CALL TO ORDER AND PLEDGE OF ALLEGIANCE TO THE FLAG 2. REPORT OF CLOSED SESSION ACTION 3. ORAL COMMUNICATIONS 3.1 Acceptance of Gifts to City from St. Patrick's Day Sponsors (150-70) The City Council will receive a report on monetary and in-kind sponsors who helped support the 2007 St. Patrick's Day Festival. STAFF RECOMMENDATION: Recognize the sponsors and formally accept the contributions. 3.2 Acceptance of Gifts to City from the Dublin Rotary and Host Lions Clubs (150-70) The Rotary Club and Host Lions Club of Dublin have elected to support the Dougherty Hills Dog Park by making monetary contributions. The City Council will be accepting the donations for the project. STAFF RECOMMENDATION: Recognize the sponsors and formally accept the contributions. 3.3 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Regular Meetings of February 20, 2007 and March 6, 2007. STAFF RECOMMENDATION: Approve April 3, 2007 Dublin City Council Agenda Page I of 4 4.2 Request for Authorization to Use AERC Recycling for the Recycling of City Electronic Waste and Surplus Computer Equipment (350-40) The City routinely has surplus computer equipment which must be disposed of in accordance with environmental regulations. AERC is a State certified recycler located in Hayward. Due to the age and condition of the equipment they are not useable in their current state. STAFF RECOMMENDATION: Authorize the disposal of the computer equipment to AERC, a State certified recycler. 4.3 Preliminary Financial Reports for the Months of January 2007 and February 2007 (330-50) STAFF RECOMMENDATION: Receive reports. 4.4 Acceptance of Work - Contract 05-07, Undergrounding of Utilities at the Intersection of Dublin Boulevard/Dougherty Road (600-35) This project undergrounded existing overhead utilities along Dougherty Road between Sierra Lane and Dublin Boulevard, and portions of Dublin Boulevard and Scarlett Court in preparation for the project to widen and improve the intersection of Dublin Boulevard/Dougherty Road. STAFF RECOMMENDATION: Accept improvements under Contract 05-07, Undergrounding of Utilities at the intersection of Dublin Boulevard/Dougherty Road, and authorize release of the retention after 35 days if there are no subcontractor claims. 4.5 Consolidation of Existing Agreements with Linhart, Petersen, Power and Associates and Berryman & Henigar into a Consulting Services Agreement with Bureau Veritas North America, Inc., for Building and Safety Services (600-30) The City Council will authorize Staff to hire outside consultants to assist Staff with projects on an as-needed basis. STAFF RECOMMENDATION: Adopt Resolution consolidating the existing agreements with Linhart, Petersen, Powers and Associates and Berryman & Henigar into a Consulting Services Agreement with Bureau Veritas North America, Inc., for building and safety services; and authorize City Manager to execute. 4.6 Fee Adjustments to Existing Planning Division Consultant Agreements for Overflow Services in the Community Development Department (600-30) The City Council will conduct an annual review of the contracts and consider approving fee adjustments for all Planning Division consultants. STAFF RECOMMENDATION: Adopt Resolution approving Fee Amendment Agreements and authorizing the City Manager to execute the amendments and the revised agreement on behalf of the City. 4.7 Warrant Register ($1,024,903.22) dated April 3, 2007 (300-40) STAFF RECOMMENDATION: Approve 5. WRITTEN COMMUNICATIONS - None 6. PUBLIC HEARINGS 6.1 Approval of Engineer's Report and Ordinance Creating Dublin Ranch East Side Storm Drain Benefit District (360-40) The City Council will consider adopting an Ordinance approving the creation of the Dublin Ranch East Side Storm Drain Benefit District (which includes the property within the City's territorial limits to the east of Dublin Ranch and Fallon Road) to levy and collect charges, as a condition of development, to reimburse developers who construct and install drainage facilities that benefit properties other than their own. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance to create the Dublin Ranch East Side Storm Drain Benefit District. UNFINISHED BUSINESS 7.1 Proposal to Display Alameda County Fair Banners on City-Owned Light Poles in Dublin (450-20) In September 2006, the City Council agreed to co-sponsor the Alameda County Fair and include the Alameda County Fair Banners in the City's Banner Program. Staff was directed to bring back the banner design for approval and to work with the Fair to place banners at locations throughout the City. This item will identify the Fair's 12 requested locations and provide the design for the Fair's banner. STAFF RECOMMENDATION: Approval the Alameda County Fair's request to display promotional banners on 12 selected light poles in Dublin from May 23, 2007 to July 7, 2007 at the proposed locations; and approve banner design. 7.2 Award of Contract for Area F Neighborhood Square - Contract No. 07-03 (600-35) At its meeting of February 7, 2007, the City Council authorized Staff to advertise for bids for the Area F Neighborhood Square. Receiving two bids over the project budget, the City has three options for the project: I) Reject all bids, revise plans and re-bid; 2) Award project with or without alternates and authorize Staff to appropriate additional funds to the project; or 3) Award project and authorizes Staff to work with Contractor to determine options for value engineering in which improvements may be eliminated or design details modified so that the improvement is retained yet modified to achieve some cost reduction. STAFF RECOMMENDATION: Determine whether to award bid with or without Alternate #1. 7.3 Exclusive Negotiating Rights Agreement (ENRA) with City of Dublin, Housing Authority of the City of Dublin, Housing Authority of the County of Alameda, Eden Housing, Inc., and Citation Homes Central for the Arroyo Vistas Redevelopment Project (600-40) The City Council will consider the approval of an ENRA for the Arroyo Vista Redevelopment Project. The purpose of the ERNA is to provide the project developers with assurances that they will be negotiated with exclusively and to assure the Housing Authority and the City that the developers will pay for the predevelopment processing costs. The ERNA also outlines the terms for the future transfer of the property. STAFF RECOMMENDATION: I) Authorize Mayor to sign ENRA on behalf of the City of Dublin; 2) Direct Staff to include a reserve in the Inclusionary Zoning In Lieu Fee Fund for a future loan of $1,500,000 as a low interest loan to Eden Housing for the affordable rental units; and 3) Direct Staff to include an appropriation from the Inclusionary Zoning In Lieu Fee Fund in the amount of $250,000 for Transactional Cost in the Fiscal Year 2007-2008 Budget. 8. NEW BUSINESS 8.1 Review of General Plan and Specific Plan Residential Land Use Designations for Properties Generally East of Dougherty Road and Including the East Dublin Specific Plan Area (410-20) The City Council will provide Staff with direction regarding current residential land use policies and future residential development for the properties generally located to the east of Dougherty Road and including the Eastern Dublin Specific Plan Area. STAFF RECOMMENDATION: Direct Staff to either: a) Prepare General Plan/Specific Plan Amendments to include two new land use designations including Medium-Low (6.1-10 dulacre) and Medium (10.1-14 dulacres); b) Prepare a Specific Plan Amendment to adopt development standards that require a minimum usable yard area; c) Prepare General Plan/Specific Plan Amendments to include two new land use designations including Medium-Low (6.1-10 dulacre) and Medium (10.1-14 dulacre and prepare a Specific Plan Amendment to adopt development standards that require a minimum usable yard area; or d) Continue to implement existing General Plan and Specific Plan policies. April 3, 2007 Dublin City Council Agenda Page 3 of 4 8.2 Request to Initiate a General Plan Amendment and Eastern Dublin Specific Plan Amendment Study to Modify the Existing Land Designations at 6960 Tassajara Road, Commonly Referred to as the Fredrich Property (410-55/420-30) The City Council will consider a General Plan Amendment and Specific Plan Amendment Study request. STAFF RECOMMENDATION: Adopt Resolution approving the General Plan and Eastern Dublin Specific Plan Amendment Study request; or Adopt Resolution denying the General Plan and Eastern Dublin Specific Plan Amendment Study request. 8.3 Consultant Services Agreement with Jerry Haag, Urban Planner, for a Joint Environmental Impact Statement/Environmental Impact Report for the Arroyo Vista Project (600-30) The City Council will consider authorizing Staff to hire outside consultants to assist Staff with the preparation of an environmental document for the Arroyo Vista project. STAFF RECOMMENDATION: Adopt Resolution approving agreement with Jerry Haag, Urban Planner; and authorize City Manager to execute agreement. 8.4 Report on 2007 Dublin Pride Week Activities (150-80) The City Council will receive a report on the planned activities for the 2007 Dublin Pride Week, scheduled for April 28 - May 5, 2007. STAFF RECOMMENDATION: Receive the 2007 Dublin Pride Week activities report. 8.5 Resolution of Intent to Adjust the Amount of the Existing Public Facilities Fee that is Imposed Pursuant to Chapter 7.78 of the Dublin Municipal Code (390-20) The proposed Resolution notifies developers and other interested persons of the amount, nature and basis for the anticipated update to the City's existing Public Facilities Fee, which was established by Chapter 7.78 of the Dublin Municipal Code. . STAFF RECOMMENDATION: Adopt Resolution expressing the City's intent to adjust the amount of the existing Public Facilities Fee. 9. OTHER BUSINESS 9.1 Brief INFORMATION ONLY reports from Council and/or Staff, including Committee Reports and Reports by Council related to Meetings Attended at City Expense (AB 1234). 10.
