HomeMy WebLinkAbout*CC Agenda 04-10-1995A G E N D A DUBLIN CITY COUNCIL REGULAR MEETING - April 10, 1995 DUBLIN CIVIC CENTER Monday - 7:00 p.m. 100 Civic Plaza A complete packet of information containing Staff Reports and exhibits related to each item is available for public review several days prior to a Council meeting in the City Clerk’s Office and also at the Dublin Library. 1.CALL TO ORDER 2.PLEDGE OF ALLEGIANCE TO THE FLAG 3.ORAL COMMUNICATIONS 3.1Proclamation declaring April 9-15, 1995 as National Library Week 3.2Proclamation declaring April 10-14, 1995 as National Community Development Week 3.3Appointments by Mayor to Heritage Center Advisory Committee In response to advertisements, the City received applications from 6 individuals interested in serving on the Heritage Center Advisory Committee. Mayor Houston requests that the City Council confirm the appointment of Mary Beth Acuff, Mary Jane Hyde, Ellen Johnson, Janet Lockhart and Vyann Stager to this Committee. STAFF RECOMMENDATION: Confirm 5 appointments or provide appropriate direction to Staff. 3.4Recognition of Award to City of Dublin for outstanding achievement in the area of special events The 1994 St. Patrick’s Day Celebration was chosen as a 1994 award recipient in the Special Events/Festivals Division by District III of the California Park and Recreation Society. STAFF RECOMMENDATION: Receive Award. At this time, members of the audience are permitted to address the City Council on items of interest to the public; however, in accordance with State Law, no ACTION or DISCUSSION shall take place on any item which is NOT on the City Council Agenda. The Council may respond briefly to statements made or questions posed, or may request Staff to report back at a future meeting concerning the manner. Further, a member of the City Council may direct Staff to place a matter of business on a future agenda. Any person may arrange with the City Clerk (no later than 11:00 a.m., on the Tuesday preceding a regular meeting) to have an item of concern placed on the agenda for the next regular meeting. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in GC 54954.2(b)(1)(2)(3). 4.CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1Minutes of Regular Meeting of March 27, 1995 STAFF RECOMMENDATION: Approve. 4.2Amendment to Rules of Conduct of Meetings of the City Council On March 27, 1995, the City Council unanimously voted to change City Council meeting days for regular meetings from the second and fourth Monday evenings to the second and fourth Tuesday evenings beginning in June, 1995. STAFF RECOMMENDATION: Adopt Resolution amending Resolution No. 2-95. 4.3Unmarked Police Vehicle Purchase As a result of requesting bids in January, 1995, the City received only one bid for an unmarked vehicle to be used by the Chief of Police and on occasion for surveillance operations. The bid received from Shamrock Ford was for a 4-door 1994 Ford Taurus. In order to maintain a balance between 4-door and 2-door unmarked vehicles, Police Staff is requesting that the Council authorize a revision to the bid specifications to request a used 2-door vehicle and to go out to bid again. STAFF RECOMMENDATION: 1) Reject bid submitted by Shamrock Ford on February 14, 1995 and 2) reauthorize Staff to solicit bids for an unmarked police vehicle in accordance with revised specifications. 4.4City Treasurer’s Investment Report as of March 31, 1995 The City’s investment portfolio totals $19,240,322.74 and funds are invested at an average annual yield of 5.850%. STAFF RECOMMENDATION: Receive Report. 4.5City Council Support for AB 866 and SB 602 which would change the method used to allocate sales tax on leased vehicle purchases If a vehicle is purchased the local 1% share of the sales tax is allocated to the jurisdiction where the dealership is located. If a lease is arranged by the dealer, the tax 4.6Complaint by Mark Dorazio regarding Pak ‘N Save Storage A San Ramon resident has contacted the City with his concern about the high piled storage practices at the Pak ‘N Save store in Dublin. He feels that if an earthquake should occur, there is a potential for injury to the customers. Staff was directed to review potential violations and prepare a report to the Council. Staff found no building regulation violations. STAFF RECOMMENDATION: Receive Report; take no action. 4.7Alameda County Economic Development Advisory Board (EDAB) Agreement EDAB has been the primary provider of economic development services over the last 4 years for both the County and Cities in Alameda County. Fourteen Alameda County Cities and the County are being asked to participate in this joint agreement to help fund the efforts of EDAB in promoting the County. STAFF RECOMMENDATION: Authorize City Manager to execute agreement with Alameda County for EDAB services ($4,730) for Fiscal Year 1994-95. 4.8Award of Bid - Contract 95-02 The City of Dublin has, on a year-by-year basis, set a policy to repair sidewalk that has been offset such as to become a tripping hazard. This contract will remove and replace concrete sidewalk areas that meet the tripping hazard criteria. STAFF RECOMMENDATION: Adopt Resolution awarding bid to Lucas Concrete ($37,325.20) 4.9Financial Report for the Months of February and March, 1995 STAFF RECOMMENDATION: Receive Reports. 4.10Authorization to solicit bids for two replacement copier machines: one Konica 2028 for Civic Center City Manager’s Office and one Konica 6190 for Civic Center First Floor Mail Room The two copier machines being replaced have been in service since 1987 and 1989 and have 493,418 and 2.9 million copies recorded, respectively. Both copiers have exceeded their useful life. STAFF RECOMMENDATION: Authorize Staff to solicit bids. 4.11Delegation of duty to Staff regarding Alcoholic Beverage Control license applications State law provides that the City Council has the duty to determine whether or not the issuance of a retail license for alcoholic beverages would meet public convenience and necessity. The City Council may delegate this duty to Staff. STAFF RECOMMENDATION: Adopt Resolution delegating duty regarding ABC license applications to the Chief of Police. 4.12Report on Schaefer Ranch General Plan Amendment and adopted Planning Department Goals & Objectives Mr. Jim Parsons, representing Schaefer Ranch, expressed concern with the order of the Schaefer Ranch General Plan Amendment among the Planning Department’s approved 1995 Goals & Objectives. With the current service level, the Planning Department can handle this objective/project. Other objectives cannot be handled without additional resources. STAFF RECOMMENDATION: Receive Report. 4.13Aerial Photography Project On February 27, 1995, the City Council conceptually approved the City’s participation in the Regional Aerial Photography Project which will consist of taking aerial photos of the City and ultimately converting those photos into a digital format that can be used on a computer. An agreement has been developed based on a cost sharing arrangement with Alameda County, DSRSD and Viacom Cable and the City to share costs for Dublin. STAFF RECOMMENDATION: Authorize Mayor to execute agreement and approve budget adjustment of $6,305 for Fiscal Year 1994-95. 4.14Warrant Register ($306,592.50) dated April 10, 1995 STAFF RECOMMENDATION: Approve 5.WRITTEN COMMUNICATION 5.1Request from Dublin Historical Preservation Association (DHPA) to change the status of the Heritage Center Advisory Committee to the Heritage Center Commission The City Council will consider a request from DHPA President Tom McCormick regarding changing the Heritage Center Advisory Committee to the Heritage Center 6.PUBLIC HEARING 6.1Ordinance Revising Chapter 9.40 of Title 9, Subdivisions, of the Dublin Municipal Code to permit Vesting Tentative Maps to be allowed for residential and non-residential developments Vesting Tentative Maps, when they are approved, lock in a vested right to proceed with development in substantial compliance with the ordinances, policies and standards in effect at the time of approval for a period of one year after the date of the recordation of the final map. This protects the subdivider from changes to those ordinances, policies and standards for a period of time. This change would give non- residential developers the same vesting protection as residential developers receive. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance. 6.2No Parking Zones on Sierra Lane at Dougherty Road (related to new construction and restriping) The design for improvements currently being constructed at the Dougherty Road/Sierra Lane intersection requires that parking be prohibited on Sierra Lane near the intersection except for a small area of 15-minute parking proposed for the north side of the street west of Dougherty Road. The improvements will reduce congestion and improve safety for drivers. STAFF RECOMMENDATION: Conduct public hearing; deliberate; adopt Resolution. 6.3New Speed Surveys and proposed Ordinance to change speed limits on 3 streets Engineering speed surveys recently conducted on 3 streets indicate that a speed limit change may be required to avoid a “speed trap” situation. This is the first reading of a proposed Ordinance to change speed limits as follows: Amador Valley Boulevard (Village Parkway to Stagecoach Road) - 30 mph; Dougherty Road (Monterey to Amador Valley Boulevard) - 45 mph; and Peppertree Road (West Vomac to Silvergate Drive) - 30 mph. The Chief of Police recommends that the speed limits remain at 25 mph for Amador Valley Boulevard and for Peppertree Road and that the Dougherty Road segment be increased to 40 mph rather than 45 mph. STAFF RECOMMENDATION: Conduct public hearing; deliberate; waive reading and INTRODUCE Ordinance 1A (per engineering survey) -OR- 1B (as recommended by Police Chief) 7.UNFINISHED BUSINESS 7.1Rowell Ranch Rodeo Banner Request At the March 27 meeting, the City Council reviewed a request from the Rowell Ranch Rodeo to use the City’s banner poles to advertise the 1995 rodeo. The Rodeo Committee proposed to utilize the services of a local electrical contractor to install the banner, rather than paying the cost of having the City maintenance crew install it. Staff has contacted the proposed installer and feels that this proposal is feasible. STAFF RECOMMENDATION: 1) Approve issuance of permit to Rowell Ranch Rodeo on the basis that the applicant’s installer will install the banner, subject to permit conditions, and 2) direct Staff to prepare a revised policy and fee schedule for future banner installations. 8.NEW BUSINESS 8.1Senate Bill 323 - Amending Public Records Act Senate Bill 323, sponsored by Senator Kopp, would make significant amendments to the Public Records Act. As written, the bill would require an unknown but substantial expense to the City to upgrade its computer equipment. The League of California Cities has several concerns, including: that the bill creates an unfunded mandate; that many smaller agencies lack the specialized knowledge required to comply; and that security of computerized records may be jeopardized. STAFF RECOMMENDATION: Send letter opposing the bill to Senator Kopp and members of the Senate Judiciary Committee where the bill will be heard on April 18. 8.2City Council Team Building Consultant At the City Council meeting of March 27, 1995, the Council directed the City Manager to contact Arlene Willits, Communication & Management Consultant, to propose and prepare a Scope of Work for a Team Building Workshop for the City Council.. STAFF RECOMMENDATION: Consider proposal and provide Staff with appropriate direction. 8.4Alameda Countywide Long Range Transportation Plan The Alameda County Congestion Management Agency, of which Dublin is a member, has completed its Long Range Transportation Plan and is requesting approval of the Plan by its member agencies. The Plan sets goals, policies and capital projects for the long term transportation needs of the County. It will also be used as the basis and recommendation for future transportation funding. STAFF RECOMMENDATION: Adopt Resolution. 9.OTHER BUSINESS - Brief INFORMATIONAL ONLY Reports from City Councilmembers and/or Staff 10.CLOSED SESSION 10.1Conference with Legal Counsel - Anticipated Litigation - initiation of litigation pursuant to subdivision (c) of Government Code Section 54956.9 - One potential case REPORT ON CLOSED SESSION ACTION 11.ADJOURNMENTThe next Regular Meeting of the Dublin City Council will be on Monday, April 24, 1995 at 7:00 p.m., in the Council Chambers The Dublin City Council has been invited by CTV 30 to participate in a live call-in show on Wednesday, May 17, 1995, from 7:30 p.m., to 8:30 p.m. PLEASE NOTE: PLEASE NOTE: Effective with the first meeting in June, 1995, Regular City Council meetings will be changed from the second and fourth Monday evenings of each month to the second and fourth TUESDAY evenings.
