DUBLIN CITY COUNCILDUBLIN CITY COUNCIL
REGULAR MEETING - Tuesday, March 26, 1996, 7:00 p.m.

A complete packet of information containing Staff Reports and exhibits related to each
item is available for public review several days prior to a Council meeting in the City
Clerk’s Office and also at the Dublin Library.

3.ORAL COMMUNICATIONS
3.1Dublin Police Services Certificate of Appreciation to Ramon Gonzales
At this time, the public is permitted to address the City Council on non-agendized items. The
Council must, however, comply with all State Laws in regard to items not appearing on the
posted agenda. The Council may respond to statements made or questions asked, or may request
Staff to report back at a future meeting concerning the matter. Any member of the public may
contact the City Clerk’s Office related to the proper procedure to place an item on a future City
Council agenda. The exceptions under which the City Council MAY discuss and/or take action on
items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3).
4.CONSENT CALENDAR
Consent Calendar items are typically non-controversial in nature and are considered for
approval by the City Council with one single action. Members of the audience, Staff or
the City Council who would like an item removed from the Consent Calendar for purposes
of public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of March 12, 1996

4.2Financial Report for the Month of February 1996

4.3Request for Authorization to Distribute a Request for Proposal for an Evidence Tracking
System and a Fixed Asset Inventory System
The City Council has budgeted to purchase bar-code/scanner systems to track evidence and to
inventory City assets. This is a request by Staff to circulate an RFP to purchase those systems.
STAFF RECOMMENDATION: Authorize Staff to distribute the RFP
4.4Authorization to Solicit Bids for Contract 96-03, Annual Slurry Seal Program
Each year, the City rehabilitates a portion of the street system by applying a sand/oil slurry
seal. This seal helps to keep water out of the street subgrade to prolong the life of the streets
as well as add a new wearing surface.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids
4.5Amendment to Agreement with Alameda County for Traffic Signal and Street Lighting
Maintenance (Addition of 2 Signalized Intersections, Expanding Scope of Work for Street
Lighting Maintenance; Addition of Real Estate Services)
This proposed amendment would add 2 signalized intersections, expand the scope of work for
street lighting maintenance, and add real estate services to the current contract with Alameda
County.
STAFF RECOMMENDATION: Adopt Resolution approving amendment to agreement
4.6Program Supplement No. 009 - Local Agency-State Agreement for Federal Aid Projects No.
04-5432, Caltrans Project No. CML-5432 (005), with Caltrans to reimburse the City of
Dublin
The City of Dublin has obtained a Federal ISTEA grant in the amount of $1,000,000 to aid in
the construction of the widening of Dublin Boulevard between Clark Avenue and Sierra Court.
This agreement will allow the City to proceed with preliminary engineering work as a first
phase of the project.
STAFF RECOMMENDATION: Adopt Resolution and authorize the Public Works Director to
execute Program Supplement No. 009
4.7Program Supplement No. 008 - Local Agency-State Agreement for Federal Aid Projects
No. 04-5432, Caltrans Project No. CML-5432 (003), with Caltrans to reimburse the City of
Dublin at Force Account for Funding for the City of Dublin Traffic Signal Coordination
and Updating the Traffic Signals
The City of Dublin has obtained State and Federal grants in the amount of $49,701 to upgrade
the City's traffic signal system hardware and software and to perform a signal coordination
study.
STAFF RECOMMENDATION: Adopt Resolution and authorize the Public Works Director to
execute Program Supplement No. 008
4.8Award of Bid 1995-96 Annual Street Repair and Overlay, Contract 96-02
The low bid received, $329,291.96, is within funds budgeted for construction. Funding is
provided through Measure B, Gas Tax, SB 300, and the City's General Fund. This project
provides contract services for the repair of streets to be overlayed and slurry sealed as well as
provides for a 1 1/2" asphalt overlay of a portion of the City's streets.
STAFF RECOMMENDATION: Adopt Resolution awarding bid to O'Grady Paving
4.9Warrant Register ($368,933.91) dated March 26, 1996

5.WRITTEN COMMUNICATIONS
5.1Dublin Fine Arts Foundation Loaned Arts Program Sculpture #5
DFA would like to display a sculpture "Steel Watercolor #99" created by internationally
known Bay Area artist, Fletcher Benton, at the Civic Center. The sculpture stands 22 1/2 feet
tall and is approximately 3 feet wide. The proposed location is in the grassy area between the
Plaza Fountain and the Civic Center building facing Dublin Boulevard.
STAFF RECOMMENDATION: Approve proposal from DFA and authorize Mayor to execute
agreement and direct Staff to work with DFA to complete the installation
6.PUBLIC HEARING
6.1Reduction of Rental Availability In-Lieu Rental Fee Amount
The In-Lieu Rental Fee amount is determined by the City Council every 2 years. The Fee is
used to assure the provisions of rental housing in the City of Dublin. This item would result in
a reduction of the In-Lieu Rental Fee from $10,808 to $986.24 per unit not provided.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution revising
the In-Lieu Rental Fee amount - OR - provide direction and continue this item
6.2Public Facilities Fee
The City Council will review the results of the Public Facilities Fee Justification Study and
consider adoption of a Public Facilities Fee to finance municipal public facilities to reduce the
impacts caused by future developments in the City of Dublin and Eastern Dublin. Such
facilities include the following: completion of the Civic Center office space, construction of a
new library and expansion of the existing library, relocation and expansion of the existing
senior center, acquisition and construction of neighborhood and community parks and
community buildings (including a community theater, a community center, a recreation center
and an aquatic center).
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution
establishing a public facilities fee.
6.3Amendment to Chapter 9.28 of the Dublin Municipal Code - Quimby Act Ordinance
Proposed amendments to the Quimby Act Ordinance pertain to the amount of land to be
dedicated, the calculation of in-lieu fees, and credits for open space and recreational facilities.
STAFF RECOMMENDATION: Conduct public hearing; waive reading and INTRODUCE
Ordinance.
6.4Revision to Eastern Dublin Traffic Impact Fee/Area of Benefit Fee
This is the annual update of the existing Traffic Impact Fee for the Eastern Dublin
development. Proceeds from this fee will fund the oversizing of arterial streets, the provision
of park and ride lots and selected regional transportation improvements. Staff feels that
additional time is needed to discuss the value of required rights-of-way with major property
owners.
STAFF RECOMMENDATION: Continue public hearing to City Council meeting of April 9,
1996
6.5Noise Mitigation Fee
The Noise Mitigation Fee will allow the City to cover the cost of mitigating noise impacts to
existing residences in the Eastern Dublin Specific Plan from development in the EDSP at
buildout when noise impacts will be greatest, and of administering the intake of the Fee
program. The fee amount is determined by land use category and for residential land use,
ranges from $2.85 to $4.74 per unit.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution
establishing amount of Noise Mitigation Fee for future developments within the City of Dublin
6.6Adoption of Urgency Ordinance amending the Municipal Code and Zoning Ordinance to
assign responsibilities to the Community Development Director
An ordinance has been drafted to reassign duties designated in the Municipal Code and Zoning
Ordinance of the Planning Director to the Community Development Director. With the
resignation of the Planning Director, this ordinance will insure that applications are handled in
an appropriate fashion.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and adopt
Ordinance on an urgency basis
7.UNFINISHED BUSINESS
7.1Eastern Dublin Scenic Corridor Adoption and Eastern Dublin Scenic Corridor Policies and
Standards
This item was continued from the March 12, 1996 City Council meeting. In compliance with
the Eastern Dublin Specific Plan and EIR, the City Council will consider the official adoption
of Tassajara Road, I-580 and Fallon Road as designated scenic corridors, and approval of
scenic corridor policies and review procedures and standards for projects within the scenic
corridor viewshed.
STAFF RECOMMENDATION: Adopt Resolution related to the official adoption of designated
Scenic Corridors and approving the Eastern Dublin Scenic Corridor Policies and Standards - OR -
give Staff direction and continue the matter
8.NEW BUSINESS
8.1Tri-Valley Crossings (Santa Rita Commercial Center) Revised Site Plan

The City Council will review a revised Site Plan for an 800,000 sq.ft. shopping center
approved by the City Council on August 22, 1995. The Council will determine if the
Approved Site Plan should be revised in accordance with the proposed revisions to the Site
Plan.
STAFF RECOMMENDATION: Adopt Resolution revising the Site Plan
8.2Dublin Police Services 1995 Calendar Year Report
This report, prepared on an annual basis, documents police response to crimes reported or
detected within the City, response relative to traffic offenses and/or accidents and all programs
administered by the Dublin Police Services. It should be pointed out that comparisons from
year to year which are shown in percentages can be very misleading when applied to small base
numbers.
