3.1 Proclamation declaring April 6-12, 2003 "National Library Week" (File # 610-50)
3.2 Acceptance of Grant from the Tri-Valley Community Foundation (File # 150-70)
Dublin Police Services is requesting Council approval to accept a $5~000 grant from the Tri-
Valley Community Foundation. These funds would be used to increase funding available for
printing of Crime Prevention Parent Resource Handbooks.
STAFF RECOMMENDATION: Accept Grant; accept and direct Staff to execute
Conditions/Restrictions Agreement; approve Budget Change; and direct Staff to prepare formal
acknowledgement to donor.
3.3 Acceptance of Grant from the Altamont Cruisers (File # 150-70)
Dublin Police Services is requesting Council approval to accept a $1,000 grant from the
Altamont Cruisers. These funds would be used to purchase safety and informational signage
for Police Services Crime Prevention Unit bicycle Rodeos.
STAFF RECOMMENDATION: Accept Grant; approve Budget Change; and direct Staff to
prepare formal acknowledgement to donor.
3.4 PubLic Comments
At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium
and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In
accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda.
The Council may respond to statements made or questions asked, or may request Staff to report back at a future
meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper
procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY
discuss and/or take action on items not appearing on the agenda are contained in Government Code Section
54954.2(b)('1)(2)(3).
4. coNSENT
Consent Calendar items are typically non-controversial in nature and are considered for approval by the City
Council with one single action. Members of the audience, Staff or the City Council who would like an item
removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item.
4.1Minutes of Regular Meeting of March 18, 2003
STAFF RECOMMENDATION: Approve
4.2 Authorization to Solicit Bids, Contract 03-06, 2002-03 Annual Street Overlay Program
(File # 600-35)
This program will remove and replace failed asphalt concrete pavement and resurface entire
streets with 1 ½' of asphalt concrete and restripc pavement markings on various City streets.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids.
4.3Acceptance of Work - Swim Center Roof Replacement Project, Contract 02-13
(File # 600-35)
In October of 2002, the City Council awarded the contract for the Swim Center Roof
Replacement Project to CBC construction. The project provided for the replacement of thc
roof on thc main building and snack bar, as well as the installation of a new skylight and
additional building ventilation. The project has been satisfactorily completed.
STAFF RECOMMENDATION: Accept improvements and authorize release of retention, less
the cost of a replacement copier ($6,975.86), after 35 days if there are no subcontractor claims.
4.4 Intent to Vacate Excess Right-of-Way on Dublin Boulevard west of Arnold Road pursuant
to Streets & Highways Code Section 8310 et seq. (File # 670-40)
The original alignment of Dublin Boulevard in eastern Dublin curved up to the north from
west of Arnold Road and generally followed Central Parkway to Hacienda Drive. The
alignment has since been moved south and the remnant right-of-way is no longer needed for
public street purposes.
STAFF RECOMMENDATION: Adopt Res, olution of Intent to Vacate Excess ROW identified
as Parcel C on ?arcel Map 7395.
4.5 Amendment to Tract Developer Agreement, Tract 7075 (Tassajara Creek, Phase I -
Greenbriar by GHC Investments, LLC) (File # 600-60)
This Tract is located west of Tassajara Road at thc intersection of South Dublin Ranch Drive.
It contains 126 single-family and clustered residential lots. Thc public improvements and
housing units are not yet completed and it is appropriate to extend thc date of required
completion to the projected tract completion.
STAFF RECOMMENDATION: Adopt R_~esolution extending the completion date to April 16,
2004, to coincide with thc proposed completion date for Tract 7279, which is Phase It of this
same development.
4.6 Approval of Agreement between City of Dublin and Shamrock Ford, Inc., for Maintenance
of Landscaping along 1-580 (File # 600-30)
As a condition of approval, Shamrock Ford (formerly AutoNation) was required to landscape
and maintain a small strip of land along and within thc 1-580 Caltrans fight-of-way. The City
has an agreement with Caltrans to maintain this landscaping. This agreement will transfer the
City's responsibility to Shamrock Ford.
STAFF RECOMMENDATION: Adopt ~ approving agreement.
4.7 Amendment to Agreement with Linhart Petersen Powers Associates (LPZA) for
Engineering Services (600-30)
This amendment would provide for the continuation of resident engineer and inspection
services for the Dublin Boulevard Widening project (Village Parkway to Sierra Court) as the
existing Consultant Firm is closing their business.
STAFF RECOMMENDATION: Adopt Resolution amending existing contract with LP2A to
add two new positions for Engineering Services.
4.8 Amendment to Consulting Services Agreement with Washington Infrastructure Services
(formerly MK Centennial) for the widening of Dublin Boulevard from Vffiage Parkway to
Sierra Court (Modification to Scope of Work and Additional Compensation) (File # 600-30)
This amendment will allow for the continuation of on-call construction consulting services through the
end of the project.
STAFF RECOMMENDATION: Adopt Resolution approving Amendment No. 4 to Agreement
to expand the scope of work as described in letter dated February 11, 2003; and approve a
Budget change from Gas Tax reserves in the amount of $50,000.
4.9 Warrant Register ($4,746,336.25) dated April 1, 2003 (File # 30040)
STAFF RECOMMENDATION: Approve
5. WRITTEN COMMUNICATIONS
5.1 Request from Dublin Unified School District for additional funding for "Computers For
Our Schools Project" (File # 515-60)
The City Council will consider a request from the Dublin Unified School District for an additional
$9,500 in matching funds for the Computers for our Schools Project.
STAFF RECOMMENDATION: Consider request and if approved, adopt Resolution and
authorize Budget Change.
6. PUBLIC HEARING
6.1 City of Dublin Zoning Ordinance Amendment - PA 03-002 - Amendment to Chapters 8.12,
8.76 and 8.100 of the Dublin Zoning Ordinance (File # 450-20)
This is the second reading of an Ordinance which would amend the Dublin Zoning Ordinance, Chapter
8.12 - Zoning Districts and Permitted Uses of Land, Chapter 8.76 - Off-Street Parking and Loading
Regulations, and Chapter 8.100 - Conditional Use Permit of the Dublin Zoning Ordinance. These
amendments will allow for the conversion of garages to living space in R-1, Single-Family Residential
Zoning districts by means of a Conditional Use Permit.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and ADOPT
Ordinance.
6.2 Weeds and Combustible Refuse Abatement Order (File # 540-50)
In accordance with Resolution No. 31-03, the City Council declared that there is a public nuisance
created by weeds and combustible debris growing, accumulating upon the streets, sidewalks and
property within the City of Dublin. This public hearing will allow property owners to present
objections to the abatement order.
STAFF RECOMMENDATION: Conduct public hearing; deliberate; direct Stuff to continue the
weed abatement process.
7. UNFINISHED BUSINESS
7.1 Final Design for Bus Shelter Art Project (File # 600-30)
The City Council approved the conceptual design of the Bus Shelters by Artist Dan Dykes in
November of 2002. The final design options will be presented for approval for fabrication of the bus
shelters.
STAFF RECOMMENDATION: Select and approve Bus Shelter final design.
7.2 Fairway Ranch Affordable Housing Project PA 03-010 (File # 430-80)
The City Council will review the proposed financial package and issues relating to the proposed
Fairway Ranch Affordable Housing Project.
STAFF RECOMMENDATION: Provide direction to Staff on whether to continue processing
the Application. If yes, provide direction on whether to proceed to complete the financial terms
of this proposal as recommended by Staff which consist of: a) Financial assistance (loan) not to
exceed $4.5 million for Phases I & II in equal increments; b) A 3% compounded interest rate; c)
No waiver of future commercial linkage fees for Dublin Ranch commercial areas; d) Other issues
that have been agreed to by Staff and Applicants; e) Review and resolve whether to provide a
loan for the project which will assist the Applicant to construct the project without paying
prevailing wage rates; and f) Review and comment on Applicant's proposal for construction,
management and long-term operation of the proposed project.
NEW BUSINESS
8.1 Authorization to Solicit Bids for Lighting for Freeway Underpass Artwork Project,
Contract 03-04 (File # 600-35)
Th~s project would install a row o£1ight fixtures above the murals on the walls of the two
freeway underpasses. The budget for the lighting portion of the project is $105,950.
STAFF RECOMMENDATION: Authorize Staff to advertise for bids.
8.2 Letter of Participation for Multi-Family Affordable Itousing Green Building Design
Assistance (File # 600-40/810-60)
The City Council will consider authorizing the Mayor to sign a Letter of Participation
Agreement with Alameda County Waste Management Authority for participation in the
Authority's Multi-Family Affordable Housing Green Building Design Assistance Program.
STAFF RECOMMENDATION: Authorize Mayor to sign participation agreement letter.
8.3 Kolb Park Play Equipment Proposals (File # 350-20)
In January of 2003, the City Council authorized Staff to distribute a Request for Proposals for
the Kolb Park Play Equipment Replacement Project. Five proposals were submitted by the
deadline. Upon review by Staff and the Parks & Community Services Commission, the
proposal by NorCal Leisure Sales is recommended to the City Council for approval.
STAFF RECOMMENDATION: Approve play equipment design and authorize Staff to issue a
Purchase Order for equipment.
8.4 Dedication of Murray School Bell Tower (File # 910-40)
The City Council will review the recommendation to have a dedication ceremony for the
Murray School Bell Tower at the Heritage Center on Thursday, May 1, 2003, at 6:00 p.m.
STAFF RECOMMENDATION: Confirm date and time for dedication ceremony.
8.5 Acceptance of ~Vork~ Contract 01-03~ Civic Center Library Improvements (File # 600-35)
The new Dublin Public Library will be ready for acceptance of work. This will complete the
project construction and allow for the building to be opened to the public on April I2, 2003.
STAFF RECOMMENDATION: Approve Change Order in the amount of $120,402; authorize
City Manager to accept the final improvements upon completion of the remaining minor punch
list items; and adopt Resolution authorizing City Manager to accept the completed Library
improvements.
8.6 Approval of Street Name Change from Altamirano Way to MartineHi Way (File # 820-60)
The proposed naming of a street to "Martinelli Way" is a recommendation to honor Adolph
Martinelli, Alameda County Planning Director, who is now retiring from County service and
who has been invaluable in the coordination of the development of County owned lands with
the City of Dublin.
STAFF RECOMMENDATION: Adopt Resolution approving the renaming of street.
