The packet is available in the City Clerk's Office and also at the Dublin Library. 1. CALL TO ORDER 2. PLEDGE OF ALLEGIANCE TO THE FLAG 3. ORAL COMMUNICATIONS 3.1 Presentation by Marcus Beverly, Director of Risk Management, ABAG PLAN Corporation (140-10) Mr. Beverly will discuss the ABAG PLAN and the City of Dublin's success in meeting the Plans Risk Management standards. STAFF RECOMMENDATION: Receive presentation. 3.2 2008 Bike to Work Day (585-95) Bike to Work Day is an annual regional event organized by the East Bay Bicycle Coalition to promote the use of alternative modes of transit. This presentation is intended to update the City Council on the City's involvement in Bike to Work Day events taking place in Dublin. STAFF RECOMMENDATION: Receive presentation. 3.3 Public Comments At this time, the public is permitted to address the City Council on non-agendized items. Please step to the podium and clearly state your name for the record. COMMENTS SHOULD NOT EXCEED THREE (3) MINUTES. In accordance with State Law, no action or discussion may take place on any item not appearing on the posted agenda. The Council may respond to statements made or questions asked, or may request Staff to report back at a future meeting concerning the matter. Any member of the public may contact the City Clerk's Office related to the proper procedure to place an item on a future City Council agenda. The exceptions under which the City Council MAY discuss and/or take action on items not appearing on the agenda are contained in Government Code Section 54954.2(b)(1)(2)(3). 4. CONSENT CALENDAR Consent Calendar items are typically non-controversial in nature and are considered for approval by the City Council with one single action. Members of the audience, Staff or the City Council who would like an item removed from the Consent Calendar for purposes of public input may request the Mayor to remove the item. 4.1 Minutes of Special City Council Meeting of March 4, 2008 STAFF RECOMMENDATION: Approve. April 15, 2008 Dublin City Council Agenda Page 1 of5 4.2 Agreement Between the County of Alameda and the City of Dublin for Participation in the Alameda Urban County HOME Investment Partnership Program to Receive Community Development Block Grant (CDBG) Funds for Fiscal Years 2009-2010, 2010-2011, and 2011-2012 (600-40/480-20) The City Council will consider authorizing a 3-year agreement between the City of Dublin and the County of Alameda, enabling the City to continue receiving CDBG funds. STAFF RECOMMENDATION: Adopt Resolution authorizing an agreement between the City of Dublin and the County of Alameda for participation in the Alameda Urban County HOME Investment Partnership Program for Fiscal Years 2009-2010, 2010-2011, and 2011-2012; and authorizing the City Manager to execute five original agreements. 4.3 Adoption of Resolution Approving Use of Fiscal Year 2008-2009 Community Block Grant (CDBG) Funds by Executing Agreements with the following: The County of Alameda for Use of the $80,524 in CDBG Funds, Axis Community Health, Bay Area Community Services, Community Resources for Independent Living, Eden Council for Hope & Opportunity, Open Heart Kitchen, Senior Support of the Tri Valley, Spectrum Community Services, Inc., and Tri-Valley Haven (600-40/600-30/480-10) The City Council will consider authorizing contracts between the City of Dublin and the County of Alameda and the City of Dublin and Council recommended recipients of CDBG funds for Fiscal Year 2008-2009. STAFF RECOMMENDATION: Adopt Resolution authorizing the following Agreements with the County of Alameda, Axis Community Health, Bay Area Community Services, Community Resources for Independent Living, Eden Council for Hope & Opportunity, Open Heart Kitchen, Senior Support of the Tri Valley, Spectrum Community Services, Inc., and Tri-Valley Haven; and authorizing the City Manager to sign the above listed agreements to utilize CDBG funds for Fiscal Year 2008-2009. 4.4 Approval of Final Map and Tract Improvement Agreement for Tract 7854, Neighborhood "B," PositanolFallon Village (Braddock and Logan Group II, L.P.) and Acceptance of Community Parkland Dedication In-Lieu Fees (600-60) Tract 7854 is the subdivision map for Neighborhood "B," part of the Positano development within Fallon Village by Braddock and Logan Group II, L.P. Tract 7854 dedicates the right- of-way for a number of internal neighborhood streets, and creates 93 single-family residential lots. The developer is providing a payment for Community Parkland in lieu of dedicating land. STAFF RECOMMENDATION: Adopt Resolution Approving Final Map and Tract Improvement Agreement for Tract 7854 (Fallon Village); and adopt Resolution Accepting Parkland Dedication In-Lieu Fees and Credits for Park Dedication Requirements for Tract 7854 (Positano Neighborhood "B"). 4.5 Approval of Parcel Map 9185 (KBH Investments, LLC) (410-40) KBH Investments, LLC (aka Dublin Honda) is seeking City Council approval of Parcel Map 9185. Parcel Map 9185 subdivides an existing lot (former Dublin Lumber and Honda Used Car sites) into two parcels and is located at the southeast corner of Dublin Boulevard and Scarlett Court. Parcel A (5.50 acres) and Parcel B (2.21 acres) house 53,860 square feet of auto sales and service establishment. STAFF RECOMMENDATION: Adopt Resolution Approving Parcel Map 9185. April 15, 2008 Dublin City Council Agenda Page 2 of 5 4.6 Approval of Release of Security for Tract 7525 (600-60) Tract 7525 contains the common area of the Dublin Transit Center Area B. Tract 7525 included public improvements within DeMarcus Boulevard and Iron Horse Parkway, which were completed with Parcel map 7892 improvements and were accepted by the City Council on March 18, 2008, with Resolution No. 40-08. Tract 7525 also included private improvements for Hamlet Lane and the Campbell Green roadways, which are now complete, and will be privately maintained. The private improvements required for Tract 7525 are now complete and the bonds provided by Western Pacific Housing, Inc. (D.R. Horton) for the Tract 7525 improvements may now be released. STAFF RECOMMENDATION: Adopt Resolution approving Release of Security for Tract 7525. 4.7 Approval of Final Map and Tract Improvement Agreement for Tract 7853, Neighborhood "A," PositanolFallon Village (Braddock and Logan Group II, L.P.), Approval of Agreement for Long Term Encroachment for Landscape Features with Tracts 7853 and Tract 7854, and Acceptance of Community Parkland Dedication Fees (600-60) Tract 7853 is the subdivision map for Neighborhood "A," part of the Positano development within Fallon Village by Braddock and Logan Group II, L.P. Tract 7853 dedicates the right of way for Positano Parkway and a number of internal neighborhood streets, and creates 72 single-family residential lots. The Agreement for Long Term Encroachment for Landscape Features within Tracts 7853 and 7854 (the adjoining Neighborhood "B") provides for the Homeowners' Association to maintain project-related landscape features. within the public rights-of-way, including decorative pavements and median landscaping. The developer is providing a payment for Community Parkland in lieu of dedicating land. STAFF RECOMMENDATION: Adopt Resolution Approving Final Map and Tract Improvement Agreement for Tract 7853 (Fallon Village); and adopt Resolution Approving Agreement for Long Term Encroachments for Landscape Features with Tracts 7853 and 7854, Positano Neighborhoods "A" and "B". 4.8 Amendment of Dublin Municipal Code Chapter 4.24 (Drug Paraphernalia) (660-60) This is the second reading of an Ordinance that will amend the Chapter to prohibit, and provide for the sanction of, activity that is not otherwise regulated by State law. STAFF RECOMMENDATION: Waive reading and adopt Ordinance Amending Chapter 4.24 of the Dublin Municipal Code relating to Drug Paraphernalia. 4.9 Approval of Parcel map and Tract Improvement Agreement for Parcel Map 9759, Chevron Site, 6400 Sierra Court (600-60) Parcel Map 9759 subdivides the existing Chevron property at 6400 Sierra Court into two parcels. Street improvements and public right-of-way are existing. A tract improvement agreement and cash security will guarantee that on-site improvements needed to provide separate access and utilities for the parcels will be completed. STAFF RECOMMENDATION: Adopt Resolution Approving Parcel Map and Tract Improvement Agreement for Parcel Map 9759 (Chevron Site). 4.10 Award of Bid - Contract No. 08-01, San Ramon Road Wooden Soundwall Repair and Painting Project (600-35) This project will repair damaged face panels and repaint the wooden soundwall along the western side of San Ramon Road. The City Council will consider awarding the contract to the apparent low bidder, Bella Painting. STAFF RECOMMENDATION: Adopt Resolution Awarding Contract No. 08-01, San Ramon Road Wooden Soundwall Repair and Painting Project, toBella Painting. 4.11 Warrant Register ($1,264,029.51) dated April 15, 2008 (300-40) STAFF RECOMMENDATION: Approve. April 15, 2008 Dublin City Council Agenda Page 3 of 5 4.12 Amendment to the Dublin Historic Park, Phase I Consultant Services Agreement (600-30/295-10) In August 2007 the Council approved an Agreement with Royston Hanamoto Alley and Abbey for consultant services for the Dublin Historic Park, Phase 1. In March 2008 the Council approved the relocation of five structures from the Kolb Ranch to the Dublin Historic Park. As a result it is necessary to amend the original agreement. STAFF RECOMMENDATION: Approve Change Order #1 for Additional Services and Approve Budget Change Form. 5. WRITTEN COMMUNICATIONS 5.1 Request for the Placement of Purple Ribbons on City Street Trees to Recognize the American Cancer Society's "Paint the Town Purple" Campaign (130-60) The City Council will consider Maureen Cornejo's request for the placement of Purple Ribbons on City street trees to recognize the "Paint the Town Purple" Campaign. STAFF RECOMMENDATION: Receive presentation and provide Staff with direction regarding the placement of purple ribbons on City street trees. 6. PUBLIC HEARINGS 6.1 Weeds and Combustible Refuse Abatement Order (540-50) In accordance with Resolution No. 34-08, the City Council declared that there is a public nuisance created by weeds and combustible debris growing and accumulating upon the streets, sidewalks and property within the City. Notice of this was posted and letters sent to those property owners with violations. STAFF RECOMMENDATION: Conduct public hearing; deliberate; and direct Staff to continue the weed abatement process. 6.2 Amendment to Dublin. Municipal Code Chapter 5.48 (Gaming) (585-50) This is the first reading of an amendment to the Dublin Municipal Code Chapter 5.48 relating to Gaming. STAFF RECOMMENDATION: Conduct public hearing, deliberate, wave reading and introduce Ordinance Amending Chapter 5.48 of the Dublin Municipal Code relating to Gaming. 6.3 Ordinance Adding Chapter 4.36 (Emergency Medical Services) to Dublin Municipal Code (DMC) (660-60) This is the first reading of an ordinance that would add Chapter 4.36 to the DMC requiring any emergency medical service provider based or operating within the City of Dublin to comply with requirements imposed by Chapter 6.114 of the Alameda County General Ordinance Code. STAFF RECOMMENDATION: Conduct public hearing, deliberate, waive reading and introduce Ordinance Adding Chapter 4.36, relating to Emergency Medical Services, to the Dublin Municipal Code. 7.
