If any person feels that this is not suf f ic ient time to addres s the ir concern, tha t person should arrange vJi th the Ci ty Clerk to have the i r particular concern placed on the agenda for a future meeting. 3.1 Presentation of Proclamation "AH.C-lvlental Retardation Awareness Honth" 3.2 Presentation by Betty Croley, Alameda County Planning Department, on Final Alameda County Hazardous Waste Management Plan STAFF RECOMMENDATION: Hear Staff and County presentations, pose questions, identify all Council concerns and direct Staff to write a letter to the Alameda County Waste Management Authority specifying all Council concerns. 4. CONSf:NT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. The request may be made at :he time that the Mayor asks the audience members if there is anyone interested in removing an item fraIl! the Consent Calendar. 4.1 Minutes of Regular Meeting of February 13, 1989 STAFF RECOMMENDATION: Approve 4.2 l{equest from Rowell Ranch Rodeo Committee to install Banner advertising Rodeo on San Ramon Road Banner Poles The Kowell Ranch Rodeo Committee is requesting use of the San Ramon Road banner poles for the \veeks of nay 7th & 14th to advertise their Rodeo \vhich is being held Hay 20 & 21 at the ~odeo Park. STAFF RECOl'll''1ENDATIOl~: Approve request and authorize Staff to issue encroachment permit once insurance certificate has been received. 4.3 Claim #0041DU received February 21, 1989 from Pacific Bell This claim is the result of construction work performed by Gallagher & Burk, Inc., the general contractor for the San Xamon Road Phase III project. While digging storm drain trench, Gallagher & Burk Ilit 1500 pair cable with backhoe. STAfF RECOMMENDATION: Deny claim and direct Staff to notify claimant and the City's Insurance Provider. 4.4 Contract 89-4 Annual Slurry Seal Program Slurry seal is a preventive maintenance technique used to prolong the life of a street. The estimated cost of the project, $50,000, is within funds budgeted. STAFF RECOMMENDATION: Authorize Staff to advertise for bids. 4.5 City Treasurer's Illvestment Report for Period Ending February 2d, 1989 STAFF ~ECOMMENDATION: Approve 4.6 Stagecoach Park - Kecluest for Budget Transfer to make final payment to aafanelli & Nahas In December, 1987, the City Council accepted ilnprovements constructed by Rafanelli & Nahas in Stagecoach Park and authorized payment of their final invoice. STAFF l-{ECOl'klENDATION: Authorize budget transfer in the amount of $4,978.b1 from unallocated reserves. 4.7 Agreement with Jones Hall Hill & lJhite for the purpose of determining the arbitrage calculations of the refinanced Certificates of Participation The Internal l:Zevenue Codes require that the issuer of tax excmpt bonds perform a calculation annually. The result of the calculations determine \vhc~ther the bonds retain their tax exempt status. STAFF I(ECCJi'W1ENDATIOU: Authorize the i-layor to sign the Arbitrage Agreement \vith Jones Hall Hill & i"Jhite to perform the calculations and submit the reports. 4.3 Request for Waiver of Competitive Bid Provision of City Purchasing Ordinance for purpose of purchasing replacement Pool Pumps StafE is requesting that the City Council authorize a waiver of the section of the City's Purchasing Ordinance \vhich requires competitive bids be solicited for purchases over $5,000. The cost of the pool pUrnps is $(),569.80. Due to changes in the ownership of public facilities it is appl:"opria te to amend the schedule or fac i 1 i ties serviced. STi\FFl{ECOtE"iENDATION: Authorize tvlayor to execute an Al1lendlflent to the Agreement dated ['ilarch 10, 1986 for Collection & Disposal of Waste (aevision to Schedule 1) and authorize City Manager to execute Amendment for Special Pick-ups. 4.10 l-'lanageffient Audit of Development Services In accordance with the City Council direction, a Request for Proposal was circulated. A subcommittee met with the providers to evaluate their proposals. The purpose of the audit will be to evaluate the provision of Planning services within the City. STAfF RECOMMENDATION: Approve Agreement with ~lughes, Heiss & Associates and authorize Mayor to execute same. 4.11 Warrant Register dated March 13, 1989 STAff RECor,H.IENDATION: Approve 4.12 financial Report for February, 1989 STAfF RECOMMENDATION: Approve 5. \-JRITTEN COHHUNICATIONS 5.1 Request from California Youth Soccer Association to Waive field Use Fees at Dublin Sports Grounds The City Council will consider a request to waive field use fees for the Far West Regional Soccer Championships. STAfF RECOMMENDATION: Consider request 6. PUBL1C HEARING 6.1 Appeal of PA 88-150 Goodwill Industries Donation Station ConditioIlal Use Permit, 7745 Amador Valley Boulevard The Applicant proposed to locate a 25' long truck trailer for a Donation Station in the Shamrock Village Shopping Center near the Goodwill Store. The Planning Commission approved, with conditions, the Applicant's request. Three different Ilearby business owners have appealed the Planning COlt1i1lission action. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution upholding Planning Commission action -OR- give Staff and Applicant direction and continue the matter. 6.2 Request for Variance to Section 3301(c) of the 1985 Uniform Building Code relating to the distance between required exits at 6800 Sierra Court Bill Garaway, Contractor, is requesting a Variance on behalf of the owner who is objecting to installing a 3' exit door in an existing roll-up door because of security reasons. The overall diagonal of the approximately 72' x 96' space is 120'; therefore, the exit doors are requireJ to be 60' apart. STAFf RECOt,L.IENDATION: Conduct public hearing; deliberate; adopt l{esolution denying Variance. 6.3 Ordinance Increasing City Council Salaries This Ordinance would provide for a 5% increase to Councilmernbers salaries for calendar year 1989. Incumbent Councilmernbers would not, however, bc eligible to receive the incrcase until after the November 1990 election. STAFF RECO~lMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT Ordinance. 6.4 Amend Zoning Ordinance No. 4-87 by changing penalty for failing to install street address numbers on existing buildings from a misdellleanor to an infraction This amendment \'Jould change the penalty for failing to installing address numbers on existing buildings from a misdemeanor to an infraction. STAFF ~ECO~lMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 6.5 Amend Zoning Ordinance No. 7-86 and 7-87 This amendUlent would delete Section 8-87.87 of the Zoning Ordinance making violation of sign regulations an infraction. N E ~~ bUS IN E S S 8.1 City Participation in Dublin Pride ~Jeek [\layor i'.Joffatt has been 'vJorking \,vith cOI1l11lunity representatives to sponsor a Dublin Pride ~Jeek A~ril 15-22, 1989. The ~Jayor has requested that the City contribute up to $2,500 towards tl1is campaign. In addition, it is requested that authorization be granted for use of the City seal on special trash bags. '- Consideration of a 200 S?ace BART Park & Ride Lot Mayor ~loffatt has requested that the Council discuss whether it is interested in working wittl BART to study the feasibility of developing a 200 space BART Park & Ride lot on the downtown BAdT Station site. The City litigated the proposed 750 space BART Park & Ride lot facility on this same site sometiltle ago. STAFf RECOM~lENDATION: Discuss and provide Staff with appropriate direction. 9.
