dates for the opening. STAFF RECOMMENDATION: Provide Staff direction as to date of Dog Park grand opening. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from eouncil and/or Staff, including eommittee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
