ORAL COMMUNICATIONS 3.1 Acknowledge Rotary Superstars - DUSD, ACL, Police, Fire and City Personnel (610-50) 3.2 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE !31 MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes -None 4.2 Award of Bid -Contract No. 10-01, Fiscal Year 2009-2010 Annual Sidewalk Safety Repair Program (600-35) On February 16, 2010, the City Council authorized Staff to solicit bids for Contract No. 10- 01, Fiscal Year 2009-2010 Annual Sidewalk Safety Repair Program. This year's Annual Sidewalk Safety Repair Program (CIP No. 949101) will remove and replace approximately 3,100 square feet (s.f.) of sidewalk with offsets of 3/4-inch or more that may pose a tripping hazard. March 16, 2010 Dublin City Council Agenda Page 1 of 4 STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 10-01, Fiscal Year 2009-2010 Annual Sidewalk Safety Repair Program to RP Engineering Contractors Inc.; and authorize the City Manager to execute the agreement. 4.3 Annual Progress Report on the Status of the Dublin General Plan and Housing Element for Calendar Year 2009 (420-30) The City Council will review the Annual Progress Report on the status of the Dublin General Plan and Housing Element for Calendar Year 2009 in accordance with Government Code Section 65400(b). STAFF RECOMMENDATION: Accept the Annual Progress Report on the status of the Dublin General Plan and Housing Element Compliance for Calendar Year 2009; and direct Staff to forward the Annual Progress Report to the California State Office of Planning and Research and the California Department of Housing and Community Development. 4.4 Resolution of Local Support -Jobs for Main Street Act of 2010 Funding (600-35/820-20) The City of Dublin has applied for a grant from the Federal Stimulus II (Jobs for Main Street Act of 2010) Program to be used for the repair and resurfacing of Village Parkway and Scarlett Court. This work also includes the upgrading of curb ramps along these two streets to ADA Guidelines. STAFF RECOMMENDATION: Adopt Resolution of Local Support Jobs for Main Street Act of 2010 Funding, Authorizing the Filing of an Application for Federal Jobs for Main Street Act of 2010 Funding and Stating the Assurance to Complete the Project; and authorize Staff to advertise for bids for this project once funding has been acquired and the project bid documents have completed. 4.5 Approval of Cooperative Agreement with the California State Department of Transportation (Caltrans) and Approval of Consultant Agreement for Design Engineering Services with BKF Engineers, for the Village Parkway-Amador Valley Boulevard Stormwater Treatment Project, CIP No. 960009 (600-50) Caltrans will provide to the City of Dublin funding in the amount of $647,800 for the installation of two water quality storm drain manholes in the Village Parkway/Amador Valley Boulevard neighborhood as mitigation for construction of High-Occupancy Vehicle (HOV) Lanes on Interstate 680. Approval is needed by the City Council of a Cooperative Agreement with Caltrans and also a consultant contract with BKF Engineers to complete the design for the work. STAFF RECOMMENDATION: Adopt Resolution Approving Cooperative Agreement Between the City of Dublin and State of California Department of Transportation (Caltrans) for Village Parkway/Amador Valley Boulevard Stormwater Treatment CIP Project 960009; and Adopt Resolution Approving Agreement with BKF Engineers for Consulting Services for Village Parkway/Amador Valley Boulevard Stormwater Treatment CIP Project 960009. 4.6 Check Issuance Reports and Electronic Funds Transfers (300-40) STAFF RECOMMENDATION: Review and authorize the issuance of payments. 5. PUBLIC HEARINGS 6.1 Resolution Adopting Revisions to the Eastern Dublin Traffic Impact Fee (EDTIF) and Area of Benefit Fee (390-20) The City Council, in adopting the 2009 Update to the Eastern Dublin Traffic Impact Fee, directed Staff to determine if a fee reduction for residential development within the Eastern Dublin Transit Center was warranted due to lower vehicle trip generation. Staff has prepared the 2010 Update, which provides a 25% trip reduction rate for the Transit Center, resulting in a total fee reduction of 27% for residential development within the Transit Center. The fee for all other development will be reduced by 1-3% based on minor adjustments to construction costs. Additional adjustments are also proposed as they relate to classifications of uses STAFF RECOMMENDATION: Conduct public hearing; determine value of protests (to Area of Benefit Fee only); deliberate; and adopt Resolution Revising the Traffic Impact Fee and Area of Benefit Fee for Future Developments with the Eastern Dublin Area, as Previously Established by Resolution No. 1-95 and Revised by Resolution No. 41-96, Resolution No. 225-99, Resolution No. 111-04, and Resolution No. 41-09. 7. UNFINISHED BUSINESS 7.1 Report on the Digital Infrastructure and Video Competition Act (DIVCA) (1050-20) The City Council will receive a report on the Digital Infrastructure and Video Competition Act of 2006 (DIVCA) and its impact on local access programming within the City of Dublin. In addition, the City Council will be informed about federal legislation being considered that will affect the provision of local cable television programming. STAFF RECOMMENDATION: Receive the report. 8. NEW BUSINESS 8.1 Designation of No Parking Zones on Brannigan Street (590-20) The City received a request that measures be taken to improve sight distance at the intersection of Brannigan Street and Aviano Way. Afield investigation confirmed the need to improve sight distance at this intersection since vehicles are usually parked along the east side of Brannigan Street north and south of Aviano Way. A designation of one 40-foot "No Parking" zone on Brannigan Street immediately south of Aviano Way and one 15-foot "No Parking" zone on Brannigan Street immediately north of Aviano Way would improve sight distance at this intersection. STAFF RECOMMENDATION: Adopt Resolution Approving Parking Regulation on Brannigan Street. 8.2 Healthy Cities and Communities (585-95) The City Council has proposed a high priority objective to implement a Health and Wellness program (i.e. Healthy Cities, Healthy Communities Network, etc.). The City Council will receive a report on the strides the City has made to provide a healthy environment for City residents and also receive information on various programs related to healthy cities. STAFF RECOMMENDATION: Receive the report and provide direction to Staff on how to pursue the proposed objective related to a City Health and Wellness program. 8.3 2010 Day on the Glen Event (150-80) The Day on the Glen event was started in 2001 as a one-day festival at Emerald Glen Park. In 2002 the event was expanded to two days and it has remained atwo-day event since then. The City Council will consider whether the Day on the Glen event should be discontinued in 2010 as a cost savings measure in light of a projected budget deficit of between $3.1 million and $4.6 million in Fiscal Year 2010-2011. STAFF RECOMMENDATION: Receive the report and provide direction on whether to discontinue the Day on the Glen event for 2010. March 16, 2010 Dublin City Council Agenda Page 3 of 4 8.4 Report on Development Agreement Process (600-60) At the February 2, 2010 City Council meeting, Mayor Sbranti requested that Staff bring back an item for the City Council to consider the City's development agreement process. STAFF RECOMMENDATION: Approve a new high priority Goal and Objective, under General Government, Administration, to "conduct a Study of the City's development agreement process." 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
