ORAL COMMUNICATIONS 3.1 Introduction of New Employee: Nicole Woolf, Public Works Technician I (700-10) 3.2 Presentation by Dublin Police Services on Identity Theft (580-60) STAFF RECOMMENDATION: Receive report and provide comments. 3.3 Update Presentation of Tri- Valley Adolescent Health Initiative Activities and Consideration of a Request to Appoint Two City Councilmembers as Members of a Regional Work Group for the Tri-Valley Adolescent Health Initiative (560-10/110-30) The purpose of the Tri- Valley Adolescent Health Initiative is to engage the youth in the Tri- Valley in the planning process on health and wellness services for the adolescents living in the Tri- Valley region. Alameda County Supervisor Scott Haggerty and Alameda County Health Care Services Agency Director Dave Kears have requested the appointment of no more than two governing bodies from the Cities of Dublin, Livermore, and Pleasanton and the respective School Districts to serve on a Regional Work Group for the Tri-Valley Adolescent Health Initiative. STAFF RECOMMENDATION: Receive the presentation and confirm Mayor's appointment of two City Councilmembers to the Regional Work Group for the Tri-Valley Adolescent Health Initiative for a limited time for a period ending December 2007. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Special Meeting of February 20, 2006. STAFF RECOMMENDATION: Approve 4.2 Proposed Ordinance Repealing and Replacing Density Bonus Regulations (610-20) The City Council will consider adopting an Ordinance repealing Chapter 8.52 of the Dublin Municipal Code (Zoning Ordinance) and adding new Chapter 8.52 of the Dublin Municipal Code relating to Density Bonus Regulations. The City Council conducted a public hearing, waived the first reading and introduced the proposed Ordinance at its March 6, 2007 meeting. STAFF RECOMMENDATION: Waive second reading and adopt Ordinance Repealing Chapter 8.52 of the Dublin Municipal Code and adding new Chapter 8.52 of the Dublin Municipal Code (Zoning Ordinance) relating to Density Bonus Regulations. 4.3 Amendment to Dublin Municipal Code Pertaining to Peddlers and Solicitors Ordinance and Addition of Charitable Solicitation and Sales Ordinance (585-60) A comprehensive update to the Dublin Municipal Code (DMC) is currently underway. At its March 6, 2007 meeting, the. City Council conducted a public hearing, waived the first reading and introduced Ordinances amending Chapter 4.16 of the DMC relating to Peddlers and Solicitors and adding Chapter 4.18 to the DMC relating to Charitable Solicitation and Sales. STAFF RECOMMENDATION: Waive second reading and adopt Ordinance Amending Chapter 4.16 of the Dublin Municipal Code relating to Peddlers and Solicitors; and waive reading and adopt Ordinance Adding Chapter 4.18 to the Dublin Municipal Code relating to Charitable Solicitation and Sales. 4.4 Agreement for Street Sweeping and Parking Lot Sweeping Services (600-30) Universal Building Services has provided street sweeping and parking lot sweeping services to the City of Dublin for the past five years. The proposed new rates would decrease the total cost of street sweeping services. This is a new five-year agreement that would begin July 1, 2007 and continue until June 30, 2012. STAFF RECOMMENDATION: Adopt Resolution approving agreement with Universal Building Services for Street and Parking Lot Sweeping Services. 4.5 Annual Progress Report on the Status of the Dublin General Plan and Housing Element Compliance (420-30) The City Council will review and consider accepting the Annual Progress Report on the status of the Dublin General PLAN and Housing Element Compliance for Calendar Year 2006 in accordance with Government Code Section 65400(b). STAFF RECOMMENDATION: Accept Annual Progress Report on the Status of the Dublin General PLAN and Housing Element Compliance; and direct Staff to forward the Annual Progress Report to the California State Office of Planning & Research (OPR) and the California Department of Housing and Community Development (HCD). March 20, 2007 Dublin City Council Agenda Page 2 of5 4.6 Approval of Utility Agreement with Pacific Gas & Electric Company for the Relocation of Existing Electrical Facilities within 1-580/Fallon Road Interchange Improvements Project Limits (600-30) The City of Dublin plans to improve the 1-580/Fallon Road Freeway Interchange to mitigate the Dublin Ranch area development. The proposed improvement would require the relocation of several overhead utility lines owned by Pacific Gas and Electric Company (PG&E) along the north edge of the freeway. A Utility Agreement with PG&E is required in order to reimburse PG&E for half of the actual costs for this work. STAFF RECOMMENDATION: Adopt Resolution approving Utility Relocation Agreement with PG&E and authorizing City Manager to execute said agreement. 4.7 Authorization to Solicit Bids - Contract No. 07-06, 2006-2007 Annual Street Overlay Program (600-35) This program will remove and replace failed asphalt concrete pavement, resurface the entire street with 1 12" of asphalt concrete, and re-stripe pavement markings on various City streets. STAFF RECOMMENDATION: Authorize Staff to solicit bids for Contract No. 07-06, 2006- 2007 Annual Street Overlay Program. 4.8 Fiscal Year 2006-07 Mid-Year Budget Review and December 2006 Monthly Report of Financial Activities (330-50) Staff has prepared a Mid-Year Budget Review to identify any material deviations from the adopted Fiscal Year 2006-07 Budget. The primary focus of the report is on the General Fund, which accounts for the majority of City operations. Staff has identified proposed adjustments to Revenues and Expenditures. This item also provides the report ofthe financial statements for the month of December 2006. STAFF RECOMMENDATION: Approve Budget Change and an Operating Transfer of$1,097. 4.9 Warrant Register ($996,009.08) dated March 20, 2007 (300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS 5.1 Request for the Placement of Purple Ribbons on City Street Trees to Recognize the American Cancer Society's "Paint the Town Purple" Campaign (130-60) The City Council will consider the American Cancer Society's request for the placement of Purple Ribbons on City street trees to recognize the "Paint the Town Purple" Campaign. STAFF RECOMMENDATION: Provide Staff with direction regarding the placement of Purple Ribbons on City street trees. 5.2 Donation of Piano to City (150-70) The City Council will consider the donation of a baby grand piano and notify the donor of the Council's action. STAFF RECOMMENDATION: Determine if the City should accept the donation of the piano and notify the donor of the Council's action. 6. PUBLIC HEARINGS 6.1 Shannon Community Center - Environmental Review and Award of Bid (210-30/600-35) The Council will receive a presentation of the CEQA documentation by the City's Environmental Consultant and conduct a public hearing for the Shannon Community Center project; and Council will also evaluate and award the base bid and alternates from Sierra Bay Contractors, Inc. who was the low bidder for the project. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution adopting the Mitigated Negative Declaration and the Mitigation Monitoring and Reporting Program; adopt Resolution awarding Base Bid and Alternates, as appropriate; and approve Budget Change. UNFINISHED BUSINESS 7.1 Possible Incorporation of the Village Parkway Specific Plan Area into the Future Downtown Dublin Specific Plan (410-55) The City Council will provide Staff with direction regarding whether to incorporate the existing Village Parkway Specific Plan area into the scope of work for the preparation of the future Downtown Dublin Specific Plan, or to leave the Village Parkway Specific Plan as a separate planning area from the future Downtown Specific Plan. STAFF RECOMMENDATION: Provide direction to Staff to either: a) Incorporate the Village Parkway Specific Plan area into the future Downtown Dublin Specific Plan; or b) Leave the Village Parkway Specific Plan as a separate planning area from the Downtown Dublin Specific Plan. 7.2 Presentation Regarding Geologic Hazard Abatement Districts (GHAD) and Potential Annexation of Additional Parcels (360-60) Pursuant to the City Council's direction at the December 5, 2006, Regular Council meeting, this presentation will discuss the feasibility of annexing additional parcels to a pre-existing GHAD to allow property owners to make an informed decision whether to pursue a GHAD. STAFF RECOMMENDATION: Receive the presentation. 7.3 Consultant Services Agreement for the Park & Community Services Needs Assessment (600-30) The City Council has a high priority objective to conduct a Parks & Community Services Needs Assessment. This would provide a community-based assessment of the recreation and cultural arts programs the City currently offers and recommendations for future programs that the City should design and implement. Staff received proposals from eight firms for the proj ect. STAFF RECOMMENDATION: Adopt Resolution approving Agreement with National Research Center. 7.4 Proposed Impact Fee Assistance Program for Second Units (430-60) At the City Council meeting of January 16, 2007, Staff presented a report on options for a proposed Impact Fee Assistance Program for Second Units funded from the Inclusionary Zoning In-Lieu Fee Fund. The City Council directed Staff to work with the Housing . Committee on proposed recommendations and then report back to the City Council. The City Council will consider the Housing Committee's recommendations. STAFF RECOMMENDATION: 1) Determine whether the City's Inclusionary Zoning In-Lieu Fee Fund should be used to subsidize second unit impact fees; 2) Determine the amount of subsidy to be granted based on the percentage of fee assistance and the size of the unit to which the fee assistance applies; 3) Determine an amount for each fiscal year to allocate toward the Impact Fee Assistance Program (IFAP); and 4) Determine whether a 30 year rent restriction should be a condition of receiving assistance. 7.5 Dublin Civic Center - Workspace Programming Report (600-30) As approved in the 2006-2011 Capital Improvement Program, the Dublin Civic Center Workspace Programming Study provides a recommendation to accommodate the space needs associated with the growth in staffing levels through 2026. The process for the Work Space Programming Study included an evaluation of population data, projected staffing needs, storage requirements, work functions and technological options. STAFF RECOMMENDATION: 1) Approve Dublin Civic Center Workspace Programming Study's recommended alternative to accommodate growth through 2026, in concept; 2) Approve a budget change and change order #2 for additional consultant services; 3) Authorize Staff to study the inclusion of the additional Civic Center expansion costs as part of an update to the Public Facilities Fee; and, 4) Authorize Staff to develop a Request for Proposal for Architectural Services to provide services identified in the Next Steps portion ofthis report.
