CALL TO ORDER DUBLIN LIBRARY, Meeting Room 7606 Amador Valley Boulevard 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS At this time, members of the audience are permitted to address the City Council on any item which is not on the City Council Agenda. Comments should not exceed 5 minutes. If any person feels that this is not sufficient time to address their concern, that person should arrange with the City Clerk to have their particulccr concern placed on the agenda for a future meeting. 3.1 Proclamation for Eagle Scout Gary Dowell 4. CONSENT CALENDAR Consent Calendar items are typically of a non-controversial nature and are considered for approval by the City Council with one single action. Members of the audience who would like an item removed from the consent calendar for purpose of public input may request the City Council to remove the item from the consent calendar. The request may be made at the time that the Mayor asks the audience members if there is anyone interested in removing an item from the Consent Calendar. 4.1 Minutes: Adjourned Regular Meeting-February 23, 1989 & Regular Meeting-February 27, 1989 STAFF RECOMMENDATION: Approve 4.2 Tract 4978: Replacement of Developer The Final Map for this Tract, located on Dougherty Road just south of Borcher Bros., was approved by the City Council in 1984, and no improvements have been constructed to date. The interest in this Tract has transferred to BJ Dublin Commercial, a new developer. STAFF RECOMMENDATION: Adopt Resolution approving new Developer and authorize Mayor to execute agreement. 4.3 Authorization to Apply for Funding for Transportation Development Act (TDA) Projects Staff is requesting authorization to apply for funding for two projects through the Transportation Development Act. The projects are: 1) handicap curb ramps Phase IV and 2) Catch Basin Grate Replacement Phase I. STAFF RECOMMENDATION: Adopt Resolution directing Staff to apply for funding. 4.4 Dublin Police Services 1988 Calendar Year Report This report tabulates police response to crimes reported or detected, activity relative to traffic offenses and/or accidents, programs instituted and/or regulated by Police Services within the City and compares 1988 statistics to the previous years. STAFF RECOMMENDATION: Receive Report. 4.5 Regional Open Space, Wildlife, Shoreline and Parks Bond The City Council will consider applying the $473,487 received from EBRPD, Measure AA, to the renovation of Shannon Park. STAFF RECOMMENDATION: Approve Grant Application and authorize Mayor to execute Resolution. 4.6 Acceptance of Improvements: Village VI "Ridgecreek" of the Villages @ Willow Creek Improvements within Village VI have been inspected and determined to be complete and in accordance with approved plans and specifications. STAFF RECOMMENDATION: Adopt Resolution to accept the work completed & authorize Staff to accept maintenance bond at a future date. 4.7 Award of Bid - Contract 89-3 - Annual Street Overlay & Repair Program The low bid received, $340,358.05, is within funds budgeted for this project. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Bay Cities Paving & authorize Mayor to execute agreement. 4.8 Dublin Sports Grounds Barrier Fencing for Softball Fields During softball season, balls are being hit over the 1-580 fence at the Dublin Sports Grounds. This fencing project will solve this potentially dangerous situation. STAFF RECOMMENDATION: Approve installation of fencing at Dublin Sports Grounds as a new parks Capital Improvement Project; authorize $16,000 budget transfer from the street maintenance operating budget to the Capital Projects fund; and authorize Staff to solicit bids. 4.9 Clorox Foundation Community Development Program Staff has applied for a $10,000 grant for aluminum bleachers at the Dublin Sports Grounds through the Community Development Program sponsored by the Clorox Foundation. STAFF RECOMMENDATION: Approve project submission and authorize Staff to prepare the necessary written and oral presentation materials. 4.10 1988-89 Mid-Year Financial Review STAFF RECOMMENDATION: Receive Report 4.11 Warrant Register dated March 27, 1989 STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLl.C HEARING 6.1 Amendment of Ordinance No. 3-87 which regulates the enclosure of swimming pools by making a violation of this Ordinance an infraction. STAFF RECOMMENDATION: Open public hearing; receive Staff presentation; receive Public testimony; close Public Hearing; deliberate; waive reading and ADOPT Ordinance amending Ordinance No. 3-87. 6.2 Amendment of Ordinance No. 4-87 by changing penalty for failing to install street address numbers on existing buildings from a misdemeanor to an infraction. STAFF RECOMMENDATION: Open public hearing; receive Staff presentation; receive Public testimony; close Public Hearing; deliberate; waive reading and ADOPT Ordinance amending Ordinance No. 4-87. 6.3 Amendment of Ordinance by deleting Section 8-87.87 of the City of Dublin Zoning Ordinance. Amending Ordinance would delete Section 8-87.87 of the Zoning Ordinance making violation of sign regulations an infraction. STAFF RECOMMENDATION: Open public hearing; receive Staff presentation; receive Public testimony; close Public Hearing; deliberate; waive reading and ADOPT Ordinance amending Ordinance deleting Section 8-87.87. 6.4 The Casden Company (formerly titled Heritage Commons Phases 2-4) Planned Development Rezoning, Tentative Map 5883 & Site Development Review PA 88-009.1/.2/.3 This item is the concurrent processing of 3 planning permits. The Casden Company proposes 206 apartment/condominium units on 17.45 + acres located south of Amador Valley Boulevard, south and east of Stagecoach Drive. Three main issues are: 1) use of Stagecoach Drive; 2) traffic and circulation; and 3) apartment vs. condominium ownership. STAFF RECOMMENDATION: Open public hearing; receive Staff presentation; receive Public testimony; close Public Hearing; deliberate; adopt resolutions -OR- give Staff and Applicant direction and continue the item. 6.5 Appeal of Goodwill Industries Donation Station Conditional Use Permit, 7745 Amador Valley Boulevard, PA 88-150 The Applicant proposes to locate a 25' long truck trailer for a Donation Station in the Shamrock Village Shopping Center near the Goodwill Store. The Planning Commission approved, with conditions, the Applicant's request. The action was appealed, considered and continued by the Council at its March 13, 1989 meeting. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt appropriate resolution modifying Planning Commission action -OR- give Staff and Applicant direction and continue the matter. 6.6 Appeal of Howard Johnson Hotel Conditional Use Permit, 6680 Regional Street, PA 88-148 The Applicant proposed to establish a dance floor and to add a hair salon, gift shop, offices and temporary retail sales/auction activities within the existing hotel building. The Planning Commission approved the permit request with conditions. The appelant is appealing the Commission's action allowing the temporary retail sales/auction activities to occur. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt resolution upholding Planning Commission action -OR- adopt modified resolution -OR- give Staff and Applicant direction and continue the matter. 7. UNFINISHED BUSINESS 7.1 Award of Bid - Contract No. 89-5 Replacement of Pumps - Dublin Swim Center The Bid opening for this contract was rescheduled for Friday, March 24; therefore, bid results were not available at the time the agenda was prepared. Bid results will be communicated to the City Council on March 24th along with Staff's recommendation. STAFF RECOMMENDATION: Undetermined at this time. 8. NEW BUSINESS 8.1 Review of Policy for Use of San Ramon Road Banner Poles The adopted policy for the use of the banner poles requires that the applicant be a non- profit organization holding an event in Dublin. Staff has received some requests involving events being held outside Dublin that benefit Dublin residents and is asking the City Council to consider revising the policy. STAFF RECOMMENDATION: Consider possible changes to policy and direct Staff to take appropriate action. 8.2 Senior Center Facility Use Policy The City Council will review and provide input on the proposed Senior Center Facility Use Policy. STAFF RECOMMENDATION: Approve policy and adopt Resolution Establishing Policies for the Use of the Senior Center. 9. OTHER BUSINESS 10. CLOSED SESSION - Potential Litigation - Government Code Section 54956.9(c). 11. ADJOURNMENT
